22 FOR THE CALENDAR YEAR 1979FATALITY REPORT NO. 1

Fatal accident to Junior Ross DeWitt (age 34), Terra Alta, WestVirginia, at the deep mine of Mettiki Coal Corporation, located nearTable Rock, Maryland.

A fatal accident occurred at Mettiki Coal Corporation onWednesday, April 18, 1979, at approximately 9:45 p.m.

The fatality at the Gobbler's Knob (B) Mine was Junior RossDeWitt, age 34, of Terra Alta, West Virginia. He was a continuousminer operator, and after cutting the last cross cut through, hebacked the miner out about 20 feet from the mine face. He and theacting mine foreman, Jim Kelly, (who also runs the roof boltingmachine) went back to the face to examine the roof. While they wereexamining the roof, a slab of rock fell, striking DeWitt in the back.

Jeff Layman, miner operator helper, standing at the miner, sawthe rock start to gap and yelled to the two men to get out. Jim Kellyturned to the upper right of the coal seam, and DeWitt was knockedparallel with the heading. When he was struck by the rock it causedsevere liver damage.

The accident was also investigated by MSHA Federal inspectors.We came to the conclusion that Mr. DeWitt was out beyond the lastroof support which caused the accident.

RECOMMENDATIONS OF DISTRICT INSPECTOR:I recommend that the workmen stay in compliance with the

approved roof control plan for this mine and that workmen shall notadvance beyond the protection of supported roof except to installtemporary supports.

FATALITY REPORT NO. 2

Fatal accident to William G. Bowmar (age 52), Tunnelton, WestVirginia, at the deep mine of Mettiki Coal Corporation, located nearTable Rock, Maryland.

On Wednesday, June 20, 1979, at approximately 9:00 a.m. afatal roof fall accident occurred near the face area of No. 7 entrystraight main, Beaver Run Mine of Mettiki Coal Corporation.Resulting was the death of William G. Bowmar, Section Foreman.

After examining the roof of No. 7 entry, Bowmar went backalong the side of the continuous miner, 22 feet from the face. Part ofthe roof fell, riding out three aluminum cross bars, pinning Mr.Bowmar between the miner and rock.

RECOMMENDATIONS OF DISTRICT INSPECTOR:I recommend that during the penetration of the face when

abnormal roof conditions are encountered, that no more than fourtemporary supports (cross bars) be set at three foot centers or less,with every cross bar supported with a wooden post. Permanentsupports must be installed before further advances are made.

I also recommend that the safety engineer hold classes with allsafety inspectors and workmen concerning roof control, equipment,mine maintenance, rib control and safety. This must be startedimmediately.

FATALITY REPORT NO. 3

Fatal accident to Wilbur Burton Bowser (age 38), Accident,Maryland, at the Teets Daylighting Project No. F12-704, locatednear McHenry, Maryland.

The fatal accident occurred on December 31, 1979, atapproximately 9:15 a.m., on an abandoned mine drainageabatement project, Project No. F12-704, located in Garrett County,near McHenry, Maryland. The contractor on the Project isAllegheny Mining Corporation, Mt. Storm, West Virginia, alicensed Maryland coal operator.

Mr. Harold Sherwood, a project superintendent for AlleghenyMining and two other employees, Wilbur B. Bowser and Rodney W.Tichnell, had started to work at approximately 7:00 a.m. They hadworked at another Allegheny Mining permit (no. 277) as well as atthe Daylighting Project site. Mr. Bowser had driven the front-endloader to the Project site from Permit No. 277.

At the time the accident occurred, only two employees were atthe Project site working, Mr. Bowser and Mr. Tichnell. They werepreparing to dewater the pit in order that coal could be loaded fromthe site on the next working day. Mr. Tichnell was in the pit at thetime of the accident.

The accident occurred as Mr. Bowser, operating a Terex 72-51Loader, was backing the loader down a 15-18° ramp leading to theexposed coal in the pit. The ramp was constructed of spoil material,including material taken from immediately above the coal seam.There was also an embankment on the southwest side of the ramp.The material in the ramp was frozen and was snow covered and icy.Apparently, as Mr. Bowser backed the loader down the ramp, withthe loader bucket lowered and scraping the ramp surface, the righttires on the loader and the right corner of the bucket ascended theembankment on the southwest side of the ramp causing the loaderto upset. The loader turned onto its left side and then proceeded toturn onto its top. The loader was not equipped with a roll cage. Theweight of the loader caused the steel cab to completely collapse,trapping Mr. Bowser in the cab and crushing him.

Actual rescue operations to extricate Mr. Bowser from the loaderwere started at approximately 12:00 noon and continued untilapproximately 2:00 p.m., when Mr. Bowser was removed from theloader by the Northern Garrett County Rescue Squad.

The victim died of asphyxiation due to chest compression.Inspector in charge of District—Stephen M. Layton

REVEGETATION OF STRIP MINED LANDSFred L. Bagley

The Bureau of Mines received planting reports totaling 1,317acres eligible for revegetation bond release after the 1979 growingseason which ended in September, 1979.

