Decision

The Council approved the above Minutes of Meetings as correct records.

SC115 WRITTEN QUESTIONS

The Provost confirmed that three written questions had been received in terms ofStanding Order No. 27. The answers provided by the Chairs are contained inAppendix 1.

SC116 QUESTION TIME

In terms of Standing Order No. 28, Members had the opportunity to put questions toChairs of Committees on relevant and competent matters contained in the Volume ofMinutes of Committees circulated with the agenda for the meeting. On this occasionno questions were asked.

SC117 REVIEW OF POLITICAL MANAGEMENT ARRANGEMENTS

At the Special Meeting of the Council held on 17 August 2000 the Council agreed tocontinue consideration of a report by the Director of Civic Services which posedsome key questions which the Council might wish to consider in reaching a decisionon what changes it would wish to propose in respect of its political managementarrangements in the light of the McIntosh Report and the work of the LeadershipAdvisory Panel which had been established by the Scottish Executive to take forwardsome of the McIntosh recommendations.

It was further agreed to convene a Members’ Seminar (which had subsequentlytaken place on 27 September 2000) to consider the extent to which currentarrangements met the requirements of the McIntosh Report and the criteria set bythe Scottish Executive/Leadership Advisory Panel for the conduct of Council reviews.The Chief Executive confirmed that the Leadership Advisory Panel would visit theCouncil on 20 October to discuss the progress being made by the Council on itsreview, the outcome of which would require to be submitted to the Panel by the endof December. A report by the Chief Executive and the Director of Civic Servicessummarised the main points discussed at the Seminar. It was proposed that theAppendix to the report should form the basis to the Council’s submission to theLeadership Advisory Panel. The Appendix summarised the process of review whichthe Council had undertaken and proposed:

• that the Council should not adopt a cabinet/executive model of decisionmaking but should continue to evolve its thematic Policy Committeestructures in response to changing circumstances.

• a variety of improvements to the way in which Policy Committees deal withbusiness.

• that the Policy Executive should meet fortnightly to co-ordinate policydevelopment, facilitate community planning and expedite items of businessmanagement of the Council and that, to ensure openness and transparency,the Policy Executive should be subject to scrutiny by the Council.

• more detailed proposals to clarify and build on existing good examples ofscrutiny already undertaken by the Council should be brought forward andthat a Member/Officer Group should be established to prepare more detailedproposals.

• a job profile for Councillors should be developed and training and supportneeds of Councillors should be reviewed.

Decision

The Council agreed: -

1. to adopt the suggested changes detailed in the Appendix to the report subjectas undernoted and that the Appendix (as amended) should form the basis ofthe Council’s submission to the Leadership Advisory Panel:-

13(i) Amend to read “Committee reports should be limited to no more thanfour pages where possible. Appendices should be posted on theIntranet and copies to be placed in the Members Lounge”;

13(ii) All introductions if required to reports to be limited to three minuteswhere possible, the same as afforded to Elected Members in debate;

13(iii) No change.

13(iv) Members should be allowed ask about items in the InformationBulletin through the Written Questions section of committee andCouncil meetings;

13(v) Committees should not necessarily always meet in the CouncilChambers. The Administration should consider further howcommittee meetings could from time to time take place elsewhere;

13(vi) The Administration should further consider how items on agendascould be identified as not subject to a party whip. Recognition thatparty policy, particularly reflected in manifestos could not be subject tothis consideration.

2. to establish a Scrutiny Member/Officer Group comprising 3 Labour,2 Conservative and 1 SNP and to appoint the following Members to theGroup:-

Councillors Kelly, McChord, Thomson, Greenhill, Scott and Love,

and that it be remitted to the Chief Executive to determine Officerrepresentation on the Group.

3. that the Member/Officer Group should submit its final report to Council on7 December 2000.

4. that it be remitted to the Director of Civic Services to bring forward a reportdetailing how any changes which the Council decides upon should beimplemented including any necessary amendments to the Council’s StandingOrders and Scheme of Delegation.

