Cal/OSHA Reminds California Employers to

Post Annual Work-Related Injury and Illness

Summaries

Cal/OSHA reminds all California employers to post

their annual summaries of work-related injuries and

illnesses from February 1 through April 30.

“This yearly requirement is a graphic reminder

on the importance of workplace safety. It provides

important data about injuries and illnesses that took

place at the worksite, and highlights the need to

address potential hazards,” said Christine Baker,

Director of the Department of Industrial Relations

(DIR). Cal/OSHA, also known as the Division of

Occupational Safety and Health, is a division of

DIR.

“Employers must summarize information about

every work-related death, and every recordable

work-related injury or illness,” said Cal/OSHA

Chief Juliann Sum.

The definitions of and requirements for recordable

work-related fatalities, injuries and illnesses are

detailed in California Code of Regulations Title 8

Sections 14300 through 14300.48.

Instructions and form templates can be downloaded

for free on Cal/OSHA’s Record Keeping Overview.

The overview includes the summary template, Form

300A, a required workplace posting which must be

placed in a visible and easily accessible area at each

worksite. All current and former employees, as well

as employee representatives, must be allowed the

opportunity to review any injury or illness that took

place at the worksite during 2014.

Employers are required to complete and post Form

300A even if no workplace injuries occurred. More

information on employers’ posting requirements

or how to reduce workplace injuries and illnesses

is available on the DIR’s Employer Information

webpage.

Cal/OSHA helps protect workers from health and

safety hazards on the job in almost every workplace

in California. Cal/OSHA’s Consultation Program

provides free and voluntary assistance to employers

and employee organizations to improve their

health and safety programs. Employers should call

(800) 963-9424 for assistance from the Cal/OSHA

Consultation Program.

March 1, 2015 Deadline to Register as Public

Works Contractor – If You Do Public Works

Projects YOU MUST BE REGISTERED!

California contractors who work on public works

projects are facing a crucial deadline IF you want to

bid or perform public works with the state or local

agencies!! You MUST go online to the address listed

below, register and pay the $300 fee! Waiting until

past the deadline is NOT permissible!

The requirement to list only registered contractors

and subcontractors on ALL public works

bids becomes effective on March 1, 2015. The

requirement to only use registered contractors and

subcontractors on public works projects applies to

all projects awarded on or after April 1, 2015.

Essentials of public works contractor registration

program:

• Contractors will be subject to a registration and

annual renewal fee that has been set initially

at $300. The fee is non-refundable and applies

to all contractors and subcontractors who

intend to bid or perform work on public works

projects (as defined under the Labor Code).

• Contractors will apply and pay the fee online

and must meet minimum qualifications to be

registered as eligible to bid and work on public

works projects:

o Must have workers’ compensation coverage for

any employees and only use subcontractors who are

registered public works contractors.

o Must have Contractors State License Board

license if applicable to trade.

o Must have no delinquent unpaid wage or penalty

assessments owed to any employee or enforcement

agency.

o Must not be under federal or state debarment.

o Must not be in prior violation of this registration

requirement once it becomes effective. However, for

the first violation in a 12 month period, a contractor

may still qualify for registration by paying an

additional penalty.

• The registration fee is not related to any project. It

is more like a license that enables the registrant to

bid on and perform public works.

If a contractor violates the deadlines, he may have to

pay significant penalties, ($2,000); and risk having

work stopped until the registration is rectified.

Awarding bodies (both state and local) will be

closely following the new law!

So, don’t delay! Register today and be done with it!

me about California’s roads. So too, because the

governor and legislature recognize the problem, you

will be reading considerably more in the papers and

on TV this year.

California Eyes Road Repair Fees as Gas Tax

Receipts Ebb

California Governor Jerry Brown is preparing

bills aimed at helping the state pay for a $59 billion

backlog of road and bridge repairs as he also seeks

to curb gasoline consumption that traditionally

pays for road construction. The legislation, part of

a package of budget bills Brown must submit by

Feb. 1, would allow local transportation agencies to

expand carpool lanes to drivers willing to pay a toll.

