fee of Rs. 2000/- in the form of DD drawn in favor of “ Executive Engineer, Maharashtra Jeevan

Pradhikaran Division Gondia, “which should be submitted to Executive Engineer, MJP, Division

office Gondia physically and also shall be scanned and uploaded online, with the

prequalification application.

Only those Contractors who fulfill to following requirements / condition will be eligible

to apply for prequalification to The Chief Engineer Maharashtra Jeevan Pradhikaran Region

Nagpur.

a) The contractor shall be registered contractor in class- IA (Civil) and above in

Maharashtra Jeevan Pradhikaran. The copy of valid registration certificate in this

respect shall be produced.

b) Maharashtra Value Added Tax 2002 registration certificate. C) Contractor should have his bid capaci ty more than 685.0 lakhs, which should be

worked out by formula given in detailed tender notice.

Contractor has to upload scan copies of above document as well as He has to submit the hard

copies on Key dates given in tender notice.

Sealed online tenders (e-tender) in B-1 forms (Percentage Rate Tenders) are invited by the

Executive Engineer, Maharashtra Jeevan Pradhikaran Division Gondia, in a manner of the “Two

Envelope system “online by e-tendering system from the Pre-qualified contractors only.

a) The security deposit at 4% of estimated cost put to tender or accepted cost whichever is higher, will have to be deposited by the successful contractor.

b) The Security deposit will be accepted in the following manner. Initial S.D., 2% in the form of FDR/TDR or bank guarantee, valid for minimum period of 24 months and will have to be extended further by every 12 month till the contract is alive.

And 50% of Security Deposit will be recovered at 4% through each R.A. Bill so as to make total Security Deposit 4%.

15. Additional Security Deposit

In case of those tenderer whose offer is less than 10% of the cost put to tender it is binding on

contractor to pay additional security deposit as mentioned below.

i) Offer up to 10% below : Initial 2% of cost put to tender + 2% of

RA Bill (i.e. no additional security deposit)

ii) Offer more than 10% below : Initial security charges 4% + 2% from to

15% below R.A.bills

iii) Offer more than 15% below : Initial security deposit 6% + 2% from

R.A.bills

16. PREQUALIFICATION CONDITIONS

The Pre-qualification certificate shall be issued only to those Contractors who fulfill following

primary requirements / condition:-

a) The contractor shall be registered contractor in class- IA and above (Civil) in

Maharashtra Jeevan Pradhikaran. The copy of valid registration certificate in this

respect shall be produced.

b) Maharashtra Value Added Tax 2002 registration certificate.

(c) BID CAPACITY:-

Bidding capacity of contractor for completion of work will be decided by the following

formula:-

Note:-

Since all the data is pertaining to the contractors own performance the contractors are required

to provide its bidding capacity for this work by furnishing the calculations and

supporting documents to prove it contents. Also has to upload scan copies of supporting

documents to prove Bid Capacity online. If support documents are not found uploaded, bit

capacity will not be taken into account which will result in dis-qualification for this tender.

1) The statement showing the value of existing commitments of ongoing works during N year

for each of works in the list should be counter signed by the Engineer-in-charge not below the

rank of an Executive Engineer. Also has to upload scan copies of these Certificates.

2) Submission of false information shall result in black listing of the agency.

3) Following experience certificates to the effect of having successfully completed and

commissioned the said works within the stipulated period of the contract from the officer not

below the rank of Executive Engineer and countersigned by Superintending Engineer or

equivalent shall be produced for prequalification.

d) EXPERIENCE CERTIFICATE OF FOLLOWING WORKS.

2. Only those contractors who are short listed in pre-qualification stage are eligible

for participating in main tender. The cost of main tender is Rs. 5200 /- only

(including VAT). It is necessary to draw the Demand Draft of Rs. 5200 /- in favour of

“Executive Engineer, Maharashtra Jeevan Pradhikaran Division : Gondia Dist:- Gondia.

'' Payable at Gondia and submit it to the office of the Execitive Engineer M.J.P. Works

Dn , Gondia. on or before the last date of issue of tender online. DD shall also be

scanned & uploaded in Envelope No 1 without which Envelope no 2 i.e.commercial

bid will not be opened.

3. It is necessary to give the undertaking as follows by the contractor, that he will not make

any changes in tender documents downloaded from website. If it is done the tender of

such contractors will be rejected and the contractors who made such changes are liable

for action as per Rules. Tender documents published on Government website are

considered as authentic and legal documents in case of any complaint about the tender.

4. It is necessary to give undertaking as follows "I have seen detailed drawings of works on

website. It is part of tender documents. I have visited the site and I am well conversant

to site condition. I have quoted my offer by considering all these things. I am ready to

5. In order to participate in the tenders floated using the Electronic Tender Management

System (ETMS), all contractors/bidders are required to get enrolled on the ETMS portal

6. The bids submitted online should be signed electronically with a Digital Certificate to

establish the identity of the bidder bidding online. The registered contractors has to

obtain the Digital Certificate. For information required for Digital Certificate he may

contact ETMS Help Desk.

7. For submitting the bids online, the contractors/bidders are required to make online

payment using the electronic payments gateway service Bid Submission Fee Rs.1024/-.

13. Manner of submission of main tender & its accompaniments

The tenderer shall submit the tender documents in two sealed envelope system as below.

The following documents shall be scanned and uploaded in envelope No. 1

a) Scanned copy of D.D.of Rs 5,200 /- as cost of blank tender form

b) Scanned copy of earnest money deposit receipt

deed and power of attorney to sign the tender documents and other

proceedings pertaining to the work tendered.

Maharashtra Jeevan Pradhikaran, Region Nagpur

f) Detailed time schedule programme of the work (month wise) in the form

of Bar-Chart

g) List of technical persons and list of machinery and plant immediately

available with the tenderer for use on this work and list of machinery

proposed to be utilized on this work, but not immediately available and

the manner in which it is proposed to be procured.

All the above documents shall be uploaded in the envelope No. 1. If these

documents are not found, envelope No. 2 will not be opened.

Envelope No. 2

The second envelope shall contain only the main tender, including the common set of

conditions/stipulations uploaded by the department alongwith scanned copy of prebid

minutes duly signed by the contractor.A bid submitted without this would be considered

as invalid.

The tenderer should quote his offer on B-1 form (at relevant place) of the tender

as percentage of estimated rates at the appropriate place on tender documents to be

submitted only in Envelope No. 2. He should not quote his offer anywhere else, directly

or indirectly in Envelope No. 1. The contractor shall quote for the work as per details

given in the main tender and also based on the details of conditions issued/ additional

stipulations made by the department as informed to him by letter after pre-tender

conference.

14. Opening of tenders.

The bids will be opened on 18/05/2011 from 12 hours to 19/5/2011 upto

17.00 hrs. in the Office of Chief Engineer, Maharashtra Jeevan Pradhikaran, Region

Nagpur if possible. Following procedure will be adopted for opening of tender.

