CAGAYAN de Oro City––What would have seemed to be the answered prayers for the power consumers of Davao del Norte Electric Cooperative (DANECO) has melted-down partly by some legal wilting against the dominant muscles of a local political bigwig.

Consumers alleged that local executive is behind the ousted DANECO executives to shell off the cooperative’s Administra-

tion Office from the Temporary Restraining Order (TRO) issued by the Court of Appeals (CA).

However, Rey T. Uy is the mayor of Tagum City.

It was also learned that the removed BOD President Dean C. Briz is the current Tagum City Budget Officer.

DANECO member-consumers allegedly linked Briz to the city’s executive.

Atty. Conchito J. Oclarit, legal counsel of the Association of Mindanao Rural Electric Coopera-tives (AMRECO), expected that, by virtue of the CA’s TRO, state takeover would have included not only DANECO’s Monte-vista control premises but also its ad-ministration office.

DANECO’s administration office is located in the city proper.

Oclarit lamented that police

force has been fielded around the administration premises to close the cooperative against person-nel from the state run National Electrification Authority (NEA).

because of the Nabunturan Re-gional Trial Court’s TRO.

THINK a minute.A king was offering a

prize to the artist who could paint the best picture of peace.

Many artists from around the country tried. The king looked at all the pictures and there were only two he really liked. But he had to choose between them.

One picture was of a calm lake. The lake was surrounded with peaceful, towering mountains. Above them, was a blue sky with fluffy white clouds.

Everyone who saw this picture thought that it was a perfect picture of peace.

The other picture had mountains too. But these were rugged and bare. Above was a dark, angry sky and

Picture of peace

heavy rain with flashes of lightning. Down the side of the mountain roared a huge, powerful waterfall. It did not look peaceful at all.

But when the king looked closely at the second picture, he saw behind the waterfall a tiny bush growing in the crack of the rock. A mother bird had built her nest in the bush. There, in the middle of all the noise of rushing

water and scary, thunder-ing skies, that mother bird sat—in perfect peace.

Which picture do you think won the prize?

The king chose the sec-ond picture and he said: “Peace does not mean you must be in a place where there is no noise, trouble, pain, or pressure from work. The real meaning of peace is to be right in the middle

of all those difficult experi-ences, and still be calm and confident in your heart.”

It doesn’t matter what difficult situation you’re in right now.

Jesus, the Christ of Christmas and Prince of Peace, loves you. And this Christmas season, even with everything you may be going through, you also can have peace in your heart.

If you’ll ask Jesus, God the Son, to forgive you for all your wrongs, and then ask Him to take full control of every area of your life, every day.

He will fill your heart with His power and peace that you can never find anywhere else.

THE Supreme Court’s tradition as the last recourse of ordinary Filipino citizen seeking justice and relief might finally lose that reputation. No thanks, to President Aquino’s personal ani-mosity against perceived corruption in the judiciary. In the end, Aquino’s finger dipping at the high court left a gaping wound of mistrust against the revered institution.

This early, the perception of dis-trust snowballs as controversy seemed to mar the selection of next possible Chief Justice. Even the independent Judicial Bar Council (JBC), tasked to strain and squeeze the next possible CJ, could not escape being suspect. There are views that membership into the JBC has the imprimatur of Aquino himself. For whatever reason, an ordinary observer could simply surmise that Aquino wants JBC to get the ‘right’ next CJ. What is right is contextual since it could be misconstrued as ‘within the standard’ of Aquino’s personal taste.

Consider the case of Justice Secretary Laila Delima, a JBC member, who earlier declined nomination as next CJ. On the last day of the accepting nomination, Delima suddenly resigned her JBC membership and accepted the nomination. Delima’s action was not only surprising but became questionable, too. Prior to her resignation as JBC member and subsequently accepting the nomination, Delima reportedly talked to Aquino. Whether their conversation has something to do with

Assailing the high court’s integrity

Billionaires in the Philippines

the CJ nomination, one does nothing but disbelief. Act-ing CJ Antonio Carpio also declined the nomination but finally accepted it. Did Aquino tell them to accept the nomination since their possible appointment to the coveted CJ position is in the bag?

