SUBJECT: LEGISLATIVE PROPOSAL TO ESTBALISH STATEWIDE UNIFORM

STANDARDS FOR STORMWATER MANAGEMENT

We are sending this memorandum to provide you with the Southeastern Wisconsin Regional PlanningCommission staffs comments on a recent vote by the Wisconsin State Legislatures Joint FinanceCommittee on Motion #62 (copy attached) to transfer commercial construction site erosion controlregulation from the Department of Safety and Professional Services to the Department of Natural

Resources. Items 1 through 5 of the motion call for statewide uniform standards t o be applied tostormwater management, and Item 3 specifically prohibits local governments from enacting stormwater

management ordinances that are stricter than statewide uniform standards included in WDNR rules.

The attached letter to the Secretary of the WDNR notes some potential problems that we have identified

with the adoption of statewide uniform standards as they could relate to the ability of municipalities toregulate stormwater quantity and quality.
