    Factual Background

    8 On or about January 19 2004 Plaintiff executed a mortgage loan with respect to theresidential real estate located at 1928 Wind R ive r Drive Lancaster Ohio 43130 theProperty evidenced by a promissory note and a mortgage in favor ofDominion HomesFinancial Services Ltd

    9 On August 6 2007 Defendant filed a complaint for foreclosure in the Fairfield CountyCourt of Common Pleas seeking judgment against Plaintiff and foreclosure of theProperty the Foreclosure Action The Foreclosure Action bore case no 2007 CV00952 A copy of th e complaint in t h e Foreclosure Action with t h e note a n d mortgage isattached hereto as ExhibitA

    14 In the Affidavit Defendants stated1 Affiant is a Vice President of Loan Documentation withWells Fargo BankNAn this jo b pos ition a ffiant has the cus tody of and has personalknowledge of the accounts of said company and specifically with theaccount ofPLAINTIFF defendant herein2 Affiant states that this s aid a cc ount is in default and that plaintiff haselected to call the entire balance of said account due an d p aya ble inaccordance with the terms of the note and mortgage attached to the

    16 It is wel l documented that for years Wells Fargo h a s u s e d so called robosigners in itsmortgage servicing division to expedite foreclosures Robosigners are individualsw h o s e s o l e job responsibility is to sign affidavits a s s i g n m e n t s of mortgage a n d other

    legal documents used in foreclosures en masse so t ha t homeowners can be removed fromtheir h o m e s by b a n k s a s quickly a n d cheaply a s possible As a result ofWells Fargosu s e o f ro bo signers t h e Ohio Attorney General h a s launched a n investigation into itspractices See article from Bloomberg News attached hereto a s ExhibitD

    17 Because they a r e required to sign s o many documents in order to effectuate cost savingsfo r the banks robosigners do no t even read the documents containing critical statementsnecessary to g r e a s e the wheels of their foreclosure mills The typical robo signer simplyattests under oath that he or she has personal knowledge of the statements made andswears that those statements a r e true and accurate without even having read thedocument In addit ion in the rush to generate these documents the robosigner willgenerally s ign the document outside the presence of a notary public w ho later notarizesthem

    18 The above practices fail to comport with legal requirements thereby rendering thedocuments fraudulent and invalid

    19 China Brown is and was at all relevant t imes employed and con tro lled by Wells FargoChina Brown is and w as a robosigner

    20 Based upon the foregoing Plaintiff has reason to believe and does believe that theAffidavit contained material false and fraudulent statements in thata China Brown did not have custody of the documents she referred to in the

    Affidavitb The records and accounts referred to were not compiled by Wells Fargo a t or near

    21 By giving China Brown the title of Vice President of Loan Documentation WellsFargo meant to m is lead the Court in the above noted foreclosure action and Plaintiff intobel ieving she w as a person with the knowledge and authority to make the statements shedid in the Affidavit and thus not ques tion the validity of it

    22 Defendants statements that they were the holder of the note and mortgage we re falsean d we re mean t to mislead the Court an d the Plaintiff into believing Wells Fargo had theright to foreclose

    23 Based upon the Affidavit and the false allegations in the complaint in the ForeclosureAction the Court granted WellsFargosotion for default judgment

    24 The enti re Forec losure Action noted w as contaminated by the fraud ofWells Fargo andChina Brown A s a result of that fraud Wells Fargo w as permitted under color of lawto ta ke the Property away fromPlaintiff
