Information Exchange Acknowledgement and Co-operation AgreementThe Modern Apprenticeship Programme (‘Programme’) is funded by The Skills Development Scotland Co Ltd (‘SDS’). It is necessary for information regarding yourself, including the information provided in this Training Agreement, details of your achievements and progress, your records of work and portfolios relating to your training and subsequent progression from your training (“Relevant Information”) to be passed to SDS for the purposes set out in SDS’s Privacy Notice relating to the Modern Apprenticeship Programme, which can be found on the SDS website. The information may be shared with third parties in the manner described in the Privacy Notice. In addition, for the purposes of monitoring training provider compliance and quality assurance, validation of training provider claims for payment and to assist with policy development, SDS or its nominated agents, may wish to contact you by text message, post, email or telephone, or meet with you directly to discuss matters associated with the provision of your training.

Participant’s Acknowledgement and Undertakings to SDSBy agreeing to participate in the Programme, I confirm that I have read and understand the contents of this Agreement and hereby:

(a) acknowledge that the Relevant Information will be passed to SDS and used in the manner identified in SDS’s Privacy Notice for the Modern Apprenticeship Programme;

(b) undertake to co-operate with SDS and/or any of its partners or agents who may contact me to assist SDS and/or its partners in the monitoring, audit and/or evaluation of the Programme and the assessment of the impact of the Programme;

(c) undertake to co-operate fully with SDS (and/or SDS’s agents, as applicable) in response to any text or other message request for information to enable SDS to validate training provider claims for payment concerning my participation in the Programme;

(d) undertake to co-operate fully with SDS (and/or SDS’s agents, as applicable) in response to any reasonable request for information concerning my participation in the Programme, to enable SDS to monitor training provider compliance and quality assurance, measure outcomes and to assist with policy development; and

(e) confirm that the details entered on the Training Agreement (and in respect of my Modern Apprenticeship framework only, the eligibility declaration) is/are correct.

Employer Declaration and Agreement with SDSName of Employer (“Employer”)

The Modern Apprenticeship Programme (“MA Programme’) is funded by The Skills Development Scotland Co Ltd (‘SDS’).

You should be aware that the following apply in order to operate an effective MA Programme:

Personal Data relating to the Employer’s staff (including the Participant)Personal data (i) relating to the training of the Employer’s employee (‘Participant’) under the MA Programme, and (ii) containing contact details of any Employer staff (collectively, “Relevant Information”), may be passed to SDS for the purposes set out in SDS’s Privacy Notice relating to the MA Programme, which can be found on the SDS website.

Other Dealings with the Employer SDS may (i) request the Employer to complete any questionnaire issued by or on behalf of SDS and/or Scottish Ministers for the purposes of evaluating the MA Programme and/or (ii) disclose the Employer’s contact details to other public bodies concerned with quality assurance to enable them to contact the Employer in relation to their respective functions, and/or (iii) contact the Employer to alert the Employer to, and discuss with the Employer, any additional services offered by SDS from time to time. SDS or its nominated agents, may wish to contact the Employer to discuss matters associated with the training of the Employer’s Participant.

The Employer’s Acknowledgement and Undertakings to SDSBy the placement of the Participant in the MA Programme, I confirm on behalf of the Employer that:

(i) in relation to the Personal Data relating to the Employer’s staff (including the Participant), the Employer hereby: (a) acknowledges that the Relevant Information will be passed to SDS and used in the manner identified in SDS’s Privacy Notice for the Modern Apprenticeship Programme;

(ii) in relation to the Other Dealings with the Employer, the Employer hereby: (a) acknowledges that it’s contact details may be used by SDS to contact the Employer to alert the Employer to, and discuss with the Employer, any additional services offered by SDS from time to time;

(b) acknowledges that it’s contact details may be disclosed to other public bodies concerned with quality assurance to enable them to contact it in relation to their functions;

(c) undertakes to co-operate with and assist SDS and any of its partners or agents in the monitoring, audit and/or evaluation of the MA Programme and the assessment of the impact of the MA Programme;

(d) undertakes to co-operate fully with SDS (and/or SDS’s agents, as applicable) in response to any request for information, to enable SDS to validate its claims for payment concerning the Participant’s participation in the MA Programme;

(e) undertakes to co-operate fully with SDS (and/or SDS’s agents and/or any independent quality assessor body, as applicable) in response to any reasonable request for information concerning the participation in the MA Programme by the Participant and the applicable training provider, to enable SDS (and/or such body, as applicable) to monitor training provider compliance and quality assurance, to measure outcomes and to assist with policy development; and

(f) confirms that its details and the training and employment status details for the Participant entered on the Training Agreement are correct.
