Section 2. Two hlillion One Hundred Twenty Two Thousand Six
Hundred and Eighty Dollars ($2,122,680) are hereby appropriated from the
General Fund to the Public UtiHty Agency of Guam fcr the design and
construction of sewer lines in the following areas of the municipality of
Agana Heights :
1. Faha Drive
2. Mendiola Drive
3. Manha Drive
4. Untalan Drive
5. Tun Kiko Drive
6. Cotla Drive
7. Tenorlo Drive
8. Lorenzo Drive
9. Vicente Salomon Street
10. Cilalan Makana
11. Dadig Street
12. Chargualaf Street
13. Portion of Untalan-Ulloa Avenue.
Any remaining funds are hereby authorized for use in the design and
construction of sewer lines in other areas in the munidpality of Agana
Heights . Section 3. The Sinajana hlunicipal Planning Coundl and the Agana
Heights Munidpal Planning Council shall coordinate the installation of sewer
lines and appurtenances and the design and construction of sewer lines as
authorized by Sf 1 and 2 of this Act and shall coordinate with the Public
Utility Agency of Guam in its implementation. The contracting officer shall
be the Chief Officer of the Public Utility Agency of Guam.

BILL NO. 312: "AN ACT APPROPRIATING EIGHT HUNDRED EIGHTY FOUR THOUSAND DOLLARS ($884,000) T O INSTALL A SEWER LINE IN THE AREA AROUND AGANA SPRING AND AFAME, SINAJANA.
A public hearing was conducted by the Committee on Ways & Means on Thursday, May 11, 1989, beginning at 8:00 a.m. at the Legislative Session Hall to hear testimony on Bill No. 312. Committee Chairman, Senator Carl T.C. Gutierrez was joined by Senator Ted S. Nelson.
BACKGROUND
Bill No. 312 would appropriate $884,000 from the General Fund to the Public Utility Agency of Guam for the installation of sewer lines and appurtances in the area around Agana Spring and Afame, Sinajana.
TESTIMONY
No witnesses came forward to testify, however, written testimony was received from the Speaker of the Twentieth Guam Legislature, Senator Joe T. San Agustin in full support and urging the passage of Bill No. 312 (see Exhibit A). He noted that water and sewer improvements are a major priority of the government and this will extend service to families in isolated pockets where sewer lines have not previously reached.
Mr. Francisco N. Lizama, Commissioner of Sinajana submitted written testimony in favor of Bill No. 312 (see Exhibit B). Commissioner Lizama in his testimony stated that the projects to be funded are long overdue and have been under consideration by the Legislature for quite some time.

Written testimony was also received from Mr. Anthony C. Blaz, Chief Officer of the Public Utility Agency of Guam, supporting the Bill. (see Exhibit C) He noted that reliability in sewage collection in this area is crucial to insuring that the water wells in the area do not become contaminated.
COMMIITEE FINDINGS
Documentation from the public hearing has been reviewed and verified. A fiscal note was provided by the Bureau of Budget and Management Research which indicates that the amount necessary for the project is now $1,000,000 as the original cost estimate was made a few years ago. The Bill must be amended to the new amount.
In addition, it has been noted that areas of the village of Agana Heights are without sewer lines. Information was received from the .
Commissioner, Frank M. Portusach, that this project is necessary to reduce health hazards in the village. (see Exhibit D) He also provided a map and a cost estimate of the project from Guam Environmental Protection Agency Administrator, Fred. M. Castro. (see Exhibit E). Cost for design and construction of these lines will be $2,122,680.
RECOMMENDATION
The Committee on Ways and Means recommends that Bill 312, as substituted to include the adequate appropriations for sewer lines in Afame, Sinajana, and in Agana Heights, be passed by the Twentieth Guam Legislature.

