Yancy participated in previous Paint Memphis projects, but it was his own plan to place the masked man on the Gloco wall, a work inspired by coronavirus-relat-ed cancellations and isolation in March.

“As you can see, there’s art all around that area. So, that wall is like a perfect space,’’ Yancy said. “If I’m going to put up a piece, I’m going to put up something with purpose — something that people can think about.”The character he painted sports an Afro hairstyle and a mask fash-ioned to resemble the American flag. For Yancy, whose themes focus on socioeco-nomic mobility and race, the masked man invokes “the American Dream and being an African American.”

“With different political pieces that I have done, whether Trump or Dr. Martin Luther King, it’s about my feelings. And I don’t try to push my feelings on anybody. I just try to express it the best way I can, which is art.”

Public art can create controversy. In 2018, the founder of the Paint Memphis nonprofit, Karen Golightly, had conten-tious debates with Memphis City Council members over complaints about murals at Lamar and Willett.

Golightly says the owner of Gloco Iron Works, who couldn’t be reached for com-ment, had expressed displeasure about one of the pieces which made its way to her wall during October’s Paint Memphis.

“She tried to get us to paint over the mural that’s there,” Golightly said.

As authorship of the permitted work falls under the Visual Artists Rights Act of 1990, the mural couldn’t be painted over.

“That’s why I said, ‘We can’t paint there, but we’ll paint the front and the sides.’ She has a few murals on her build-ing that she gave us permission to do.”

Though Golightly found out about Yancy’s masked piece as many others did, by driving by once he was done, she says the piece is a striking example of art’s timeliness.

“One of the things that we have not had in Memphis during this time period is any murals that spoke to COVID-19 and the situation we are in. That is going to be one of the themes of Paint Memphis’ 2020 event,” Golightly said.

“David’s piece really does answer the idea of so many people being affected and how we honor our health care workers and the value of people wearing masks. It’s only one artist’s opinion, but it adds to the conversation that is happening in

the news media, on social media and on people’s front porches.”

Yancy’s work makes a loud state-ment in a venue with a lot of competing narratives.

“I have heard of a lot of artists who’ve lost jobs. But a lot of great art has been created, as well, because you have to stay

home, sit by yourself, and figure out, ‘What am I going to do?’”

“I think people have been reaching deep inside and pulling out things that they have been holding onto, or waiting to do, because they didn’t have the time to really work on it. Now they’ve got that time.”

Experts say there is ample evidence to show the lifelong ramifications for school children who don’t read at grade level by the end of third grade — a point when students transition from learning to read to reading to learn.

Studies have found those chil-dren are more likely to not gradu-ate from high school, have a low-er earning potential and will face a myriad of ongoing challenges.

“And it’s an indicator for the school-to-prison pipeline. They are able to project how many beds they are going to need in prison based on what third-grade reading levels are,” said Anne Pitts, director of Give901.

Give901 is working with area

literacy nonprofits ARISE2Read, Porter-Leath’s Books from Birth program and local businesses to divert that pipeline by put-ting summer reading kits in the hands of 1,300 needy children. Business partners include Burkes Books, the Art Center and Inter-national Paper.

The goal is to raise $15,000 to purchase age-appropriate books, learning activity packs and inter-active toys to fill those kits for young learners in Binghampton, Frayser, Berclair, Hickory Hill, Midtown and Orange Mound.

Give901 is a platform cre-ated by City Leadership and Choose901 to support education in Memphis, where 45 % of chil-dren live in poverty and many don’t have books in their homes, Pitts said.

“We’re talking about kids who are living in homes and com-munities where books are very low on the priority list. Families struggling with food security and housing security, the last thing they think about are books,” she said. “That’s why getting books in hands of these 1,300 kids is so important.”

With the coronavirus inter-rupting the school year and stu-dents losing about a fourth of their classroom time, providing these kits this year is even more important.“That’s why we felt like this is a critical project. We need to get tools into the hands of these kids so that they can continue learning those skills, of learning to read, loving to read, reading with the adults in their home,” Pitts said.