Envelope No. 1

First envelope No. 1 of the bid will be opened online to verify it contains as per

requirement. If various documents contained in this envelope do not meet the the requirement as

mentioned in 13, then envelope No. 2 will not be opened.

Envelope No. 2

This envelope shall be opened immediately after opening of envelope No. 1 only if contains

of envelope No. 1 are found to be acceptable to the department.

14. Key Dates:

The Contractors are strictly advised to follow the Dates and Times as indicated in the Time

Schedule in the Notice Inviting Tender for each Tender. All the online activities are time tracked

and the e-Government Procurement System enforces time-locks that ensure that no activity or

transaction can take place outside the Start and End Dates and Time of the stage as defined in the

Notice Inviting Tenders.

14. Prebid Minutes :

Minutes of pre-bid meeting shall be sent to contractors physically. However being part and

parcel of main tender, contractor has to upload these minutes and submit alongwith main tender

online, without which his bid shall be treated as incomplete and shall be rejected.

15. INCOME TAX

The income tax shall be deducted at 2.3 % or as applicable including surcharge from time

to time from each R.A. bill and shall be remitted to Income Tax Office by the department.

16. VALUE ADDED TAX

The value added tax shall be deducted at 2% from the contractor or at appropriate rate as

may be determined by the sale tax department from time to time on basis of actual work done

by the contractor from each R.A. bill and shall be remitted to sales tax department. No payment

on account of reimbursement of value added tax will be made to contractor by Maharashtra

Jeevan Pradhikaran.

17. CONDITION RELATING TO INSURANCE

Contractor shall take out necessary insurance policy / policies so as to provide adequate

insurance cover for execution of the awarded contract work from the Director of insurance,

Maharashtra State Mumbai 51, only. Its postal address for correspondence is 264-1St floor,

MHADA, Opposite Kala Nagar, Bandra (East), Mumbai-51 (Tel. No. 26438403 / Fax –

26438461 / 26438690). Insurance policy / policies taken out from any other company will not

be accepted. However if the contractor desires to effect insurance with the local office of any

insurance company, the same should be under the co-insurance cum servicing arrangement

approved by the Director of Insurance. The policy taken out by the contractor is not on co-

insurance basis (G.I.F. 60% and Insurance Company 40%). The same will not be accepted and

amount of premium calculated by Director of Insurance will be recovered directly from the

amount payable to the contractor for the executed contract work which may be noted.

20. The contractor shall study the guidelines regarding e-tendering to get clarify

e-tendering procedure.

Guidelines to Contractors Regarding Government of Maharashtra e-tendering system

1. These conditions will overrule the conditions stated in the Tender Documents,

wherever relevant and applicable.

2. Registration of the Contractors:

The Contractors registered with Maharashtra Jeevan Pradhikaran in relevant Categories and

Classes are eligible to participate in Open Tenders processed by Maharashtra. Jeevan

Pradhikaran Contractors are required to get enrolled on the Portal

http://maharashtra.etenders.in & sub portal http-://mjp.maharastra.etender.in and get

and empanelled in relevant sub portal. After submitting their enrollment request online, the

enrollment shall be required to be approved by the Representative of the Service Provider.

After the approval of enrollment, the Contractors shall have to apply for empanelment

online which shall be required to be approved by the Nominated Authority of

Maharashtra/Department. Only after the approval in the relevant Category / Class, the

Contractor shall be able to participate in the Open Tenders online.

Open Tenders in which eligible Contractors may enroll on the Portal in registered category

shall be able to participate in such Tenders. The online Enrollment of such Contractors shall

be required to be approved by the Representative of the Service Provider.

The approval of enrollment of Contractors is done by the Representative of the Service

Provider upon submission of mandatory documents by the Contractors. The Contractors

may obtain the list and formats of required documents from the Nodal Officer of e-

Tendering System for Government of Maharashtra / Service Provider.

3. Obtaining a Class II – Digital Signature Certificate:

The Bids required to be submitted online should be signed electronically with a Class II –

Digital Signature Certificate to establish the identity of the Bidder bidding online. These

Digital Certificates are issued by an approved Certifying Authority, authorized by the

Controller of Certifying Authorities, Government of India.

A Digital Signature Certificate may be used in the name of Authorized Representative of the

Organization. A Digital Certificate is issued upon receipt of mandatory identity proofs. Only

upon the receipt of the required documents, a Digital Signature Certificate can be issued.

Bid for a particular Tender may be submitted only using the Digital Signature Certificate,

which is used to encrypt the data and sign the hash during the stage of Bid Preparation and

Hash Submission. In case, during the process of a particular Tender, the Authorized User

looser his / her Digital Signature Certificate (i.e. due to virus attack, hardware problem,

operating system problem); he / she may not be able to submit the Bid online. Hence, the

Authorized User is advised to back up his / her Digital Signature Certificate and keep the

copies at safe place under proper security to be used in case of emergencies.

In case of online tendering, if the Digital Signature Certificate issued to the Authorized User

of a Firm is used for signing and submitting a Bid, it will be considered equivalent to a no

objection certificate / power of attorney to that User. The Digital Signature Certificate should

be obtained by the Authorized User enrolling on the behalf of the Firm on the e-Tendering

System for Government of Maharashtra.

Unless the Digital Signature Certificate is revoked, it will be assumed to represent adequate

authority of the Authority User to bid on behalf of the Firm for the Tenders processed by the

Maharashtra as per Information Technology Act 2000. The Digital Signature of this

Authorized User will be binding on the Firm. It shall be the responsibility of Partners of the

Firm to inform the Certifying Authority or Sub Certifying Authority, if the Authorized User

changes, and apply for a fresh Digital Signature Certificate. The procedure for application of

a Digital Signature Certificate will remain the same for the new Authorized User.

• The same procedure holds true for the Authorized Users in a Private / Public Limited

Company. In this case, the Authorization Certificate will have to be signed by the Directors

of the Company. (process of procuring Digital Certificate will take minimum 4/5 days)

4. Set up of Computer System:

In order to operate on the e_Tendering System for Government of Maharashtra. the User’s

Computer System is required to be set up. A Help File on setting up of the Computer

System can be obtained from the Service Provider or downloaded from the Home Page of

the Portal http://maharashtra.etenders.in. The Bidders may refer e_Tendering Tool Kit

available online to perform their online activities as mentioned below. In case of any query

he may contact Help Desk for the same.

5. Online Viewing of Detailed Notice Inviting Tenders:

The Contractors can view the detailed Notice Inviting Tenders and the detailed Time Schedule

(Key Dates) for all the Tenders processed by Maharashtra using the E_Tendering System for

Government of Maharashtra on http://maharashtra.etenders.in.

