Type Approval of Marine Equipment (UK Nominated Bodies) Notice to Manufacturers, Shipbuilders, Shipowners, Ship Operators and Managers, Designers and Marine Consultants, Masters and Officers of Merchant Ships, Skippers of Fishing Vessels and Owners of Yachts and Pleasure Craft This Notice supersedes Merchant Shipping Notice No.M.1645 and MGN 43. The following text is to be inserted in MSN 1688 - end of para 1, and MSN 1714 - end of para 3: ‘In the case of a ship of a Member State of the European Union, the performance standards applicable to equipment installed on or after 1 January 1999 are specified in the Merchant Shipping (Marine Equipment) Regulations 1999, as they may be amended from time to time.’ MERCHANT SHIPPING NOTICE MSN 1735 (M+F) Summary This Notice covers equipment listed in Annex A.2 of Directives 96/98/EC and 98/85/EC where no detailed internationally agreed testing standards exist. This equipment will continue to be type approved by the Nominated Bodies until international standards are agreed. This Notice advises about:- the delegation of marine equipment approvals by the MCA to the Nominated Bodies the appropriate tests and procedures to be used for future type approvals the categories of equipment for which approval has been delegated the retention by MCA of type approval of novel items 1 Introduction 1.1 The Merchant Shipping (Marine Equipment) Regulations 1999 SI (1999 No. 1957) provide for the "type approval" of marine equipment, of a safety or pollution prevention nature, for use on board United Kingdom ships. This legislation implements the European Community (EC) Directive 96/98/EC of 20 December 1996 on Marine Equipment and 98/85/EC of 11 November 1998. Directive 98/85/EC contains an Annex A which amends Annex A of Council Directive 96/98/EC. After 30 April 1999, the testing standards in the amended Annex A must be used to obtain an EC type approval certificate. However, for equipment manufactured between 1 January 1999 and 30 April 1999, manufacturers may use the testing standards contained in Annex A of 96/98/EC. 1.2 The equipment listed in this notice covers equipment listed in Annex A 2 of Directives 96/98/EC and 98/85/EC where no detailed internationally agreed testing standards exist. Such equipment will continue to be type approved by the Nominated Bodies to standards agreed with the MCA until international standards are agreed. 1.3 Type approval of Annex A 1 Equipment must be conducted by an EC Notified Body. Details of Notified Bodies nominated by the UK are contained in MSN 1734. 1.4 Where equipment is of a novel nature or subject to significant design changes or the specifications or testing requirements are not considered to be sufficiently developed or experience of their usage is limited, the MCA will undertake the necessary approval procedure. 1

MSN 1735 (M+F)

Summary

This Notice covers equipment listed in Annex A.2 of Directives 96/98/EC and 98/85/EC where nodetailed internationally agreed testing standards exist. This equipment will continue to be typeapproved by the Nominated Bodies until international standards are agreed.

This Notice advises about:-

● the delegation of marine equipment approvals by the MCA to the Nominated Bodies● the appropriate tests and procedures to be used for future type approvals● the categories of equipment for which approval has been delegated● the retention by MCA of type approval of novel items

1 Introduction

1.1 The Merchant Shipping (Marine Equipment)Regulations 1999 SI (1999 No. 1957) providefor the "type approval" of marine equipment,of a safety or pollution prevention nature, foruse on board United Kingdom ships. Thislegislation implements the EuropeanCommunity (EC) Directive 96/98/EC of 20December 1996 on Marine Equipment and98/85/EC of 11 November 1998. Directive98/85/EC contains an Annex A which amendsAnnex A of Council Directive 96/98/EC. After30 April 1999, the testing standards in theamended Annex A must be used to obtain anEC type approval certificate. However, forequipment manufactured between 1 January1999 and 30 April 1999, manufacturers mayuse the testing standards contained in AnnexA of 96/98/EC.

1.2 The equipment listed in this notice coversequipment listed in Annex A 2 of Directives96/98/EC and 98/85/EC where no detailedinternationally agreed testing standards exist.Such equipment will continue to be typeapproved by the Nominated Bodies tostandards agreed with the MCA untilinternational standards are agreed.