More than 2,600 books have been donated by ARISE2Read, an agency that works specifically with second-grade students.

Volunteers tutor students in reading at elementary schools across Shelby County and lo-cal schools in the Tennessee’s Achievement School District.

“It’s been wonderful to know we’ve been able to collaborate together to get reading materials into another pocket of our com-munity,” said Karen Vogelsang, executive director.

The nonprofit buys books in large quantities, as many as 4,000 copies at a time. But because the school year ended unexpectedly, some books weren’t distributed, Vogelsang said.“I don’t want books sitting on our shelves in here. I want books in the hands of kids,” she said. “This was a no-brainer, to help Give901 get the books into the hands of the chil-dren they support.”Also, she said, they make sure that the books chosen reflect the community.

“That’s something that’s very important to me. We painstak-ingly select books, making sure there’s a mix in there,” Vogelsang said.The Books from Birth pro-gram was started by entertainer Dolly Parton to give books to children in Sevier County where she grew up, said Wynett Jones,

program director for Porter-Leath Books from Birth.

Parents sign up and begin re-ceiving books addressed to the child each month until they’re 5 years old.“This affiliate is the largest in the world. We have over 43,000 children per month in Shelby County who receive a book in the mail,” Jones said.

Sometimes, the books come back.They’re donating 200 of those books to the cause and hope to be able to do more, she said.“We’re thrilled to partner with City Leadership and with other community partners to provide the literacy packets to students in the community,” Jones said.COVID-19 was a dis-ruption for school children, Jones said, but this program will also help with “the summer slide” where kids, especially younger students, lose ground during the break.So far, Give901 has raised about $6,500 toward the $15,000 goal, Pitts said.

“We’re trying to nurture and encourage the next generation of community leaders, of educated workers who will attract more business and will grow the busi-ness we have,” she said.

“That’s an investment that need to make and should value. We have to do all we can to invest in these children.”

hearts are broken as we think about the men and the women who served our country and gave the supreme sacrifice.”

But he encouraged visitors to be thankful veterans were will-ing to die for freedom.

“Today is the day we applaud their heroic deeds,” he said.

“Today is the day that we stand in honor and we say thank you. Today is the day that we salute them and say a job well done.”

He said it was “repulsive” the holiday is known for sales.

“(Memorial Day) is about giv-ing – men and women giving so that you and I can enjoy the free-doms this country has to offer.”

The ceremony included songs and a cannon salute.

West Tennessee State Veter-ans Cemetery did not hold a cer-emony. Usually more than 100

people gather on Memorial Day morning.Brad Sparks, a Marine Corps veteran, looked across the property for several minutes. He knew the significance of the day because he lost friends while serving.“It’s sad enough,” he said. “I’ve lost more friends after than I did during deployment … they were unable to cope.”

Each of the more than 20,000 graves had flags placed next to their headstones.

“People just showed up (to place f lags),” said Ben Kemker, a bagpiper who played some pa-triotic tunes to pay his respects.

“I had a son in the army,” he said. “I have played at a lot of fu-nerals. (Playing) is the least I can do for those that gave it all.”

His son served in Afghani-stan, and he considered himself “fortunate.”

“My son made it back,” he said. “A lot of people didn’t. It’s kind of personal.”

Something else is going viral because of the pandemic: New language in com-mercial real estate leases that acknowl-edges the potential effect of occurrences like COVID-19 on the contract between a landlord and tenant.

It’s basically putting in writing some-thing that was hardly imagined before three months ago: My business agrees to pay you X amount a month for X years for the space, but this contract changes if the government orders me to close for reasons beyond my control.

Barry Maynard, vice president for

brokerage at Gill Properties, says he’s see-ing the new language now.

Maynard paraphrased the typical new contracts he’s been seeing: “In the event any force majeure event occurs this sus-pends automatically until the force ma-jeure terminates.”

