The 155th meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from 23rd to 25th

January, 2010 at Jaipur. The following members and convener were present:

Remarks:The matter was placed in 152nd meeting of NRC. The committee has observed that:

Dr. Vishwas saxena appointed as Reader is not qualified as per NCTE norms for M.Ed.

The list of appointed Faculty pertains to 2008 which is too old. Thus, the Institution is directed to submit the fresh list of appointed Faculty as per NCTE norms for M.Ed.

Hence, the committee directs the University to appoint Faculty as per NCTE norms for M.Ed. Within 60 days.

The Professor has not been appointed through properly constituted selection committee. Mr. Mukesh Kumar Meena appointed as lecturer is not qualified as per NCTE norms for M.Ed.

Hence, the committee decides to refuse additional intake in M.Ed.

The council accepted the appeal, set aside NRC’s order dated 17.08.2009. and the case remanded to NRC for causing a composite inspection of the institution to ascertain availability of adequate facilities as per norms for all the teacher training programmes i.s. B.Ed. (2 Units) & M.Ed. (1 Units) and thereafter pass appropriate orders. Till then the institution is lo continue as a recognized institution.

The said institution filed a writ petition no. 234 / 2010 in the Hon'ble High Court of Allahabad, Uttar Pradesh against the order issued vide this office order dated 22.12.2009 for granting recognition from the academic session 2009-2010 instead the academic session 2008-2009.

Hon'ble High Court of Allahabad, Uttar Pradesh disposed of the writ petition with a direction that in the event the petitioners file a certified copy of this order before the Committee within a period of two weeks from today, the respondents shall pass an appropriate order expeditiously.

As per the direction of Hon’ble High Court of Allahabad, Allahabad, UP, the committee reviewed the case and decided that the previous decision is appropriate and as such it stands.

The Northern Regional Committee may pass fresh orders within 6 weeks from the date of production of certified copy of this order.

37. 4. J.P.C.L. (Manohar Lal) Degree College, Post - Shewan Tanneroy, Jajmon, Kanpur, Uttar Pradesh

(Course - B.Ed., - UP - 1089)

The application of said institution withdrawn in 153rd

meeting of NRC held on 11th - 12th December, 2009. Accordingly, an order was issued to the institution vide this office order dated 06.01.2010 due to the following reasons:

a) The Show Cause Notice was issued through letter no. F. NRC / NCTE / F-3/ UP-1089/ 137 meeting / 2009 / 72563-64 dated 30 March 2009 and the Institution was directed to reply within One month. The reply has not been received till date. Hence, the committee decides to withdraw recognition of B.Ed. programme from 2010 – 2011 academic session.

The said institution filed a writ petition no. 192 / 10 in the Hon'ble High Court of Allahabad, Uttar Pradesh against the order issued vide this office letter dated 06.01.2010.

Hon'ble High Court of Allahabad, Uttar Pradesh disposed of the writ petition with a direction that in the event the petitioners file a certified copy of this order along with a copy of the reply submitted by the

The application of the institution was refused by the NRC in its 123rd meeting of NRC held on 19th - 22nd Nov, 2009. Accordingly an order was issued to the institution on 29.11.2009.

The said institution filed a writ petition no. 67087 / 09 in the Hon'ble High Court of Allahabad, Uttar Pradesh.

The only relief sought for by means of this petition is that the pending appeal before NCTE against the order of Northern Regional Committee, Jaipur may be directed to be decided within a fixed time framed. It is further submitted that the said appeal is pending since 1.10.2009

Considering the facts and circumstances of this case, the writ petition is disposed off with a direction to decide the pending appeal of the petitioner within a period of two months from the date of production of certified copy of this order in accordance with law.

As per direction of Hon’ble High Court of Allahabad, Allahabd, UP, the case is to be decided by the appeal committee within a period of two months from the date of production of certified copy of this order in accordance with law. Hence the committee directs the NRC office to send the relevant papers to the appeal committee for necessary action.

The application of said institution placed before the NRC in its 152nd meeting held on 23rd - 25th May, 09 and the committee decided as follwos:

The said institution filed a Contgempt Appliction civil No. 4909 / 09 in the Hon'ble High Court of Allahabad, UP.

This contempt petition has been filed with the allegation that inspiote of an order dated 21.10.09 passed by this Court in Writ petition no. 50104 of 2009 the opposite party has not decided the representations of the applications through the stipulated time has elapsed.

The opposite party is bounded by the order of this Court and in case he does not decide the representations of the applicants within a month of receipt of this order. without any reassonable cause, the Court would have not option except to punish him under section 12 of the Contempt Act and other allied powers.

The applications shall supply duly stamped registered envelope addressed to the opposite party and another self - adddressed stamped envelope to the office within two weeks from today. The office shall send a copy of this order along with the self - addressed envelope of the applications to the opposite party within three weeks from todat and keep a record thereof.

The opposite party shall decide the representations of the applications and intimate them of the order through the self - addressed envelope within a week thereafter.

40. 7. Indian Institute of Education, Hari Devi, Ghana Hatti, Shimla, HP

(Course - M.Ed., HP-282)

A deficiency letter was issued to the institution on 23.06.2008.

After the issuance of deficiency letter the said institution has filed a writ petition no. 95/2008 in the Hon’ble High Court of Himchal Pradesh at Shimla.

The Hon’ble High Court has directed to dispose the case within two week.

NRC office vide letter no. NRC/NCTE/2005/54535 dt 14.07.2008 has informed the Legal Counsel of NRC at Shimla that the matter will be placed in the forth coming meeting of NRC and Hon’ble high Court may be informed accordingly.

From the records (minutes of NRC meetings) of office it is observed that the decision in the matter is yet to be taken by NRC.

As per the direction of Hon’ble High Court of Himachal Pradesh, Shimla, the case was considered. The following deficiencies were observed:

The land is not in the name of Institution.

The Institutional website has not been developed as per NCTE norms for M.Ed.Hence the committee directs the Institute to remove above deficiencies within three months.

41. 8. Shakuntala Devi Educational Institute,88, Adarsh Vihar, Kargi Road, Dehradun, Utrakhand

The institution submitted a reply on 09.11.2009 in this office for grant of recognition for M.Ed. Course as per the Hon’ble High Court order dated 12.10.2009.

Hon’ble High court vide order dt. 12.10.2010 has directed that” in case the petitioner institute has already removed all the discrepancies as raised by the respondent, the respondent shall reconsider and decide his application dt. 17.09.2009 within a period of one month from the date of production of a certified copy of

The bank statements related to salary of staff were not made available. Provision for art and workexperience was not made. Playground facilities have not been developed.Hence the committee decides to issue Show Cause Notice on above points and directs the Institute to reply within one month.