6. Online Purchase / Download of Tender Documents:

The Tender documents can be purchased / downloaded by registered and eligible

Contractors from the e-Tendering System for Government of Maharashtra available on

http://maharashtra.etenders.in.

7. Submission of Bid Seal (Hash) of Online Bids:

Submission of Bids will be preceded by submission of the digitally signed Bid Seals

(Hashes) as stated in the Tender Time Schedule (Key Dates) In the detailed Tender.

8. Generation of Super Hash:

After the expiry of the time of submission of digitally signed Bid Seals (Hashes) by the

Contractors has lapsed, the Bid round will be closed and a digitally signed Super Hash

will be generated by the Authorised Officers of Maharashtra Jeevan Pradhikaran . This is

equivalent to sealing of the Tender Box.

Decryption and Re-encryption Online Bids:

Contractors have to decrypt their Bids and immediately re-encrypt their Bids online and

upload the relevant Documents for which they generated the respective Hashes during the

Bid Preparation and Hash Submission stage after the generation of Super Hash within the

date and time as stated in the Notice Inviting Tenders (Key Dates). The Bids of only the

Contractors who have submitted their Bid Seals (Hashes) within the stipulated time, as

per the Tender Time Schedule (Key Dates), will be accepted by the e-Tendering System

for Government of Maharashtra. A Contractor who has not submit his Bid Seals (Hashes)

within the stipulated time will not be allowed to submit his Bid.

For submitting the Bids online, the contractors/bidders are required to make online

payment using the electronic payments gateway service Bid Submission Fee Rs 1024 /-

i) The Contractor shall pay along with the tender the sum of Rs. 5,12,660/) as T.D.R./F.DR and by way of earnest money. 7. No receipt for any payment alleged to have been made by a contractor in regard to any matter relating to this tender or the contract shall be valid and binding on MJP unless it is signed by the Executive Engineer. 8. The memorandum of work to be tendered for and the Schedule of materials to be supplied by the MJP and their rates shall be filied in and completed~by the office of the Executive Engineer before the tender form is issued. If a form issued to an intending tenderer has not been so filied in and completed, he shall request the said office to have this done before he completes and delivers his tender.9. All work shall be measured net by Standard measure and according to the rules and customs of the MJP and without reference to any local custom.10. Under no circumstance shall any contractor be entitled to claim enhanced rates for items in this contract.11. Every registered contractor shall produce along with his tender certificate of registration as approved contractor in the appropriate dass and renewal of such registration with date of expiry.12. All corrections and additions or pasted slips should be initialed.13. The measurements of work will be taken according to the usual methods in use in the MJP and no proposals to adopt alternative methods will be accepted. The Executive Engineers decision as to what is 'vthe usual method in use in the MJP" will be final.14. A tendering Contractor shall furnish a declaration alongwith the tender showing all works for which he has already entered into contract, and the value of the work that remains to be executed in each case on the date of submitting, the tender.15. In view of the difficult position regarding the availability of foreign exchange, no foreign exchange would be released by the MJP for the purchase of plant and machinery required for the execution of the work contracted for. The contractor will have to construct shed for storing controlled and vaTuable materials issued to him under Schedule ' A' of the agreement at work site. having double locking arrangement. The materials will be taken for use in the presence of the MJP person. No materials will be allowed to be removed from the site of works.18. The contractors shall also give a list of machinery in their possession and which they propose to use on the work.19. Every Contractor shall furnish along with the tender a Statement showing previous experience and technical staff employed by him.20. CONDITIONS OF CONTRACT

Clause-1. (Modification as per the G.R. P.W.D. No. CAT -1087 / CR-94/ Bldg. - 2 dated 14.6.1989) "The person/persons whose tender may be accepted [hereinafter calJed the contractor, which expression shall unless excluded by or repugnant to the context include his heirs, executors, administrators, and assignes] shall (A) within ten days, [which may be extended by the Superintending Engineer concerned upto fifteen days if the Superintending Engineer thinks fit to do so] of the receipt by him of the notification of the acceptance of his tender, deposit with the Executive Engineer in cash or MJP securities endorsed to Executive Engineer (if deposited for more than 12 months) of sum sufficient which will make up the full security deposit specified in the tender or [B] [Permit MJP at the time of making any payment to him for work done under the contract to deduct such sum as will amount to 4% of all moneys so payable such deductions to be held by MJP by way of security deposit] Provided always that in the event of the contractor depositing a lump sum by way of security deposits as contemplated at [A] above then and in such case, if the sum so deposited shall not amount to 4 % of the total estimated cost of the work it shall be lawful for MJP at the time of making any payment to the Contractor for work done under the contract to make up the full amount of 4 percent by deducting a sufficient sum from every such payment as last aforesaid until the full amount of the security deposit is made up. All compensation or other sums of money payable by the contractor to MJP under the terms of his contract may be deducted from or paid by the sale of sufficient part of his secmitvjleposit or from the interest arising therefrom, or from any sums which may be due or may become due by MJP to the contractor under any other contract or transaction of any nature on any, account whatsoever and in the event of security deposit reduced by reason of any such deduction or sale as aforesaid, the contractor shall, within 10 days thereafter, make good in cash or Government securities endorsed as aforesaid any sum or sums which may have been deducted from, or raised by sale of his security deposit or any part thereof. The security deposit referred to, when paid in cash may, at the cost of thedepositor, be converted into interest bearing securities provided that the depositor has expressly desired this in writing.If the amount of the security deposit to be paid in a lump sum within the period specified at [A] above is not paid the tender/contract already accepted shall be considered as canceled and legal steps taken against the contractor for recovery of the amount. The amount of Security deposit retained by the MJP shall be released after expiry of period upto which the contractor has agreed to maintain the work in good order is over. In the event of the contractor failing or neglecting to complete rectification work within the period upto which the contractor has agreed to maintain the work in good order, then, subject to provisions of clauses 17 and 20 hereof the amount of Security Deposit retained by Government shall be adjusted towards the excess cost incurred by the department on rectification work.Clause-2.The time allowed for carrying out the work as entered in the tender shall be strictly observed by the contractor and shall bereckanedfrom the date on which the order tocommence work is given to the contractor. The work shall throughout the stipulated period of the contract be proceeded with all due diligence [time being deemed to be the essence of the contract on the part of the contractor] and the contractor shall pay as compensation amount equal to one percent or such smaller amount as the Superintending Engineer [whose decision in writing shall be final] may decide, of amount of the estimated cost of the whoie work as_shnwn by the tenderer for everyday that the work remains uncommenced or unfinished after the proper dales. whole security deposits forfeited[a] To rescind the contract [for which rescission notice in writing to the contractor under the sarid of Executive Engineer shall be conclusive evidence] and in that case the Security deposit of the contractor shall stand forfeited and be absolutely at the disposal of Government.[b] To carry out the work or any part of the work departmentally debiting the contractor with the cost of the work, expenditure incurred on tools and plant and charges on additional supervisory staff including the cost of work-charged establishment employed for getting unexecuted part of the work completed and crediting him with the value of the work done departmentally in all respects in the same manner and at the same rates as if it had been carried out by the contractor under the terms of his contract. The certificate of the Executive Engineer as to the cost and other allied expenses so incurred and as to the value of the work so done departmentally shall be final and conclusive against the contractor.[c] To order that the work of the contractor be measured up and to take such part thereof as shall be Unexecuted, out of his hands, and to give it to another contractor to complete, in which case all expenses incurred on advertisement for fixing a new contracting agency, additional supervisory staff including the cost of work charged establishment and the cost of the work executed by the new contract agency will be debited to the contractor and the value of the work done or executed through the new contractor shall be credited to the contractor in

