I. EXECUTIVE SUMMARY

A. REGIONAL DIRECTOR’S REPORT

The Office attained an overall Annual Accomplishment of 160%. This, despite the number of resignations of our personnel to seek greener pastures and the demise of key personnel. Activities which were mainly due to the nature of these being clientele-dependent were a major factor in the attainment of the annual accomplishment. MGB-10 presented its issues and concerns and update of accomplishment at the DENR-10 Reprogramming Workshop in May and in the Mid-Year Assessment in July. The 2008 budget proposal as well as the proposed capital outlay was presented at the NEDA-10 on May 30. As an active member of the Regional Disaster Coordinating Council-10, MGB-10, the focal point of DENR-10 to the RDCC, hosted the regular monthly meeting of the RDCC Technical Management Group on April 27. MGB-10 was at the forefront of DENR-10 activities during the observance of Women’s Month in March and Environment Month in June. Our personnel attended seminars and trainings to enhance their capabilities in their respective fields of endeavor. Our technical personnel attended the National DENR-EMB Inter-Comparison Exercise for Laboratory Analysts held at the DENR-EMB-10 Laboratory in Cagayan de Oro City on October 15-24. Our supervisors attended the Supervisory Development Course Tracks II and III conducted by the MGB-Central Office in Mandaluyong City on December 3-6. As part of the technology transfer program of the Lands Geological Survey Division-MGB-Central Office, chemists from the PETROLAB-Central Office conducted a training-workshop on the application of spot tests for the identification of minerals to our technical personnel held at the DENR-EMB-10 Laboratory on December 12-13. Our geoscientists continued with their mandate on carrying the national program on Geohazard Assessment even to far-flung barangays. Likewise, in support of the President’s agenda, our geoscientists conducted Geo-Resistivity survey to provide potable water to concerned LGUs. Our mining engineers continued with their mandate to revitalize the mining industry. Carrying with them our mission to promote responsible

mining and environmental laws, our IEC-SDMP Unit enlightened our countrymen on the salient features of the Mining Law especially on the rights of affected communities. During the conduct of IEC review and action planning workshop for MGB and EMB Information Officers and Community Affairs Officers and DENR Regional Public Affairs Officers held in Calatagan, Batangas on December 11-13, Ms. Liza Socorro J. Manzano, MGB-10 IEC-SDMP Unit Chief, was elected president of the organization tasked to spearhead the IEC campaign particularly on mining and minerals development and geohazards awareness.

B. OPERATIONS 1. MINE MANAGEMENT DIVISION The Mine Management Division is keeping pace with the country’s thrust in promoting mining investment in the country. The region is potentially mineralized, thus, the significant influx of mining rights applications in the region. Despite its being undermanned, the Division continuously makes effort to assist mining rights applicants in complying with their requirements.

There were thirty-two (32) new Exploration Permit Applications processed. An application for Mineral Production Sharing Agreement filed by Mr. Epetacio D. Beltran, located at Magsaysay, Misamis Oriental, was approved by the Secretary and was registered in the region on May 23, 2007. There were four (4) approved applications for exploration permit, including Eagle Crest Mining Dev. Corp., Cypress Mining & Dev., Norte de Oro Mining & Industry Corp., and Glendale Mining & Dev. Corp. Other four (4) applications for MPPA & EPA were endorsed to the Central Office for approval. Most of the major activities were already accomplished and even exceeded the annual target. The number of Ore Transport Permits processed and issued was thirty-three (33), which is 250% of the annual target. Likewise, there were seventeen (17) accreditations issued which is 212% of the annual target. On the illegal mining activities acted/investigated, the Division has already accomplished more than 100%. This activity is clientele-dependent.

2. MINING ENVIRONMENT AND SAFETY DIVISION Targets of the Mining Environment and Safety Division for calendar year 2007 were accomplished through field inspection, monitoring, and investigations. The protection of the environment and the promotion of accident-free workplace in large- and small-scale mining operations are still the Division’s primary objectives. Accomplishments of the Division are the routinary safety inspection of three (3) large-scale companies namely, Iligan Cement Corporation (ICC), Mindanao Portland Cement Corporation (MPCC), and Holcim Philippines Manufacturing Corporation; AEPEP and SDMP monitoring; and monitoring of the four river systems (Iponan, Mandulog, Bigaan, and Tagoloan rivers) that are within the region. Basic Occupational Safety and Health (BOSH) Seminars were conducted at two different locations: first, to fifty-nine (59) participants on January 8-12 at the Holcim Training Center in Dalipuga. Iligan; and second, to twenty-eight (28) participants on June 18-22 at Iligan Cement Corporation (ICC) Training Hall in Kiwalan, Iligan City. The objective of the seminar is to ensure occupational safety and health knowledge in accident prevention and hazard detection and saving lives and property through accident prevention. The Division also conducted environmental and safety inspections on sand and gravel operations.

