LAW on the Approval of the Spatial Planning of the National Territory

Section II - Water

The Parliament of Romania has adopted this Law.

Art. 1 - Spatial Planning of the National Territory - Section II Water is approved according to annexes no. 1-8, which are an integral part of this Law.

Art. 2 - The works stipulated in this law on the Spatial Planning of the National Territory - Section II Water are of national interest and represent public utility cause.

Art. 3 - (1) The provisions of the Spatial Planning of the National Territory - Section II Water are compulsory for the authorities of the public administration.

(2) Subject to the financing necessities and possibilities of the annual state budget, these works may be extended and diversified, on the proposals of the public administration authorities of the counties, municipalities, cities or communes.

(3) Definition of the land necessary for water works that are the subject matter of this law shall be established through urban and territorial planning documents, specialised and feasibility studies prepared as by law.

(4) The occupation of the necessary land and its conversion from agricultural and forestry production shall be made as by law.

Art. 4 - The authorities of the public administration shall cooperate in implementing the provisions of this law, taking measures in order to:

a) ensure the protection of water sources against exhaustion, pollution and degradation, through a sustainable utilization;

b) correlate the resources with the water demand of the population, industry, irrigation

and other uses, and integrate these actions in short, medium and long term territorial planning.

Art. 5 -1) The works of the Spatial Planning of the National Territory - Section II Water shall be included in the investment lists annex to the budgets of the main credit release authorities, based on the technical and economic specifications, prepared and approved according to the legal provisions, and shall be financed in completion according to the funds assigned for this destination by the annual budget laws.

(2) The works may be totally or partially financed by other investors too, as by law.

Art. 6 - The priorities on water are set out by the Ministry of Water, Forests and Environmental Protection, correlated with the programs of national interest.

Art. 7-The definition of the areas included in the annexes of this law with great disfunctions in drinking water supply and / or sewerage in municipalities and towns, of rural areas with scarce water resources, of areas with water resources polluted by industry, as well as areas necessary for irrigation and/or drainage works, in need of priority rehabilitation actions, shall be established by urban and/or territorial planning documents approved as by law.

Art. 8 - Violating the provisions on water conservation and protection by natural or legal persons, entails civil, contraventional or penal liability, as by law.

The Chamber of Deputies has adopted this Law in its Session of October 6, 1997, pursuant to

the provisions of Article 74 (1) of the Romanian Constitution.

ANNEX 1

SPATIAL PLANNING OF THE NATIONAL TERITORRY

Section II - WATER

Definitions of the main terms used For the purposes of this Law, the meaning of the following terms shall be:

1. Fresh water resources - resources including surface waters: rivers, fresh water lakes or the Danube river, and also underground waters, excluding the geothermal mineral waters and plain water;

2. Water for population - fresh water necessary for human living and for the environment of human settlements, supporting various and multiple functions and uses associated with household demand, animal rearing, public and industrial activities of the inhabitants and others;

3. Drinking water - any surface or underground water that, in its natural state or after proper physical and chemical and/or microbiological treatment, may be drunk without damaging health;

4. Household wastewater - Wastewater resulting from household need for water in human settlements, as well as from hygienic- sanitary and social - administrative need of various industrial units;

5. Water for industry - Raw or treated fresh water, used by companies deploying industrial activity;

6. Industrial wastewater - wastewater resulting from the water needs of the technological processes of industrial units and of other similar activities (construction, transport, etc);

7. Water for irrigation - fresh water necessary for the irrigation of agricultural crops, provided mainly by surface water sources: interior rivers and the Danube river.

8. Drainage water - surplus water from drainage works - drainage, discharged in the hydrographic network;

9. Hydrographic basin - natural entity including the hydrographic network up to the watershed;

10. Water pollution - any physical, chemical or biological alteration of water, including exceeding of the natural level of radioactivity, as a direct or indirect result of human activity, that makes it improper for the uses which were possible before the alteration;

11. Vulnerability - the sensitivity of underground waters system to human and/or natural impact;

12. Conduit - the assembly of buildings and installations serving for the transfer of water under pressure or at free level, from the catchment to the distribution network;

13. Water user - any natural or legal person, using water, water surface in the course of their activity or turning them into account;

14. Flow in-take - catchement of water from surface or ground sources, for economic and social activities;

15. Distribution network - part of the water supply system, including pipes and auxiliary works serving for the transfer of water from the main storage constructions or for creating the working pressure up to the customer branching;

16. Wastewater treatment plant - constructions and installations through which wastewater impurity is being reduced;

17. Treatment step - Functional wastewater treatment unit, independent or part of a wastewater treatment system, achieving a certain level of treatment;

18. Primary treatment - mechanical separation of floating and decantable materials from wastewater;

19. Chemical treatment - treatment of wastewater by chemical means;

20. Biological treatment - decomposition and mineralization of the organic substances in wastewater by microorganisms;

21. Water treatment plant – ensemble of necessary constructions and installations for improving the physical, chemical and biological qualities of raw water intended for certain uses;

22. Compensation - storage – ensemble of constructions and installations to ensure the rational distribution of water during peak hours, interruptions in catchment and in case of fire;

23. Water supply in zonal system - zonal public service of water supply, providing for users in several settlements located at some distance from the source;

24. Water supply system modernization - optimization of water production constructions and installations, by adopting a new conception and high performance objectives;

25. Sewerage system modernization - optimizing the operation of the sewerage

network and of the wastewater treatment plant, by adopting a new conception and high performance objectives;

26. Water intake - the point where the water is mechanically or gravitationally extracted from its natural source;

27.Rehabilitation of the irrigation system - bringing the catchments, pumping units, main canals, secondary canals and watering wings to the initial parameters;

28. Rehabilitation of the drainage systems - bringing to the initial parameters the secondary canals and the drains, the main drains and the draining pumps units;

29. Rehabilitation of the areas with water resources polluted by industry – restoring the natural characteristics of the soil, of the underground layers and of the groundwater tables, in order to ensure the economic and social development of the country;

30. Water flows quality - all the conditions surface waters have to comply with, as stipulated in standard STAS 4706-88, for organoleptic, physical, chemical,

microbiological parameters and level of radioactivity.

Subject to compliance with these conditions, water flows, in their natural or harnessed form, shall be classified in terms of their field of use, in three quality categories Ist, IInd and IIIrd:

• The Ist category includes water flows that may be used in all activity fields;

• The IInd category includes water flows that may be used in industry, irrigation and for urban and tourist uses;

• The IIIrd category includes water flows that may be used for irrigation, engine cooling, in washing units and in hydroelectric power plants.

Beside these quality categories, there are polluted water flows that may not be used in any activity field.

Annexes no 2 and 6 of this law render graphically the quality categories of the main rivers in Romania as by standard STAS 4706-88, considered at their current status in 1993.
