The Alabama Board of Licensure for Professional Engineers and Land Surveyors was established by legislative action in 1935. 18-001. IT WAS MOVED by Mr. Johnson and seconded by Mr. Grace to adopt the agenda as proposed. MOTION CARRIED 5-0.

Minutes of the seventh meeting of the 2016-2017 Board were received for approval.

18-002. IT WAS MOVED by Mr. Grace and seconded by Mr. Johnson that the minutes of the seventh meeting of the 2016-2017 Board held July 18, 2017 be approved. MOTION CARRIED 4-0. Ms. Adams-Morales recused herself from the vote since she was not present at the July 18, 2017 meeting.

Action items from previous meetings were reviewed. APPLICATIONS – Mr. Nathan G. Johnson, Advisor The Board previously authorized the Executive Director to approve applications for licensure, intern certification, and examinations if the application is in order and all requirements have been met. Applications of those applying for Professional Engineer licensure by comity since July 18, 2017, as provided by Section 34-11-4(1)(b) of the Licensure Law, were considered. Applications of those applying for Professional Engineer licensure by examination since July 18, 2017, as provided by Section 34-11-4(1)a and b, of the Licensure Law having previously passed the FE Examination in Alabama or in another jurisdiction, were considered. Applications of those applying for Engineer Intern certification since July 18, 2017, as provided by Section 34-11-4(2) of the Licensure Law, were considered. Applications of those applying for Professional Land Surveyor licensure since July 18, 2017, as provided by Section 34-11-4(3)a and b of the Licensure Law, were considered. Applications of those applying for Professional Land Surveyor licensure since the July 18, 2017, having previously passed the Fundamentals of Land Surveying Examination and the Principles and Practice of Land Surveying Examination in Alabama or in another jurisdiction were considered and were approved to take the Alabama Land Surveying Standards, History, and Law Examination.

18-003. IT WAS MOVED by Mr. Johnson and seconded by Mr. Grace that the Board ratify the approval of licenses issued since the July 18, 2017, Board Meeting and that the list of those issued be included in the minutes on Attachment #1. MOTION CARRIED 5-0.

18-004. IT WAS MOVED by Mr. Johnson and seconded by Ms. Adams-Morales that the Board

ratify the approval of Intern Certifications issued since the July 18, 2017, Board Meeting and that the list of those be included in the minutes on Attachment #2. MOTION CARRIED 5-0.

18-005. IT WAS MOVED by Mr. Johnson and seconded by Ms. Adams-Morales that the Board

ratify the approval for examination those applicants approved since the July 18, 2017, meeting and that the list of those be included in the minutes on Attachment #3. MOTION CARRIED 5-0.

18-006. IT WAS MOVED by Mr. Johnson and seconded by Mr. Christy that the Board approve for examination Susanne Whitney Kerr. MOTION CARRIED 5-0.

18-007. IT WAS MOVED by Mr. Johnson and seconded by Mr. Christy to deny for licensure

the application of Mr. Corbin Clay Hardy. MOTION CARRIED 3-2 with Mr. Johnson, Mr. Christy and Mr. Grace voting for the motion, and Mr. Barter and Ms. Adams-Morales voting against the motion.

The Board considered a request from Babak Shayan, (a previously deferred examination applicant) that it allow him to take a chemistry course offered by Straightliner, a Non-ABET accredited University. After review, the Board determined it would inform Mr. Shayan that the chemistry course must be completed through an ABET accredited university. The Board met with Mr. David Anderson, a previously denied exam applicant, and his PE supervisor Robert M. Kehrman, regarding the status of his application. Additional information was presented on his work experience and the Board advised Mr. Anderson to submit a new experience verification form completed by a different verifier for its consideration. The Board met with Mr. Ryan Pecora, a previously denied exam applicant, regarding the status of his application. No additional information was presented on his work experience, and the Board advised Mr. Pecora to submit a new experience verification form completed by a different verifier for its consideration.

18-008. IT WAS MOVED by Mr. Barter and seconded by Mr. Johnson that the Board go into Executive Session to discuss Mr. Pecora’s application. MOTION CARRIED 5-0 with Mr. Barter, Mr. Johnson. Mr. Grace, Mr. Christy and Ms. Adams-Morales voting for the motion.