SC118 LOCH LOMOND & TROSSACHS INTERIM COMMITTEE

The Loch Lomond & Trossachs Interim Committee (LL&TIC) was a joint Committeeformed with Argyll and Bute and West Dunbartonshire Councils of which one thirdwere non-elected members. The Association of Community Councils nominatedthree of these non-elected members.

Previously, at the Adjourned Statutory Meeting on 27 May 1999, Stirling Council hadagreed to accept the nominations of the Association of Community Councils andappoint Frank Bracewell, representing the Stirling Council area, Murdoch Cameron,representing the West Dunbartonshire Council area and Joan MacLean Davidson,representing the Argyll and Bute Council area.

Following recent elections, the Association had requested that Mrs C Bannerman beappointed as the Association’s Stirling Council area representative on the InterimCommittee, with Dr Jeffrey Scott of Gartocharn as the West Dunbartonshire Councilarea representative and Mrs Joan MacLean Davidson, remaining as the Argyll andBute Council area representative.

Having considered the Association’s request at its meeting on 7 September, 2000,the Envirnomental Quality Committee had agreed to recommend to Council theappointment of the Association’s nominees.

Decision

The Council agreed: -

1. to appoint Mrs C Bannermann and Dr J Scott to the Loch Lomond & TrossachsInterim Committee in place of Mr Frank Bracewell and Mr M Cameron;

2. to note that Mrs J MacLean Davidson remained the Association’s representativeof the Argyll and Bute Council area.

SC119 CHILDREN’S COMMITTEE – APPOINTMENT OF CO-OPTEES

The membership of the Children’s Committee included provision for the appointmentof four non-voting co-optees, comprising one staff, one parent, and two studentrepresentatives. As both of the student representatives had recently left school, aballot of all secondary school pupils had taken place and Mark McMillan and FionaMcPherson had been duly selected for appointment to the Children’s Committee.

“That the Council appoint Mark McMillan and Fiona McPherson as the StudentRepresentatives on the Children’s Committee.”

Moved by Councillor Ann Strang, seconded by Councillor Tom Hazel.

Amendment

“The Council welcomes Mark McMillan and Fiona McPherson as student advisers toall meetings of the Children’s Committee, but not as members of the committee, asthat would contravene the Local Government (Scotland) Act 1973, which prevents aLocal Authority from appointing to its committee anyone who is ineligible to stand forelection so that the Authority either by reason of age, ie anyone under 21, or byreason of employment, ie anyone employed by the Authority.”

Moved by Councillor Helen Scott, seconded by Councillor Ann Dickson.

SC120 APPOINTMENTS TO PRISON VISITING COMMITTEES AND FUTUREARRANGEMENTS

The Prison and Young Offenders Institutions (Scotland) Amendments Rules 1996which came into force in February 1996 placed a statutory requirement on theCouncil to appoint four members to Glenochil Over 21’s Prison Visiting Committee.

A report by the Director of Civic Services confirmed the death of one of the Council’sappointees on the Glenochil Prison Over 21’s Prison Visiting Committee and theresignation of another. The Council was required to determine how it wished to fillthese vacancies given that at its meeting on 29 June, 2000 the Council had agreedthat a recruitment and selection process should take place to augment the ‘pool’ ofsuitable candidates from which appointments might be made.

The Council was also requested to establish a Prison Visiting Appointments Panel toundertake interviews of those expressing an interest in being considered as amember of either the Glenochil or Cornton Vale Prison Visiting Committee followingthe planned recruitment campaign.

Decision

The Council agreed: -

1. to defer appointments to the Glenochil Prison Over 21’s Prison VisitingCommittee until the proposed recruitment process had taken place;

2. to establish a Prison Visiting Committee Panel comprising the Chair of theAppointments Panel, the Chair of the Care Committee, a Member of theOpposition and the Chair of the relevant Prison Visiting Committee;

3. to appoint Councillors Tom Coll, Pat Kelly and Ann Dickson to the Panel andconfirm that in the event of the Chair of the relevant Prison Visiting Committeebeing unable to attend meetings of the Panel, the Depute Chair couldsubstitute on the same basis as the Council’s substitution arrangements.

