Chapter 165 of the Acts of the Acts of theGeneral Assembly of Indiana of 1939

Embalmers' and Funeral Directors' Law(H.B. 260, Approved March 10, 1939)

AN ACT to establish a state board of embalmers and funeraldirectors; to provide a system of examinations for embalmers’ licensesand funeral directors’ licenses; to provide for the registration andlicensing of embalmers and funeral directors to practice their professionin the state of Indiana; to provide for the better protection of life andhealth, and the prevention of the spread of infectious and contagiousdiseases; to provide regulations for the revoking of embalmers’ licensesand funeral directors’ licenses by the state board of embalmers andfuneral directors; defining violations hereof and fixing penalties there-for; and repealing all laws in conflict herewith.

Declaration of Public Policy.

Section 1. Be it enacted by the General Assembly of the State ofIndiana, That it is hereby declared that this act shall be deemed anexercise of the health powers of the state for the prevention of thespread of infectious and contagious direases; for the protection of thesanitation, health and welfare of the people of the state and that all of theprovisions of this act and regulations authorized to be made are neces-sary to effectuate its purpose; and all of the provisions of this actshall be construed liberally.

Present State Board of Embalmers’ and Directors’ Continued—Vacancies—Governor to Fill.Sec. 2. The present state board of embalmers and funeral direc-

tors, now acting under appointment by the governor of the state offndiana, is hereby declared to be officially appointed and commissionedfor all intents and purposes of this act, and shall continue with theduties and obligations heretofore conferred upon it and the duties andobligations as set out in this act and the members thereof shall serveto the end of their respective terms for which they have been appointed,unless sooner removed for cause, and said board shall be perpetuatedand continued through appointment made by the governor to fill allvacancies which may hereafter occur either through death, resignationor expiration of term of office as provided in section 3 of this act.

Members of Board—Qualifications—Terms—Compensation.Sec. 3. Chapter 332 of the Acts of the Acts of the General Assem-

bly of Indiana of 1945, Senate Bill No. 194, Approved March 9th, 1945.

AN ACT to amend Section 3 of an Act entitled “An Act to establisha State Board of Embalmers and Funeral Directors; to provide a systemof examinations for embalmers’ licenses and funeral directors’ licensesto provide for the registration and licensing of embalmers and funeraldirectors to practice their profession in the state of Indiana; to pro-vide for the better protection of life and health, and the prevention ofthe spread of infections and contagious diseases; to provide regula-tions for the revoking of embalmers’ licenses and funeral directors’licenses by the State Board of Embalmers and Funeral Directors; de-fining violations hereof and fixing penalties therefor; and repealing alllaws in conflict herewith” approved March 10, 1939, and declaring anemergency”.

Section 1. That Section 3 of the above entitled Act be amended toread as follows; Section 3. There is hereby established a State Boardof Embalmers and Funeral Directors. Said board shall consist of sixmembers five of whom shall be both practical and practicing licensedembalmers and also practicing and licensed funeral directors and whoshall then be practicing their profession and business in the state ofIndiana. The sixth member shall be the Secretary of the State Board ofHealth ex officio. That all appointments hereafter made on said boardshall be for the term of four years, except such appointment as shallbe made for unexpired terms. That all appointments hereafter made tofill vacancies made on said board by death, resignation or removalduring a term, shall be made by the Governor for the remainder of suchterm only. And that the Governor shall, under this Act, appointsuccessors to the present members of said board in the order that theirpresent appointments expires; and according to the qualifications aboveset out in this section.

The members of said board, except the Secretary of the State Boardof Health, before entering upon their duties, respectively, shall takeand subscribe to the oath of office provided for other state officers andthe same shall be filed in the office of the Secretary of State; and theSecretary of State is hereby authorized and directed to administersuch in the line of his duty. The Governor shall appoint one of themembers as chairman of said board, and the board shall elect one ofits members as chairman pro tempore, who shall serve in the chair-man’s absence. The board, with the approval of the Governor, shallselect a secretary-treasurer and fix his compensation, which shall notexceed three thousand dollars ($3,000.00) per annum, plus an allowancefor necessary travel. The board, with the consent of the Governor,shall employ an agent or agents, whose title shall be Inspector of theIndiana Board of Embalmers and Funeral Directors, and who shallserve at the discretion of the board and be paid a salary to be fixedby the Governor and the board, plus necessary traveling expenses. Theboard may employ such other assistants as it may deem necessaryand fix the qualifications, compensations and duties thereof. The mem-

bers of the board, other than the secretary-treasurer, shall receive nosalary but shall be allowed necessary traveling expenses and such otherexpenses incident to and attendant upon the business of the board, andeach member thereof, except Secretary of the State Board of Health,shall receive ten dollars ($10.00) per diem for each day actually spentby the respective members upon the business of the board, all of whichshall be paid out of receipts of the board as hereinafter set out.