Former Solicitor General Frank Chavez also ques-tioned the inclusion of members of Congress Neil Tupas and Chiz Escudero with the JBC. Chavez cited a phrase in Section 8, Article VIII of the 1987 Constitution that ‘only one representative from Congress should be al-lowed as JBC member’.

Actually, Sen. Chiz Escudero as JBC member repre-senting Congress would suffice. Truth is, the presence of Ilo-ilo Rep. Neil Tupas at JBC casts doubt on the body’s integrity.

It is of public knowledge that Rep. Neil Tupas was Aquino’s lead prosecutor in the impeachment of former CJ Renato Corona. Unless, Tupas has nothing personal, he should have declined membership at JBC. Well, al-though Tupas could not take the JBC membership, he could not do otherwise. Being Aquino’s stool Tupas is obliged to be at JBC to protect the interest of his ‘boss.’

What is, therefore, the point of accepting as many as 70 nominees to fill up the position as Supreme Court’s Chief Justice? Could it be that such move is but to show a semblance of fair play? Nevertheless, the Filipino citizenry have had more of this under Aquino’s watch. When the Supreme Court becomes a victim of distorted politics, how could justice be steadfast?

THE country together with the world press celebrated the billion-aires of the Philippines recently.

And why not, so we may all know of their successes, right? Or at least drool over their monies identified.

With reference to one of the more infamous characters known as a pacman with no reference to the professional boxer, is there not a law that prohibits a monopoly for broadcast TV and the presses.

Assuming there is no regulation, shouldn’t there be one? Is this not anti-trust? The senate is set to tackle this bill to regulate theft and monopolies but till the day it ascends to a republic act we need to be vigilant to stop the manipulation of the rich and powerful to get even richer with absolute power.

He who’s name will not be mentioned is known in the industry to have purchased as announced on media the gargantuan major TV network GMA7.

It is common knowledge he already controls TV networks ABC5 and IBC13 and a slew of major print broadsheets namely the Inquirer, the Star and the Busi-ness World.

With GMA7 TV network up his sleeve to tow the line for media, who can negate public opinion as he calls it? Now all we need do, to get the news, is to ask

the “man” right? He has become all powerful, absolute if anything

and uncontestable because he controls media as we know it today.

Public Opinion will be controlled and perceptions managed towards personal interests. Business lobby-ing will be coherent and unstoppable for those who are connected. No administration will be able to stand or contest this power.

Now didn’t we just read of the scandals that have recently rocked the British media with Rupert Murdock at the helm?

His caliber however encompasses the world media from Australia to the Americas. Should we allow his slippery lawyers to skirt the spirit of the laws of the land to place him at the helm?

He who’s name will not be mentioned need not run for president or chief justice, he will be more authorita-tive and feared by many administration to come. Now if you are not alarmed, you should be.

He suffers obviously from survivor ego negating the misery of the common folk with our inequitable distribu-tion of wealth keeping us from any sustainable growth.

At the rate he is expanding his influence and pow-ers, next stop would be the banks––so beware the rich that are already comfortable in their industry, you are prime targets.

The Central Bank as we know it will likewise be

Salamat.

under his control. The business acumen and the financial wizards that have successfully syndicated the broadcast take-over need to be applauded for a job well done.

The “barbarians at the gate” have forced entry and we are willing subjects for the manipulation for a sin-gly person authority and Indonesia––shame on them.

They need to realize one day they will fall prey for these acts of seeming success only for their chil-dren and grand children to suffer, unless of course these businessmen, financial wizards and lawyers will leave the country for good to become citizens of some other country.

Come to think off it, this may already be the case. Should he be the all-powerful Filipino, it is be-cause the majorities that rule our country have stood by to watch it happen only to rally again and again not knowing what they do (let us not forget the red flags that are waved in rallies forever).