all respects and in the same manner and at the same rates as if it had been carried out by the contractor under the terms of his. yatr&ct. The certificate of Executive Eismeer as to all tuis. cost of the work and other expenses incurred as aforesaidior or in getting the unexecuted work done by the new contractor and as to the value of the work so done shall be final and conclusive against the contractor.in case the contract shall be rescinded under clause [a] above the contractor shall not be entitled to recover or be paid any sum for any work therefore actually performed by him under this contract unless and until the Executive Engineer shall have certified in writing the Performance of such work and the amount payable to him in respect thereof and he shall only be entitled to be paid the amount so certified. In the event of either of the courses referred to in clause [b] or [c] being adopted and the cost of the work executed departmentally or through a new contractor and other allied expenses exceeding the value of such work credited to the contractor, the amount of excess shall be deducted from any money due to the contractor by Government under the contract or otherwise howsoever or from his security deposit or the sale proceeds thereof provided however that the contractor shall have no claim against Government even if the certified value of the work done depaifmratally or through a new contractor exceeds the certified cost of weh w-ork and allied expenses, provided always that whichever of the three courses mentioned in clauses [a] [b] or [c] is adopted by the Executive Engineer , the contractor shall have no claim to compensation for any loss sustained by him by reason of not his having purehased, or procured any materials, or entered into any engagements or made any advances on account of, or with a view to the execution of the work or the Performance of the contract.Contractor No.of Correction Executive Engineer

Clause-4.If the progress of any particular portion of the work is unsatisfactory, rhe Executive Engineer, shall not withstanding that the general progress of the work of in aecordance with the conditions mentioned in cl >use 2, be entitled to take action under clause 3[b] after giving the contractor 10 days' notice in writing. The contractor will have no claim for compensation, for any loss sustained by him owing to such action.

tools, plant, materials, or Stores, from the premises within a time to be specified in such notice; and in the event of the contractor failing to comply with any such requisition, the Executive Engineer may remove them at the contractors expense or seil them by auction or private sale on account of the contractor and at his risk in all respect, and the certificate of the Executive Engineer as to the expense of any such removal and the amount of the proceeds and expense of any such sale shall be final and conclusive against the contractor.Clause-6.If the contractor shall desire an extension of the time for completion of work on the ground of his having been unavoidably hindered in its execution or on any other ground he shall apply in writing to the Executive Engineer before the expriation of the period stipulated in the tender or before the expiration of 30 days from the date on which he was hindered as aforesaid or on which the cause for asking for exiension occurred, whichever is earlier and the Executive Engineer or in the opinion of the Superintending Engineer or Chief Engineer as the case may be if in his opinion, there were reasonable grounds for graming an extension, grant such extension as he thinks necessary or proper. The decision of the Executive Engineer / Superintending Engineer or Chief Engineer in this matter shall be final.

Extension of time

Clause-7.On the completion of the work the contractor shall be furnished with a certificate by the Executive Engineer [hereinafter called the Engineer-in-charge] of such completion, but no such certificate shall be given or shall the work be considered to be complete, until the contractor shall have removed from the premises on which the work shall have been

executed, all scaffolding, surplus materials and rubbish, and shall have cleaned off, the dirt from all woodwork, doors, Windows, walls, floor or other parts of any building in or upon which the work has been executed or of which he may have had possession for the Engineer-in-charge or where the measurements have been taken by his subordinates until they have received approval of the Engineer-in-charge the said measurements being binding and conclusive against the contractor. If the contractor shall fall tocomply with the requirements ofthis clause as to the removal of scaffolding, surplus materials and rubbish and cleaning of dirt on or before the date fixed for the completion of the work the Engineer-in-charge may at the expense of the contractor, remove such scaffolding, surplus materials and rubbish, and dispose of the same as he thinks fit and clean off such dirt as aforesaid and the contractor shall forthwith pay the amount of all expenses so incurred, but shall have no claim in respect of any such scaffolding or surplus materials as aforesaid except for any sum actually realised by the sale thereof.Clause-8.No payment shall be made for any work, estimated to cost less than rupees one thousand tili the whole of work shall have been completed and certificate of completion given but in the case of works estimated to cost more than rupees one thousand the contractor shall, on submitting a monthly bill therefor, be entitled to receive payment proportionate to the part of the work then approved and passed by the Engineer-in-charge, whose certificate of such approval and passing of the sum so payable shall be final and conclusive against the contractor. All such intermediate payments shall be regarded as payments by way of advance against the final

payment only and not as payments for work actually done and completed and shall not preclude the Engineer-in-charge from requiring any bad, unsound, imperfect or unskillful work to be removed or taken away and reconstructed or re-erected or unskillful work to be removed or taken away and reconstructed or re-erected nor shall any such payment be considered as an admission of the due Performance of the contract or any part thereof in any respect or the accuring of any claim nor shall it conclude determine or effect in any other way the powers of the Engineer-in-charge as to the final settlement and adjustment of the accounts, or otherwise, or in any way vary or affect the contract. The final bill shall be submitted by the contractor within one month of the date fixed for the completion of the work, otherwise the Engineer-in-charge certificate of the measurements and of the total amount payable for the work shall be final and binding on all parties.Clause-9.The rates for several items of works estimated rates to cost more than Rs. 1000/- agreed to within shall be valid only when the items concerned is accepted as having been eompleted fully in accordance with the sanctioned specification. In cases where the items of work are not accepted as so eompleted the Engineer-in-charge may make payment on aecount of such item at such reduced rates as he may consider reasonable in the preparation of final or on aecount bills.

Engineer-in-charge for all work executed in the previous month, and the Engineer-in-charge shall take or cause to be taken the requisite measurement for the purpose of having the same verified, and the claim, so far as it is admissible, shall be adjusted, if possible within ten days from the presentation of the bill. If the contractor does not submit the bill within the time fixed as aforesaid, the Engineer-in-charge may depute a subordinate to measure up the said work in the presence of the contractor or his duly authorised agent whose counter signature to the measurement list shall be sufficient Warrant, and the Engineer-in-charge may prepare a bill from such list which shall be binding on the contractor in all respects.