Dear Sen. Gutierrez:
As you are aware, water and sewer improvements are a major priority of this government. In response to concerns conveyed to me by constituents in Sinajana and Maite, I have sponsored Bill Nos. 312 and 302. Both these bills were originally introduced in the 19th Legislature as Bill Nos. 1104 and 1103- respectively. Unfortunately, they were not acted on. These bills provide for the installation of sewer lines in these communities.
Bill No. 312 appropriates $884,000 for a sewer lines in the area around Agana Spring and Afame, Sinajana. Bill No. 302 appropriates $118,000 for sewer lines in the area behind the Hotel Plumeria in Maite. This will provide 1100 feet of sewer lines with manholes. Both of the areas addressed in Bill Nos. 312 and 302 are isolated pockets which do not have sewer lines at present.
The estimated cost for both projects is based on a letter, dated Nov. 18, 1988, received from Anthony Blas, Chief Officer of PUAG (see attachment).
I am sure your Committee shares my concern for the needs of these communities. I am therefore hopeful for your favorable consideration of both bills.

This is i n response t o your letter addressed to the Chief Officer of the Public U t i l i t y Agency of Wrn (PUAG) regarding the problem of overflowing sewage located below the Chaot bridge in Sina jam,
To protect public health and permanently solve the problem of sewage overflowing, Guam EPA and WAG has taken action t o prevent the problem from re-occurring, In 1985, an emergency generator was ins ta l led t o prevent sewage from overflowing when there is a power outage. Additionally, federal funding was obtained from the Federal EPA f o r the construction of a new pump .station and a relief sewer l i n e along Route 4 i n Agana.
The plans and specif icat ions f o r the construction of the project have been completed and a r e presently undergoing f i n a l review by the Corps of Fngineers and Federal EPA'. ?he project w i l l be bidded out by December, 1988 and construction w i l l be completed within three hundred s i x t y (360) days a f t e r a Notice t o Proceed is issued by PUAG.

Means. I am here today to testify in support of Bill 312(=) - An Act
0 Appropriat ing 118,O 0 to Install a Sewer Line in the Area around Agana Spring
and Afame, Sinajana.
Presently, PWG has four ( 4 ) wells in operation as part of the Afame
integrated water source system. We are in the process of conpleting the
construction of two (2) wells at Agana Spring. Total water production of
these six (6) wells is about 2,000 gallons per minute. Any contamination of
these water resources will force the government to abondon these wells and
resulting in a substantial decrease in the water supply for central and
southern &an.
The proposed sewr line will provide a reliable method of sewage collection
and eliminate many individual septic tank/leachfields that may not be properly
maintained. This will greatly reduce the risk of contaminating our valuable
unlerground water resources in this district.

We are very pleased to see bills such as these introduced by the 20th Guam
Legislature. We strongly support such ini t iat ives which muld provide
financing for water and wastewater infrastructure inprovements and faciliiate
better service to our residents.
This bill will provide adequate wastewater infrastructure to not only
accomnodate existing residences, but also future developnents in the area. By
doing so, we will ensure that the health of the people ami environnent of the
area are protected through the proper disposal of sewage.
RlAG encourages your passage of this legislation. Not only will .it inprove

Agency o f Guam (PUAG) t o i n s t a l 1 sewer l i n e s and appurtenances i n the
v i c i n i t y o f Agana Springs and Afame, Sina jana.
Information received from the Chief Engineer o f PUAG revealed t h a t the
proposed p ro j ec t i s i n conjunction w i t h various p ro jec ts s la ted by the Agency
i n i t ' s Rural Islandwide Wastewater F a c i l i t i e s Plan. The plan was developed
i n 1982 and was t o address the i s land 's wastewater needs i n r u r a l areas. The
o r i g i n a l cost est imate o f the p ro j ec t to ta led E igh t Hundred Eighty-Four
Thousand Dol lars ($884,000) and was based on const ruct ion cost a t the time.
Since then, the p ro j ec t cost has been adjusted t o r e f l e c t cur rent construct ion .

breakdown i s as fo l lows:
