It was determined that a quorum was present, and the meeting was opened with the Pledge of Allegiance and a prayer. The proposed meeting agenda was reviewed.

18-021. IT WAS MOVED by Mr. Christy and seconded by Mr. Johnson to adopt the agenda as

proposed. MOTION CARRIED 5-0. Minutes of the first meeting of the 2017-2018 Board held on October 6, 2017, were received for approval. Ms. Adams-Morales noted two items that required correction.

18-022. IT WAS MOVED by Mr. Christy and seconded by Mr. Johnson that the minutes of

the first meeting of the 2017-2018 Board held October 6, 2017 be approved as corrected. MOTION CARRIED 5-0.

Action items from previous meetings were reviewed. The Board discussed the action item regarding Certificates of Authorization and directed staff to conduct a survey of licensees to determine the number of licensees that did not use a fictitious firm name and therefore were not required to obtain a certificate of authorization. The survey was to ask two questions: (1) Do you practice under your own name, and (2) Do you have more than one office? At 8:15 AM Board Member Randall D. Whorton arrived and began participating in the meeting. At 8:30 AM Chair Hyde stated that the hearing in the matter of Stephen P. Maslan, professional engineer scheduled to begin at 8:30 would be presided over by Administrative Law Judge Dana Billingsley, and that Judge Billingsley would now conduct the hearing. At the start of the hearing Judge Billingsley noted that Stephen P. Maslan, professional engineer was not present, and the hearing would proceed in accordance with the Administrative Procedures Act. During the hearing, Board Counsel Ben Albritton questioned witnesses and entered documents into evidence. The hearing ended at 9:30 AM, and the Board requested that Judge Billingsley prepare the Findings of Fact, Conclusions of Law, and Recommendations for the Board to consider. Board Member Richard Grace arrived at 9:30 AM and begin to participate in the meeting after the hearing was concluded. APPLICATIONS – Mr. Nathan G. Johnson, Advisor The Board previously authorized the Executive Director to approve applications for licensure, intern certification, and examinations if the application is in order and all requirements have been met. Applications of those applying for Professional Engineer licensure by comity since October 6, 2017, as provided by Section 34-11-4(1)(b) of the Licensure Law, were considered. Applications of those applying for Professional Engineer licensure by examination since October 6, 2017, as provided by Section 34-11-4(1)a and b, of the Licensure Law having previously passed the FE Examination in Alabama or in another jurisdiction, were considered. Applications of those applying for Engineer Intern certification since October 6, 2017, as provided by Section 34-11-4(2) of the Licensure Law, were considered. Applications of those applying for Professional Land Surveyor licensure since October 6, 2017, as provided by Section 34-11-4(3)a and b of the Licensure Law, were considered. Applications of those applying for Professional Land Surveyor licensure since the October 6, 2017, having previously passed the Fundamentals of Land Surveying Examination and the Principles and Practice of Land Surveying Examination in Alabama or in another jurisdiction were considered and were approved to take the Alabama Land Surveying Standards, History, and Law Examination.

The Board discussed the additional information provided by Mr. Michael D. Anderson regarding his previously denied exam application. After this discussion, the Board determined to approve Mr. Anderson to take the professional engineer examination and to include is name in the list of approved applicants. The Board discussed the professional engineer comity licensure application submitted by Mr. Matthew Lovelace Carter. After this review and discussion, the Board determined to approve Mr. Carter for professional engineer licensure. The Board discussed the professional engineer comity licensure application submitted by Mr. Jason Dantlzer Wimberly. After this review and discussion, the Board determined to approve Mr. Wimberly for professional engineer licensure and to include his name on the Attachment # list. The Board discussed the professional engineer exam application of Mr. Jason Dale Box, and determined that he needed an additional thirty-eights months of engineering experience to qualify to take the examination. The Board discussed the professional engineer exam application of Mr. Joel Brandon Horton, and determined to approve Mr. Horton and include his name on the Attachment #3 list. The Board discussed the professional engineer comity licensure applications of Mr. O. David Preston and Mr. Carl Angeloff and determined that these applicants had provided false information on their licensure application. The Board determined that it would deny the applications of Mr. Preston and Mr. Angeloff.

18-023. IT WAS MOVED by Mr. Christy and seconded by Mr. Johnson that the Board ratify the approval of licenses issued since the October 6, 2017, Board Meeting and that the list of those issued be included in the minutes on Attachment #1. MOTION CARRIED 7-0.

18-024. IT WAS MOVED by Mr. Christy and seconded by Mr. Johnson that the Board ratify

the approval of Intern Certifications issued since the October 6, 2017, Board Meeting and that the list of those be included in the minutes on Attachment #2. MOTION CARRIED 7-0.