Definition of Terms.

Sec. 4. The following terms wherever used or referred to in this act,shall have the following meaning, unless the context clearly requiresotherwise;

(a) The term “board” shall mean the state board of embalmersand funeral directors of Indiana.

(b) The term “embalming” shall be construed to mean the preserva-tion and disinfection or attempted preservation and disinfection of thedead human body by application of chemicals, externally or internallyor both.

(c) The term “embalmer’s license” shall mean a professional licenseissued by the state board of embalmers and funeral directors to anindividual for the purpose of licensing him to operate as a professionalembalmer in the state of Indiana.

(d) The term “funeral directing” or “funeral director” shall meanthe business and profession of directing or supervising funerals, or thebusiness and profession of preparing dead human bodies for burialin any manner; by preservation and disinfection or attempted preserva-tion and disinfection by application of chemicals, externally or inter-nally or both, or the disposition of dead human bodies in any mannerwhatsoever, or the provision or maintenance of a place for preparationfor disposition, or for the care or disposition of dead human bodies,or for the conduct of funerals, or the use in connection with a busi-ness of the word or words, term or terms, “funeral director,” “under-taker”, “mortician” or any other word or term from which can beimplied the business of funeral directing or the holding out to the publicthat one is a funeral director or is maintaining a place pertaining tothe funeral business.

(e) The term “funeral director’s license” shall mean the licenseissued by the Indiana state board of embalmers and funeral directorsto an individual, being a resident of Indiana, for the purpose of licensinghim to engage in the profession and business of a funeral director orfuneral directing at a designated place and in compliance with therequirements defined, set out and authorized in this, act.

A “funeral director’s license’’ as used in this act shall be construedto mean a business-professional license, issued to individuals for thepurposes set forth in this act, and because of the business and healthfeatures of such license, the issuance thereof shall be subject to the

requirements of this act and whatever requirements or requirementsdeemed necessary by the board in its rules and regulations to limit theoperation thereunder to a designated place within the state of Indiana.Any individual who holds himself out to the public as a funeral director,or who manages, supervises and has a financial interest in the opera-tion of a mortuary, funeral home or funeral business, is required toobtain a funeral director’s license according to the provisions of thisact.

(f) The term “individual” or “person” shall mean natural personsonly. The singular shall include the plural and the masculine genderincludes the feminine.

(g) Upon compliance with the terms of this act in respect to ob-taining a funeral director’s license, the manager of any non-profitco-operative association which does business only v/ith its members,shall be licensed as a funeral director under this act and shall beauthorized to engage in and carry on the business of funeral directingfor said association, but the property of said association and the con-duct of the business of said association by the manager shall be subjectto the same inspection and control and other limitations as are applic-able to individual licenses hereunder. Any such association heretoforeformed may conduct business in the name of the association.

Power and Duties of the Board.

Section 5. The board is hereby empowered to

(a) Investigate and report violations of this act and violations ofthe rules and regulations of the board to the prosecuting attorney ofthe county in which such violations are committed, or to the attorneygeneral or to the grand jury of the county in which such violations arecommitted.

(b) Make, promulgate, alter, amend or repeal rules and regulationsfor the conduct of the meetings of the board, and for the holding oflicense examinations and license revocation hearings before such boardfor the granting and revocation of license, for the practice of embalmingand the operation of funeral homes and establishments, and for theenforcement of any of the rules and regulations adopted and promulgatesby the board and as set out in this act.

(c) Examine and inspect all premises and equipment, used or pro-posed to be used by licensed funeral directors or applicants for suchlicenses, and to determine the suitability of such premises and theadequacy of such equipment as a basis for the issuance of an initialfuneral director’s license or the yearly renewal of the funeral director’slicense or the refusal to so issue.

(d) Hold examinations for embalmers’ licenses and funeral direc-tors’ licenses at times and places prescribed by the board, provided,however, that embalmers’ examinations shall be held not less often thanonce in each calendar year, and funeral director examinations shall beheld not less often than semi-annually.

(e) Issue embalmers’ licenses and funeral directors’ licenses toindividuals as provided by this act and prescribed by the rules andregulations of the board.

(f) Refuse to issue or to revoke issued embalmers’ licenses andfuneral directors’ licenses for causes provided in this act or prescribedin the rules and regulations adopted and promulgated by the board.

(g) To fix or provide by rule or regulation the standards ofethical practice to which licensed funeral directors must adhere.

(h) To require the aid of the state and any and all local boards ofhealth and health officials throughout the state of Indiana in fixingand enforcing standards of cleanliness, disinfection and sanitation forall premises which are used in the business of embalming or funeraldirecting.

