A bill to be entitled1
An act relating to the issuance and renewal of2
driver's licenses and identification cards; creating3
s. 322.0805, F.S.; providing legislative intent;4
prohibiting the Department of Highway Safety and Motor5
Vehicles from copying and retaining certain6
verification documents of any United States citizens7
who is obtaining, renewing, or modifying a driver's8
license or identification card; limiting requirements9
to provide verification documents; requiring10
destruction of such documents received and retained by11
the department; exempting certain licensed persons or12
identification card holders from requirements to13
provide proof of address; requiring the department to14
use existing records for identity verification for a15
normal renewal, reinstatement, or modification of a16
license or identification card; prohibiting the17
department from using certain standards for18
photographs, incorporating any electronic tracking19
device upon or within any driver's license or20
identification card, and obtaining fingerprints or21
biometric DNA material of citizens; allowing use of a22
nonresidential address for certain persons; providing23
for application; providing an effective date.24

Section 1. Section 322.0805, Florida Statutes, is created28
to read:29
322.0805 Florida Driver's License Citizen Protection Act.30
(1) It is the intent of the Legislature to minimize any31
inconvenience to citizens transacting business with the32
department while maintaining security for the issuance of33
driver's licenses and identification cards to citizens and34
aliens legally residing within the state.35
(2)(a) Notwithstanding any law to the contrary, the36
department may not copy or retain in any form or format any37
document submitted by a United States citizen as proof of38
identification, proof of Social Security number, or proof of39
residence or any other verification document required or40
formerly required under this chapter for original issuance,41
normal renewal, reinstatement, or modification, such as an42
endorsement or address change, of a driver's license or43
identification card. Proof of citizenship required for issuance44
of an original driver's license or identification card may not45
be copied or retained by the department but shall be noted in46
the department's records when received and returned. Once47
established, proof of identity or citizenship may not be48
required by the department for renewal, reinstatement, or49
modification of a license or identification card. By September50
11, 2012, the department shall securely destroy so as to make51
irretrievable any such verification documents that have been52

Florida identification card, the department shall grant a normal56
renewal, reinstatement, or modification, such as an endorsement57
or address change, of the license or identification card in the58
name already existing in the records of the department and the59
citizen may not be required by the department to provide further60
proof of identity. The department may not require a citizen who61
has held a valid Florida driver's license or a valid Florida62
identification card for at least 10 years to submit proof of his63
or her residence address for renewal of the license or64
identification card. In all cases, the department shall65
primarily use the existing photographs in its records as the66
best evidence for identification upon renewal or modification of67
a driver's license or identification card.68
(3) The department may not use any national or69
international standard for the photographs required under this70
chapter and may not incorporate any radio frequency71
identification device, any device known as a RFID, or any72
similar electronic tracking device upon or within any driver's73
license or identification card issued. The department may not74
obtain any fingerprints or biometric DNA material from a United75
States citizen for purposes of any issuance, renewal,76
reinstatement, or modification of a driver's license or77
identification card.78
(4) A residential address is not required to be displayed79
on the driver's license or identification card of any person80

(5) This section does not prohibit the copying and83
retention of documents submitted by noncitizens when applying84
for a driver's license or identification card.85
Section 2. This act shall take effect July 1, 2012.86

appears): Technically, Floridians, i.e., Citizens of The State
of Florida, cannot claim to be United States citizens except inrelation to the land of one of the several States of The Union.
The United States, except for the land area which Maryland ceded
to the federal government, is not a stand alone country as
England is, and has no defined land boundaries. It is a Union of
several land-defined States. Therefore, no American, except
those born on the soil of Washington, DC or its possession,
enclaves, or military bases, can claim to be United States
citizens. Currently, there is no application available forCitizens of The State of Florida on the soil to apply for a
driver license as Citizens of The State of Florida. For every
other status, there is an application. Why does it not suffice
the DMV to say that one is a Citizen of The State of Florida or
any other State of the Union?

request. That Act is codified in Title 5 Sec. 552a. In the
Definitions section of Title 5 Sec. 552a of the United Stated
Code, sections (a) (2) and (a)(13), an "individual" is definedas a "citizen of the United States" and a "Federal personnel" is
defined as "...individuals entitled to receive immediate or
deferred retirement benefits under any retirement program of theGovernment of the United States (including survivor benefits)",
respectively. Since the government requires people to acquire a
social security number in order to work, it forces people to be"entitled" to receive benefits under its retirement program,
i.e., social security. Thus, unknowingly, people are attesting
to being "citizens of the United States" when the social
security number is assigned to them, with or without their
consent. Because of this imposed status to which many of us donot consent, Floridians must be allowed to opt-out of using an
SSN and of being asked whether he/she is a United States
citizen. Only those who are born on the land of Washington,
D.C. or United States possessions or enclaves can reasonably