GEOSCIENCES DIVISION A rapid geohazard investigation was conducted to assess the reported occurrence of ground ruptures within the limestone quarry of Holcim Philippines Manufacturing Corporation-Lugait Plant in So. Angkalon, Brgy. Lower Talacogon, Lugait, Misamis Oriental. All stakeholders were invited by MGB-10 at the Sangguniang Bayan of Lugait on June 13 for the presentation of the findings, observations, and recommendations of Chief Geologist Juanito A. Manzano, Jr. These were again presented by Chief Geologist Manzano, who is the DENR-10 Disaster Action Officer, at the joint meeting of the RDCC-10 - PDCC-Misamis Oriental in Cagayan de Oro City on June 22. In response to the letter-request of the DepEd School Division Superintendent for the Province of Bukidnon to determine whether it is safe to hold classes at the Magsaysay Elementary School located at Brgy. Magsaysay, Kibawe, Bukidnon, a follow-up geohazard assessment was undertaken by Chief Geologist Manzano on June 14-15. The said school was affected by ground instability last year. An exit conference was conducted immediately after the assessment at the Magsaysay Barangay Hall to immediately inform local officials, representatives from DepEd-Bukidnon and CENRO-Don Carlos, and members of the Parent Teachers and Community Association, of the results of the assessment. Likewise, a rapid assessment of an area located at Purok-3 as a proposed school site was also undertaken. Geologist Beverly Mae M. Brebante was both Resource Person and Participant during the Water Search and Rescue (WaSAR) Training organized by RDCC-10 on April 25-29. Geologist Brebante completed the 3-day training course. Supervising Geologist and DENR-10 Alternate Disaster Action Officer Osin A. Sinsuat, Jr. was Resource Person on Geologic Hazards during the Seminar on Disaster Management for RDCC-10 Action Officers on March 15, and on SLF Site Selection to DENR-10 PENROs/CENROs on May 10. Supervising Geologist Marino B. Uncad conducted geohazard assessment on November 20 of the landslide and flash flood occurrences in Iligan City caused by typhoon Lando. Messrs. Uncad and Sinsuat attended the RDCC-10 meeting in Iligan City on November 22 presided by Her Excellency President Gloria Macapagal-Arroyo.

I. GENERAL ADMINISTRATION AND SUPPORT SERVICES Annual total budget for PS is P15,647,000.00 while the MOOE is P4,044,000.00.

total allotment for CY 2007 – P19,691,000.00. III. A. MINERAL LANDS ADMINISTRATION

1. Mining Industry Development Program No. of Permit Areas/Program Monitored (FTAA, MPSA, EP, ISAGP, MPP, MLC/PLC/LLC, THP (no.) A total of ten(10) approved Mining Rights and permit areas were monitored for the year, accomplishing 100% of the annual target.

Of the ten (10) permit areas monitored, three(3) are Mineral Production and Sharing Agreements (MPSAs). One of these MPSAs is that of MCCI under MPSA No. 105-98-XII. Stripping of fresh limestone was stopped since last November 2006 when the plant was shut-down. To date, only intermittent hauling of limestone from its quarry is undertaken for its clean-up operation. The permit area in Kiwalan, Iligan City is located about eight kilometers from the plant site of MCCI.

The MPSAs of Iligan Cement Corporation (MPSA permit no. 104-98-XII) and Mindanao Portland Cement Corporation (MPSA permit no. 031-95-XII) were also conducted to monitor compliance of their approved work programs. Iligan Cement Corp. is operating the quarry/permit area of Mindanao Cement Corp. through an accredited contractor, ANSECA-ACELCO. The permit area of Mindanao Cement Corp and Iligan Cement Corporation are located adjacent to each other in Kiwalan, Iligan City.

Monitoring was also conducted on three (3) Industrial Sand and Gravel (ISAG) – that of Uriel G. Borja covering approximately eight (8) hectares under ISAG permit no. IP-000004-X. During the conduct of the activity, there was extraction of sand and gravel within the permit area of the applicant.