The package also would start a pilot program to test

whether charging a fee based on miles driven works

better than the current excise tax on fuel to pay for

road work, according budget documents released

earlier this month.

California, like other U.S. states, is struggling

with how to pay for transportation infrastructure

as more fuel-efficient and electric vehicles hit the

roads, causing a drop in excise taxes that are most

commonly used to pay for maintenance and repairs.

States such as Minnesota, Oregon and Washington

have already begun testing user fees as leaders in

Washington oppose raising the federal gas tax or

a levy based on miles driven. “To the extent that

we can bring down gasoline consumption, we are

going to have to find another way to finance upkeep

of the roads,” Brown told reporters Jan. 9 when he

unveiled his budget.

Are Cell Phones Going to be Your New Driver’s

License?

And speaking of the DMV, a new bill from

Assemblyman Matt Dababneh (D–Encino) would

digitize driver’s licenses and ID cards. Gregory J.

Wilcox reports in the Los Angeles Daily News:

“There might come a day when a cop asks to see

your driver’s license, and you simply whip out your

cell phone and activate an app.

“San Fernando Valley Assemblyman Matt

Dababneh (D–Encino) this week introduced AB

221, legislation that would let the Department of

Motor Vehicles develop a mobile application for a

digital driver’s license, which would be accessed via

smartphone.

“’California has always been at the forefront of

digital innovation and last year passed legislation

allowing individuals to access their automobile

insurance on their smartphones,’ Dababneh said in

a statement.

“’What my bill will do is not replace traditional

licenses,’ he added when contacted by phone. ‘It will

supplement options for people who want to have a

traditional ID.’”

the same as our first contractor learns. We

‘dash’ the hopes of another contractor who has

discovered you can’t work without ‘DOSH’.

What you don’t know can hurt you, as a Nevada

contractor gets a tax bill from California he

didn’t know was coming…

Q: We will soon be making some structural changes

to our corporation. It will keep the same EIN

number and Secretary of State registration number

but we will be changing the name and Officers on

our license. Is there a certain amount of time that we

have to report these changes to the CSLB? Will this

require the need for a new license number?

The CSLB allows 90 days to report a name and/

or Officer change. Please note that for the name

change you must first register the change with the

CA Secretary of State. As long as your registration

number with the Secretary of State remains the

same, you do not need to apply for a new license

number.

Q: When a contractor has the ASB (Asbestos)

Certification, doesn’t that also require them to have

the Division of Occupational Safety and Health, or

DOSH, registration in order to perform asbestos

abatement? Is there any restriction if they don’t also

have the DOSH?

A: Yes, if a contractor has the Asbestos Certification

they are required to register with DOSH. They

cannot perform asbestos abatement without it.

Q: My Sole Proprietor license was revoked last year

and I was wondering if I may form a corporation

with an Responsible Managing Officer (RMO) in

order to do business? I would be the owner and

Vice President but he would be President/Secretary/

Treasurer/RMO so he would be the only one on the

contractor’s license.

A: According to B&P Code 7121.5 an individual

who was the Qualifying individual on a revoked

license “shall be prohibited from serving as an

officer, director, associate, partner, manager, or

qualifying individual of a licensee”. In order to

act in any other capacity other than a bona fide

non-supervising employee for a contractor, is with

the CSLB’s approval and most likely a disciplinary

bond.

Q: We are a Nevada corporation and you helped us

get licensed years ago in California. We did a couple

jobs but haven’t worked out there in several years

and we let our contractor’s license expire. I was just

made aware that we were still being taxed and I want

to cancel our corporate status in CA so that we don’t

incur any further taxes. Are we required to pay back

taxes prior to closing the CA corporation?

