This is a selective bibliography of primary and secondary materialsused in the practice of law in Nebraska. For the most part, materialsfocusing exclusively on Nebraska law published between 1991 andJune 30, 1999 are included. It updates the 1991 bibliography "LegalResearch Tools for the Nebraska Practitioner: An AnnotatedBibliography" by Sally Wise and Patricia Cervenka.1 The mostobvious difference between this bibliography and the earlier one is theprevalence of electronic resources such as sites on the World WideWeb. Electronic resources have been incorporated with print sources,rather than treated separately.

The bibliography is arranged in the following sections: referenceworks; periodicals; newspapers; primary sources (legislative, judicial,administrative, and municipal); secondary sources arranged by

Michie's Research Guide to Nebraska Law. Ann C. Fletcher, Paul F.Hill, Kay L. Andrus, and Ana Marie Hinman. Charlottesville, VA:LEXIS Law Publishing, 1995. Former publisher: The Michie Com-pany. Softbound. It is also available on LEXIS Law Publishing's CD-ROM Nebraska Law on Disc. The guide was written by the librariansof the Klutznick Law Library, Creighton University, who are cur-rently working on an updated edition. It includes the following units:Courts; Constitutions; Legislature; Statutory Codes; Administrativeand Executive Research; and Electronic Sources of Nebraska Legal In-formation. A "User's Guide to the Revised Statutes of Nebraska Anno-tated" is an appendix.

Nebraska Legal Research & Reference Manual. Paul F. Hill. St. Paul,MN: Mason Publishing Company, 1983. Looseleaf. Although thework is a bit dated, it is an excellent resource for historical informa-tion. It has the following chapters: Courts; Constitutions; Legislature;Administrative Law; and Legal Bibliography.

The Nebraska State Constitution: A Reference Guide. Robert D.Miewald and Peter J. Longo. Westport, CT: Greenwood Press, 1993.(No. 13 of the series Reference Guides to the State Constitutions of theUnited States.) Hardbound. Not updated. The first section is a his-tory of the Nebraska Constitution. The bulk of the book reprints eachsection of the Constitution, followed by commentary that includes casereferences. A bibliography, table of cases, and index are included.

B. Directories of Agencies

A Legislator's Guide to Nebraska State Agencies. Lincoln, NE: Ne-braska Legislative Fiscal Office. Biennial. 1999/00 is the most recentedition. The budget, program objectives, program description, andstatistics are listed for each Nebraska agency.

Nebraska Blue Book. Lincoln, NE: Clerk of the Legislature.Softbound. A new edition is published every other year in odd-num-bered years. 1998/99 is the most recent edition. The book includes afairly detailed description of each state agency, including references tothe sections of the Nebraska Code or Constitution that authorize theagency's actions. Names of officials, addresses, and phone numbersare listed. It includes the Nebraska Constitution, a directory of sena-tors, judges, and county officials, and an index. It is also available onthe web at http://www.unicam.state.ne.us/bluebook/index.htm.

It includes business and legal news, court docketsfrom the Fourth Judicial District and Douglas County courts, bank-ruptcy filings, legal notices, items filed with the Register of Deeds, and

A. Legislative Materials

1. Statutory Compilations

Revised Statutes of Nebraska. Lincoln, NE: Revisor of Statutes, 1943.12 hardbound volumes. Updated by new reissue volumes,2 addedvolumes and softbound supplements. Cumulative softbound supple-ments are issued in even-numbered years. In odd-numbered years,additional noncumulative softbound supplements are issued.

In addition to statutory text, the set contains source notes and annota-tions of selected cases. In the hardbound volumes, case annotationsfollow the statutory text. In the softbound supplements, case annota-tions are located at the beginning of volume 1. The Nebraska Consti-tution is located at the beginning of volume 2. A softbound index isreissued periodically, most recently in 1998. The set includes a crossreference tables volume.

