BACKGROUND INFORMATION:

West Wits MLI (Pty) Ltd (West Wits) appointed Malan Scholes Consulting (Pty) Ltd (MSC) to facilitate the necessary

regulatory processes that are required to form part of two Mining Permit Applications and one Mining Right

Application processes (please see attached locality map).

The Two Mining Permit Applications:

West Wits Mining MLI (Proprietary) Limited (West Wits) has started the environmental assessment processes that

form part of the two mining permit applications to the Department of Mineral Resources (DMR) for the Kimberly

West and Creswell Park opencast areas. The mining permit opencast areas would each be mined and rehabilitated

within one to two years.

On behalf of West Wits, Malan Scholes Consulting (Pty) Ltd (MSC) appointed Elemental Sustainability (Pty) Ltd

(Elemental-S) to undertake the Environmental Authorisation Application processes that form part of two proposed

opencast mining areas that are less than five hectares, namely the Kimberley West opencast pit and Creswell Park

opencast pit. Elemental-S is the independent Environmental Assessment Practitioner (EAP) responsible for compiling

the two separate Basic Assessment (BA) Reports which includes the Environmental Management Programme

(EMPr), and incorporating all necessary environmental specialist studies into the two separate BA Reports. Whereas,

SLR Consulting (South Africa) (Pty) Ltd (SLR) are playing a support role in the Public Participation Process.

The One Mining Right Application:

West Wits have also lodged one Mining Right Application (MRA) to the DMR for the remainder of the proposed

West Wits Mining Project (WWMP). This will involve opencast mining and the rehabilitation of five opencast pits

areas, as well as the refurbishment of three existing underground shafts and infrastructure. The opencast pits that

form part of the MRA will be mined within three to five years. Whereas, the refurbishment of longer term

underground mining operations on the Main/South Reef and the Kimberley Reef horizons is planned for Year six to

Year 30.

process. SLR is responsible for compiling the Scoping Report and facilitating and incorporating all necessary

environmental specialist studies into the Environmental Impact Assessment (EIA) Report which includes the EMPr

for the proposed opencast and underground mining activities within the mining right application area. SLR is also

responsible for facilitating the Public Participation Process.

CURRENT STATUS:

The Two Mining Permit Applications:

Compilation of the BARs and incorporation of the necessary environmental specialist studies is currently underway.

studies have been completed. Please take note that comments can however be submitted throughout the

regulatory process. The public will be informed of the deadline to submit comments on the BA and EIA Reports.

Attorneys to facilitate the necessary regulatory processes that are required to form part of two (2) Mining Permit

Applications and one (1) Mining Right Application.

The Two (2) Mining Permit Applications:

West Wits Mining MLI (Proprietary) Limited (West Wits) has started the environmental assessment processes that

form part of the two (2) mining permit applications to the Department of Mineral Resources (DMR) for the Kimberly

West and Creswell Park opencast areas. The mining permit opencast areas would each be mined and rehabilitated

within 1 to 2 years.

On behalf of West Wits, Malan Scholes Consulting (Pty) Ltd (MSC) appointed Elemental Sustainability (Pty) Ltd

(Elemental-S) to undertake the Environmental Authorisation Application processes that form part of two (2) proposed

opencast mining areas that are less than 5 hectares, namely the Kimberley West opencast pit and Creswell Park

opencast pit. Elemental-S is the independent Environmental Assessment Practitioner (EAP) responsible for compiling

the two (2) separate Basic Assessment Reports (BARs) and incorporating all necessary environmental specialist

studies into the two (2) separate BARs. Whereas, SLR Consulting (South Africa) (Pty) Ltd (SLR) are playing a support

role in the Public Participation Process.

Status on the two (2) Mining Permit Applications: (namely Kimberley West opencast pit and Creswell Park opencast pit)

• Elemental-S is the lead EAP with SLR play a supporting role in the Public Participation Process • The BARs have not yet been placed out for public review yet, as the independent specialists have not yet

The One (1) Mining Right Application:

West Wits have also lodged one (1) Mining Right Application (MRA) to the DMR for the remainder of the proposed

West Wits Mining Project (WWMP). This will involve opencast mining and the rehabilitation of five (5) opencast pits

areas, as well as the refurbishment of three (3) existing underground shafts and infrastructure. The opencast pits that

form part of the MRA will be mined within 3 to 5 years. Whereas, the refurbishment of longer term underground

mining operations on the Main/South Reef and the Kimberley Reef horizons is planned for Year 6 to Year 30.