A: Yes. In order to surrender the corporation you

must file any delinquent tax returns and file a final/

current year tax return. You should contact your

Heating Devices—Space Heaters

Use of space heaters:

According to the Consumer Product Safety Commission, millions of consumers rely on portable and in-wall gas or electric space heaters to warm their homes and offices. Many of these users fail to follow important safety instructions, not knowing perhaps that death and serious injury, including burns and carbon monoxide poisoning, can occur.

• Every year, people receive emergency room treatment for injuries associated with the use of gas, kerosene, oil, and electric space heaters.

• More than two-thirds of those injured are children under the age of five.

Carbon monoxide poisoning:

Fuel-oil space heaters emit significant amounts of carbon monoxide gas—which is odorless, tasteless, colorless, and can kill a person in a short period of time.

• Non-vented heaters which burn natural gas, liquefied petroleum, and other fuels pose the threat of carbon monoxide poisoning because they need to be used where there is access to fresh air to operate safely. Such non-vented heaters have been outlawed in many areas.

• Symptoms of carbon monoxide poisoning can be as mild as drowsiness, headaches, and nausea and are frequently misdiagnosed.

‒ Exposure to carbon monoxide is of special concern to those with heart problems, the elderly, pregnant women, and the very young.

‒ Significant overexposure results in severe injuries including permanent brain damage and death.

Burns and structural fires:

Consider the problems common to all space heaters:

• Children and adults often contact exposed flames or hot heater surfaces and suffer severe burns.

• Clothing, fabrics, and other materials that come in contact with heaters cause serious burn injuries and fires.

Heating Devices—Space Heaters

Installation:

• Use qualified service personnel to install or repair in-wall heaters.

Location of space heaters:

• Locate heaters away from traffic and play areas, as well as areas occupied by children. Keep them clear of furniture, draperies, and other combustibles.

• Alert children and adults about where heaters are located and remind them of the hazards of their high surface temperatures.

• Supervise young children when they are near space heaters.

Recommendations for use:

• Only use heaters that are thermostatically controlled.

• Warn children not to insert fingers or other objects into any heater openings where they can be burned or receive an electric shock.

• Do not use extension cords with electric heaters.

• Use only portable heaters that are equipped with an automatic shut off device that shuts off the heater if it is tipped over.

• If possible, use heaters that are equipped with automated high temperature switches that prevent them from overheating.

• Do not use a portable electric heater in a bathroom or around wet or grounded surfaces.

• Never place a heater near a tub or sink where it could get splashed or fall into the water.

• The filling of all fueled heaters needs to be well controlled in a safe and well- ventilated area, away from ignition sources.

• Never fill a heater when it is hot or in use and follow all manufacturers’ instructions.

• Never substitute a heater’s proper fuel with a different type of fuel and never convert a heater to a different type of fuel.

• All heating equipment should be inspected before use and in accordance with the manufacturer’s instructions.

Uso de calefactores personales:

De acuerdo con la Comisión para la Seguridad de los Productos de Consumo, millones de consumidores dependen de calefactores personales portátiles o empotrados a gas o eléctricos para calentar sus hogares y oficinas. Muchos de estos usuarios omiten seguir instrucciones de seguridad importantes, sin saber, tal vez, que la muerte y lesiones graves, incluyendo quemaduras e intoxicación por monóxido de carbono, puedan ocurrir.

• Cada año, las personas reciben tratamiento en salas de emergencia por lesiones asociadas con el uso de calefactores personales a gas, queroseno, aceite y eléctricos.

Intoxicación por monóxido de carbono:

In the event of an emergency, our first responders will be overwhelmed. It is critical for citizens to be prepared to take care of themselves, their neighbors, and their community for at least 3 days, and preferably 5-7.

ReadyMarin.org is Marin County’s website for information on emergency preparedness, whether you are just learning or an experienced emergency volunteer. Our mission is to provide guidance, training and resources to keep you and your family safe during an emergency, whether it requires you to evacuate or shelter in place. For those of you who wish to step beyond preparing your home and reach out to help your community in an emergency, train to be a Community Emergency Response Team (CERT) member.