Revised Statutes of Nebraska Annotated. Charlottesville, VA: LEXISLaw Publishing. Former publisher: The Michie Company. 23hardbound volumes. The unofficial Nebraska code uses the samenumbering system as the official code. The set is updated by replace-ment and added volumes, pocket parts, softbound supplements, and asoftbound Advance Code Service which includes new statutory textand annotations. The Advance Code Service is issued three times ayear and is cumulative. In addition to statutory text, the set containssource notes, case annotations, and references to Nebraska AttorneyGeneral opinions, law review articles, and American Law Reports

2. There is no schedule for the reissuing of bound volumes, and the volumes are notall reissued at the same time. A list of the current reissue dates can be found onthe page immediately following the title page of the first volume of the most re-cent supplement. Reissue volumes should be at least as current as those on thislist.

(ALR) annotations. The Nebraska Constitution is at the beginning ofvolume 1. The set includes a softbound Nebraska Court Rules Anno-tated volume. The softbound index covers the Code and court rulesand is replaced annually. A cross reference tables volume is included.

The Nebraska Code is on the Legislature's web site at http://www.unicam.state.ne.us/statutes.htm. The statutes may be browsedsection by section or searched by key word. There are no case annota-tions, source notes, or information about the currentness of thedatabase.

LEXIS-NEXIS. The Nebraska Code (NECODE) database includesNebraska statutes, Constitution, and court rules accompanied bysource notes, case annotations, and references to Nebraska AttorneyGeneral opinions, law review articles, and American Law Reports(ALR) annotations. It includes Nebraska session laws enacted sincethe Code was last updated. LEXIS-NEXIS is a product of Lexis Pub-lishing and is available to subscribers on the web at http://www.lexis.com/xchange/.

Westlaw. The NE-ST database includes unannotated Nebraska stat-utes, Constitution, and court rules accompanied by source notes. TheNE-ST-ANN database has Nebraska statutes, Constitution, and courtrules accompanied by source notes and case annotations. Westlaw is aproduct of West Group and is available to subscribers on the web athttp://westlaw.com/.

Nebraska Law on Disc (CD-ROM). Charlottesville, VA: LEXIS LawPublishing. Former publisher: The Michie Company. Laws of Nebraska. Lincoln, NE: Secretary of State. Annual. This isthe official publication of the Nebraska session laws, which are ar-ranged in the volumes by bill number. The volumes include a subjectindex, list of statutes amended or repealed, list of legislators, and theNebraska Constitution.

LEXIS-NEXIS. The Nebraska Slip Laws (NEALS) database has Ne-braska session laws beginning 1989. The Nebraska Code (NECODE)database includes Nebraska session laws enacted since the Code waslast updated, in addition to annotated Nebraska statutes, court rules,and Constitution.

Westlaw. The NE-LEGIS database covers session laws from the mostrecent legislative session. The NE-LEGIS-OLD database includes ses-sion laws from 1990 to the second most recent legislative session.

West Premise (CD-ROM). Eagan, MN: West Group. The CD-ROM in-cludes session laws from the most recent legislative session.

3. Bills

Legislative bills and resolutions are available from the Clerk of theLegislature, Bill Room, during legislative sessions. To check the sta-tus of a bill during session, call the legislative hot line, a service of theClerk of the Legislature, at (402) 471-2709 or (800) 742-7456.

Nebraska bills from the current session are on the Legislature's website at http://www.unicam.state.ne.us/Bills.htm. They are accessibleby bill number and searchable by key word.

LEXIS-NEKIS. The Nebraska Bill Text (NETEXT) database has billsfrom the current legislative session. The Nebraska Bill Tracking(NETRCK) database includes summaries and legislative chronology ofbills from the current session.

Westlaw. The NE-BILLTXT database has bills from the current legis-lative session. The NE-BILLTRK database includes summaries andlegislative chronology of bills from the current session.

4. Other Legislative Materials

Legislative Journal of the State of Nebraska. Lincoln, NE: Legisla-ture. The Journal is issued daily when the Legislature is in sessionand recompiled as bound volumes after the session is over. Approxi-mately 2 volumes are issued per year. The Journal has summaries ofthe Legislature's daily floor activities, votes, the text of amendments,opinions by the Attorney General in response to senators' questions,messages to the Legislature from the Governor, a list of senators,rules of the Legislature, a chronology of bills, a list of bills and resolu-tions by introducer, a list of bills by committee, and a subject index.