18-025. IT WAS MOVED by Mr. Christy and seconded by Mr. Johnson that the Board ratify

the approval for examination those applicants approved since the October 6, 2017, meeting and that the list of those be included in the minutes on Attachment #3. MOTION CARRIED 7-0.

18-026. IT WAS MOVED by Mr. Christy and seconded by Mr. Johnson that the Board defer

for licensure Leland Randell Chapman, Ryan Spencer Wright, Darron Wayne Derrick. MOTION CARRIED 7-0.

18-027. IT WAS MOVED by Mr. Christy and seconded by Mr. Johnson to deny for licensure

O. David Preston, and Carl Angeloff. MOTION CARRIED 7-0. 18-028. IT WAS MOVED by Mr. Christy and seconded by Mr. Johnson to deny for

examination the application of Jason Dale Box. MOTION CARRIED 7-0.

18-029. IT WAS MOVED by Mr. Christy and seconded by Mr. Johnson to include the list of

Inactive Applications in the minutes on Attachment #5. MOTION CARRIED 7-0.

The Board discussed a letter received from Mr. Robert Sternenberg and engineering experience gained in the construction industry. The Board determined that in order for construction experience to qualify as engineering experience non-exempt firms must hold a certificate of authorization and employ an Alabama licensed professional engineer. If a firm meets the exempt clause of the Code of Alabama a certificate of authorization is not required, however the engineering experience must still be verified by a licensed professional engineer or a substantially equivalent individual. The Board instructed staff to inform Robert Sternenberg that in order for engineering experience to be acceptable for licensure non-exempt employing firms must have a certificate of authorization for engineering issued by the Board. The Board reviewed a request from Mr. Antonios Tsoumas to determine if the Bachelors in Geo-Information Technology and Land Survey degree he received from the Technological Educational Institute of Central Macedonia met the requirements for certification as a Land Surveyor Intern. After its review and discussion, the Board determined the degree held by Mr. Tsoumas qualified him for certification as a Land Surveyor Intern.

18-030. IT WAS MOVED by Mr. Johnson and seconded by Mr. Christy to accept the Bachelors in Geo-Information Technology and Land Survey degree of Mr. Antonios Tsoumas for Land Surveyor Intern Certification. MOTION CARRIED 7-0.

LAW ENFORCEMENT – Ms. M. Elisabeth Hyde, Advisor The Board reviewed the status of the files pending with the Board, the Investigator, and/or the Investigative Committee. The Board was briefed on the 2016-2017 statistics. The Board reviewed pending cases that the investigative committees had completed to accept, modify, or reject the suggested courses of action. The cases were discussed in a sanitized format so that in the event the Board suggests another course of action that the due process of the investigation has not been compromised. Respondent’s information is not divulged until after the proposed consent order is accepted and a final order was approved.

18-031. IT WAS MOVED by Mr. Johnson and seconded by Mr. Barter that the Board accept

the Consent Order and issue a Final Order in reference to Case 2017-18-B. MOTION CARRIED 6-0 with Mr. Christy recused.

CERTIFICATES OF AUTHORIZATION – Mr. Randall D. Whorton, Advisor The Board previously authorized the Executive Director to issue certificates of authorization to applying firms if the application is in order and all requirements have been met. A list of the certificate of authorizations issued since the October 6, 2017, Board Meeting were reviewed.

COMMUNICATIONS AND PUBLICATIONS - Mr. Marc S. Barter, Advisor The Board was briefed on current Outreach activities. These activities included the AL.com Article, and presentations at the North Alabama Fire Marshall's Conference in September, at the Alabama Society for Professional Land Surveyors in October, and the Alabama Fire Marshall's Association and Troy University Geomatics Program in November. The Board also discussed the Outreach items purchased in 2017 and the monetary amount it would be willing to designate for Outreach in 2018.

18-033. IT WAS MOVED by Mr. Barter and seconded by Ms. Adams-Morales that the Board allow staff to spend $8,000 in 2018 for Outreach Activities. MOTION CARRIED 7-0.

The Board recessed for lunch at 11:42 AM. and went back into session at 12:35 PM. FINANCE – Mr. Richard Grace, Advisor The FY 2016-2017 monthly financial report for September and the FY 2017-2018 monthly financial report for October were briefed. It was noted that the Board would have a surplus over the allowable fiscal year carryover funds and that amount would be submitted to the General Fund. The proposed budget for FY2018-2019 was discussed and the Board felt it may have to discuss a fee increase for the FY2019-2020 budget year in order to purchase a new licensing system.

18-034. IT WAS MOVED by Mr. Christy and seconded by Mr. Grace that the Board approve the FY 2018-2019 proposed budget. MOTION CARRIED 7-0.