(i) To issue provisional or temporary licenses as in this act pro-vided.

Embalmers’ and Funeral Directors’—Licensed Required Qualifications—

Price Advertising Prohibited.Sec. 6. It shall be unlawful for any person to act, directly or in-

directly, as an embalmer or funeral director, or to engage in the em-balming or funeral directing profession and business, or to hold him-self out as so acting or being so engaged, unless and until such personhas been licensed by the state board of embalmers and funeral direc-tors, pursuant to the provisions of this act, to so act or to be soengaged. Dead human bodies shall be in no way prepared for burialexcept in an approved embalming room by an embalmer licensed to doembalming in the state of Indiana, nor shall any permit for the burialof a dead human body be issued by any health officer in this state to anyperson other than a duly licensed funeral director.

On or after the passage date of this act, no funeral home, estab-lishment, or any other place pertaining to funeral directing or theconducting of funerals, shall be established and operated in the stateof Indiana under any name other than that of the holder of an Indianafuneral director’s license or the holders of Indiana funeral directors’licenses under whose direction and management such establishment isoperated and for which such license has been issued. Natural personsonly shall be eligible to apply for a funeral director’s license and noperson shall hereafter be granted an initial funeral director’s licenseto operate as the full-time funeral director of more than one establish-ment at one time. When more than one person propose to engage inthe funeral directing business, either as partners, or in some other non-corporate association, it shall be necessary for all persons in suchpartnership or other non-corporate association, regardless of the de-gree of financial participation except those who are members of a non-profit or cooperative association, such as described in subsection (g)of section 4 thereof, to secure a license to operate as a funeral directorfrom the state board of embalmers and funeral directors. Provided,

however, that the owners of any funeral home, mortuary or establish-ment which has been licensed prior to the effective date of this act tooperate under a firm, trade or corporate name, shall be permitted thecontinued use of such name and be authorized to transfer and re-trans-fer, sell and resell such funeral home, mortuary or establishment toany Indiana licensed funeral directors and to include as part of theconsideration for such transfer or re-transfer, sale or resale the con-tinued use of such firm, trade or corporate name, or any portion there-of which the purchaser of transferee may so desire to use.

It shall be unlawful for any individual or individuals so licensed toadvertise under any name other than that which is according to the aboverequirement registered with the board. It shall be unlawful for anyindividual or individuals so licensed to advertise the price of services,merchandise and equipment to the public or to advertise any portionthereof as being offered free to the public. By advertising is meantany form of printed matter, newspaper or otherwise, holding out suchfacts to the public.

From and after the effective date of this act, any person desiringto become a licensed embalmer shall submit to the state board of em-balmers and funeral directors satisfactory evidence that such person:

(a) Has attained the age of 21 years;

(b) Has been graduated by an accredited high school;

(c) Has successfully completed a one year’s course in a recognizedcollege of embalming which is acceptable to and accredited by theboard;

(d) Has filed an application with the board for any examination asto his fitness, on a form prescribed by the board, at a time not laterthan fifteen days prior to the date set by the board for such examina-tions and has successfully passed said examination as required by theboard in its rules and regulations. Such application shall be accom-panied by the fee hereinafter prescribed in this act.

Embalmers’ licenses heretofore issued by the state board of em-balmers and by the state board of embalmers and funeral directors, andwhich are in effect on the effective date of this act, are hereby continuedin full force and effect.

From and after the effective date of this act, any person desiringto become a licensed funeral director shall submit to the state boardof embalmers and funeral directors satisfactory evidence that suchperson:

(a) Has been a legal resident of the state of Indiana for a periodof two years immediately prior to the filing of his application;

(b) Has served at least two years continuous apprenticeship underan Indiana licensed funeral director prior to the filing of his application;

(c) Has held an Indiana license as an embalmer for a period of twoyears immediately prior to the filing of his application;

(d) Has filed an application with the board for an examination asto his fitness, on a form prescribed by the board, at a time not later thanfifteen days prior to the date set by the board for such examinationsand has successfully passed said examination as required by the boardin its rules and regulations.

(e) In lieu of any and all requisites and requirements set forthin subsection (b), (c) and (d) of this section, the board shall issue afuneral director’s license to any individual who files an application tobe so licensed with the board on a form prescribed by the board, if saidapplication is accompanied by a signed or verified copy of partnershipagreement which discloses that the applicant for such license proposesto associate or is associated as a partner in the funeral directingbusiness with the holder of an Indiana embalmer’s license and that saidholder of such embalmer’s license is the bona fide owner of at leastone-third interest in the partnership funeral directing business.

