MINUTES OF THIRD MEETING 2015-2016 BOARD OF LICENSURE

FOR PROFESSIONAL ENGINEERS AND LAND SURVEYORS Montgomery, Alabama

February 9, 2016

Chair Barter called the third meeting of the 2015-2016 Board to order at 12:00 P.M., Tuesday, February 9, 2016 at the Board Office, Montgomery, Alabama. The following were in attendance:

It was determined that a quorum was present. The meeting was opened with the Pledge of Allegiance and a prayer.

The proposed meeting agenda was reviewed.

16-041. IT WAS MOVED by Mr. Barter to strike Agenda Item N-1 from the agenda. Motion died for lack of a second.

16-042. IT WAS MOVED by Mr. Christy and seconded by Mr. Willis to adopt the proposed agenda. MOTION CARRIED 5-1 with Mr. Barter voting in the negative.

Minutes of the second meeting of the 2015-2016 Board were received for approval.

16-043. IT WAS MOVED by Mr. Grace and seconded by Mr. Christy that the minutes of the second meeting of the 2015-2016 Board held January 12, 2016 be approved as written. MOTION CARRIED 6-0.

Action items from previous board meetings were reviewed.

HEARINGS

The disciplinary hearing originally scheduled had been continued at the request of the respondent.

APPLICATIONS - Mr. Nathan Johnson, Advisor

The Board previously authorized the Executive Director to approve applications for licensure, intern certification, and examinations if the application is in order and all requirements have been met. All applications for licensure, intern certification and examinations issued since the January 12, 2016 Board meeting were reviewed.

Ms. Hyde arrived for the meeting.

Applications of those applying for Professional Engineer licensure by comity, as provided by Section 34-11-4(1)(b) of the Licensure Law, were considered.

Applications of those applying for Professional Engineer licensure by examination, as provided by Section 34-11-4(1)a. and b. of the Licensure Law having previously passed the FE Examination in Alabama or in another jurisdiction, were considered.

Applications of those applying for Engineer Intern certification, as provided by Section 34-11-4(2) of the Licensure Law, were considered.

Applications of those applying for Land Surveyor licensure by examination, as provided by Section 34-11-4(3)a., b., and c. of the Licensure Law, were considered. Applications of those applying for Professional Land Surveyor licensure by examination having previously passed the Fundamentals of Land Surveying Examination and the Principles and Practice of Land Surveying Examination in Alabama or in another jurisdiction were considered and were approved for the Alabama Land Surveying Standards, History, and Law Examination.

16-044. IT WAS MOVED by Mr. Christy and seconded by Mr. Willis that the Board ratify the approval of licenses issued since the January 12, 2016 Board Meeting and that the list of those issued be included in the minutes on Attachment #1. MOTION CARRIED UNANIMOUSLY.

16-045. IT WAS MOVED by Mr. Willis and seconded by Mr. Christy that the Board ratify the approval of Intern Certifications issued since the January 12, 2016 Board Meeting and that the list of those be included in the minutes on Attachment #2. MOTION CARRIED UNANIMOUSLY.

16-046. IT WAS MOVED by Mr. Willis and seconded by Mr. Johnson that the Board ratify the approval for examination those applicants approved since the January 12, 2016 meeting and listed as approved on Attachment #3. MOTION CARRIED UNANIMOUSLY.

16-04 7. IT WAS MOVED by Mr. Johnson and seconded by Mr. Willis that the Board ratify the conversion from pending status to inactive status those applicants listed on Attachment #4. MOTION CARRIERD UNANIMOUSLY.

16-048. IT WAS MOVED by Mr. Whorton and seconded by Mr. Grace that the Board approves Ronald Edward Jackson, Jr. for licensure by comity. MOTION CARRIED UNANIMOUSLY.

16-049. IT WAS MOVED by Mr. Whorton and seconded by Mr. Christy thatthe Board approves Daniel Heath Price for intern certification. MOTION CARRIED UNANIMOUSLY.

16-050. IT WAS MOVED by Mr. Christy and seconded by Mr. Johnson that the Board denies for licensure Michael Adam Conner and Rene Romeo Salinas for licensure. MOTION CARRIED UNANIMOUSLY.

16-051. IT WAS MOVED by Mr. Whorton and seconded by Ms. Hyde that the Board approve for examination those applicants listed as "approved" on Attachment #5 to sit for the professional licensing examinations. MOTION CARRIED UNANIMOUSLY.

16-052. IT WAS MOVED by Mr. Grace and seconded by Mr. Willis that the Board defer for examination those applicants listed as "deferred" on Attachment #5. MOTION CARRIED UNANIMOUSLY.

16-053. IT WAS MOVED by Mr. Grace and seconded by Ms. Hyde that the Board deny for examination those applicants listed as "denied" on Attachment #5. MOTION CARRIED UNANIMOUSLY.

LAW ENFORCEMENT - Ms. M. Elisabeth Hyde, Advisor

The Board reviewed the status of the files pending with the Board, the Investigator, and/or the Investigative Committee. The Board was briefed on the 2015-2016 statistics.

The Board reviewed pending cases that the investigative committees have completed to accept, modify, or reject the suggested courses of action. Cases that are being recommended for closure or where they are recommendations from the investigative committee are discussed in a sanitized format so that in the event the Board suggests another course of action that the due process of the investigation has not been compromised. Respondent's information is not divulged until after a proposed consent order is accepted and a final order is approved.

