DESCRIPTION

This annual report highlights the main events that were undertaken in 2013 under the METRO (Institute for Transnational Legal Research, Maastricht University) umbrella. It therefore contains an overview of all meetings, publications and other noteworthy information. Publications of the METRO researchers are highlighted, but also the various activities mentioned above, more particularly publications within the Maastricht Journal of European and Comparative Law as well as within the Ius commune Europaeum book series and the Ius Commune casebooks for the common law of Europe. Also the ongoing and initiated research projects by METRO are mentioned in this annual report.

Foreword!Michael Faure!

!Metro is the Institute for Transnational Legal Research (Maastricht Europees Instituut voor Transnationaal Rechtswetenschappelijk Onderzoek), founded as the Faculty Research Institute in September 1991. The goal of METRO was and is to bring together the international, European and comparative research within the law faculty of Maastricht University and to stimulate and facilitate this type of research. As a result, METRO on the one hand organizes many (usually international) conferences where the METRO secretariat provides facilitation and support; METRO also facilitates the faculty research by running the M a a s t r i c h t J o u r n a l o f E u r o p e a n a n d C o m p a r a t i v e L a w

(www.maastrichtjournal.eu). The Maastricht Journal already exists since 1993 as a result of which in 2013 the 20th issue could be published. In addition, METRO publishes the Ius Commune Europaeum book series (www.iuscommune.eu) in which meanwhile more than 120 books have been published. !METRO undertakes high quality international academic research in the fields of law and economics, accident law, environmental law and especially climate change. !In 2007, Metro initiated the METRO seminar series. These METRO seminars are scheduled on Wednesdays during lunchtime on a monthly basis. Seminars provide an academic forum in which Metro-related scholars present their current research and gain instant feedback from their colleagues. These seminars are open to all members of the faculty. More info, see: maastrichtuniversity.nl/metro/research. !METRO is also the host for the Ius Commune Casebooks for the Common Law of Europe. Within that Casebook series many books were published under the inspiring leadership of Prof. Dr. Walter Van Gerven. !This annual report highlights the main events that were undertaken in 2013 under the METRO umbrella. It therefore contains an overview of all meetings, publications and other noteworthy information. Publications of the METRO researchers are highlighted, but also the various activities mentioned above, more particularly publications within the Maastricht Journal of European and Comparative Law as well as within the Ius Commune Europaeum book series and the Ius Commune Casebooks for the Common Law of Europe. Also the ongoing and initiated research projects by METRO are mentioned in this annual report.

METRO also attempts to be an international inspiring academic environment for many visiting researchers from abroad. Not only are the PhD researchers from METRO increasingly coming from a variety of continents (including Asia and Africa); METRO is also receiving many visitors. All of these widely varying activities are mentioned in this annual report. !We very much hope that you find the information provided in this report of interest and inspiring. Ongoing Contract Research!!

!EFFACE - a research project on environmental crime!!Type of project: FP7 Collabarative project Title: EFFACE – European Union Action to Fight Environmental Crime Coordinator: Ecologic Institute. The website of EFFACE, the FP7 project on Environmental Crime in which Metro participates, is now online! Please visit: www.efface.eu (also for information on its Twitter account). Metro will lead one of the work packages and participate in several others. Abstract: Environmental crime is a threat to environmental, social and economic sustainability and is in conflict with key commitments and strategies of the European Union, including the Europe 2020 Strategy. EFFACE will propose effective and feasible policy options for the EU to combat environmental crime. The recently adopted Environmental Crime Directive, the Ship-Source Pollution Directive, and the new provisions of the Lisbon Treaty have created new instruments and opportunities for increasing the effectiveness of EU measures against environmental crime through harmonisation and co-ordination. However, utilisation of these opportunities suffers from a serious lack of information on environmental crime: e.g. harmonisation measures based on the new Article 83(2) TFEU depend on the availability of reliable information on the impacts of environmental crime. EFFACE will help to address this gap by generating relevant information. Drawing on a combination of quantitative and qualitative approaches and data and an in-depth investigation of different types of environmental crime, EFFACE will provide an assessment of the main costs, impacts and causes of environmental crime in the EU, including those linked to the EU, but occurring outside its territory, complemented by a comprehensive analysis of the status quo in terms of existing instruments, actors and institutions. A SWOT analysis will identify strengths, weaknesses, threats and opportunities associated with the EU’s current efforts to combat environmental crime. Feasible policy options for harmonisation and better co-ordination of actors will then be developed with the help of, i.a., typologies of different approaches to harmonisation, sanctioning and strategic enforcement. These policy options will consider the use of policy mixes and innovative approaches to govern such mixes. Stakeholder involvement in EFFACE through interactive policy analysis will promote mutual learning with and among a broad range of stakeholders. Abstract: At the policy level, the desire was formulated to develop a regime which would guarantee compensation to victims in case of an incident with an offshore facility. In addition to the goal of victim compensation, the need to provide financial security (both to operators as well as to victims) was stressed. Hence, the questions central to this project can be formulated as follows: - To what extent can liability play a role in both aiming at prevention of accidents and at compensating victims of offshore oil and gas activities,focusing both on environmental damage as well as on traditional damage? - How should such a civil liability regime be shaped to make civil liability efficient, effective and insurable? - What options do currently exist for liable operators to cover the costs resulting from such liabilities and which mechanisms (such as compensation funds, solvency guarantees, insurance or risk sharing agreements) either exist or can be developed to reach that goal? - How can mechanisms be developed to make an early compensation of victims after the accident possible? Background is Article 9 of the Aarhus Convention on Access to Information, Public Participation in Decision-making and Access to Justice in Environmental Matters, which under the “third pillar” calls for a reasonable entitlement to access (locus standi) and reasonable conditions of access (i.e. fair and effective procedures in terms of time and costs). Ontwikkeling onderwijsProgramme Afrikaans Milieurecht Togo-Benin !A b s t r a c t : I n j u n i 1 9 9 7 w e r d e e n samenwerkingsovereenkomst gesloten tussen de universiteiten van Maastricht, Luik, Cotonou (Bénin) en Lomé (Togo) tot het ontwikkelen van een postdoctorale opleiding in het milieurecht en het milieubeleid. Primaire doelstelling van het project is het ontwikkelen van kennis van het milieurecht en het milieubeleid en de toepassing daarvan in de context van de milieuproblematiek in Franstalig Afrika. Teneinde deze doelstelling te verwezenlijken dient enerzijds jaarlijks een éénjarige Master Course te worden georganiseerd op het terrein van het milieubeleid en milieurecht in Franstalig Afrika. Anderzijds dient een (regionaal) kenniscentrum voor milieurecht te worden opgezet, teneinde studenten en wetenschappers de mogelijkheid te geven hun kennis op het gebied van het milieurecht verder te ontwikkelen.