On behalf of West Wits, Malan Scholes Consulting (Pty) Ltd (MSC) appointed SLR Consulting (South Africa) (Pty) Ltd

(SLR), as the independent Environmental Assessment Practitioner (EAP) to undertake the Environmental

Authorisation Application process. SLR is responsible for compiling the scoping report and facilitating and

incorporating all necessary environmental specialist studies into the Environmental Impact Assessment Report (EIR)

and the Environmental Management Programme Report (EMPr) for the proposed opencast and underground mining

activities within the mining right application area. SLR is also responsible for facilitating the Public Participation

Process.

Notwithstanding this, our client has concerns in respect of the environmental consequences of such applications, among others.

4. We have been instructed to advise our client and to act on its behalf throughout the respective application processes, and seek hereby to come on record on behalf of our client.

5. We have been provided with copies of the background information documents ("BID") for each of the mining permits application and the mining right application respectively. We would like to request from West Wits the following additional information:

5.1 a copy of the Prospecting Right;

5.2 proof of the conversion of the Prospecting Right from the old order prospecting right under reference MPT No. 29/2016;

Dino, as a property development company, did not have the skills to discharge the obligations under the

Directive and appointed Mintails Soweto Cluster (Pty) Ltd, defined as Mintails and West Wits MLI (Pty) Ltd,

defined as West Wits, to carry out the rehabilitation activities prescribed in the Directive. West Wits are

1. We refer to our correspondence dated 10 May 2018 and 23 May 2018, to which we have

received no substantive response to date. All defined terms herein shall bear the

meanings ascribed to them in the above correspondence.

2. We wish to record that your and West Wits' continued failure to acquiesce to our client's

requests for information is jeopardising our client's ability to meaningfully engage with and

comment on the reports and processes being published by West Wits for the purposes of

its mining right and mining permit applications, which failure will negatively impact on

West Wits' compliance with due process and which will be brought to the competent

authority's attention.

3. Accordingly, we have been instructed to reiterate our client's request for the following

documentation:

3.1 a copy of the Prospecting Right;

3.2 proof of the conversion of the Prospecting Right from the old order prospecting right under reference MPT No. 29/2016; and

3.3 proof of the consent under section 11 of the Mineral and Petroleum Resources Development Act, 2002 obtained from the Department of Mineral Resources for

4. We wish to further request the following information, pursuant to our review of the Initial

Scoping Report for the Proposed West Wits Mining Project, submitted as part of the

application process for environmental authorisation in terms of the National Environmental

Management Act, 1998 ("NEMA") and the National Environmental Management Waste

Act, 2008 in respect of listed activities that have been triggered by applicants in terms of

the MPRDA, prepared by SLR Consulting (South Africa) Proprietary Limited as the

responsible environmental assessment practitioner, which report was published for public

comment on 17 May 2018 ("Initial Scoping Report"):

4.1 a copy of the NEMA directive in respect of the Solplaatjie operation, referred to at page v of the Initial Scoping Report; and

4.2 a copy of each of (i) the mining right application; and (ii) the integrated environmental authorisation and waste management licence application lodged at the DMR on 9 April 2018 under DMR reference number GP 30/5/1/2/2 (10068) MR, as referred to at page 5 of the Initial Scoping Report.

Applications and one (1) Mining Right Application.

The Two (2) Mining Permit Applications:

West Wits Mining MLI (Proprietary) Limited (West Wits) has started the environmental assessment processes that

form part of the two (2) mining permit applications to the Department of Mineral Resources (DMR) for the Kimberly

West and Creswell Park opencast areas. The mining permit opencast areas would each be mined and rehabilitated

within 1 to 2 years.

On behalf of West Wits, Malan Scholes Consulting (Pty) Ltd (MSC) appointed Elemental Sustainability (Pty) Ltd

(Elemental-S) to undertake the Environmental Authorisation Application processes that form part of two (2) proposed

opencast mining areas that are less than 5 hectares, namely the Kimberley West opencast pit and Creswell Park

opencast pit. Elemental-S is the independent Environmental Assessment Practitioner (EAP) responsible for compiling

the two (2) separate Basic Assessment Reports (BARs) and incorporating all necessary environmental specialist

studies into the two (2) separate BARs. Whereas, SLR Consulting (South Africa) (Pty) Ltd (SLR) are playing a support

role in the Public Participation Process.