Attorney Ben Albritton verified that due to the application confidentially requirements this was sufficient reason for the Board to go into Executive Session At 9:52 A.M. Mr. Christy announced that the Board would go into executive session for approximately 15 minutes. The Board came back into open session at 10:02 A.M. Mr. Tomas Nation of the Arthur J. Gallagher Insurance firm met with the Board and provided a proposal for additional insurance coverage related to anti-trust claims.

18-009. IT WAS MOVED by Mr. Barter and seconded by Ms. Adams-Morales that the Board purchase the three million-dollar policy offered by the Arthur J. Gallagher firm. MOTION CARRIED 5-0.

The Board recessed for lunch at 11:50 AM. and went back into session at 12:50 PM. LAW ENFORCEMENT – Ms. M. Elisabeth Hyde, Advisor The Board reviewed the status of the files pending with the Board, the Investigator, and/or the Investigative Committee. The Board was briefed on the 2016-2017 statistics.

The Board reviewed pending cases that the investigative committees had completed to accept, modify, or reject the suggested courses of action. The cases were discussed in a sanitized format so that in the event the Board suggests another course of action that the due process of the investigation has not been compromised. Respondent’s information is not divulged until after the proposed consent order is accepted and a final order was approved.

2016-20-C with a letter of caution. MOTION CARRIED 4-0 with Mr. Christy recused. 18-011. IT WAS MOVED by Mr. Johnson and seconded by Ms. Adams-Morales that the Board

close Case 2016-21-C with a letter of caution. MOTION CARRIED 4-0 with Mr. Christy recused.

18-012. IT WAS MOVED by Mr. Grace and seconded by Mr. Barter that the Board close Case

2017-13-C with a letter of caution. MOTION CARRIED 4-0 with Mr. Christy recused. 18-013. IT WAS MOVED by Mr. Barter and seconded by Mr. Johnson that the Board close Case

2017-24-C with no action. MOTION CARRIED 4-0 with Mr. Grace recused. 18-014. IT WAS MOVED by Mr. Grace and seconded by Mr. Barter that the Board close Case

2017-23-B with no action. MOTION CARRIED 4-0 with Mr. Johnson recused. 18-015. IT WAS MOVED by Mr. Johnson and seconded by Mr. Barter that the Board accept the

Consent Order and issue a Final Order in reference to Case 2017-25-B. MOTION CARRIED 4-0 with Mr. Christy recused.

CERTIFICATES OF AUTHORIZATION – Mr. Randall D. Whorton, Advisor The Board previously authorized the Executive Director to issue certificates of authorization to applying firms if the application is in order and all requirements have been met. A list of the certificate of authorizations issued since the July 18, 2017, Board Meeting were reviewed.

18-016. IT WAS MOVED by Mr. Johnson and seconded by Mr. Grace that the Board ratify the approval of the Engineering and Land Surveying Certificates of Authorization issued since the July 18, 2017, Board Meeting and that the list of those issued be included in the minutes on Attachment #4. MOTION CARRIED 5-0.

The Board discussed the Certificate of Authorization applications that had exceptions.

18-017. IT WAS MOVED by Mr. Johnson and seconded by Mr. Grace to approve the application

for Damar Solutions LLC, and NTS Engineering & Manufacturing Inc. MOTION CARRIED 5-0.

FINANCE – Mr. Richard Grace, Advisor The FY2017 financial report and the monthly financial reports for July and August 2017 were briefed. It was noted that the Board would have a surplus over the allowable fiscal year carryover funds and that amount would be submitted to the General Fund.

PERSONNEL – Mr. Marc Barter, Advisor The Board was introduced to its newest employee, Mr. Darrick Bradford, ASA II, and briefed on the process of hiring a second special investigator. LEGISLATIVE – Mr. Randall Whorton, Advisor The Board determined it would postpone the discussion on the proposed law change until its November 14, 2017 meeting. EXECUTIVE DIRECTOR’S REPORT The Board was provided the following office updates: The Architect’s Board has moved into Suite 390 and is renting the space for a one year period, Special Investigator Bob Herbert received the Council on Licensure, Enforcement and Regulation (CLEAR) Investigative Excellence Award at the Conference in Denver on September 15th, the first Board sponsored content article is now on AL.com, changes to in-state travel, and a representative from State Risk Management will meet with Board at its November meeting. The Board reviewed possible meeting dates for FY2017-2018, and determined the following dates should be posted on the Secretary of State’s Open Meetings website: January 30th, March 27th, May 22nd, July 31st, September 18th and November 14th. The Board was informed that no public comments were received regarding the proposed new language to be placed in its Administrative Code that would award new licensees 30 professional development hours (PDH) to be used for their first license renewal.