Clause-11.The contractor shall submit all bills on the printed forms to be had on application at the office of the Engineer-in-charge. The charges to be made in the bills shall always be entered at the rates speeified in tender or in the case of any extra work ordered in pursuance of these conditions, and not mentioned or provided for in the tender at the rates here in after provided for such work.

Clause-12.If the specification or estimate of the work supplied provides for the use of any special description of materials to be supplied from the store of the MJP or if it is required that the contractor shall use certain Stores to be provided by the Engineer-in-charge [such material and Stores and the price to be charged therefor as hereinafter mentioned being so far as practicable for the convenience of the contractor but not so as in any way to control the meaning or effect of this contract specified in the schedule or memorandum

hereto annexed] the contractor shall be supplied with such materials and Stores as may be required from time to time to be used by him for purposes of contract oniy and the value of full quantity of the material and stores, so supplied shall be set off or deducted from any sums then due, or thereafter to become due to the contractor under the contract, or otherwise of from the security deposit, or the proceeds of sale thereof if the security deposit is held in Government securities, the same or a sufficient portion thereof shall in that case be sold for the purpose. All materials supplied to the contractor shall remain the absolute property of MJP and shall on no account be removed from the site of the work and shall at times be open for inspection by the Engineer-in-charge. Any such material unused and inperfectly good condition at the time of completion or termination of the contract shall be returned to the MJP store,if the Engineer-in-charge so requires by a notice in writing given under hishand, but the contractor shall notbe entitled to return any such materials except with such consent of the Engineer-in-charge and he shall have no claim for compensation on account of any such material supplied to him as aforesaid but remaining unused by him or for any wastage in or damage to any such materials thereto.Clause-12[A].All stores of controlled material such as cement steel etc. supplied to the contractor by MJP to the contractor should be kept by the contractor under lock and key and will be accessible for inspection by the Executive Engineer or his authorised agent at all the timeClause-13.

The contractor shall execute the whole and every part of the work in the most substantial*and workman like manner and both as regards material and every other respect in strict accordance with specifications. As per norms of the MJP, after ascertaining the recuperation lest of the percolation well and potability of water, the work of percolation well shall be continued and completed. The further sub-works shall be taken as under.

1) ESR, GSR2) Gravity Main, Rising Main, Switch House, Installation of Pumping Machinery after 80% work of storage tank is completed.3) Distribution System.4) StandpostThe contractor shall also conform exactly, fully and faithfully to the designs drawings and instructions in writing relating to work assigned by the Engineer-in-charge and lodged in his office and to which the contractor shall be entitled to receive three sets of contract drawing and working drawings as well as one certified copy of the accepted tender along with the work order free of cost. Further copies of the contract drawings and working drawing if required by him, shall be supplied at the rate of Rs. 1000 per set of contract drawing and Rs. 500 per working drawing except where otherwise specified.Clause-14.The Engineer-in-charge shall have power to make any alteration in or additions to the original specification, drawings, designs and instructions that may appear to him to be necessary or advisable during the progress of the work and the contractor shall be bound to carry out the work in accordance with any

Instruction in this connection which may be given to him in writing signed by the Engineer-in-charge and such alteration shall not invalidate the contract and any additional work which the contractor may be directed to do in the manner above specified as part of the work shall be carried out by the contractor on the same conditions in all respects on which he agreed to to do the main work and if the additional and altered work included in this dass bf work' for which no tate is specified in this contract, then such dass of work shall be carried out at the rates entered in the scheduled of Rates of the Division or at rates mutually agreed upon between the Engineer-in-charge and the Contractor whichever are lower. If the aditional or altered work for which no rate is entered or in the schedule of Rates of the Division is ordered to be carried out before the rates are agreed upon then the contractor shall within seven days of the date of receipt by him of the order to carry out the work, inform the Engineer-iriHcharge does not out such dass of work and arrange to carry out in such manner as he may consider advisable provided always that if the contractor shall commence work or incur any expenditure inregard thereto before the rates shall only be entitled to be paid in determination of the rates as aforesaid according to such rate or rates as shall be fixed by the Engineer-in-charge. In the event of a dispute, the decision of the Superintending Engineer of the Circle will be final. Where, however, the work is to be executed according to the designs, drawings and specifications recommended by the contractor and accepted by the Competent Authority the alterations above referred to shall be within the scope of such designs, drawings and specifications appended to the tender.

The time limit for the completion of the work shall be extended in the proportion that the increase in its cost occasioned by alterations or addiuons bears to the cost of the original contract work, and the certificate of the Engineer-in-charge as to such proportion shall be conclusive. Clause-15.1. If at any time after the execution of the contract documents the Engineer-in-charge shall for any reason whatsoever [other than default on the part of the contractor for which the MJP is entitled to rescind the contract] desires that the whole or any part of the work specified in the tender should be suspended for any period or that the whole or part of the work specified in the tender should not be carried out at all he shall give to the contractor a notice in writing of such desire & upon the receipt of such notice the contractor shall forth with suspend or stop the work wholly or in part as required, after having due regard to. the appropriate stage at which the work should be stopped or suspended so as not to cause any damage or injury to the work or any part of it could be or could have been safely stopped or suspended shall be final and conclusive against the contractor. The. contractor shall have no claim to any payment or coinpensation whatsoever by reason of or in presuance of any notice as aforesaid, on account of any Suspension, stoppage or curtailment except to the extent specified here in after.2. Where the total Suspension of work ordered as aforesaid continued for a continuous period exceeding 90 days the contractor shall be at liberty to withdraw from the contractual obligations under the contract so far as it pertains to the unexecuted part of the work by giing a 10 days prior notice in writing to the Engineer, within 30 days of the expiry of the said period of 90 days, of such intention and requiring the Engineer to record the final measurement of the work already done and to pay final bill. Upon giving such notice the contractor shall be deemed to have been discharged from his Obligation to complete the remaining unexecuted work under his contract. On receipt of such notice the Engineer shall proceed to complete the measurement and make such payment as may be finally due to the contractor within a period of 90 days from the receipt of such notice in respect of the work already done by the contractor such payments shall not any manner prejudice the right of the contractor to any further compensation under the remaining provisions of this clause. 3. Where the Engineer required the contractor to suspend the work for a period in excess of 30 days at any time or 60days in the aggregate the contractor shall be entitled to apply to the Engineer within 30 days of the resumption of work after such Suspension for payment of compensation to the extent of pecuniary loss suffered by him in respect of working machinery rendered idle on the site or on the account of his having had to pay the salary or wages of labour engaged by him during the said period oi Suspension, provided always that the contractor shall not be entitled to any claim irrespect of any such working machinery, or such Suspension or in respect of any Suspension whatsoever occasioned by unsatisfactory work or any other default on his part. The decision of the Engineer in this regard shall be final and conclusive against the contractor.4. In the event of-

i) Any total stoppage of work on notice from the Engineer under Sub clause [1] in that behalf,ii) Withdrawal by the contractor from the contractual Obligation to complete the remaining unexecuted work under sub-clause [2] on account of continued Suspension of work for a period exceeding 90 days.iii) Curtailment in the quantity of item or items originally tendered on account of any alteration, Omission or substitutions in the specification drawings, designs, or Instructions under clause 15 [1] where such curtailment exceeds 25% in percent in quantity and the vaiue of the quantity curtailed beyond 25% at the rates for the item specified in the tender is more than Rs. 5000/-.