While Valdez’s superiors were quizzed on his where-abouts, Facebook revealed where he was. Valdez was actually in Boracay shar-ing his photos through his Facebook account.

“Mabuhay! NEHS’ 75 Pasyal sa Boracay, July 18-21, 2011” read the Facebook pictures that bore the dates when Valdez closed the Nueva Ecija Information Center.

“An institution like the PIA should not be debased by an employee who con-tinually fails to perform his duties and responsibili-ties and who easily turns his back away from public service when opportunities for personal pleasure arise,” the decision reads.

The case is considered to be a landmark case in the Philippine government service and one of the few administrative cases in the world that have used the internet to track and dis-cipline errant employees. (PIA)

Initial investigation showed that the husband killed his wife first before taking his own life.

The woman’s body was found sprawling on the

floor and bore a ligature strangulation mark on her neck while the husband’s was on a kneeling position with a wire tied to his neck and the other end fixed to a post inside the room, police report said.

“To my body of elders, Dear Brothers, I wrote this letter to inform you all that I voluntarily stepping down my privileges as one of the elders in our congregation due to the wrongdoings that I have been committing. It is sad that it happens to me but I know,” the statement of the suicide note recovered in the scene.

Authorities are now looking into the authenticity of the note and real motive of the incident.

of the alleged anomalies rigged DANECO.

At about 8:30 morning of Saturday, 29 June 2012, officials from NEA took over DANECO’s premises in Monte-vista, Davao del Norte.

Likely, the take-over was a micro-stereotype of EDSA I and II, there being the presence of the military, police, civil groups and the people.

The TRO ruled against former DANECO execu-tive’s TRO obtained from the Nabuturan Regional Trial Court (RTC) for lack of jurisdiction, having co-equal capacity with the NEA.

It can be recalled howev-er that the relieved DANE-CO executives managed their way against the NEA decision for a time by the said RTC’s TRO.

NEA’s Decision: At least 11 DANECO officials NEA removed from posts after

its judgement in the case, Administrative Case No. 01-10-11, finding them guilty of Grave Misconduct and Gross Neglect of Duty.

The decision included forfeiture of the said of-ficials’ retirement benefits and restitution of damages.

It may also file civil charges against the said officials, it further stated.

This the CA upheld.Earlier, DANECO power

consumers charged Board of Directors Dean C. Briz, Roberto C. Alam, Ananias B. Darjan, Roman C. Calicdan, Bredno T. Ceniza, Miguel F. Fernil, Roberto S. Binasbas, Eugenio S. Ramonida, Dan P. Gervacio, Ramon L. Zafra, Nelson N. Balangan and OIC-GM Felix P. Hibionada.

The complaints, which the NEA ruled against the said executives included misappropriation of co-operative funds, entering into anomalous contracts grossly prejudicial to mem-ber-consumers, usurpation of powers and functions, grave abuse of authority and discretion, gross dishonesty and misconduct and gross dereliction of duty.

Balance of p ower : DANECO power consum-ers sought for no less than Secretary Jose Rene D. Al-mendras, Department of Energy (DOE), in-order to intervene, there being the police force detailed in the cooperative premises.

According to Clint Pa-cana, Executive Director of AMRECO, the police offi-cers are among the reasons that NEA officials could not enter DANECO’s adminis-tration office.

Member-consumers however confirmed that the presence of the police force was under the auspices

of Tagum City local govern-ment executive, Mayor Uy.

Pacana, on the other hand, bewailed over the political motives behind the attempts to control the cooperative.

He blamed it on the DANECO eliminated ex-ecutives to be subservient to their political benefac-tor at the expense of the member-consumers.

Hence, the DANECO ousted officials have suc-ceeded at railroading the sale of Samal Island to Aboitiz group during a pre-mature general assembly the said cooperative officials organized last Sunday, 30 July 2012.

They claimed to have been attended with some eight thousand (8,000) members, it was further learned.

Among other things the said assembly made to ap-prove were the Articles of Cooperation and By-laws and the conversion of meter deposit as capital.

