MINUTES OF 157th MEETING OF NORTHERN REGIONAL COMMITTEE HELD FROM 24th to 27th MARCH, 2010

The 157th meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from 24TH to 27th

March, 2010 at Conference Hall, NRC, NCTE, Jaipur. The following members and convener were present:

It indicates that some other course is being run by the Institute which the Institute did not disclose. Language learning lab is not available.

The playgrounds have not been properly leveled and marked for different courses. Too small blackboard. Number and titles of books are not as per NCTE norms. Further there are too many books of one title. Furniture for the classroom, multipurpose hall and Library are not adequate. Physical Education Labs, like, Anatomy, Physiological, etc. are not available. Gymnasium equipments have not been installed.Hence, the committee decides to issue Show Cause Notice on above points and directs the Institute to submit reply within 30 days.

9. 7. Sagar Mahila Mahavidyalaya, 403, Bhimpura - 01, Bethra Road, Tehsil - Ballia, U.P.

The college approach road is very narrow.Hence, the committee decides to issue Show Cause Notice on above points and directs the Institute to submit reply within 30 days.

The decision with respect to Writ Case No.8506 of 2010 filed in , the Honourable Highcourt Allahabad is as follows.

The petitioner-Institution has sought the quashing of the order dated 7th October,2009 passed by the Northern Regional Committee of the National Council for Teachers Education ( hereinafter referred to as the NCTE to the extent it grants recognition to start the M.ED Course from the session 2009- 10 instead of 2007-08.

The said institution filed a writ petition no. 51245/09 in the Hon’ble High Court of Allahabad, Uttar Pradesh. The order passed in the Hon’ble Court dated 06.10.2009 is as follows:-

“The only grievance of the petitioner is that Pursuant to order of remand passed by the National Council for Teachers Education on the appeal of the petitioner directing Northern Regional Committee to reconsider the matter relating to approval of 100 seats for B.Ed. post in the petitioner’s institution still pending disposal. In the circumstances it has been prayed that a direction be issued commanding respondent no. 5, the Northern Regional Committee to take an early decision.

The institution has filed another writ petition no. 6602/2010 in the Hon’ble High Court of Allahabad, Uttar Pradesh received in the NRC, NCTE on 19.02.2010. The order passes by Hon’ble Court dated 08.02.2010 is as follows:-

“Committee of Management, Shukdeo Prasad Tripathi Mahavidyalaya Bhathi Khurd, Kushinagar has filed this petition for setting aside the order dated 29th

January, 2010 passed by Northern Regional Committee of the National Council for Teacher Education.

A perusal of the impugned order shows that the only ground taken for not granting additional seats in the B.Ed. Additional intake is that the institution was not accredited with National Assessment and Accreditation Council (NAAC) with a letter grade B so as to make it eligible for the additional intake.

Sri P.S. Baghel, learned Senior Counsel assisted by Sri R.C. Dwivedi, appearing for the petitioner has placed reliance upon Regulations 8(4) and 8(5) of the National Council for Teacher Education (Recognition Norms and Procedure) Regulations, 2007 (hereinafter referred to as the ‘Regulations’) and has submitted that in terms of Regulation 8(5) of the Regulations, the institution after the grant of additional sears shall have to be accredited with the NAAC with a Letter grade B before 1st April, 2010 but this fact has not been taken into consideration by the Appellate Authority.

Sri R.A. Akhtar, learned counsel appearing for the respondents states that it may not be necessary to file the counter affidavit and the petition may be disposed of at this stage.

In order to appreciate he contentions advanced by the learned Senior Counsel for the petitioner, it is necessary to reproduce Regulations 8(4) and (5) which are as follows:-

“8(4) An institutions shall be permitted to apply for enhancement of intake in Secondary Teacher Education Programme- B.P.Ed. Programme, if it has accredited itself with the National Assessment and Accreditation Council (NAAC) with a Letter Grade B developed by NAAC.

(5) An institution that has been granted additional intake in B.Ed. and B.P.Ed. teacher training courses after promulgation of the Regulations, 2005 i.e. 13.01.2006 shall have to be accredited itself with the National Assessment and Accreditation Council (NAAC) with a Letter Grade B, under the new grading system developed by NAAC before 1st April, 2010 failing which the additional intake granted shall stand withdrawn w.e.f. from the academic session 2010-2011”.

A perusal of Regulation 8(5) clearly shows that the institution after it has been granted the additional intake is required to get accreditation with NAAC with a Letter Grade B before 1st April, 2010 failing which the additional intake shall stand withdrawn w.e.f. the session 2010-11.

In such circumstances, the additional intake could have been granted so that the petitioner- Institution could have obtained accreditation by NAAC before 1st April, 2010 but that was not done.