Said board shall hold not less than one meeting annually for thepurpose of examining applicants for embalmers’ licenses and not lessthan two meetings annually for the purpose of examining applicantsfor funeral directors’ licenses, such examinations to be at the time ortimes and place or places designated by the board. All manuscripts sub-mitted as answers to questions on the examination shall be kept on filefor a period not to exceed ninety days by said board and shall bemade available for reviews by the applicant in the presence of a mem-ber of the board during said period.

All applications for examinations under this act shall be madeupon forms to be provided by said board, and shall be subscribed andsworn to before some officer authorized to administer oaths; and, for thepurposes of this act only, each member of said state board of embalmersand funeral directors is hereby vested with authority to administer alloaths required in connection with all applications, examinations, charges,trials and hearings provided for in this act or in the rules and regula-tions of the board.

Annual Renewal of Licenses Required.

Sec. 7. Funeral directors’ licenses heretofore issued by the stateboard of embalmers and funeral directors are hereby cancelled andannulled. The owners of funeral firms and establishments which havebeen heretofore licensed by the state board of embalmers and funeraldirectors, pursuant to the provisions of Chapter 62 of the Acts of theGeneral Assembly of Indiana of 1923, as amended, and who are on theeffective date of this act actively engaged in the profession and busi-ness of funeral directing as herein defined, as licensed embalmers andfuneral directors, shall be licensed to engage in the business and profes-sion of funeral directing, under this act, without examination, uponfiling an application to be so licensed with the state board of embalmersand funeral directors, on a form prescribed by the board, within ninetydays from the effective date of this act. Such application shall be ac-companied by such proper evidence of identification, ownership and

previous licensing, as the board may deem necessary, and for thispurpose the board may consider the information heretofore submittedin the embalmers’ and funeral directors’ license renewal applicationsto the board for renewal licenses for the calendar year, 1939, and by alicense transfer fee in an amount which shall be determined by theboard, but which in no event will exceed two dollars.

Before any such application shall be considered and approved by theboard, the individual must show to the satisfaction of the board thathe has a bona fide business or financial interest iri a now existingfuneral firm, partnership or corporation. Upon receipt of said license,the individual licensees shall hereafter comply with all of the require-ments set out in this act or set out in the rules and regulations adoptedand promulgated by the board regarding the annual renewal of saidlicenses.

Failure to Renew—Automatic Cancellation.Sec. 8. All embalmers’ licenses and funeral directors’ licenses here-

after issued shall automatically terminate on the 31st day of Decemberin each calendar year. On or before the last day of each calendar yeareach embalmer or funeral director hereafter licensed to act as an em-balmer or funeral director or to engage in the funeral directing busi-ness shall transmit to the secretary-treasurer of the state board ofembalmers and funeral directors an application for renewal of hislicense, together with the fee for such renewal hereinafter prescribed.If any holder of an embalmer’s license or funeral director’s licenseneglects to secure the renewal certificate herein provided for by March

1 of the calendar year succeeding the previous renewal date, such neglectshall, without any action by the board, automatically cancel and annulthe license previously granted, together with any related renewal cer-tificate, and no renewal license shall be issued until a regularly pre-scribed reexamination has been passed by the applicant to the satisfac-tion of the board. Provided, however, that any license may be renewedby the board, subsequent to its expiration date and prior to March 1of the next succeeding calendar year upon payment by the applicantof the required renewal fee and a penalty of ten dollars.

Fees for Examinations—Renewals—Branch Establishments.Sec. 9. There shall be paid to the state board of embalmers and

funeral directors the following fees set out in this act:(a) Embalmers’ examination fee: A ten dollar examination fee

shall be required of each applicant taking an examination for anembalmer’s license.

(b) Embalmer’s license renewal fee: The board shall determineand fix a fee in an amount not to exceed five dollars for the annual re-newal of each embalmer’s license.

(c) Funeral director’s examination fee; An examination fee shallbe required of each applicant taking an examination for a funeral direc-

tor’s license in an amount which shall be determined by the board, butnot to exceed ten dollars.

(d) Funeral director’s license renewal fee. The board shall deter-mine and fix a fee in an amount not to exceed five dollars for theannual renewal of each funeral director’s license.

(e) Re-examination fee: All applicants failing to pass examina-tions for either funeral director’s license or embalmer’s license shall berequired to file new applications and pay the fee prescribed for originalexaminations.

(f) Fees and requirements for operating more than one establish-ment: Any individual or group of individuals who are, after the effectivedate of this act, initially licensed to open or establish a funeral home,mortuary or “branch establishment” shall pay in addition to all otherfees heretofore provided an annual fee of fifteen dollars for operatingeach establishment so licensed.

