R-1 Deferred Items – (None)
A. Sugarman & Susskind demand letter Re: Amada Gonzalez – Mr. Kaufman said that he had advised Ms. Gonzalez prior to the meeting coming
to order that he had not spoken to Ron Cohen regarding Mr. Cohen’s
agreement to represent Ms. Gonzalez. He said that he would not
move forward with the case until he received confirmation from Mr.
Cohen.
R-2 New Items
A. Funding for HR Specialist in Benefits Division – The Trustees
reviewed the legal opinion provided by the Board’s counsel
regarding the City’s Human Resource department’s request to have
MBERP and the Miami Beach Police & Fire pension plan fund an HR
specialist position each contributing 50% or approximately $45,000.
The legal opinion stated that funding the City HR position may
violate the Boards’ fiduciary duties because the position is solely
responsible for administering health insurance benefits to City
retirees and not with the administration, operation, or management
of the Funds or pension benefits. A discussion ensued. The Board
decided to take no action on this matter.
B. Presentation of 10/01/2017 Actuarial Valuation by the Fund’s
Actuary Melissa Moskovitz from GRS - Ms. Moskovitz went over the
discussion of valuation results on page 1 of the report. She said
that there had been a slight decrease of approximately $28K in the
required city contribution amount compared to last year going from
$31,892,485 to $31,864,304. She said that the investment rate
assumption was lowered from 7.65% to 7.60% and will continue to be
ratcheted down to 7.4% by 10/1/2019. A discussion ensued regarding
what the Florida Retirement System’s (FRS) investment return
assumption currently was. Chairman Boyd said that FRS’ investment
return assumption was 7.5%. Trustee Woodruff felt the Board should
revisit the lowering of the investment return assumption beyond
FRS’ 7.5%. A discussion ensued.
Ms. Moskovitz went over the actuarial experience of the Plan. She
said that the Fund had not commissioned an experience study since
2010. She said that it was recommended that pension plans run an
experience study every 6-8 years. Ms. Moskovitz said that the
study was comprised of looking at each assumption individually,
collecting actual experience from the past (5-10 years), comparing
it to the current assumption and determining whether a change
should be made. A discussion ensued. The Chairman asked Ms.
Moskovitz the cost of an experience study. She said the cost was
approximately $20K. Ms. Moskovitz was instructed to send an
engagement letter to the Administrator and the Administrator was
directed to place the experience study engagement letter on the
Board agenda for the Board to approve.

Ms. Moskovitz continued to go over the valuation report including
the 10 year projection of actuarially determined contributions and
funded ratio. She also discussed the possibility of reducing the
UAAL amortization period. She said this information would be
included in the experience study. Ms. Moskovitz reviewed the
smoothing method and development of actuarial value of assets. She
continued to go over the valuation report.
A motion was made by Ms. Bernstein duly seconded by Mr. Casanova,
and with all in favor, it was unanimously
RESOLVED that the Plan’s Actuarial Valuation dated October 1,
2017 be approved as presented.
R-3 Administrator’s Report
The Administrator shared information with the Board that a local
municipality had reached out to him for pension consulting and
services. He said that he would be remunerated if he accepted the
request. He said that this work would not interfere with his day
job. The Chairman said that MBERP did not have an outside
employment policy like the City of Miami Beach. The Administrator
said that he felt the matter should be disclosed. A discussion
ensued. Mr. Kaufman, the Board’s legal counsel, said that there
was no conflict of interest and the information had now been
properly disclosed.

Bernstein duly seconded by Mr. Casanova and unanimously