For CY-2007, there were three(3) companies of permit areas monitored for AEPEP. These are Holcim Philippines-Lugait Plant, Iligan Cement (ICC), Mindanao Portland Cement Corporation (MPCC). On the other hand SDM monitored four (4) areas, which are Holcim Philippines-Lugait Plant; Iligan Cement Corp. (ICC) and Mindanao Portland Cement Corporation (MPCC); Maria Cristina Chemicals Inc. 7. Reported illegal mining activity at the applied area of CPO Mineral Resources Dev. Corp.

8. Illegal mining activity within the mining claims of CDO International Metal Corp. 9. Illegal mining activity within the applied area of Mr. Alfredo Roxas 10. Treasure-hunting activity at Jasaan, Misamis Oriental 11. Treasure hunting activity at Claveria, Misamis Oriental Accomplishment for this activity is dependent on complaints received. As early as June, the Division already accomplished its target for the entire year. Eleven (11) complaints were verified/investigated in response to letter-complaints on illegal mining/treasure hunting activities within the region. On January 10, this Office received through the Presidential Action Center, a complaint on the alleged gold tunnel at Villanueva, Misamis Oriental. Verification revealed that there was an activity at the reported area. However, there was no evidence found to confirm the existence of gold treasure except for talks of gold hidden underground. They were advised to secure a Treasure-Hunting Permit should they resume their activity. Another complaint investigated/verified by this Office was the reported treasure-hunting activity at the Municipality of Quezon, Bukidnon. The technical personnel who conducted the investigation found diggings beside the house. The owner was instructed to stop the operation and secure a Treasure-Hunting Permit from the MGB-10 before resuming activity. The third letter-complaint came from Cypress Mining and Development Corporation on the alleged illegal mining activities within their applied area for Exploration Permit. Investigation conducted showed that there were such activities but with Special Permits issued by the local government. The Special Permits were issued by the City Mayor of Cagayan de Oro for a period of six months. This Office received a letter-complaint from a certain Mr. Joel Penas on the alleged illegal mining activity of CDO International Metal Corporation at San Isidro, Manticao, Misams Oriental. The technical team found out that the area is within an application for small-scale mining permit still under process. There was no evidence of an alleged stockpile of chromite ore produced from the illegal activity of CDO International Metal Corporation. There was no actual excavation/extraction found except for an access road. The team recommended and advised the SSMP applicant to get consent from the EXPA area holder (CDO International Metal Corporation) as a requirement for the processing of the application. In the meantime, they were advised to refrain from mining activity until a permit is approved/granted. A letter-complaint was also received from the Kisanlu Homeowners Association of Iponan, Cagayan de Oro City on the alleged treasure-hunting activity outside the perimeter fence of the subdivision. The complaint was triggered by the homeowners’ fear that the cracks on the concrete road were the result of the illegal treasure-hunting

activity located at about fifty meters from the road. Upon investigation/verification, the team found an excavation outside the perimeter fence of the subdivision. Those involved have stopped their operation. Further investigation showed that there was no possibility of a horizontal opening. No timbers were even observed being brought to the area. The team instructed those concerned that a Treasure-Hunting Permit should be secured prior to resumption of activity.

This Office also responded to a letter-complaint from the OIC-ENRO of Misamis Oriental regarding the illegal activity of First Mineral Mining Ventures in Manticao and Opol, Misamis Oriental by sending its technical personnel to investigate allegations. During verification/investigation, there was nobody found in the area and no equipment was in sight. It was recommended that the alleged persons involved be called for a conference in the Office of the ENRO-Misamis Oriental for a conference to shed light on the alleged illegal activity. Another complaint received and acted was the alleged illegal mining activities within the Exploration Permit Application of CPO Mineral Resources Development Corporation located in the Municipality of Impasug-ong, Province of Bukidnon.

The technical personnel from MGB-10 and BENRO Samuel Cadavos conducted ocular inspection and found that out that there were two sites operated through small-scale mining operations. The first area was allegedly covered by a small-scale mining permit, however, no activity in the subject area was observed during the inspection. Furthermore, it was found out that the area of operation is outside the Small-Scale Mining permit area hence they were advised to amend their applied area. It is also outside the CPO EPA application. The second site was in the northern boundary of the CPO applied area. There was no operation during the inspection. They were also advised to refrain from any operation until a permit is granted. The Governor of Bukidnon gave instructions to stop illegal operations. A Cease-and-Desist Order was recommended by the team to be issued by the Governor to the persons involved.