The order dated 29th January, 2010 passed by 48


respondent No. 2- Regional Director, Northern Regional Committee, therefore, deserves to be set aside. It is, accordingly, set aside. The Northern Regional Committee shall now reconsider the matter on merits in the light of Regulations 8(4) and (5) of the Regulations expeditiously, preferably within a period of three weeks from the date a certified copy of this order is filed by the petitioner institution.

The writ petition is allowed to the extent indicated above.

138. 2. Subharti Institute of Management & Information Technology, Khasra No.-1628 & 1629, Subharti Puram, VPO-Maliyana, Distt.-Meerut, Up-3118, M.Ed

The institution had submitted an application for M.Ed. course on 29.09.2008 and the application of the institution was rejected by the NRC in its 139th Meeting held on 10th – 12th April, 2009. Accordingly, an order was issued to the institution on 05.06.2009.

The said institution preferred an appeal at NCTE Hqtrs, New Delhi on 10.06.2009. After the hearing oral arguments advanced during hearing, the council reached conclusion that there was no ground to accept the appeal and the appeal was rejected.

The said institution filed a writ petition on 61124/2009 in the Hon’ble High Court Allahabad.

The application of the petitioners for grant of recognition of M.ED. Course has been rejected by Regional Committee and the Appeal filed by the petitioners was rejected by the NCTE on 07.08.2009. The ground taken for rejection of the appeal is that the land is not in the name of the institution as per the requirement under the Regulations and therefore, recognition cannot be granted.

According to Sri Khanna, Learned counsel for the petitioners on 31-08-2009 the NCTE has come up with the new Regulation. According to Which the land could be either in the name of the Socity, Institution or the Trust. Sri Khanna states that in the circumstances the

In the facts and circumstances of the case, this petition is disposed of with a direction that in case petitioner files such an application for recognition, the Regional Committee shall consider the same and pass appropriate order in accordance with law within a period of two months from the date of production of certified copy of this order.

139. 3. Shanti Niketan Institute of Technology, VPO- Rahu Nangli, Tehsil- Chandpur, District- Bijnor, U.P.UP-3000, Course B.ED

The application of the institution was closed by the NRC in its 140th Meeting of NRC held on 25th – 26th

April, 2009. Accordingly an order was issued on 10.06.2009.

The said institution filed a writ petition no. 896/2010 in the Hon’ble High Court of Allahabad, Uttar Pradesh.

Shanti Niketan Institute of Technology, Rahu Nangli, Tehsil- Chandpur, District- Bijnor (hereinafter referred to as the “Institution”) has sought the quashing the order dated 10th June, 2009 passed by the Regional Director of the Northern Regional Committee of National Council for Teachers Education. The order dated 07th

August, 2009 passed by the Appellate Authority has also been impugned in the present petition.

It is stated in the petition that a communication dated 11th June, 2008 was issued by the Regional Committee asking the petitioners to remove the deficiencies mentioned in the letter so that the application submitted by it for grant of affiliation for establishing a new Institution for B.Ed Teacher Education Programme could be considered. The

petitioners submitted a reply where after the order dated 10th June 2009 was passed by the Northern Regional Committee that the application was being returned as the petitioners had not removed the deficiencies. The petitioners filed an appeal which has been rejected by the order dated 07th August, 2009.

Learned counsel for the petitioners has pointed out that the order dated 10th June, 2009 mentions only one deficiency that the land use certificate was not submitted by the petitioners but the Appellate order mentions two more deficiencies namely that the Institution had not submitted a proper building plan and the building completion certificate. It is his submission that the Institution had removed all these deficiencies but the Appellate Authority has recorded incorrect finding that the deficiencies had not been removed. It is pointed out by learned counsel for he petitioners that the land use certificate had been obtained after the order was passed by the Regional Committee and eh Appellate Authority was apprised of this fact but it has not been taken into consideration by he Appellate Authority.

Sri R.A. Akhtar, learned counsel for the respondents states that the petitioner may now apprise the Northern Regional Committee of the correct facts so that an appropriate order can be passed.

It, is therefore, for the petitioner- Institution to approach the Northern Regional Committee with all the relevant documents regarding removal of the deficiencies pointed out and in case such an application along with all the relevant documents is filed before the Northern Regional Committee, an appropriate reasoned order shall be passed expeditiously, preferable within a period of Six weeks’ from the date a certified copy along with all the relevant documents is filed by the petitioners before the Northern Regional Committee. The impugned order shall abide by the final order to be

The institution was recognized vide officer order no. F.NRC/NCTE/F-7/UP-2129/2008/56380-86 dated 18.08.2009.


The petitioners have sought the quashing of the order dated 18th August 2008 passed by the Northern Regional Committee of the National Council for Teacher Education to the extent that the recognition for conducting B.Ed Course of one year with annual intake of 100 students should be for the academic session 2007-2008 instead of 2008-2009. The petitioners have also sought the quashing of the order dated 23rd April, 2009 by which the Appeal filed by the petitioners under Section 18 of the National Council for Teacher Education, Act 1993 (hereinafter referred to as the ‘Act’) has been rejected on the ground of delay.