A “force majeure,” according to Web-ster’s, is a superior force and cannot be reasonably anticipated or controlled.

A few parties “will say ‘I’m not signing that’, but expect attorneys to put clauses in there,” Maynard said.

“I can confirm that is happening,” Hunter Smith said of the new lease lan-guage. He is a Memphis commercial

landlord who, w ith his father Wise Smith, owns and operates Marketplace Development.

The contracts he’s seen don’t specifi-cally mention “pandemic.”

“The way we have seen it phrased is “If there’s a shutdown by government, if the government forces certain businesses to close,” said Smith, whose tenants include oil-change and smoothie businesses.

“I think it’s being super safe,” Smith said of the lease changes. “I think it’s just a way of protecting themselves.”

The scale of business that the tenant operates may also affect how they ap-proach new leases, Smith said.

“I think the level of the tenant also plays a role, depending on how many loca-tions they have and how much they have been affected by this,” he said.

Few businesses lease more locations than Starbucks. The Seattle-based cof-fee shop chain operates about 30,000 sites worldwide and more than 40 in the Memphis area.The pandemic has hurt Starbucks sales even though the company has kept drive-thru operations open and offered prepared, pick-up service at the entryways of some shops.

Starbucks’ chief operating officer Roz Brewer wrote an open letter to its land-lords on May 5 stating that effective June 1 “and for at least a period of 12 consecu-tive months, Starbucks will require con-cessions to support modified operations and adjustments to lease terms and base rent structures, so we can withstand this uncertainty together.

“In many ways, this historic shift is dramatic; yet it’s simply accelerated the trends in retail and digital commerce, driving us to close, renegotiate, and rein-vest in the right footprint for Starbucks,” the letter states.“Of course, none of us know (sic) the full extent of the challenges ahead, but it is clear the value of commer-cial real estate has changed. We under-stand what we ask of you may not be easy,

and our commitment is to be fair in our discussions,” Brewer writes.

In response to questions on Wednes-day Starbucks spokesperson Jory Mendes said that chief financial officer Pat Gris-mer had addressed the rent issue during an earnings call about three weeks earlier.

According to the transcript, Grismer said, “... To date we’re quite proud of the fact that we have remained current on all our rent payments which we believe reinforces our position as a developer of choice, if you will.“We are having ongoing conversations with our landlords in vari-ous markets regarding what may be com-mercially reasonable lease concessions in the current environment. So we’ve not yet confirmed those arrangements and it’s really premature to indicate what that re-lief may look like. But it is something that we are pursuing,” Grismer said.

A lot of leases are being amended now, said Memphis real estate attorney Allison Gilbert.Force majeure clauses should be in every lease, said Gilbert, with the Har-ris Shelton law firm.“They are intended to benefit both parties,” she said. “In the event something happens outside the con-trol of the parties, they can suspend the performance under the contract without being in default.”

It had not been uncommon for “acts of God” language to be written into con-tracts, she said.“It was a very general, sweeping provision that sometimes was meant to be very open,” Gilbert said.

“And sometimes people tried to carve it down since it does allow for parties to say ‘I can’t perform’ because of occurrenc-es like labor strikes and storm damage.”

But COVID-19 is affecting new and amended leases.“We have seen parties specifically adding the word now ‘pan-demic,’” she said.

“Which may or may not be necessary but it gives everybody something else to add to a contract and probably a little bit of a sense of calm,” she said.

RE: Comprehensive Plan to Resume In-Person Court Proceedings for General Sessions Civil Court, 30th Judicial District

Dear Sir or Ma’am:

Effective June 15, 2020, Shelby County General Sessions Civil Courts will reopen for in-person court proceedings pursuant to the mandate of the Supreme Court of the State of Tennessee and in accordance to the comprehensive plan submitted to the Chief Justice of the Tennessee Supreme Court. This mandate applies to all in-person court proceedings.