1.3 Type approval of Annex A 1 Equipment mustbe conducted by an EC Notified Body. Detailsof Notified Bodies nominated by the UK arecontained in MSN 1734.

1.4 Where equipment is of a novel nature orsubject to significant design changes or thespecifications or testing requirements are notconsidered to be sufficiently developed orexperience of their usage is limited, the MCA willundertake the necessary approval procedure.

1.5 Procedures have been agreed with the bodieslisted in the Annex which are nominated as"persons" (as referred to in the MerchantShipping (Delegation of Type Approval)Regulations 1996) who may undertake theexamination, testing and certification of theequipment listed in the Annex for which typeapproval is normally appropriate.

1.6 Existing MCA type approval certificates forequipment listed in the Annex to this noticewill remain valid until their expiry date oruntil 31 December 2000, or until cancelled.Upon the expiry date of the certificate,manufacturers are advised to re-apply forrenewal of their certificate to a NominatedBody. If requirements have not changed anew certificate will be issued. All newcertificates of type approval will be valid for aperiod of up to 5 years.

1.7 Unless there is a change in the requiredstandard, existing type approved equipmentalready fitted on board ship will continue to be accepted providing it operatessatisfactorily. If it needs to be replaced, then itmust be replaced with equipment for which acurrent type approval certificate is in force.

1.8 Equipment for new ships or for fitting onexisting ships, where required to be typeapproved, should be type approved to thelatest standards.

2 TYPE APPROVAL PROCEDURE

2.1 Application for Type Approval

2.2 A manufacturer or person wishing to gaintype approval of equipment listed in thisnotice for use on UK ships should submit anapplication to a Nominated Body. Theapplication should include:

.1 the name and address of themanufacturer and, if the application islodged by an authorised representative,his name and address;

.2 a written declaration that the same or asimilar application has not been lodgedwith another Nominated Body;

.3 the technical documentation stated inparagraph 3; and

.4 the applicant is to place at the disposalof the Nominated Body sufficient

specimens representative of theproduction envisaged. The NominatedBody may request further specimens ifneeded for carrying out the testprogramme.

2.3 The technical documentation is to enableconformity of the product with therequirements of the relevant regulations andtest standards to be assessed. It is, as far asrelevant for such an assessment, to cover thedesign, build standard, manufacture andfunctioning of the equipment.

2.4 Type approval tests are to be conducted at aUnited Kingdom Accreditation Services(UKAS) or equivalent national bodyaccredited laboratory unless no suchlaboratory is available. In this instance analternative laboratory recognised by theNominated Body as offering suitable andsatisfactory guarantees of technical andprofessional competence, quality proceduresand autonomy with particular reference to theapplication of EN 45001 or ISO/IEC Guide 25may be used.

2.5 The Nominated Body will:-

.1 examine the technical documentation andverify that the equipment has beenmanufactured in conformity with thetechnical documentation;

.2 agree with the applicant the locationwhere the examination and necessarytests are to be carried out; and

.3 perform or have performed theappropriate examination and necessarytests to check whether the relevantrequirements are complied with.

2.6 Where the equipment meets the provisions ofthe relevant applicable instruments and testand performance standards, the NominatedBody will issue a certificate of type approvalto the applicant. The certificate will containthe name and address of the manufacturer,details of the equipment, conclusions of theexamination, conditions for its validity andthe necessary data for identification of theapproved type.

2.7 A list of the relevant parts of the technicaldocumentation including drawings andinstructions will be annexed to the certificateand a copy kept by the Nominated Body.

2.8 If the manufacturer is refused a certificate oftype approval, the Nominated Body willprovide detailed reasons for such refusal.

2.9 The applicant must inform the NominatedBody that holds the technical documentationconcerning the certificate of type approval ofall modifications to the approved productwhich must receive additional approvalwhere such changes may affect the conformitywith the requirements or the prescribedconditions for use of the equipment. Thisadditional approval will be given in the formof an addition to the original certificate oftype approval.

