Trent Lakes Mining and Aggregate Advisory Committee Meeting

Peter Raymond, Councillor Staff: Lois O’Neill-Jackson, CAO Bob Angione, Clerk Kari Stevenson, Planning Technician The Clerk called the meeting to order at 6:00 p.m. and welcomed everyone. Everyone present introduced themselves and provided a brief background of their experience. Selection of Chair and Vice Chair The Clerk opened the floor for nominations. Don Young nominated Bernie Fuhrmann as Chair. The Clerk asked three times for further nominations and hearing none, announced Bernie Fuhrmann as Chair of the Mining and Aggregate Advisory Committee. The Clerk asked for nominations for Vice Chair. Janet Klein nominated Marie Windover. The Clerk asked three times for further nominations and hearing none, announced Marie Windover as Vice Chair.

Brainstorming – Expectations for the Committee Chair Fuhrmann suggested that the committee start with the broader issues such as the extent of aggregate in the Municipality of Trent Lakes and reviewing the regulation processes. It was suggested that education is the first goal. Chair Fuhrmann noted that he could provide an overview of regulatory processes. It was noted that a map (Schedule C) detailing aggregate deposits within the Municipality of Trent Lakes was developed by the previous aggregate committee. The Planning Technician provided a copy of Schedule C for the committee’s reference. Chair Fuhrmann explained the Lakehurst omissions. Don Young noted that the committee is to provide comments on a broad overview and range of issues.

The committee could create a checklist or criteria for reviewing new aggregate applications. The committee is to consider applications in general terms and not provide a site-specific review. Any policies that are suggested should not conflict with the Provincial Policy Statement (PPS) but rather should complement the PPS. This committee must work within the legislation. It was suggested that the aggregate policies of Caledon and Uxbridge be reviewed. Janet Klein asked about the possibility of developing and reviewing a cumulative impact study. The Planning Technician suggested that the committee consider receiving a delegation from a municipal planner who could provide an overview of these many issues. The Planning Technician was excused from the meeting at 7:07 p.m. Don Young explained that currently the demand for aggregate material is exceeding supply. After the 407 extension is completed large aggregate companies will come to Trent Lakes. Terms of Reference A draft terms of reference as prepared by Councillor Persson and Councillor Raymond was circulated and discussed. Key points of discussion included the following roles for the committee;

Facilitate communication between stakeholders. Provide feedback to Council e.g. regarding haul routes when decisions are

pending. Avoid commenting on specific applications. Identify historical or other issues of significance. Perhaps develop a liaison committee to deal with any specific issues that arise. Develop policies for consideration by Council.

Councillor Raymond suggested that the draft terms of reference be reviewed by each committee member and that feedback and suggestions be brought to the next meeting.

Aggregate Advisory Committee Terms of Reference

A. Purpose

The Township of North Dumfries Aggregate Advisory Committee is to monitor the oversight responsibilities of all levels of government, the aggregate industry and other stakeholders pertaining to the extraction, processing and transport of aggregate while offering ideas and advice to improve the sustainability of the aggregate industry and the well-being of Township

B. Mandate

The Township of North Dumfries Aggregate Advisory Committee will:

• Review and comment on the development of provincial policy, official plan policy, site plan guidelines and zoning regulations;

• Review proposed aggregate extraction applications filed with the Township (ARA Licenses, OPAs, ZBAs);

• Observe and monitor existing operations; • Observe and Monitor rehabilitation activities (Past, Present and Future); • Provide conflict resolution mechanisms; • Provide an avenue for communication and engagement between the public

and the aggregate industry; C. Lead Department

The Planning Department will act as lead to the Aggregate Advisory Committee. Staff from all departments and/or members of other agencies may attend meetings as required to provide expertise or report on various matters.

D. Reporting Relationship

The Committee is empowered by Township Council and is responsible to Township Council for its activities. The Committee is an advisory committee to Council and does not have any delegated authority. Council may cause the committee to review and report on matters pertaining to the committee’s mandate. The Committee has no authority to direct staff and any recommendations requiring implementation, reports or staff action must first be considered by Council before any action by staff may be taken. E. Committee Composition

The Committee shall be comprised of 5 – 7 members, including community, industry and regulatory specialists. Community, industry, regulatory specialists and other members of the public are eligible to volunteer or to nominate an associate, colleague or informed citizen. From those who volunteer or are nominated, Council will appoint members based on the following criteria:

• Distribution across academic, industrial, professional, societal, technical disciplines

• Membership that reflects diversity

• Distribution in terms of length of community/industry service

• Personal Qualities:

o Able to express one’s opinions comfortably and effectively

o Broad knowledge of the aggregate industry and environment

o Respectful of the views of others

o Able to consider the broader community interest

Appointments will run concurrent with the term of Council. Appointments may be revoked at any time at the discretion of staff and/or Council. The committee shall also consist of one member of Township Council who shall have full voting privileges. All members are to be appointed by way of Council resolution. The Mayor is an ex-officio member.

A Committee Coordinator will provide organizational and procedural support to the committee. Other staff and delegates may be invited to provide input at times, however, they are not to be counted towards quorum and do not have voting privileges.

F. Role of Committee Members

The role of each member will be to consider the broader interests of their committee partners and of the Township as a whole and to review any materials provided in advance and to come to each discussion prepared to express their own opinions while working towards a solution.

G. Chairperson

Of the voting members a co-chair shall be elected by majority vote. The appointed member of Council will serve as the Committee Chair. The Chair is responsible for leading the discussion at each meeting pursuant to the meeting agenda and the committee’s mandate. If a Chair or co-chair is not present, members are to select an acting chairperson to serve in the same capacity for the duration of that meeting.

H. Subcommittees

Subcommittees may be formed to complete specific tasks related to the committee’s mandate and work plan but must report through the committee.

I. Decision Making and Voting

Where possible, decisions will be made by way of consensus. When a vote is necessary, a motion must be moved and seconded prior to voting. A resolution is deemed to be carried if the majority of members present vote in the affirmative. Recorded votes shall not be permitted. The committee shall not reconsider a previous motion, unless directed to so by Council.

Quorum shall be a simple majority of the total number of committee members (i.e. 50% plus one). If determined practical, a meeting may proceed without a quorum, however, substantive recommendations are not be fully ratified until supported by the majority of members. If no quorum is present and there are time constraints with respect to a particular item on the agenda, the Committee Coordinator may canvass members through alternative means in order to determine committee support for that particular item.

K. Meeting Structure and Format

Regular meetings will be at least three times per year at the call of the Chair. Minutes will be received by Council and substantive recommendations will be forwarded to staff for review and action if deemed necessary. Recommendations must relate to the committee’s mandate.

Committee meetings are open to the public and are subject to the provisions of Section 239 of the Municipal Act, 2001. Members of the public who are in attendance shall not interfere with the conduct of the committee.

Township of North Dumfries Procedure By-law shall be followed for all matters not specifically addressed within this document. These Terms of Reference are established by Council and can only be altered by Council.

K. Conflict of Interest

Committee members will adhere to the Conflict of Interest Policy for Citizen Appointees to Committees. Members in violation of the Policy may be asked to refrain from participating or leave the Committee.