16-054. IT WAS MOVED by Mr. Willis and seconded by Mr. Johnson to accept the proposed consent order and issue the Final Order for Case 2015-39-C. It was determined that there was probable cause that ClearSpan Fabric Structures, an uncertificated firm was offering engineering services in Alabama. The accepted terms of the Consent Order are that ClearSpan Fabric Structures will pay a $1243 civil penalty made payable to the State General Fund and will pay the Board $257 for the cost of the investigation, that they will cease and desist the practice or the offer to practice engineering in Alabama until such time as they are issued a Certificate of Authorization for Engineering, and the Consent Order and Final Order will become a public record. The Board accepted the Consent Order and issued the Final Order. MOTION CARRIED 6-0 with Mr. Barter recused.

16-055. IT WAS MOVED by Mr. Willis and seconded by Mr. Grace to accept the proposed consent order and issue the Final Order for Case 2015-49-B. It was determined that there was probable cause that Richard P. Daniel, PE #26539 , had failed to meet the continuing professional development requirements for his 2015 licensure renewal. The

accepted terms of the Consent Order are that Richard P. Daniel will pay $255 to the Board for the cost of the investigation and will pay a $1 ,500 fine to the Board, his license to practice engineering is suspended for six months with the suspension being stayed, he must provide certificates showing completion of 15 professional development hours to the Board by May 1, 2016 with the understanding that these hours are in addition to those hours required for his 2016 renewal, and the Consent Order and Final Order will become a public record. The Board accepted the Consent Order and issued the Final Order. MOTION CARRIED 6-0 with Mr. Barter recused.

16-056. IT WAS MOVED by Mr. Johnson and seconded by Mr. Willis to close Case 2016-05-B with no formal action. MOTION CARRIED 6-0 with Ms. Hyde recused.

16-057. IT WAS MOVED by Mr. Willis and seconded by Mr. Grace to close Case 2015-26-B with no formal action. MOTION CARRIED 6-0 with Mr. Johnson recused.

CERTIFICATES OF AUTHORIZATION -Mr. Marc S. Barter, Advisor

The Board previously authorized the Executive Director to issue certificates of authorization to applying firms if the application is in order and all requirements have been met. A list of the certificate of authorizations issued since the January 2016 Board Meeting were reviewed.

16-058. IT WAS MOVED by Mr. Willis and seconded by Mr. Johnson that the Board ratify the approval of the Engineering and Land Surveying Certificates of Authorization issued since the January 2016 Board Meeting and that the list of those issued be included in the minutes on Attachment #6. MOTION CARRIED UNANIMOUSLY.

CORRESPONDENCE

The agenda item that involved Mr. Robert Stemenberg was taken out of order from the approved agenda since Mr. Stemenberg was present and wished to discuss his request to the Board. Mr. Stemenberg requested the Board to reconsider their recent decision where they determined they were not going to issue an opinion Mr. Stemenberg' s previously denied professional engineering licensure application. Mr. Stemenberg explained that he was not requesting a specific ruling on his application but was requesting the Board to issue guidance on what was construction engineering and suggestions as to how to get experience verifications from professional engineers since there were so few in that particular industry. It was pointed out that previous Boards have approved a mentorship process whereby a licensed professional engineer not directly in the same firm as the applicant provides engineering mentorship. It was suggested that a construction engineering discipline guideline for mentorship be developed for possible adoption by the Board.

Legislation that had been filed in the 2016 General Session was briefed.

CHAIR'S REPORT

The Board was briefed on the efforts to reformat the annual report from statistical information to look like a corporate report. Drafts of the reports will be distributed to the board members for their comments.

EXECUTIVE DIRECTOR'S REPORT

The Executive Director briefed the Board on the request received from the Speaker of the House in regards to the appointment to the Alabama Onsite Wastewater Board. Speaker Hubbard requested the Board to reconsider their nominees and to submit a new list of candidates for his consideration. The Board discussed the request and it was pointed out that a fair process had been used in selecting the first names.

16-059. IT WAS MOVED by Mr. Johnson and seconded by Mr. Willis to reconsider the original submission. MOTION CARRIED 6-1 with Mr. Barter voting in the negative.

16-060. IT WAS MOVED by Mr. Johnson and seconded by Mr. Willis to remove Mr. Darren Hamrick' s name from the list and put Mr. Ryland's name of the list with the other two names remaining from the previous list. MOTION CARRIED 6-1 with Mr. Barter voting in the negative.

UNFINISHED BUSINESS

Mr. Christy briefed on the efforts to develop a method to deliver the state specific portion of the land surveying licensure examinations. The first objective is to get an option finalized for Alabama's exam and then see how to develop options for use by Mississippi and Florida. It was noted that the surveying task force ' s priority was to resolve the exam issue but they needed to resume work on the rest of the task force's objectives including if a resolution to the QBS issued could be developed.

OPEN FORUM

No additional comments made during the open forum.

Prior to adjourning the meeting the Board reviewed the proposed law changes taking into consideration comments that had been received following the townhall meetings and webinar. Once the changes are finalized efforts will begin to get a bill introduced in the legislature.

CLOSING REMARKS

The next meeting of the Board for board business is scheduled for Wednesday, March 30, 2016 at the board office in Montgomery beginning at 8:00 A.M. The meeting adjourned at 5:10 P.M.