It shall be open to the contractor, within 90 days from the Service of [1] the notice of stoppage of work or [ii] the notice of withdrawalt'rom the contractual obligations under the contract on account of the continued Suspension of work or [iii] notice under clause 15 [1] resulting in such curtailment, to produce to the Engineer satisfactory doeumentary evidence that he had purchased or agreed to purchase materiai for use in the contracted work, before receipt by him of the notice of stoppage, Suspension or curtailment and require the MJP to iake over on payment such materiai at the rates determined by the Engineer, provided, however that, such rates shall in no case exceed the rates at which the same v as acquired by the contractor. thereafter take over the materiai so offered, provided the quantities offered, are not in excess of the requirements of the unexecuted work as specified in the accepted tender and are of quality and specifications approved by the Engineer.Clause 15 [A].The contractor shall not be entitled to claim any compensation from MJP for the loss suffered by him on account of delay by MJP in the supply of materiais entered ir. Sehedule 'A' where such delay is caused by :-i] Difficulties relatuig to the supply of railway wagons.\iij Force majeureiii] ActofGodiv] Act of enemies of the States or any other rcasonablecause beyond the controi of MJP.In the case of such delay in the supply of materiais, MJP shall grant such extension of time for the completion of the works as shall appear to the Executive Engineer to be reasonable in accordance with circumstances of the case. The decision of the Executive Engineer as to the extension of time shall be accepted as final by the contractor.

subordinate in Charge of the work, that any work has been executed with unsound imperfect or unskilled workmanship or with materials of inferior quality, or that any materials or articles provided by him for the execution of the work are unsound or of a quality inferior to that contracted for, or are otherwise not in accordance with the contract it shall be lawful for the Engineer-in-charge to intimate this fact in writing to the contractor and then not withstanding the fact that the work materials or articles complained of may have been inadvertently passed, certified and paid for the contractor shall be bound forthwith to rectify, or remove and reconstruct the work so specified in whole or in part as the case may require or if so required shall remove the materials or articles so specified and provide other proper and suitable materials or articles at his own charge and cost, and in the event of his failing to do so within a period to be specified by the Engineer-in-charge in the written intimation aforesaid, the contractor shall be liable to pay compensation at the rate of one percent on the amount of the estimate for everyday not exceeding ten days during which the failure so continues and in the event of any such failure the Engineer-in-charge may rectify or remove and re-execute the work or remove and replace the materials or articles complained of as the case may be at the risk and expense in all respects of the contractor. Should the Engineer-in-charge consider that any such inferior work or material as described above may be accepted or made use of it shall be within his discretion to accept the same at such reduced rates as he may fix therefor.Clause-18.All works under or in course of execution or executed in pursuance of the contract shall at Works to be open to

all times be open to the inspection and supervision of the Engineer-in-charge and his subordinates and the contractor shall at all times during the usual working hours, and at all other times at which reasonsible notice of the intention of the Engineer-in-charge and his subordinates, to visit the work shall have been given to the contractor either himself be present to receive Orders and Instructions or have a responable agent duly accredited in writing present for that purpose. contract or for the period as nientioned below after commissioning the work, whichever is earlier in the opinion of the Executive Engineer, the said work is defective in any manner whatsoever, the contractor shall forthwith on receipt of notice in that behalf from the Executive Engineer, duly commence execution and completely carry out at his cost in every respect all the work that may be necessary for rectifying and setting right the defects specified therein including dismantling and reconstruction of unsafe portions strictly in accordance with and in the manner prescribed and under the supervision the Executive Engineer. In the event of the contractor failing or neglecting to commence execution of the said rectification work within the period prescribed therefor in the said notice and/or to complete the same as aforesaid as required by the same notice, the Executive Engineer may get the s.ime executed.and carried out departmentally or by any other agency at the risk on account and at the cost of the contractor. The contractor shall forthwith on demand pay to the MJP che amount of such costs, charges and expenses sustained or incurred by the MIP of which the certificate of the Executive Engineer shall be final & binding on the Contractor, such costs, changes & expences, shall be deemed to be arrears of land revenue and in the event of the contractor failing or neglecting to pay the same on demand as aforesaid without prejudice to any other rights and remedies of che MJP, the same may be recovered from the contractor as arrears of land revenue. assisting in the measurement or examination at uny time and from timc to timeof the work orthe materials, failing this the saine may be provided by the Engineer-in-charge at the expense of the contractor and expenses may be deducted from any money due to the contractor under the contract or from his security deposit or the proceeds of sale thereof, or of a sufficient portion thereof. The contractor shall provide all necessary fencing and lights required to protect the public from accident, and shall also be bound to bear the expenses of defence of every suit, action or other legal proceedings, at law that may be brought by any person for injury sustained owing to neglect of the above precautions, and to pay any damages and costs which may be awarded in any such suit action or proceedings to any such person, or which may be with consent of the contractor be paid for compromising any claim be any such person. List of machinery in contractor's possession and which he proposed to use on the work should be submitted alongwith the tender.Clause-21(A). The contractor shall provide suitable scaffolds and working platforms gangways and stairways and shall comply with the following regulations in connection therewith :a) Suitable scaffolds shall be provided for workmen for all works that cannot be safely done from a ladder or by other means.b) A scaffold shall not be constructed, taken down or substantially altered except :-

e) Every crane driver or hoisting appliance operator shall be properly qualified.f) No person who i.s bciow tiie age of 18 years shall be in control of any hoisting machine, including any scaffold which, orgives Signals to the operator.g) In the case of every hoisting machine and every chain, ring, hook, shackle, swivel and pulley block used in hoisting or

lowering or as a means of Suspension, the safe working load shall be ascertained by adequate means.h) Every hoisting machine and all gear referred to in preceding regulation shall be plainly marked with the safe working load.i) In the case of a hoisting machine having a variable safe working load each safe working load and the conditions under which it is applicable shall be clearly indicated.j) No part of any hoisting machine or any gear referred to in regulation(g) above shall be loaded beyond the safe working load except for the purpose of testing.k) Motors, gearing transmissions, electric

wiring and other dangerous parts of hoisting applicances shall be provided with efficient safeguards.l) Hoisting applicances shall be provided with such means as will reduce to minimum & the risk of the accidental descent of load.m) Adequate precaution shall be taken to reduce to a minimum the risk of any part of a suspended load becoming accidentally displaced.Clause-22.The contractor shall not set fire to any Standing jungle, trees, brushwood or grass without a written permission fromthe Executive Engineer. When such permission is given, and also in all cases when destroying cut or dug up trees, brushwood, grass etc. by fire, the contractor shall take necessary measures to prevent such fire spreading to or otherwise damaging surrounding property. The contractor shall make his own arrangement for drinking water for the labour employed by him.

