" dock " includes all basins, locks, cuts,entrances, graving docks, graving

blocks, inclined planes, slipways,gridirons, moorings, transit-sheds,warehouses, tramways, railways andother works and things appertaining toany dock, and also the portion of thesea enclosed or protected by the armsor groynes of a harbour;

" foreshore " , in relation to a port, meansthe area between the high-water mark

and the low-water mark relating to thatport;" goods " includes livestock and every kindof movable property;"

, in relation to a port,means a line drawn through the highestpoints reached by ordinary spring-tidesat any season of the year at the port;

" land " includes the bed of the sea or river below high-water mark, and also things

attached to the earth or permanentlyfastened to anything attached to the earth;" low-water mark " , in relation to a port,means a line drawn through the lowest

points reached by ordinary spring-tides atany season of the year at that port;" major port " has the same meaning as inthe Indian Ports Act;

" master " , in relation to any vessel or any aircraftmaking use of any port, means any person having for the time being the charge or control of such vessel or such aircraft, as the case may be, except a pilot,harbour master, assistant harbour master, dock master or berthing master of the port;" owner " ,(i) in relation to goods, includes any consignor,

consignee, shipper or agent for the sale, custody,

loading or unloading of such goods; and(ii) in relation to any vessel or any aircraft making useof any port, includes any part-owner, charterer,consignee, or mortgagee in possession thereof,

" pier " includes any stage, stairs, landingplace, hard, jetty, floating barge,

[transhipper] or pontoon, and any bridgesor other works connected therewith.[Explanation.-For the purposes of this clause," transhipper " means a floating craft or

vessel, whether dumb or self-propelled, onwhich gears are provided for dischargingcargo from a barge or wharf and loading itinto a ship;]

" port " means any major port to which thisAct applies within such limits as may,

from time to time, be defined by theCentral Government for the purposes ofthis Act by notification in the OfficialGazette, and, until a notification is so

issued, within such limits as may havebeen defined by the CentralGovernment under the provisions of theIndian Ports Act;

" port approaches " , in relation to a port,means those parts of the navigable riversand channels leading to the port, in whichthe Indian Ports Act is in force;" rate " includes any toll, due, rent, rate, fee,or charge leviable under this Act;" regulations " means regulations madeunder this Act;" rules " means rules made by the CentralGovernment under this Act;

" vessel " includes anything made for theconveyance, mainly by water, of human

beings or of goods and a caisson;]" wharf " includes any wall or stage andany part of the land or foreshore thatmay be used for loading or unloadinggoods, or for the embarkation or disembarkation of passengers and anywall enclosing or adjoining the same.

The Board of trustees of a Major Port shallconstitute of:

ChairmanDeputy ChairmanNot more than 19 persons in case of

Mumbai, Kolkata and Chennai and notmore than 17 persons in the case ofother major ports

Persons from various interests like:(1) labour employed in the port;(2) the Mercantile Marine Department;

(3) the Customs Department.,(4) the Government of the State in whichis port is situated;

(5) the Defense Services;(6) the Indian Railways; and(7) such other interests as the Govt

deems fit.

Power of Board to execute works and provideappliances(1) A Board may execute such works within or withoutthe limits of the port and provide such appliances asit may deem necessary or expedient.(2) Such works and appliances may include-(a) wharves, quays, docks, stages, jetties, piers andother works within the port or port approaches or onthe foreshore of the port or port approaches, with allsuch convenient arches, drains, landing places, stairs,fences, roads, railways, bridges, tunnels andapproaches and buildings required for the residenceof the employees of the Board as the Board mayconsider necessary;

reclaiming, excavating, enclosing andraising any part of the foreshore of the portor port approaches which may benecessary for the execution of the worksauthorised by this Act, or otherwise for thepurposes of this Act;such breakwaters and other works as maybe expedient for the protection of the port;dredgers and other machines for cleaning,deepening and improving any portion ofthe port or port approaches or of theforeshore of the port or port approaches;

lighthouses, lightships, beacons, buoys, pilotboats and other appliances necessary for thesafe navigation of the port and of the port

approaches;vessels, tugs or other boats for use within thelimits of the port or beyond those limits, whether in territorial waters or otherwise, for the purposeof towing or rendering assistance to any vessel,

whether entering or leaving the port or boundelsewhere, and for the purpose of saving or protecting life or property and for the purposeof landing, shipping or transhipping passengersor goods under section 42;

sinking of tube-wells, and equipment,maintenance and use of boats, barges andother appliances for the purpose of thesupply of water at the port;engines and other appliances necessary for the extinguishing of fires;construction of models and plans for

carrying out hydraulic studies;dry docks, slipways, boat basins andworkshops to carry out repairs or overhauling of vessels, tugs, boats,machinery or other appliances.]

TAMP stands for Tariff Authority for Major Ports

(2) TAMP is a body corporate by thename aforesaid having perpetualsuccession and a common seal and shallby the said name sue and be sued.(3) The head office TAMP is in Mumbai.Ms Rani Jadhav is the Chairman fromOct 1, 2009 for next 5 years or age 65 yrs.

S.48 The Authority shall from time to time,by notification in the Official Gazette,frame a scale of rates for services such

as:a) transhipping of passengers or goods(b) landing and shipping of passengers;

(c) carriage or porterage of goods(d) wharfage, storage or demurrage of(e) any other service in respect ofvessels, passengers or goods,