PERSONNEL – Mr. Marc Barter, Advisor The Board was briefed on the status of the process to fill the open special investigator position. Senator Clyde Chambliss met with the Board and provided a proposal for it to consider. The two primary areas discussed in the proposal included Qualification Based Selection (QBS) and Board Composition. Senator Chambliss listened to input from Board Members and individuals representing organizations which included Renee Casillas and Jim Meads of the American Council of Engineering Companies of Alabama (ACEC), Joe Meads of the Alabama Society of Civil Engineers (ASCE) and James Monk of the Alabama Society of Professional Land Surveyors (ASPLS). Senator Chambliss advised the Board he would provide recommendations for it to consider near December 1, 2017, and asked the Board to act on the recommendations quickly in order for the proposed bill to be filed with the Legislative Reference Service as soon as possible. The Board briefly discussed items in the proposed law change that would need to be revised based on the construction experience discussion earlier in the meeting. The Board determined to review the proposed law change after Senator Chambliss provided his recommendations. The Board met with Mr. Travis McGuire regarding his professional engineer comity licensure application. The Board informed Mr. McGuire that since his educational degrees did not meet the requirements of the Code of Alabama it could not issue him a professional engineer license. It was suggested to Mr. McGuire that he contact Rice University to determine if the degree he received would be considered part of the civil engineering department and if the title of the degree could be changed in order that it could possibly meet the licensure requirements of Alabama Law.

18-035. IT WAS MOVED by Mr. Johnson and seconded by Mr. Barter that the Board defer for licensure the professional engineer comity application of Travis McGuire. MOTION CARRIED 7-0

EXECUTIVE DIRECTOR’S REPORT Vice Chair Johnson asked the Board to discuss removing the sections of the Administrative Code related to Qualification Based Selection. At the end of the discussion Vice Chair Johnson withdrew his proposed motion. Vice Chair Johnson proposed the Board consider alternative paths to licensure for individuals wishing to become licensed as professional land surveyors. After reviewing the proposal, the Board determined it would send a survey to all active professional land surveyors regarding the proposed changes to the Code of Alabama, and would review the survey results at a meeting in December before finalizing the Proposed Law Changes to be submitted in the 2018 Legislative session. Secretary Whorton provided information for the Board to consider when discussing proposed law changes regarding the composition of NCEES Member Boards. The Board was briefed on the following office updates: The Administrative Law Judge contracts for Tori L. Adams and Dana Billingsley were approved by the Contract Review Committee and were now being reviewed by the Governor's office. Staff recommended and the Board agreed to create an online Law and Administrative Code course with an examination that can be used for pdh and/or as part of a disciplinary requirement. No fee would be required for the course. The Board was asked if it wished to update the current Building Officials Handbook, and Mr. Whorton and Mr. Grace agreed to work on this action item. The Board was briefed on the travel requirements for anyone wishing to attend the FARB meeting in January 2018. Executive Director Rick Huett, Board Counsel Ben Albritton and Board Member Richard Grace indicated they wished to attend the meeting. The Board was briefed on the status of the request submitted to the Legislative Reference Service (LRS) regarding an opinion as to if Act # 2017-384 is sufficient to afford the Board immunity from anti-trust claims. At its October 6, 2017 meeting, the Board discussed a letter received from Senator

Clyde Chambliss in which he asked the Board not to move forward with the LRS rule request until he had time to meet with all parties and reach an agreeable solution. The Board was briefed on the Legislative Reference Service review process and determined that it would withdraw its request for an opinion.

18-036. IT WAS MOVED by Mr. Christy and seconded by Mr. Barter to withdraw the opinion request previously submitted to the Legislative Reference Service (LRS). MOTION CARRIED 6-1 with Vice Chair Johnson voting No.

The Board reviewed the professional engineer resumes it received for the Board Member position on the Alabama Onsite Wastewater Board. The qualifications for the position included the need to have experience and an understanding of the design and construction of onsite wastewater systems. After this review the Board made the following motion.

18-037. IT WAS MOVED by Mr. Christy and seconded by Mr. Barter to submit the names and resumes of Mr. Steven E. Speaks, Ms. Sharon Kimbrough and Mr. Bryan Scott Cummings to the Speaker of the House of Representatives for his consideration. MOTION CARRIED 7-0.

CORRESPONDENCE Mr. Terry McAnnally submitted a letter inquiring if it was possible to obtain PDH credit for developing an online engineering training course. The Board determined that the activity could only be claimed if the course content was changed from previous offerings that had been claimed previously, and the activity would qualify for pdh at twice the presentation time for the developer. Mr. Gregory Williams submitted a letter to the Board inquiring if licensure is required to perform an As-Built analysis for quality assurance and control of a construction site. In his letter, he stated: “As-Built analysis has a number of names in the region that I do business in and has several general contractors (GC) and subcontractors confused on its legal definition." After review and discussion, the Board determined that if the analysis does not tie to the property boundary, licensure is not required. OPEN FORUM No comments made during the open forum.