The Journal from the current legislative session is on the Legislature'sweb site at http://www.unicam.state.ne.us/ljournal.htm and is accessi-ble by date.

Floor debates, hearings, committee records, exhibits, and bills begin-ning 1965, 75th session of the Legislature, are available on 16 mm

Shepard's Nebraska Citations. 7th ed. Colorado Springs, CO: Shep-ard's, 1994. 3 hardbound volumes. Updated with hardbound andsoftbound supplements. It lists amendments and other legislative ac-tivity relating to each Nebraska statute, as well as Nebraska and fed-eral cases, Nebraska Attorney General opinions, and Nebraska lawreview articles citing the statute. It covers session laws and local ordi-nances and includes a table of acts by popular name. Shepard's Ne-braska Citations is also available on CD-ROM and LEXIS-NEXIS.

KeyCite. This citator is available exclusively on Westlaw. It lists stat-utory amendments and cases, law review articles and other secondarysources citing Nebraska statutes.

B. Judicial Materials

1. Court Reports

Nebraska Supreme Court Slip Opinions. Lincoln, NE: Nebraska Su-preme Court. The Nebraska Supreme Court releases opinions eachFriday while in session.

Nebraska Advance Sheets. Lincoln, NE: Nebraska Supreme Court.These contain a week's worth of opinions and are available approxi-

mately 1-2 weeks after the opinions are released. Each issue includesa table of cases reported, lists of cases disposed of by memorandumopinion, cases disposed of without opinion, and petitions for furtherreview, and an index of headnote topics.

Nebraska Reports. Lincoln, NE: Nebraska Supreme Court. The offi-cial reporter is updated by the Nebraska Advance Sheets. Approxi-mately 2-3 volumes are published each year. The set began in 1871and now consists of 253 hardbound volumes. Each volume includes atable of cases, index of headnote topics, directory of judges, and lists ofcases disposed of by filed memorandum opinion, disposed of withoutopinion, and on petition for further review.

Nebraska Court of Appeals Slip Opinions. Lincoln, NE: Nebraska Su-preme Court. The Nebraska Court of Appeals was created in 1991and heard its first case in February 1992. The court releases opinionseach Tuesday while in session.

Decisions of the Nebraska Court of Appeals. Lincoln, NE: NebraskaSupreme Court. These weekly advance sheets are available approxi-mately 1-2 weeks after the opinions are released. They include opin-ions designated by the court for permanent publication. Until July 1,1998, they also include opinions not designated for permanent publi-cation. Each issue includes a table of cases reported, lists of cases dis-posed of by memorandum opinion and judgment on appeal, casesdisposed of without opinion, petitions for further review, and opinionsnot designated for permanent publication, and an index of headnotetopics.

Nebraska Appellate Reports. Lincoln, NE: Nebraska Supreme Court.The official reporter includes only those opinions designated by thecourt for permanent publication. It is updated by Decisions of the Ne-braska Court of Appeals. Approximately 1 volume is issued per year.The set now consists of 6 hardbound volumes. Each volume includes atable of cases reported, lists of cases disposed of by memorandumopinion and judgment on appeal, disposed of without opinion, and onpetition for further review, and an index of headnote topics.

West's North Western Reporter and North Western Reporter, SecondSeries. St. Paul, MN: West Group. Updated weekly by softbound ad-vance sheet pamphlets. The first series covers 1879-1941 and has 300hardbound volumes. The second series began 1942 and has 603hardbound volumes, adding approximately 15 volumes a year. Eachvolume includes decisions of the Nebraska Supreme Court and pub-lished decisions of the Nebraska Court of Appeals, in addition to opin-ions of the state courts of Iowa, Michigan, Minnesota, North Dakota,South Dakota, and Wisconsin. Each decision has a synopsis and head-notes written by editors at West Group. The headnotes have applica-ble West digest topics and key numbers. The volumes have parallel

citation tables, tables of cases arranged alphabetically and by state,table of federal and state statutes cited, a Words and Phrases section,and a digest of cases in that volume using the West key numbersystem.

The Nebraska Judicial Branch web site has Nebraska Supreme Courtand Court of Appeals published slip opinions from the past 90 days.The opinions are available within hours of their release.