Prior to release of revegetation bonds, the State's surface mininglaw and rules and regulations require the following:

(1) A minimum of two growing seasons after planting forevaluation to determine if:

(a) the herbaceous coverage is at least 80 percent;(b) bare areas do not exceed 2,500 square feet;(c) the required legume species comprise at least

10 percent of the coverage;(d) erosion, rills and gullies do not exceed 9 inches

in depth;(e) there are no depressions in the revegetated area; and(f) if trees and shrubs are planted, at least 700 stems

per acre well distributed and living.

Longer evaluation time may be required, even if the acres meetthese criteria, if the conditions of the vegetation are questionable.

(2) The Bureau must advertise the pending bond release at leastonce a week for four consecutive weeks in a newspaper of generalcirculation in the jurisdiction affected.

(3) The operator must notify adjoining property owners, localgovernmental agencies, sewage authorities and water companies, ifinvolved, of the pending bond release.

Members of the State Land Reclamation Committee visited onsite the areas eligible for bond release during the fall of 1979 todetermine if the criteria for bond release had been accomplished.

At the November meeting, 982 acres of the 1,317 total eligibleacres were approved for release by the Committee. All acres wereplanted with a grass and legume mixture to insure adequate erosioncontrol protection. Trees and shrubs were planted on 204 acres forforestry purposes and for wildlife habitat enhancement.


The primary reason for disapproval of the i'cvegetation bondrelease was for failure to meet the 10 percent legume requirement.

Under a policy adopted in 1977, the public was given theopportunity to participate in the State's reclamation evaluationprocess by attending revegetation tours conducted during the fall.During 1977 and 1978, these tours were well attended; however, in1979 public attendance for this tour was poor.

The Bureau will continue these tours as long as Marylandcitizens show an interest in them.

During the early spring of each year, a listing of acres eligible forrevegetation bond release is compiled. Copies of this listing and tourinformation are available at the Bureau of Mine's office inWesternport, Maryland.

ABANDONED MINE LANDS RECLAMATIONPatrick E. Gallagher

A total of 77 acres of abandoned mines were reclaimed by 11different contracts with operators for backfilling, revegetation, anddiversion construction. The total cost of all 11 contracts was $75,575.The source of these funds is the Bituminous Coal Open-Pit MiningReclamation Fund.

The Bureau participated in a reclamation project on theFrostburg State College campus which included backfilling andrevegetation of approximately 16 acres of an abandoned surfacemine. A contract for $77,000 was awarded for the construction usingfunds from an Appalachian Regional Commission grant and theBituminous Coal Open-Pit Mining Reclamation Fund.

In addition, the Bureau initiated a construction contract to abatethe last known abandoned deep mine drainage point in the CherryCreek watershed. The work is to be accomplished by a methodknown as daylighting; that is, using conventional surface miningmethods, the remaining deep mine workings are removed toeliminate groundwater from coming in contact with the acid bearingcoal and rock. The contract cost of the project is $89,900 and thefunds are appropriated from an Appalachian Regional Commissiongrant and the Water Quality Restoration Loan of 1970. The project isexpected to be completed in three years.

The Bureau also received emergency funds from the U.S.Department of Interior through the Office of Surface Mining torelieve imminent dangers to life and property from abandoned deepmines in the Frostburg and Barton areas. Flyash and cement arebeing injected into the deep mines under two dormitory buildingsand a dining hall on the Frostburg State College campus. The flyashand cement will provide support undçr the buildings and reduce thelikelihood of future subsidence uncter the structures. The Bureaualso initiated a project to prevent further flooding from anabandoned deep mine in the Temperance Row area of Barton. Acollapsed deep mine had inipounded water, built up pressure insideand blew-out the collapsed portion of the mine subsequentlyflooding seven residents.

In 1976, the Bureau initiated a construction contract to reclaiman area of approximately 36 acres of abandoned mine known as theGrantsville Dump. Since the project's completion, the Bureau hasobserved the progression of revegetation on the area and thepictures shown here document the project's success:

Meetings and Time

The Land Reclamation Committee meets at the City Building inWesternport, Maryland. All meetings are open to the public and areannounced in the Maryland Register and local papers.

Functions and Duties of the Committee

The Land Reclamation Committee oversees land reclamation ac-tivities related to the surface mining of coal in Maryland. It isspecifically directed by statute (Annotated Code of Maryland, Section7-205/b/) to: .study, recommend, and approve all procedures forreclamation, conservation, and revegetation of any area affected byopen-pit mining within the State.


Specific duties addressed by the Committee during its monthlymeetings include:

1. Review and approval of reclamation plans.2. Review and approval of Annual Mining and Reclamation

Progress Reports, Final Reports, and revegetation bondreleases.

3. Establish amounts of revegetation bond for each operation.

The Land Reclamation Committee visits every site for whichmining permit applications have been filed to determine thesuitability of the reclamation plan. The Committee also examinessites for purposes of approving annual progress reports and finalreports.