Each establishment opened after the passage of this act for therendering of any service pertaining to the funeral business, such asthe preparation of the dead, the conduct of funerals, the disposition ofthe dead and any other service pertaining to mortuary practice orfuneral directing, as set out in this act, shall be at all times in the per-sonal charge of and constantly under, the supervision of a licensedfuneral director of the state of Indiana and each such establishment soopened or established must meet the same requirements as set forth inthis act and prescribed by the board in its rules and regulations for theoperation of an original establishment, and shall be operated by alicensed funeral director or directors and comply with the rules of theIndiana state board of health and any and all provisions set out inthis act.

Temporary Licenses.Sec. 10. Any license issued pursuant to the provisions of this act

shall automatically cease to exist upon the death of the licensee. Onand after the effective date of this act, the board shall, because ofdeath or other emergencies affecting the active status of a license oraffecting the business of the licensee or the firm operated by the licen-see, have power to issue temporary licenses to individuals who, bcauseof such death or other emergency affecting such licensee, have ac-quired a managerial interest in the property of the licensee. Such tem-porary license shall be issued for the express purpose of authorizingtemporary operation of the funeral directing establishment of thelicensee until such time as may be necessary to dispose of it or to meetsuch emergency as may have arisen, and may be revoked or renewedat the discretion of the board.

Revocation of Licenses—Appeal from Decisions of the Board.Sec. 11. The board may refuse to grant or renew a license, or may

revoke a license for the following reasons:

(a) If the applicant therefor or holder thereof obtained such licenseby fraud or misrepresentation, either in applying for said license or inpassing the examination for said license;

(b) If the holder thereof shall be guilty of violating any sectionof this act or any rule or regulation of the board, or any rule orregulation of the state or municipal board of health, governing thedisposition of dead human bodies;

(c) If the holder thereof shall sign a certificate stating that heembalmed or prepared a dead human body for burial, whereas, in fact,someone else did it;

(d) If the holder thereof shall be guilty of taking any undue ad-vantage of his patrons or shall be guilty of any fraudulent act in theconduct of his business; or has promoted or is promoting, or has par-ticipated in or is participating in any scheme or plan in the nature of aburial association or a burial certificate or membership certificate plan.Whenever the board shall have reason to believe that any person towhom an embalmer’s license or funeral director’s license has been issuedunder the provisions of this act has become unfitted or incompetent topractice the science of embalming and funeral directing or has violatedany of the provisions of this act, or has violated any rule or regulationheretofore made and promulgated by the state board of embalmers andfuneral directors, or heretofore or hereafter made and promulgated bythe state board of health or hereafter made and promulgated by theboard of embalmers and funeral directors for the preparation, embalm-ing, shipping or burial or disposition of dead human bodies, or has beenconvicted of a felony and such conviction has not been appealed from, orwherever complaint of a licensed embalmer or funeral director or anymember of said board or any other person has been filed with said boardcharging any licensed embalmer or funeral director with any violationof the provisions of this act, or of the rules or regulations of the stateboard of health applying to the preparation, embalming, shipping orburial or disposition of dead human bodies, then it shall be the duty ofsaid board to the person so complained of.

It shall be the duty of said board to hold the hearing hereinafterprovided for within thirty days: Provided, however, that before alicense shall be suspended or revoked, the licensee shall be furnishedwith a written copy of the charges against him and a hearing shall behad before the board at such time and place as they may fix upon, andat least ten (10) days’ notice in writing to the licensee to determinewhether such license shall be suspended or revoked, which notice maybe served either by registered mail with return receipt, addressed tosuch licensee at the address shown in his application, or in the mannerprovided by law for the service of summons.

At the time and place fixed for the hearing, the licensee may appearin person and by counsel, and such charges shall be deemed denied with-out any answer thereto, unless the licensee desires to file an answer.The hearing shall be conducted in a summary manner under such pro-

cedure as the rules and regulations may prescribe and the board shallhear and receive all the evidence and arguments offered by both parties,and shall afford the licensee full opportunity to present all defenses avail-able to him. The board, after such hearing, shall render such decisionand make such order in the premises as it may deem just, either dis-missing the proceedings or suspending the license for any fixed period,or revoking the license, which order shall be forthwith mailed by regis-tered mail, with return receipt to or served personally upon suchlicensee, and Provided, further, that any licensee affected adversely byany such decision and order of the board may appeal therefrom to theCircuit Court or Superior Coiirt of the county in which a funeral homeis operated by the licensee, by filing in such court at any time withinthirty (30) days after the day on which such decision and order is enteredof record, a complaint to rehear such charges, which complaint shallname the members of the board as the defendants, and it shall besufficient if it set out a copy of the charges and of any answer filedupon which such hearing was conducted, and recite generally the con-duct of such hearing and the decision and order made therein, and prayfor a new hearing and judgment by the court.

