What is NEPA?

• National Environmental Policy Act (NEPA) of 1969 (42 USC §4321 et seq.)

• First federally mandated program for environmental documentation

• Established the nation’s environmental policy

• Requires federal agencies to consider environmental issues in full view of the public prior to making any major decisions

• Established the agency review process

• Requires consideration of alternatives and mitigation where feasible

• Provides for meaningful and continuous public participation

– Provides “right of first refusal” to local toll authorities– Requires toll authorities and TxDOT to set business

terms (toll rates, O&M costs) – Business terms then used to set the market value of a

toll road• Scheduling Impacts of SB 792

– Trinity Parkway Design (Aesthetics) Guidelines must be complete before market valuation study begins (July 2008)

– Market valuation study must be complete before start of final design begins (October 2008)