A complaint from CDO International Metal Corporation on nickel laterite illegal activity within their applied area for Exploration Permit located in Manticao, Misamis Oriental, prompted this Office to send its technical personnel to investigate the reported illegal activity. Investigation revealed that clearing and drilling was indeed conducted in the area and the persons involved were stopped and their equipment removed from the area.

Investigation was also conducted within the mining claim of Mr. Alfredo Roxas on the basis of complaint received by this Office on the operation of First Mineral Mining Ventures using heavy equipment, particularly a backhoe. Result showed that the actual area operated during investigation/verification was in Aileen area situated within the mining claims of Global Hennessey. The persons involved were advised to remove their equipment from the area and to refrain from illegal activity.

Lastly, a reported two (2) illegal treasure-hunting activity. One(1)in Jasaan, Misamis Oriental was acted by the CENRO of Misamis Oriental who conducted the investigation and stopped the illegal activity with the assistance of the local police. On evaluation of the report made by the CENRO, a recommendation was made of the issuance of a cease-and-desist order to the concerned even if the activity was already stopped.Another illegal treasure hunting activity was at Claveria, Misamis Oriental was stopped and required to apply for a permit. Another three (3) complaints filed and taken up during CMRB meeting with the complainant such as Pacheco U. Bartolome against Orex, Mindanao Inc.; Fe Bylen A. Lagat against Orex; and Don Mickel F. Tamula against Orex.

GENDER AND DEVELOPMENT

Women’s Month 2007 celebration in the DENR gained added significance with the memorandum from then DENR Undersecretary for Special Project Concerns/Social Mobilization and Chairperson, National Gender and Development Focal Point System, Teresita Samson-Castillo dated 5 February, directing all DENR offices to conduct GAD-related activities for their employees and clientele and to submit these activities for the celebration of Women’s Month 2007 to the NGADFPS Secretariat, with this year’s theme, “CEDAW ng Bayan: Kabuhayan ng Kababaihan!”. In relation to the memo, Dr. Corazon B. Galinato, DENR-10 RTD for Forestry and Chairperson, DENR-10 GAD Focal Point, invited the GAD Focal Point Persons of the DENR-10 sectors, including from MGB-10 and EMB-10, to come up with a series of activities that will actively promote participation and provide women’s livelihood opportunities. Women’s Month celebration 2007 in DENR-10 officially started with the traditional first Friday mass in the afternoon moved to the morning of March 2 with employees enjoined to wear their new t-shirts with the CEDAW logo to mark the occasion. MGB-10 also joined the opening day celebration on March 2 organized by the Gender Advocates and Women in Government Service in Region 10 (GA-WINGS-10) with a mass at the St. Augustine Cathedral in Cagayan de Oro City. This was followed by the assembly at the Gaston Park for the Alay Lakad. The opening program, held at the Misamis Oriental Provincial Capitol kiosk, was highlighted by the speech of Ms. Virgie Cardona of DSWD-10 who presented an overview of RA 9262 or, An Act Defining Violence Against Women and Their Children, Providing for Protective Measures for Victims, Prescribing Penalties Therefore, and for other Purposes. The MGB-10 GAD Focal Point System sponsored a livelihood lecture-demonstration conducted by a resource person from TESDA-10, held at the DENR-10 conference room on March 6.

The activity aimed to develop/enhance the entrepreneurial skills particularly of the female personnel to augment the economic well-being of their families as equal partners of their men. “POT(ting) Session” was identified by the DENR National Gender and Development Focal Point System as among the major activities of the Women’s Month celebration. Its primary objective is to foster and promote greening while providing assistance to the Green Philippines Program of the Department. A nationwide competition on potting and sowing activities among the various regional DENR sectors (excluding the Forestry Sector, the organizer) was conducted on March 16 from 7:00 a.m. to 9:00 a.m. The women and men of MGB-10 placed third among the DENR-10 sectors. Women and men of MGB-10 conducted tree-planting activities and regular maintenance/nurturing of planted seedlings at the reforestation project site in Malasag, Cugman, Cagayan de Oro City under the supervision of MGB-10 GPP Focal Person For. Domingo B. Lebosada. The activities were in support of the Green Philippines Program: Trees for Life of the DENR.