Clause-23.Compensation for all damages done intentionally or unitentionally by contractor's labour whether in or beyond the limits of the MJP property including any damage caused by the spreading fo fire mentioned clause 22 shall be estimated by the Engineer-in-charge or such other officer as he may appoint and the estimate of the Engineer-in-charge, subject to the decision of the Superintending Engineer on appeal shall be final and the contractor shall be bound to pay the arnount of the assessed compensation on demand, failing which the

time carried on.Clause-30.1.Except where otherwise specified in the contract and subject to the powers delegated to him by MJP under the eode,.ruies then inforce, thedecision of the Superintending Engineer of the Circle for the time being shall be final, conclusive and binding on all parties of the contract upon all questions relating to the meaning of the specifications, designs, drawings and Instruction herein before mentioned and as to the quality of workmanship, or materials used on the wortc, or as to any other question, claim, right, matter or thing whatsoever, in any way ansing out of, or relating to the contract designs,drawings, specifications, estimates instructions, Orders or these conditions, or otherwise concerning the works, or the execution or failure to execute the same,whether arising during the progress of work, or after the completion or abandonment thereof.30.2 The contractor may within thirty days of receipt by him of any order passed by the Superintending Engineer of the Circle as aforesaid appeal against it to the Chief Engineer, concerned with the contract work or project provided that -a. Clause-31.The contractor shail obtain from MJP Stores all Stores and articles of European or American manufacture which may required for the work orany part thereof or in making up any articles required thereforor in connection therewith unless he has obtained permission in writing from the Engineer - in - Charge to obtain such Stores and articles elsewhere. The value of stores and articles as may be supplied to the contractor will be debited to his account at the rates shown in the schedule 'A' Attached to the contract and if they are not entered in the said schedule, they shall be debited to him at cost price which for the purpose of this contract shall include the cost of carriage and all other expenses. whatsoever, which shall have been incurred in obtaining delivery of the same at the stores aforesaid.

CIause-32.When the estimate on which a tender is made includes lumpsum in respect of parts of the work, the contractor shall be entitled to payment in respect of the items of work involved or the part of the work in question at the same rates as are payable under this contract for each items, or if the part of the work in question is not in the opinion of the Engineer-in-charge capable of measurement, the Engineer-in-charge may at his discretion pay the lump sum amount

entered in the estimate and the certificate in writing of the Engineer-in-charge shall be final and conclusive against the contractor with regard to any sum or sums payable to him under the provisions of this clause.Clause-33In the case of any dass of work for which there is no suchspecification as is mentioned in Rule Ion Bl such work shall be carried out in accordance with the Divisional Speci, and in the event of there buying no Divisional specification, then in such case the work shall be carried out in all respect in accordance with all instructions and requirements of the Engineer-in-charge.

CIause-34The expression "work" or "works" where used in these conditions shall unless there be some thing in the subject or context repugnant to such construction, be constructed to mean the work or the works contracted to be executed under or in virtue of the contract, whether temporary or permanent and whether original, altered, substituted or additional.

contractor.Clause-37The contractor shall be responsible for and shall pay any compensation to his workmen payable under the Workmen's Compensation Act, 1923 (VIII of 1923), (hereinafter called the said Act.) for injuries caused to the workmen. If such compensation is payable/paid by the MJP as principle under sub-section (i) of Section 12 of the said Act on behalf of the contractor, it shall be recoverable by the MJP from the contractor under sub-section (2) of the said section. Such Compensation shall be recovered in the manner laid down in Clause 1 above.

Clause-37 (A)The contractor shall be responsible for and shall pay the expenses öf providing medical aid to any workman who may suffer a bodily injuryas a result of an accident. apparatus available for the use of the persons employed on the site and shall maintain the same in condition suitable for immediate use at any time and shall comply with the following regulations in connection therewith.(a) The workers shall be required to use the equipments so provided by the contractor and the contractor shall take adequate steps to ensure proper use of the equipment by those concerned.(b) When work is carried or approximity to any place where there is a risk of drowning all necessary, equipment shall be provided & kept ready for use & all necessary steps shall be taken for the prompt rescue of any person in danger.(c) Adequate provision shall be made for prompt first-aid treatment of all injuries likely to be sustained during the course of the work.

CIause-37(C)The contractor shall duly comply with the provisions of The Apprentices Act, 196l(LII of 1961), the rules made thereunder and the Orders that may be issued from time to time under the said Act and the said Rules and on his failure or neglect to do so he shall be subject to all the liabilities and penalties provided by the said Act and said Rules.Clause-38.(l) Quantities shown in the tender are Evaluation cost

Claims arising out of reduction in the tendered quantity of any item beyond 25 per cent will be governed by the provision of clause 15 only when the amount of such reduction beyond 25 percent at the rate of the item specified in the tender is more than Rs 5000/- This reduction is exclusively the reduction in clause nos. 2,1,4 of work and site conditions.(5) There is no change in the rate if the excess is less than or equal to 25 percent. Executive Engineer, whenever the excess quantities beyond those specified in the tender are executed, the payment in excess of the quantities specified in the tender will be made by the Executive Engineer only after getting approval from the appropriate authority viz. Superintending Engineer, if the cost of excess quantity at prevailing DSR is(i) upto Rs. 50,000/ - (Rupees fifty Thousand only) for estimated cost put to tender upto Rs. 10,00,000/- and (ii) upto Rs. 1,00,000/- (Rupees One Lakh only) (considering quantities of all items and not of individual item) when the estimated cost put to tender is more than Rs. 10,00,000/-. Engineer- in-charge. etc. Clause-40No compensation shall be allowed for any delay caused in the starting of the work on account of acquisition of land or, in the case of clearance works.on account of any delay in according sanction of estimates.