Earlier, the said relieved cooperative officials grind for DANECO’s accreditation from Cooperative Devel-opment Authority (CDA). This now becomes illegal, according to Oclarit.

Almendras, on his part, summoned for the presence of the military to ensure the balance of power while expecting the CA’s TRO to be served during the day.

Horrible as scenario may seem to be, but it did serve the purpose to maintain peace, AMRECO lawyer Atty. Oclarit said.

They (removed DANE-CO executives) may have succeeded at misleading the people, everything there is null and void, he further said.

“We may file motion for contempt against the said executives,” Oclarit added.

Role of AMRECO: Be-ing the convenor of the Mindanao’s thirty six (36) rural electric cooperatives, AMRECO leadership has instituted all legal means to hold DANECO in the interest of the people, the member consumers, Pacana said.

Besides, it has carried a sole obligation for the people, ordained by the Constitution and By-laws drafted by the said power federation and the intents of its creators way back in the Martial Law era, beyond personal interest and politi-cal motives, according to Pacana.

AMRECO legal counsel and head of its advocacy component Atty. Oclarit stated the legal works to obtain the CA’s TRO was never easy.

“In fact, I never expected it (TRO) would come out a little earlier than the end-game of all manoeuvres belonging to the relieved DANECO executives with Tagum City local admin-istration backing them,” Oclarit further stated.

He further said that he owe it to the prompt re-sponse of Secretary Almen-dras instituting all means in his capacity for the member-consumers’interest.

Oclarit also credited the struggle to 1-Care Party List whose leader-ship maximized its wide alliances connecting the weak member-consumers to concerned government officials and groups.

Returning the favors: In behalf of AMRECO, 1-Care Party List and DANECO member-consumers, Pa-

cana expressed gratitude to Secretary Almendras, the military, the Court of Ap-peals (CA) based in Cagayan de Oro City, NGO’s and church organizations.

“If not only because of them, we could not have also succeeded,” the AM-RECO Executive Director added. (CRUZCENE T. MOLLEJON, N.G. News)

Guerilla Front 88, North Central Mindanao Regional Committee of the CPP/NPA, he added.

“The CNNs were just trying to sabotage the developmental efforts in the province, a criminal kkkkkkkoffense against the law and the people. Appar-ently, they are not helping the community to become progressive but instead mak-ing the lives of the populace become miserable,” Col Albano stated.

Earlier, the NPA has been accused of burning three copra-carrying trucks along the national road in Brgy Puntod, Alegria, Surigao del Norte.

For his part, Lt. Col. Jose Leonardo B. Gille, commanding officer of the 26th Infantry Battalion, also condemned the NPAs for committing a series of heinous activities to infuse fear, among the populace.

He called on the Fili-pino people “to be more courageous in informing us immediately if you have observed the presence of NPAs in your area, in order to stop them from in hurting and destroying our nation. We should not allow these criminals to suppress every-one’s rights to live freely and peacefully in the province.”

AFTER Cagayan de Oro City was devastated by typhoon Sendong on December 16 last year, rivers became

shallow, which now needs dredging to prevent another disaster and to save lives and properties. Last June 28, the dredging of Cagayan de Oro River has started with DPWH-10 Regional Director Evelyn Barroso witness-ing it. The dredging works started at the mouth

of the Cagayan de Oro River, along barangay Bonbon and move towards the upstream portion of the river. The dredging operation is undertaken by Administration with initial available funding of P610,000.00. The DPWH regional office will directly supervise the project in coordination with the Cagayan de Oro City First District En-gineering Office. Spoil/containment area of materials is at barangay Bonbon thru a

Barangay Resolution approved by Barangay Captain Allan Mabalacad. Permit from Maritime Industry Authority (MARINA) is already at hand while the Environmental Clearance from the Department of Envi-ronment and Natural Resources (DENR) Region 10 is already on process. Even as the office is waiting for the approval of the DENR Environmental Clearance, the dredg-ing equipment was already positioned since the accessories were already in place.