2.10 Each Nominated Body shall communicateupon request to the MCA and otherNominated Bodies the relevant informationconcerning the certificates of type approvaland additions issued and withdrawn.

2.11 The certificate of type approval and/or theiradditions and the annexes to the certificateswill be kept at the disposal of the MCA andthe other Nominated Bodies for the periodspecified in paragraph 2.12 and 2.13.

2.12 The manufacturer or his authorisedrepresentative is to keep with the technicaldocumentation copies of certificates of typeapproval and their additions for a period ofat least ten years after the last product hasbeen manufactured.

2.13 The Nominated Body is to keep the technicaldocumentation, other documentary evidenceused to type approve the equipment andcopies of certificates of type approval withtheir additions for a period of at least tenyears after the issue of each certificate oftype approval.

3 Technical documentation supplied by theManufacturer to the Nominated Body

3.1 The technical documentation must contain allrelevant data or means used by themanufacturer to ensure that the equipmentcomplies with the essential requirementsrelating to it.

3.2 The technical documentation must enableunderstanding of the design, manufactureand operation of the product and assessmentof conformity with the relevant requirements.

3.3 The documentation shall contain so far as isrelevant for assessment:-

.1 a general description of the equipment;

.2 conceptual design and manufacturingdrawings and schemes of components,and relevant supporting drawings;

.3 descriptions and explanations necessaryfor the understanding of the saiddrawings and schemes, including theoperation of the equipment;

.4 results of design calculations made,impartial examinations carried out, etc;

.5 impartial test reports; and

.6 manuals for installation, use andmaintenance.

3.4 Where appropriate, the design documentationmust contain the following elements:-

.1 attestations relating to the equipmentincorporated in the appliance;

.2 attestations and certificates relating to themethods of manufacture and/orinspection and/or monitoring of theappliance; and

.3 any other document making it possiblefor the Nominated Body to improve itsassessment.

3.5 On receipt of notification the NominatedBody will, in consultation with themanufacturer, agree on such particulars asmay be required to enable him to undertakean assessment of the equipment and issue therelevant certificate of type approval.

4 Waiver

In consultation with the MCA, the NominatedBody may waive the requirement for any testspecifically cited in a performance standardproviding it is satisfied that the sample hasmet the criteria of a specification superior tothat of the prescribed test.

5 Non-Compliance

If the equipment is not found to meet the

appropriate standard(s) the applicant will benotified, in writing, of the non-compliance.

6 Re-Submission

6.1 Where a submission has been rejected aftercompletion of the type approval procedure bythe Nominated Body, the manufacturer willbe required to modify the equipment to takeaccount of the reasons for non-compliancebefore making a new submission to theNominated Body. In the manufacturer’sapplication to the Notified Body he mustinclude

(a) the original examination and test results;

(b) the detailed reasons provided by theNominated Body for the previous refusal:and

(c) details of all modifications made to theequipment since the previous application.

6.2 Upon receipt of the re-submission, togetherwith the application form the NominatedBody will re-open the approval procedure.

7 Issue of Type Approval

7.1 Providing that the Notified Body is satisfiedthat the equipment complies in all respectswith the specifications laid down by the MCAand subject to the provisions below, theNominated Body will issue a certificate oftype approval stating the terms andconditions of approval and period of validitywhich will be of up to 5 years.

7.2 A certificate of type approval refers only toequipment identical to that assessed. It is alsoa condition of issue of the certificate that amanufacturer shall consult with theNominated Body prior to any alteration to thebuild standard of the equipment, hardware,software or firmware.

7.3 The Nominated Body may require furthertesting and assessment to be undertaken inthe event of a modification, or series ofmodifications, being considered to constitutesufficient departure from the build standardof the equipment hardware, software orfirmware for which the certificate of typeapproval was originally issued.

8.1 Information concerning Type ApprovedEquipment and how to obtain type approvalfor equipment as listed in the Appendices tothe Annex can be obtained from:-