Status on the two (2) Mining Permit Applications: (namely Kimberley West opencast pit and Creswell Park opencast pit)

• Elemental-S is the lead EAP with SLR play a supporting role in the Public Participation Process • The BARs have not yet been placed out for public review yet, as the independent specialists have not yet

The One (1) Mining Right Application:

West Wits have also lodged one (1) Mining Right Application (MRA) to the DMR for the remainder of the proposed

West Wits Mining Project (WWMP). This will involve opencast mining and the rehabilitation of five (5) opencast pits

areas, as well as the refurbishment of three (3) existing underground shafts and infrastructure. The opencast pits that

form part of the MRA will be mined within 3 to 5 years. Whereas, the refurbishment of longer term underground

mining operations on the Main/South Reef and the Kimberley Reef horizons is planned for Year 6 to Year 30.

On behalf of West Wits, Malan Scholes Consulting (Pty) Ltd (MSC) appointed SLR Consulting (South Africa) (Pty) Ltd

(SLR), as the independent Environmental Assessment Practitioner (EAP) to undertake the Environmental

Authorisation Application process. SLR is responsible for compiling the scoping report and facilitating and

incorporating all necessary environmental specialist studies into the Environmental Impact Assessment Report (EIR)

and the Environmental Management Programme Report (EMPr) for the proposed opencast and underground mining

activities within the mining right application area. SLR is also responsible for facilitating the Public Participation

Process.

Background Information:

West Wits MLI (Pty) Ltd (West Wits) appointed Malan Scholes Consulting (Pty) Ltd (MSC) and not Malan Scholes

Attorneys to facilitate the necessary regulatory processes that are required to form part of two (2) Mining Permit

Applications and one (1) Mining Right Application.

The Two (2) Mining Permit Applications:

West Wits Mining MLI (Proprietary) Limited (West Wits) has started the environmental assessment processes that

form part of the two (2) mining permit applications to the Department of Mineral Resources (DMR) for the Kimberly

West and Creswell Park opencast areas. The mining permit opencast areas would each be mined and rehabilitated

within 1 to 2 years.

On behalf of West Wits, Malan Scholes Consulting (Pty) Ltd (MSC) appointed Elemental Sustainability (Pty) Ltd

(Elemental-S) to undertake the Environmental Authorisation Application processes that form part of two (2) proposed

opencast mining areas that are less than 5 hectares, namely the Kimberley West opencast pit and Creswell Park

opencast pit. Elemental-S is the independent Environmental Assessment Practitioner (EAP) responsible for compiling

the two (2) separate Basic Assessment Reports (BARs) and incorporating all necessary environmental specialist

studies into the two (2) separate BARs. Whereas, SLR Consulting (South Africa) (Pty) Ltd (SLR) are playing a support

role in the Public Participation Process.

Status on the two (2) Mining Permit Applications: (namely Kimberley West opencast pit and Creswell Park opencast pit)

• Elemental-S is the lead EAP with SLR play a supporting role in the Public Participation Process • The BARs have not yet been placed out for public review yet, as the independent specialists have not yet

completed their assessments • The anticipated review periods will be in June and July 2018 • Please send all comments to [email protected] and/or to

West Wits have also lodged one (1) Mining Right Application (MRA) to the DMR for the remainder of the proposed

West Wits Mining Project (WWMP). This will involve opencast mining and the rehabilitation of five (5) opencast pits

areas, as well as the refurbishment of three (3) existing underground shafts and infrastructure. The opencast pits that

form part of the MRA will be mined within 3 to 5 years. Whereas, the refurbishment of longer term underground

mining operations on the Main/South Reef and the Kimberley Reef horizons is planned for Year 6 to Year 30.

On behalf of West Wits, Malan Scholes Consulting (Pty) Ltd (MSC) appointed SLR Consulting (South Africa) (Pty) Ltd

(SLR), as the independent Environmental Assessment Practitioner (EAP) to undertake the Environmental

Authorisation Application process. SLR is responsible for compiling the scoping report and facilitating and

incorporating all necessary environmental specialist studies into the Environmental Impact Assessment Report (EIR)

and the Environmental Management Programme Report (EMPr) for the proposed opencast and underground mining

activities within the mining right application area. SLR is also responsible for facilitating the Public Participation

Process.

Status in the one (1) Mining Right Application:

It is just a pity that West Wits Mining has already begun operations in the affected areas such as Sol Plaaitjies are in

full swing(just outside Roodepoort CBD)

Your client has little or no regard for the law. They have made promises to people in Sol Plaaitjies of housing, etc. It

is underhanded and disgusting.
