BEING a bylaw of the VillaSe of Milo in the province of Atberta, to amend Sylaw No. 397-17 being themunicipal Land Use 8ylaw.

WHER€AS the Council of the Village of Milo desires to r.rpdate and enhance administrative proceduresand standards of tand lJse Bylaw No. 397-17 to be in compliance with the modernized MunicipalGovernment Act {MGA), add regurations to manage cannabis production and retair sares inconsideration of federal and provincial laws coming into effect to legalise aannabis !se, remove therequirements for individuar arternative energy instarations from requiring a permit and arso add criteriafor residential fencing .

AND wH€REAs the generar purpose of the proposed amendments described in schedur€ ,}( and ,8, are

to:

. Add rules and criteria pertaining to the receivin& processing, and notification of developmentand subdivision applications as well as appeal timelines in order to be in compliance with theMGA, with allproposed amendments as described in attached Schedule ,A,.

. Amend and add Cannabis production Facility as a use and provide criteria and standards forCannabis Production Facilities, wjth all proposed amendments as described in attachedSchedule'B'

. Add minimlrm requi.eanents and standards applicable to Retail Cannabis Stores that will beconsidered by Village Council in making a decision on a development permit applicatjon for suchuses, with all p.oposed amendments as described in attached Schedule ,8,.

' Add defiritions to part 6 for cannabis, cannabis Accessory, cannabis production Facirities andRetail Cannabis Stores, with all proposed amendments as described in attached Schedule ,8,.

' Exempt individual alternative energy instairations which meet the criteria of the land use byrawfrom the requirement of a development permit application and approval.

. Add additional criteria for res;dential fencing, with all propos€d amendments as d€scribed inattached Schedule'8,.

AND WHEREAS the municipality must prepare an amending bylaw and provide for it5 consideration at apublic hearing.

NOW THEREFORE, under the authority and subject to the provisions of the Municipal Governmenl Act,Revised Statutes of Alberta ZOOO, Chapter M-26 as arhended, the Council of the Vjllage ol Milo, in theProvince ofAlberta, duly assembled does hereby enact the foltowing:

1. Eylaw No. 397-17 being the Land Use Bylaw, is hereby amended by Bylaw 403-18 to include thearnendments as descr;bed in the attached Schedule ,A,.

2. Bylaw No.397-17 beinE the Land Use Bytaw, is hereby amended by Bylaw 403-18 to include theamendmeols as desaribed in the attached Schedule ,8,.

3- That Table 2.2.1: Use Table, section 2 Use Table, Schedule 2 Use Regulation is amended to include"Cannabis-retail store,, as a ..tjse Type., in the,,RetailSales and service,, Commercial use categoryand classified as a Discretionary Use ,,0,, in the Commercjal- I land Use District-

4. That Table 2.2.1: Use Table, section 2 Use Table, Schedule 2 Use Regulaflon is amended to inctude"Caonabis production facility', as a ,,Use Type,, In the ,.Othe/, lndustrial use cate8ory and classifiedas a Discretionary Use "D,,in the tndustrial_ I Land lJse District.

5. That Table 2.2-1: Use Table, section 2 Use Table, Schedule 2 Use Retulation is amended to delete"Alternative e ergy, individual" as a ,,Use