Learned counsel for the petitioners submitted that pursuant to the order dated 14th November, 2006, the petitioners admitted students but subsequently by the order dated 18th August, 2008 the Northern Regional Committee has granted recognition to the B.Ed Course for the academic session 2008-2009. He has, therefore, submitted that the fate of the students has been put in jeopardy.

Sri R.A. Akhtar, learned counsel appearing for the respondents has placed before the Court Regulation 7(9) of the National Council for Teacher Education (hereinafter referred to as the ‘Regulations’) which provides that the institution shall first be informed by a letter of the decision to grant recognition or permission, subject to appointment of the faculty and after information of he same, the Regional Committee shall issue formal order for recognition that shall be notified as per the provisions of the Act under Regulation 7(11) of the Regulations. He, therefore, submits that the order dated 14th November, 2006 could not have been made a ground by the petitioners to admit the students and it is only after the order dated 18th August, 2008 that the students could have been admitted.

As per the order of Hon’ble High Court of Allahabad, Allahabad, the case was considered by the committee and decided that its’ order dated 18 August 2008 stands as it is.

These submissions have been advanced by learned counsel for the parties on the merits of the case. However, as the records of the writ petition indicate, the petitioners had filed an appeal under Section 18 of the Act which appeal was rejected only on the ground of delay.

Section 18 of the Act provides that any person aggrieved by an order made under Sections 14,15 and 17 may prefer an appeal to the Council within such period as may be prescribed. Under sub-section 2 of Section 18 of the Act, the appeal can be prescribed. Even if it is preferred after the expiry of the period prescribed thereof, if the appellant satisfies the Council that he had sufficient cause for not preferring the appeal within the prescribed period.

Learned Counsel for the petitioners has stated that reasons have been mentioned in paragraph 6 of the grounds of appeal but the same have not been taken into consideration.

Learned Counsel for the parties are agreed that instead of remanding he matter to the Council for deciding whether the delay can be conducted or not, the Court may pass an appropriate order.

Since the matter involves the fate of students and the delay is only of about three months and Eighteen days as has been noticed in the order dated 23rd April, 2009, the court is satisfied that the appellant was prevented by sufficient cause from preferring the appeal within the time stipulated. The delay is, therefore, condoned. The order dated 23rd April, 2009 is, accordingly, set aside. The council shall now decide the appeal on merits.

The petition is allowed to the extent indicated above.

Appeal has also been rejected by the appellate authority with out calling summoning the records from the respondent no. 2, vide its order dated 8th October 2009. The learned trial court simplicitor proceeded to issue notice without satisfying the elements of Order XXXIX Rules -1, 2 & 3 of Civil Procedure Code.

As such, interim stay of the operation and implementation of the order dated 08.10.2009 and order dated 24.07.2009 passed by the respondent no.1&2, till the next date of listing. The respondent no.2 is directed to give a fresh look into the matter and consider issuance of formal unconditional recognition order in terms of the Regulations 7(12) of the National Council for Teacher Education(Recognition, Norms and Procedure) Regulations 2005, in case the appellant satisfies the required norms, within a period of one month from the date a certified copy of this order is issued.

The appellant plaintiff submits that despite it having removed all defects furnishing all documents as required by the respondent no. 2 from time to time, respondent no. 2 vide order dated 05.11.2008, has declined to make any inspection of the institution and to grant recognition for running the course in B.Ed and additional intake of 100 students, on the ground that the appellant has filed to submit the reply to letters dated 12.06.2007, 28.06.2007 and 17.09.2007, of the respondent no. 2. The appellant contents otherwise and being aggrieved preferred a statutory appeal before the respondent no. 1, who rejected the appeal on the fresh ground that the institute did not take accreditation from

the NAAC, which is not a mandatory condition under the methodology of assessment and accreditation as adopted by NAAC with effect from 01.04.2007. Institution, running B.Ed courses are not covered and even in case they are considered to be covered, under NAAC only after the institution has completed five years since its establishment or with record of at least two batches of students having completed the degree courses, whichever is earlier. The appellant institution, which was, however, established in the year 2005, has to at least function for reasonable period of time before it can be accredited by the NAAC under its nine point criteria.

The counsel for the plaintiff has taken this court through various provisions of the NCTE, Regulations 2005, methodology of assessment and accreditation as adopted by NAAC with effect from 01.04.2007, NCTE Act 1993, etc.

The learned trail court simplicitor proceeded to issue notice without satisfying the elements of Order XXXIX Rules -1, 2 & 3 of Civil Procedure Code.

As such, interim stay of the order dated 11.06.2009 and order dated 05.11.2008, passed by the respondent nos. 1 & 2 till the next date of listing.