SC121 BETTER GOVERNMENT FOR OLDER PEOPLE: AN OLDER PEOPLE’SSTRATEGY FOR STIRLING

Better Government for Older People (BGOP) was a Cabinet Office initiative launchedin June 1998 which aimed to encourage initiatives which would improve publicservices for older people by meeting their needs, listening to their views andencouraging and recognising their contribution. Stirling Council was one of threeScottish BGOP pilot projects, the others being South Lanarkshire and ScottishBorders Councils. The national BGOP programme and the 28 UK wide pilot projectshad been evaluated over the two-year pilot period, which ended in June 2000.Stirling’s BGOP initiative was a partnership led by the Council, Forth Valley HealthBoard, Forth Valley Benefits Agency, Age Concern Scotland and local people’srepresentatives.

The Head of Policy provided an up-date on the progress and key achievements ofStirling’s BGOP initiative; during which reference was made to the objectives of theStirling pilot; the three projects which had been run as part of the pilot; andhighlighted the joint working which had taken place nationally and in particular withthe other Scottish pilots to lobby the Scottish Executive on taking forward the lessonsof BGOP and resourcing future developments. Ms Cathy Traynor, StirlingPartnership for Regeneration/Older Person’s Representative BGOP then gave herperspectives on the initiative and the role which she and other older people’srepresentatives had taken in national BGOP events and forums leading to her

subsequent appointment as Vice-Chair of the Active Ageing Sub-Group of thenational BGOP Older People’s Advisory Group.

Following the end of the pilot, an ‘Older People’s Draft Strategy’ had been developedto extend the BGOP approach to a wider range of services and agencies, and sharethe lessons learned about involving older people, working in partnership anddeveloping community based services. It was proposed that the draft be issued forconsultation during November.

Decision

The Council agreed: -

1. to note the achievements of Stirling’s partnership-based Better Government forOlder People pilot;

2. to note the progress which has been made, together with the other ScottishBGOP pilots in South Lanarkshire and Scottish Borders, on developing links withthe Scottish Executive and Westminster Government;

3. to approve the draft Older People’s Strategy for Stirling and agreed that the draftbe issued for consultation and referred to the Stirling Assembly Steering Groupfor comment.

SC122 STATUTORY MOTIONS

(a) The Stirling Council (Off-Street Parking Places) (Regulation of Use)(Amendment) Order 2000.

A report by the Director of Technical Services requested that the Councilconsider the objections lodged in respect of the above Order and determinewhether to make the Order, make the Order with amendments, uphold theobjections or request that a Public Hearing be convened.

Motion

“That the Council agree to make ‘The Stirling Council (Off-Street ParkingPlaces) (Regulation of Use) (Amendment) Order 2000’ which formallyproposed the introduction of parking charges in Linden Avenue car park.”

Moved by Councillor Gillie Thomson, seconded by Councillor Colin O’Brien

Amendment

“That the Council defers making ‘The Stirling Council (Off-Street ParkingPlaces) (Regulation of Use) (Amendment) Order 2000’ until an assessment ofthe impact on Viewforth and the wider area was prepared. This assessmenttogether with any proposals for control of parking at Viewforth and theintroduction of charges for the surrounding streets should be presented to therelevant committee for discussion prior to decision.”

Decision

The Motion was carried by 11 votes to 10 votes with one Member not votingand accordingly the Council agreed to make ‘The Stirling Council (Off-StreetParking Places) (Regulation of Use) (Amendment) Order 2000’ which formallyproposed the introduction of parking charges in Linden Avenue car park.

SUMMARY SCHEDULE

The Order proposed the introduction of charges for parking in the LindenAvenue Car Park, Stirling. The proposed charges were 80 pence, 90 penceand £1.00 for waiting up to 2 hours, 4 hours and more than 4 hoursrespectively between the hours of 8.45 am and 5.30 pm, Monday to Saturdayinclusive. Only private cars, light goods vehicles less than 1.5 tonnesmaximum laden weight, motorcycles and bicycles would be allowed to park inthe car park. The proposed charges only applied to private cars and theaforementioned light goods vehicles.

