Lord Jowitt and Lord Morton of Henryton expressed opposite
opinions on the question whether the Crown's right of forfeiture
is defeated, in the case of registered land, by section 23 of the
Land Registration Act, 1925. The negative answer given by the
Court of Appeal therefore still stands, but there is at least some
sign that its foundations may not be secure.