18-018. IT WAS MOVED by Mr. Barter and seconded by Mr. Grace that a proposed rule change be adopted and the adoption documentation be submitted to the Legislative Reference Service (LRS) for review. MOTION CARRIED 5-0.

The Board reviewed the term periods of its members and elected officers for the 2017-2018 fiscal year.

18-019. IT WAS MOVED by Mr. Christy and seconded by Mr. Johnson that Ms. Hyde be elected to serve as Chair, Mr. Johnson be elected to serve as Vice Chair, and Mr. Whorton be elected to serve as Secretary. MOTION CARRIED 5-0.

Mr. Johnson, the new Vice Chair, assumed the duties of the Chair after the vote. CORRESPONDENCE At its July 18, 2017 meeting the Board voted to submit a request to the Legislative Reference Service (LRS) requesting an opinion as to if Act # 2017-384 is sufficient to afford the Board immunity from anti-trust claims. The Board discussed a letter received from Senator Clyde Chambliss in which he asked the Board not to move forward with the LRS rule request until he had time to meet with all parties and reach an agreeable solution. The Board agreed to the request of Senator Chambliss. The Board reviewed a request from the American Council of Engineering Companies of Alabama (ACEC) which asked the Board to withdraw its vote to submit a request to the Legislative Reference

Service to review the Qualification Based Selection (QBS) rule currently in its Administrative Code. The Board determined that it would postpone any action until Senator Chambliss was able to meet with all parties. Ms. Renee Casillas, the Executive Director of ACEC, briefly discussed the organization’s position on certain items (public members, etc.) in the Board’s proposed law change to be submitted in the 2018 legislative session. The Board discussed a letter from Mr. Michael Henry in reference to the preparation and certification of SPCC Plans by persons other than professional engineers. After its discussion, the Board determined it would inform Mr. Henry that smaller tanks and facilities may not require the involvement of a professional engineer, while more complex larger tanks and facilities would require the services of a professional engineer. Due to the many variables associated with SPCC plans each tank or facility must be evaluated on a case by case basis and if questions arise, a professional engineer should be consulted. The Board discussed a request submitted by Mr. Sam Wainwright, Professional Engineer and Professional Land Surveyor that it consider exempting licensees over the age of 60 from the professional development hours (PDH) requirement. The Board determined it would inform Mr. Wainwright that it would not create this PDH exemption. Board Member Randall Whorton had submitted documents relating to Board Composition for the Board to discuss, and since he was not able to attend the meeting the discussion on those items was postponed to the November 14, 2017 meeting.

Mr. Dan Denton, Chapter Relations Manager for RETA (Refrigerating Engineers and Technicians Association) submitted a letter to the Board requesting that the association be permitted to retain the term “Engineers” in its name. After discussion, the Board determined that the name of the Association did not tend to convey the impression that the Association was offering engineering services and therefore the Association could retain the term “Engineers” in its name.

Mr. David Fannon submitted a request that the Board consider placing an article in its newsletter that indicates his previous guilty finding by the Board was overturned by a circuit court.

18-020. IT WAS MOVED by Mr. Barter that an article be placed in the Board’s Newsletter regarding Mr. Fannon’s request. The motion failed due to the lack of a second.

The Board reviewed a request from NCEES to update its Members, Staff and Emeritus Members. After review and discussion, the Board determined it would not submit the names of former Board Members to NCEES as Emeritus Board Members if they no longer held an active license or resided in the State of Alabama. The Board reviewed a request from the State of Alabama Engineering Hall of Fame that asked the Board to provide a donation to the organization. The Board directed that a letter be sent to the organization advising it that the Board did not by law have the authority to give donations. The Board reviewed a request from the Alabama Onsite Wastewater Board that informed the Board that the Professional Engineer serving in the position that required the Board to submit names to the Speaker of the House of Representatives for his consideration had resigned. The Board directed staff to send an email to all licensed professional engineers residing in the State of Alabama requesting interested