(b) The Stirling Council (Stirling Town Centre) (Controlled Parking Zone) Order2000

A report by the Director of Technical Services requested that the Councilconsider the objections lodged in respect of the above Order and determinewhether to make the Order, make the Order with amendments, uphold theobjections or request that a Public Hearing be convened.

Decision

The Council agreed to make “The Stirling Council (Stirling Town Centre)(Controlled Parking Zone) Order 2000” as it stood.

SUMMARY SCHEDULE

The Order retained many of the existing restrictions and included various newrestrictions on the waiting of vehicles on the roads in the Town Centre andadjacent roads in Stirling. The roads affected were within an area ofSnowdon Place in the south to the Cowane Street/Goosecroft Road junctionin the north and from King’s Park Road/Victoria Place junction and UpperCastlehill in the west to Burghmuir Road in the east.

The Order also included proposals that waiting be limited only to goodsvehicles delivering on the north-west side of Port Street and parts of UpperCraigs and Viewfield Street. A new taxi rank was proposed for DumbartonRoad and motorcyle parking for Dumbarton Road and Barnton Street.

The existing on-street parking areas and charges would generally remain asat present apart from:-

(1) Upper Craigs, Cameronian Street, Baker Street and King’s Park Road– Maximum waiting of 20 minutes at a charge of 80 pence.

(2) Barnton Street, Corn Exchange Road and the Goosecroft Roadparking area in front of Durham Pine – Maximum waiting of60 minutes at a charge of 80 pence and 20 minutes at 40 pence.

(3) Princes Street, Viewfield Place and King’s Park Road – Maximumwaiting of 2 hours at a charge of £1.00.

(4) Albert Place, Glebe Avenue, Glebe Crescent, Melville Terrace(southern part of northern section) and Windsor Place – Maximumwaiting of 4 hours at a charge of £1.30 and £1.00 for 2 hours.

(5) Irvine Place and Queen Street – A charge of £1.00 for waiting up to4 hours and £1.50 for more than 4 hours.

All the parking charges applied between the hours of 8.45 am and 5.30 pm,Monday to Saturday inclusive. Only passenger vehicles and light goodsvehicles less than 7.5 tonnes, invalid carriages and motorcycles would bepermitted to use the parking spaces.

Councillor D Thomson, Chair of the Environmental Quality Committee moved thefollowing Motions: -

(c) The Stirling Council (Stirling Town Centre) (One-Way Traffic And TrafficManagement) (Consolidation And Amendment) Order 2000

“The Stirling Council resolved to make an Order under the powers conferredupon them by Sections 1(1) and (2), 2(1) and (2) and 4(1) and Part IV ofSchedule 9 of the Road Traffic Regulation Act 1984 (as amended) and of allother powers enabling them in that behalf to be known as “The StirlingCouncil (Stirling Town Centre) (One-Way Traffic and Traffic Management)(Consolidation and Amendment) Order 2000” the effect of which would be toconsolidate all the existing one-way systems and turning prohibitions in theTown Centre of Stirling and introduce a new one-way system on the southernpart of Viewfield Street.”

SUMMARY SCHEDULE

This Order retains and consolidates into the one Order all the existing left andright hand turn prohibitions from Friars Street, Upper Craigs (Lower Section),Wellgreen Road, Dumbarton Road and Goosecroft Road at all the relevantlocations.

The Order also retains and consolidates all the existing one-way systems inBaker Street, Bank Street, Bow Street, Irvine Place, King Street (Part – fromFriars Street to the Athenaeum), Mar Place, St John Street, Spittal Street andViewfield Street (Part).

The Order also proposed a new one-way system on the southern part ofViewfield Street from Maxwell Place towards the Sheriff Court, which was themain reason for promoting the Order.

(d) The Stirling Council (Queen’s Lane, Bridge Of Allan) (Temporary Closure)Order 2000

Answer

“The site has been monitored and investigated in 1995 and 1998 when the uses atthat time were not considered sufficiently intensive to warrant enforcement action.The use at that time related to the storage and maintenance of building/constructionplant. The site will be re-inspected and any uses monitored. Any unauthoriseddevelopment will be dealt with in line with the Council’s adopted enforcementcharter.