The party appealing shall file at said time, with the complaint, abond with such surety or sureties as the clerk of such court may approve,conditioned to pay all costs if such appeal be decided adversely to theappellant, and he shall also cause summonses to be issued and servedupon members of said board as in other civil actions. Either theAttorney-General of the State or the Prosecuting Attorney of saidcounty, or both, upon notice from the board, shall appear for such boardand defend such appeal. A motion to dismiss said appeal may befiled by the defendants, if it be not perfected in time, but no furtherpleadings shall be required and the allegations of such complaint shallbe deemed denied.

The appellant shall have the right to inspect and obtain copies ofany of the proceedings, papers and records in the office of said board,or under their control, applicable to or affecting such hearing and ap-peal. Such appeal shall be placed on the advance calendar and heard assoon as possible, and if the court be in vacation, the same may be heardat any time by the judge thereof, or by any other judge designatedand appointed by him in the same manner and with the same effect as ifall such proceedings were conducted in term.

The court shall hear and conduct said appeal de novo as a civilaction upon all issues, and either party shall be entitled to offer allcompetent evidence relevant thereto, and the court shall be governedin all other respects by the procedure and rules governing the trial of allcivil causes, except that such appeal shall be tried and decided solelyby the court, and either party may have a change of judge, but thereshall be no change of venue from the county. The court shall make ageneral finding and render judgment thereon, and shall have the powerto reverse, affirm or modify in whole or in part the decision and orderappealed from, and a certified copy of such judgment, when final, shallbe filed with said board who shall enter the same of record, and in all

things comply therewith. Either party to such proceedings may appealfrom the decision and judgment of such court to the Appellate Court ofIndiana, as in other civil causes, and such appeal shall operate as a stayof such judgment until finally determined.

No decision of the board suspending or revoking any license willbecome effective until the expiration of the period of thirty (30) daysand in the event of any such appeal to the lower court, or thence to theAppellate Court by either party, such decision shall not become effec-tive until any such appeals are finally determined.

Pending any proceeding to suspend or revoke any license or anyappeal from any decision therein, every person affected thereby shallcontinue to comply with this act and such compliance may be enforcedthen and at all other times by any appropriate action in the name of theState of Indiana which shall be filed and conducted by the Attorney-General upon written request of the board.

Treasurer of Board—Bond—Fees Collected—Disposition—EducationalFund—Appropriation.

Sec. 12. All fees collected under the provisions of this act shall bepaid to the treasurer of the board, to be used for the purpose of defray-ing the necessary expenses of said board in the administration of thisact, and the treasurer of said board shall give bond in a penal sum tothe approval of said board for the faithful discharge of his duties andsafe keeping of its funds. The sum of one dollar out of each originalembalmers’ license fee or renewal fee and the sum of one dollar out ofeach funeral director’s original license fee or renewal fee shall be setaside by said board in a separate and special fund which shall be desig-nated the “educational fund of the Indiana board of embalmers andfuneral directors,” which fund shall be expended by and in the dis-cretion of said board to carry on educational work among the em-balmers and funeral directors of Indiana, and no unexpended part ofsaid educational fund shall revert to the general fund of the state ofIndiana. Any balance or balances remaining in said educational fundfrom funds deposited by the state board of embalmers and funeraldirectors prior to the passage of this act is hereby transferred to thespecial educational fund herein established and reappropriated for thepurposes herein set out.

All money accruing to the state board of embalmers and funeraldirectors by virtue of the provisions of this act is hereby appropriatedto the state board of embalmers and funeral directors and shall beexpended for the purpose of meeting its educational fund charges anddefraying the expenses incurred in the enforcement and administrationof this act, and shall be allocated for personal service and other operat-ing expenses, by the state budget committee, as nearly as practicablein the ratio that the personal service appropriation and the operatingexpense appropriation is made by the Budget Act of 1939 bear to eachother.

Reciprocity.

Sec. 13. The board may or may not, in its discretion, recognizelicenses issued to embalmers or funeral directors by state boards ofembalmers and state health authorities of other states and may, undersuch regulations as the board may prescribe, issue to the holders of suchlicenses the embalmers’ or funeral directors’ licenses herein providedfor.

Penalty for Violation.Sec. 14. Any person violating any of the provisions of this act shall

be guilty of a misdemeanor, and upon conviction thereof, shall be finedin any sum not exceeding five hundred dollars; and to which may beadded, in the discretion of the court, a sentence in the county jail of notmore than twelve months. And it shall be the duty of said state boardof embalmers and funeral directors, to, with all lawful means, aid inthe prosecution of violators of this act.

Severability.

Sec. 15. If any clause, sentence, or paragraph or any part of thisact shall for any reason be adjudged by any court of competent juris-diction to be invalid, such judgment shall not affect, impair or invalidatethe remainder of this act, but shall be confined in its operation to thecause, sentence, paragraph or part thereof directly involved in the con-troversy in which such judgment shall have been rendered.

Repeal.

Sec. 16. All laws and parts of laws in conflict herewith, includingChapter 62 of the Acts of the General Assembly of 1923, as amended,are hereby repealed.

Rules and RegulationsApproved January 1, 1946

The following rules and regulations are hereby adopted by theIndiana State Board of Embalmers and Funeral Directors, and the sameshall be published for the information of the funeral directors and em-balmers of the state:

Rule 1. Inspection certificate given by the board’s inspector shall beon display in the preparation room or main office.

Rule 2. No funeral director or embalmer shall discuss the con-fidence, privacies, or secrets of the domestic life of any family he or shemay be called upon to serve.

Rule 3. All changes of addresses of embalmers must be reportedto the secretary of the board within thirty days from moving date.

Rule 4. All waste material from the preparation room (includingdrainage, cotton, old cloths, et cetera) shall be burned or put into septictank or underground sewer.

Rule 5. The employment by a licensed funeral director of a personor persons on part or full time, for the express purpose of making con-tracts for securing business, shall be considered by this board as aviolatiton of Section 5, Sub-section (g), of the Indiana State Embalmers’and Funeral Directors’ Law, approved March 10, 1939. The paymentof a commission or an agreement to pay a commission, or the giving orpromising to give any money or other thing of value, to any person orpersons for the solicitation of business directly from relatives or next ofkin of deceased person or persons about to die, or the direct solicitationof business on the part of licensed funeral directors and licensed em-balmers, shall also be considered a violation of said section of said act,and therefore prohibited.

Rule 6. THE SOLICITATION OF HUMAN BODIES AFTERDEATH, BY ANY LICENSED FUNERAL DIRECTOR OR LICENSEDEMBALMER, AGENT, REPRESENTATIVE, OR PUBLIC OFFICIALTENDS TO INFLICT UNNECESSARY GRIEF AND EMBARRASS-

MENT ON THE BEREAVED, AND IS CONSIDERED UNPROFES-SIONAL CONDUCT, AND THEREFORE PROHIBITED.

Rule 7. Any application for embalmers’ license must be accom-panied by affidavit supporting the fact that applicant has been a residentof the state of Indiana for two years immediately prior to filing ofapplication.

Rule 8. To better protect life and health of the citizens of Indiana,and for the better prevention of the spread of contagious and infectiousdiseases, it is ordered that all licensed funeral directors, licensed pur-suant to the provisions of Section 7, of the Indiana State Embalmers’ andFuneral Directors’ Law, approved March 10, 1939, who are not them-selves licensed embalmers, shall have in his or their employ continu-ously, a licensed embalmer licensed in the State of Indiana.

Rule 9. For the purpose of completing the records of the board,and assuring the profession in each case where a partnership is formed,and an application made for a funeral director’s license, that it is a bonafide partnership, it shall be necessary that said applicants file with theboard as a part of the application, a certified copy of the partnershipagreement which has been filed with the clerk of the county in whichthe partnership is to be established.

Rule 10. Any embalming school or embalming college will be ac-cepted and accredited by the Indiana State Board of Embalmers andFuneral Directors as a recognized school, provided said embalming schoolor embalming college shall require of all its students the completion ofa high school education before matriculating therein, and shall also re-quire of all students the completion of not less than a 52 weeks’ coursewhich shall be a continuous course uninterrupted, less the regular legalholidays occurring in academic colleges; that said course above referredto shall be following in regular continuity from the date of entranceof students to the date of their graduation, the course to be so designedthat no part of the course is given in repetition.

(Reference—Section 6. Subsection (c), of the Indiana State Em-balmers’ and Funeral Directors’ Law, approved March 10, 1939. Theone year’s course referred to therein shall be considered by the boardto be a 52 weeks academic course.)

The curriculum of a school or college of embalming to be recognizedby the Indiana State Board of Embalmers and Funeral Directors shallcomply with the subjects and hours established and set out in the re-quirements of the Indiana State Board of Embalmers and Funeral Di-rectors, and must be complied with by all embalming schools or em-balming colleges desiring accreditment and recognition by the IndianaState Board of Embalmers and Funeral Directors. Each college mustnotify the board the names of students which are enrolled in their schoolthat will take the following examination.