The attached plan includes details applicable to: admission into courthouse (140 Adams, Memphis, Tennessee), management of social distancing in courtrooms and docket management. Critical details include but not limited to the following:

Only three out of the six divisions of General Sessions Civil Court will operate daily with in-person proceedings, with no more than fifteen litigants at one time in a courtroom. (The rotation of the court schedule includes the judge assigned to hear Mental Health Hearings.)No more than twenty litigants will be allowed to wait in each hallway.Clerk’s Office has been instructed not to set more than fifty cases per docket 10:00 a.m. and 1:30 p.m., per division with the exception of Fridays. Only FED cases will bet set on Mondays, Wednesdays and Fridays. Non FED cases will be set on Tuesdays and Thursdays.

Per Judge Lonnie B. Thompson, Administrative Judge of General Sessions Civil Courts, the plans may be re-assessed after the re-opening for in-person proceedings.

Enclosure: Comprehensive Plan to Resume In-Person Court Proceedings for General Sessions Civil Court, 30th Judicial District

IMPORTANT PUBLIC NOTICE The United States District Court for the Western District of Tennessee has implemented the following measures in response to the COVID-19 Pandemic: 1- All in-person civil judicial proceedings currently scheduled are CONTINUED until after May 30, 2020. Counsel and/or litigants will be notified of new settings and rescheduled dates.

2- All currently scheduled in-person criminal judicial proceedings other than the initial appearances, arraignments, bond and detention hearings and other in-person proceedings presided over by Magistrate Judges are CONTINUED until after May 30, 2020. Initial appearances, arraignments, bond and detention hearings will continue on a schedule determined by the Magistrate Judge assigned to criminal duty and will be handled by videoconferencing or as otherwise directed by the presiding judge. Counsel and/or litigants will be notified of new settings and rescheduled dates.

3- All jury selections and trials scheduled to commence now or through May 30, 2020 are CONTINUED until further notice, and all grand juries already selected will not meet until after May 30, 2020, unless an emergency proceeding is deemed necessary prior to May 30, 2020. 4- Prior to May 30, 2020, the Court will reevaluate then existing circumstances and updated guidance from reliable medical sources to determine whether to extend the May 30, 2020 date or whether judicial proceedings can resume.

5- The Clerk of Court’s offices in Memphis and Jackson are closed to the public. Staff will be available by telephone, mail will be received, but no counter operations will remain open. Attorneys and parties with access to CM/ECF are encouraged to use it for the submission of all filings. Any unrepresented litigants with access to email are encouraged to submit their filings at this email address: [email protected]. Any unrepresented litigants who do not have access to email are advised to submit their filings via U.S. Mail to one of the divisional offices:

Coverage Area – Public Records Real Estate TransactionsWarranty Deeds, Trust Deeds, and other special deeds are compiled daily from the records of the Shelby County Register’s office.Warranty Deeds usually convey title to real estate from the seller to the buyer.Trust Deeds, in effect, convey a lien on the real estate from a borrower, guarantor, person or firm putting up the real estate as collateral or security for some purpose, to a lender, person or firm receiving collateral or security for some purpose. A lender is usually designated by its trustee. In many instances, the borrower is at the same time a buyer of the real estate, and is executing a purchase money mortgage. When that occurs, the Warranty Deed and Trust Deed will usually have consecutive, or nearly consecutive, instrument numbers.Other special deeds also transfer an interest in the real estate from the grantor to the grantee.

Foreclosures – Tenn. requires foreclosure notices to run 3 times, in 3 consecutive weeks. Foreclosure sales are conducted by a Trustee, usually an officer or employee of the lender. Often, the Trustee is replaced with a Substitute Trustee or Successor Trustee – an attorney or other party who is hired to conduct the foreclosure sale.

Bid Notices & Request for Proposals – Tenn. requires county bid notices to run at least once 5 or more days prior to the bid deadline. City of Memphis bid notices run 2 consecutive days at least one week before the bid deadline.