The scope for action to address the derelict nature of the site is limited and to acertain extent the natural regeneration of woodland is helping to screen the site. Themost readily identifiable route to changing the character of the site is to allow someform of redevelopment, however the redevelopment costs of this site are likely to behigh and the current development plan mitigates against any potentially economicredevelopment as the site lies in Countryside. The development potential (housing)of this site was considered at the Stirling Local Plan Inquiry (page 30-5 to 30-11),where the Reporter concluded that the site was not suitable for development. Thesite will be considered again in the forthcoming Alteration to the Local Plan followingthe Scottish Ministers’ consideration of the new Structure Plan.”

“Following on from my question at the Environmental Quality Committee of11th November 1999, subsequent discussions, and the well-attended publicmeeting held under the auspices of Bridge of Allan Community Council, canwe have a statement on

a) what solutions have been identified to the problem of HGV Class 1lorries passing through Bridge of Allan;

b) the present load-bearing rating of the A9 bridge at Bridge of Allan;c) the rating to which it is intended to upgrade it.”

Answer

“a) The ultimate solution would be to divert through route HGV traffic away from

the A9 between Manor Powis Roundabout and Keir Roundabout. This wouldinvolve a diversionary route involving the A91 and the M9. Technical Servicesas Roads Authority do not however consider that the use of A9 by HGV trafficthrough Bridge of Allan is inconsistent with the route’s primary function. IfBridge of Allan was not to carry HGV through traffic then other routes or othersettlements within the area would have to be reconsidered as HGV throughroutes. In the overall context of traffic management within the Stirling Areathis issue is not considered to have a high priority.

b) From a traffic point of view the carriageway of the bridge has been assessedas being capable of accommodating vehicles up to 40 tonnes and onoccasions would be fit to accept loads above that figure. The footwayhowever is only capable of carrying loads of 3 tonnes. Given the existing carparking/traffic calming measures which are on the bridge, it is not envisagedthat this footway restriction creates a problem.

c) There are currently no plans to upgrade the load carrying capacity of thisbridge. Technical Services are currently preparing a list of priority structuresfor strengthening which have been identified through the Bridge AssessmentProgramme.”

“In view of the SQA fiasco which has led to much distress to many of thepupils in our secondary schools, will Stirling Council consider withholdingpayment to the Examination Board?”

Answer

“Fees for examinations are set and policy determined in a particular timetable. Allefforts at present should be in restoring credibility to the examination system and notcausing further aggravation. Withholding payment would serve no purpose andwould be detrimental to students interests by further undermining confidence in theachievements of students and schools. Restoring confidence has been necessarybecause of the appalling mismanagement of information which led to results whichwere incomplete, late or inaccurate. In the circumstances of lost credibility there hasbeen an increase in appeals, some of which are not valid. In addition in someinstances the data handling errors occurred at school level. The costs and theresourcing of SQA will have to be considered but to do so at present would be adistraction from efforts to identify root causes and to ensure there is no failure nextyear.

The top priority for all engaged in monitoring the performance of the SQA since themiddle of August has been to ensure a return to an effective and accuratetransmission of results. To this end SQA have devoted considerable time andresources.

There are a number of reservations about the capacity of the SQA as a non-governmental body to escape reasonable scrutiny and proper accountability. As aCouncil and through COSLA Stirling has regularly expressed misgivings about theoperation of such non-governmental bodies, particularly one such as SQA whichoperates a monopoly. In such matters the democratic voice of local governmentshould be united and consistent, making sure that educational policy and monitoringis a genuine partnership.

Stirling Council evidence to the parliamentary enquiry has already been circulated inthe bulletin. Stirling Council also contributed to the COSLA response and a copy isavailable in the member’s lounge.

“to ask the Scottish Executive, regarding action taken by schools and teachersthroughout Scotland to assist in resolving the difficulties experienced by the ScottishQualifications Agency in exam result notification, whether it will reimburse localauthorities for any additional monies spent as a consequence of these difficulties”.

Mr Galbraith’s answer was:

“we would consider any claims submitted by authorities”.

I have asked the Director of Children’s Services to investigate this issue and make asubmission to the Scottish Executive if one is warranted and additional expenditurecan be identified.”