Rule 11. All premises in which the business of funeral directing isconducted or where embalming is practiced, shall be maintained in aclean and sanitary condition. An operating or embalming room shall be

maintained with painted (not papered) walls, and tile, linoleum or cementcovering the entire floor. The top surface of the operating table shallbe of glass, metal or procelain, and the openings leading from theoperating room shall be tight closing doors (not curtained), for thepurpose of the better protection of the public and especially those whoneed to be about the building in their usual employment. The operatingor embalming room shall be used only as such, and not for storagepurposes, et cetera. All openings, windows, et cetera, into the operatingroom shall be permanently obscured from exterior view. The publicshall not be permitted in the operating room during operations.

Rule 12. Any person licensed as a funeral director in the State ofIndiana is hereby prohibited from sharing his establishment, furnishingfuneral equipment, rendering personal service, or in any way enteringinto any arrangement or partnership agreement with anyone who is notat the time of such above mentioned service, arrangement or partner-ship a duly licensed funeral director, or is not himself maintaining aplace suitable for the care, disposition or disposal of dead humanbodies.

Rule 13. Pursuant to the provisions of Section 4, Sub-section (e)of the Indiana State Embalmers’ and Funeral Directors’ Law, approvedMarch 10, 1939, an individual licensed as a funeral director is limitedin his operations as such, to the place designated in the records of theboard as the location of his business. In the event that the individualceases to operate or otherwise hold himself out as operating at thedesignated place registered with the board, his funeral director’s licenseshall cease to exist. The individual, or individuals, so licensed shall berequired to apply to the board, on forms prescribed by the board, fora change in the designated place of operation of his, or their, originalfuneral director’s license.

Rule 14. Funeral directors’ licenses issued to persons in Indiana arenot transferable or salable, and have no financial value as exchange, orbear no property right, and are subject to the conditions as set out inRule 13.

Rule 15. Applicants wishing to start in a funeral directing businessin Indiana, or to change the location of a funeral directing business,shall be prohibited from locating the business less than one squarefrom any public hospital, or within a reasonable seeing distance by thepatient in the hospital.

Rule 16. All subject retake embalmers’ examination must be writ-ten, the examination following the one failed.

Rule 17. Pursuant to Section 5, Sub-section (g) of the IndianaState Embalmers’ and Funeral Directors’ Law, approved March 10, 1939,the following practices, acts, or omissions shall be considered unethicaland therefore grounds for suspension or revocation of licenses:

(a) False or misleading advertising as a funeral director; adver-tising or using the name of an unlicensed person in connection with

that of any funeral establishment; advertising superiority of serviceor equipment; or advertising in or about a hospital.

(b) Gross Immorality.

(c) Solicitation or acceptance by a licensee of any commission orbonus or rebate in consideration of recommending or causing a deadhuman body to be disposed of in any crematory, mausoleum or cemetery.

(d) Refusing to promptly surrender the custody of dead human bodyupon the express order of the person lawfully entitled to the custodythereof.

(e) Failure to secure permit for removal or burial of a deadhuman body prior to interment or disposal.

(f) OBTAINING POSSESSION OR EMBALMING A DEAD HU-MAN BODY WITHOUT FIRST BEING EXPRESSLY DIRECTED ORDULY AUTHORIZED TO DO SO BY A RELATIVE OF THE DE-CEASED PERSON.

Rule 18. Pursuant to Section 9 of the Indiana State Embalmers’and Funeral Directors’ Law, approved March 10, 1939, the following feesshall prevail;

(a) An examination fee in the amount of $10.00 shall be requiredof each applicant taking the examination for embalmer’s license.

(b) A fee of $5.00 for the annual renewal of each embalmer’slicense shall prevail.

(c) An examination fee in the amount of $10.00 shall be requiredof each applicant taking an examination for a funeral director’s license.

(d) A fee of $5.00 for the annual renewal of each funeral director’slicense shall prevail.

Rule 19. The following rule and regulation shall apply to all ex-aminations for funeral director’s license and embalmer’s licenses con-ducted by this board. Immediately prior to an examination the board!shall determine the grade to be attained by the applicant and designatesame as being the passing grade. In addition the board shall determine;the number and name of subjects upon which the applicant is to beexamined immediately prior to each examination. The board reserves,the right to change the method and subject matter of its examinations.,In order to receive a funeral director’s license an applicant who hassuccessfully passed the funeral director’s license examination mustestablish himself in the funeral business within 90 days from the dateof notification of his passage of said examination.

Rule 20. Pursuant to the provisions of Section 4, Sub-section (e)of the Indiana State Embalmers’ and Funeral Directors* Law, approvedMarch 10, 1939, the following shall apply relative to dissolution of.partnerships;

Upon dissolution, the individual licensees shall appear before theboard at a time and place designated by the board, for the purpose ofdetermining their status regarding the continued operation as individuallicensees in the State of Indiana. The board may then take such actionas it may see fit regarding the status of the licensees involved. Funeraldirectors’ licenses cease to exist upon the dissolution of a partnership.