Clause-42The contractor shall not enter upon or commence any portion of work except with written authority and Instructions of the Engineer-in-charge or of his subordinate in Charge of the work. Failing such authority the contractor shall have no claim to ask for measurements of or payment for work.

iii) No animal suffering from sores lumeness or emaneination or which is immature shall be imployed on the work.iv) The Engineer-in-charge or his Agent is authorised to remove from the work, any person or animal found working which does not satisfy these conditions and no responsiblity shall be accepted by the MJP for any delay caused in the completion of the work by such removal.v) The contractor shall pay fair and reasonable wages to the workmen employed by him, in the contract undertaken by him. In the event of the dispute arising between the contractor and his workmen on the grounds that the wages paid are not fair and reasonable, the dispute shall be referred without delay to the Executive Engineer who shall decide the same. The decision of the Executive Engineer shall be conclusive and binding on the contractor but such decision shall not in any way affect the conditions in the contract regarding the payment to be made by the MJP at the sanctioned tender rates. vi) Contractor shall provide drinking water facilities to the workers. Similar amenities shall be provided to the workers engaged on large work in urban areas.vii)The contractor to take precautions against accidents which take place on account of labour using Ioose garments while working near machinery.

Clause – 45Anly contractor who does not accept these conditions shall not be allowed to tender for work Acceptance of conditions compulsary before tendering for work Clause – 46If Government declare a site of scarcity or famine to exist in any vallage situated within 10 km. of the work, the contractor shall employ upon such parts of the work as are suitable for unskilled labour, any person certified to him by the Executive Engineer, or by any person to whom the executive Engineer may have delegated this duty in writing to be in need of relief and shall be bound to pay to such person wages not below the minimum wages which Government may have fixed in this behalf any disputes which may arise in connection with the implementation of this clause shall be decided by the Executive Engineer whose decision shall be final and binding on the contractor

Clause – 47The price quoted by ihe contraclors shall not in any case exceed the control price, if any. fixed by die Government or reasonable price which it is permissible for him to charge a private purchaser for the same class and description the control price or the price Permissible under the provisions of Hoarding and Profiteering preventing Ordinance, 1948 as amended from time to time. Prevention Ordinance, the contractor will specifically mention this fact in his tender alongwith the reasons for quoting such higher prices. The purchaser at his discretion will in such case exercise the right of revising the price at any stage so as to conform with the controlled price as permissible under the Hoarding and Profiteering Prevention Ordinance. This discretion will be exercised without prejudice to any other action that may be taken against the contractor.Clause – 48The rates to be quoted by the Contractor must be inclusive of all taxes levied by the Central & state Govt .No extra payment on this account shall be made to the Contractor. Clause – 49In case of materials that may rciiiuin surplus wiüi the Contractor from those issued, the daie of ascertainment of the materials being surplus will be taken as the date of sale for the purpose of Sales Tax and the Sales Tax will be recovered on such sale.Clause - 50The contractor shall employ ai least 80 per cent of the total number of unskilled labour to be employed by him on the said work form out of the persons ordinarily residing in the district in which site of the said work is located.Provided, however, that if the required number of unskilled labour from that district is not available, the contractor shall in the first instance employ such number of persons as is avaiJable and thereafter may with the previous permission in writing öf the Executive Engineer in Charge of the said work, obtain the rest of the requirement of unskilled labour from outside district.

Clause-51The Contractor shall pay the labourers - skilled and unskilled -according to the wages prescribed by Minimum Wages Act applicable to the area in which the work of the Contractor is located.The Contractor shall comply with the provision of the Apprentices Act, 1961 and the Rules and Orders issued thereunder from time to time. If he fails to do so his failue will be a breach of the contract and the Superintending Engineer may in his discretion cancel the contract. The Contractor shall also be liable for any pecuniary liability arising on account of any violation by him of the provisions of the Act. The Contractor shall pay the labourers - skilled and unskilled - according to wages prescribed by Minimum Wages Act applicable to the area in which the work lies.

Wages to be paid to the skilled and unskilled labour engaged by the contractor

Clause-52All amounts whatsoever which the contractor is liable to pay to the MJP in connection with the execution of the work including the amount payable in respect of (i) materials and/stores stores supplied/ issued hereunder by the MJP to the contractor (ii) hire charges in respect of heavy plant, machinery and equipment given on hire by the MJP to the contractor for execution by him of the work and/or for which advances have been given by the MJP to the contractor shall be deemed to be arrears of Land Revenue and the MJP may without prejudice to any other rights and remedies of the MJP recover the same from the contractor as arrears of Land revenue.CIause-53

The successful tenders will be required to produce to the satisfaction of the specified concerned authority valid and consequent licence issued in favour of the Contractor under the provisions of the Contract Labour (Regulation and Abolition) Act, 1970 before starting the work. On failure to do so, the acceptance of the tender should be liable to be withdrawn and also the earnest money.The contractor shall duly comply with all the provisions of the contract Labour (Regulation and Abolition)Act, 1970 (37 of 1970) and the Maharashtra Contract Labour (Regulation and Abolition)Rules, 1971 as amended from time to time and all other relevant Statutes and statutory provisions concerning payment of wages particularly to workmen employed by the contractor and working on the site of the work. In particular the contractor shall pay wages to each worker employed by him on the site of the work. If the contractor fails or neglects to pay wages at the said rates or inakes short payment and the MJP makes such payment of wages in füll or part thereof less paid by the contractor, as the case may be, the amount, so paid by the MJPto such workers shall be deemed to be arrears of land revenue and the MJP shall be erititled to recover the same as such amount from the contractor or deduct the same from the amount payable by the M1P to the contractor hereunder or from any other amount/s payable to him by the MJP.Clause-54Where the workers are required to work near machines and are liable to accidents they should not be allowed to

wear loose clothes like dhoti, jhabba, etc.Clause 55The contractor shall comply with provisions of the Apprentices Act. 1961 and the Rules and Orders issued there under from time to time. If he fails to do so, his failure will be a breach of the contract the Superintending Engineer may in his discreation cancle the contract.. 1)The contractor shall provide in the joint names of Clause of InsuranceEngineer in charge and contractor, insurance cover only from the Govt. insurance, Maharashtra State is 264, Ist floor, MHADA,Opp. Kalanagar Bandra east, Mumbai-400051. Insurance policy / policies taken out from other company will not be accepted.

a)Loss of damage to civil, mechanical and Electrical equipment supplied/installed including the material such as pipes, valves specials etc brought on site.

b)Loss of damage to the Contractor’s equipment including his vehicles.

c)Loss of damage to property (except the works, plant materials and equipment) in connection with the contractor and ,

d)Personal injury or death due to vehicles of the contractor and / or due to any accident that may arise at or around the site to the contractor personal or to the MJP staff or to any other person not connected with MJP/Contractor.

2)Policies and certificates for insurance shall be delivered by the contractor to the Engineer for starting of work. All such insurance shall provide for compensation to be payable in the types of proportions of currencies required to rectify the loss or damage incurred.

3)If the Contractor does not produce any of the policies and certificates and required, the Engineer may effect the insurance for which the contractor should have produced the policies and certificates and recovered the premiums it has paid from payment otherwise due to the contractor or , if no payment is due , the payment of the premiums shall be of debt due.

4)Alterations to the terms of an insurance shall not be made without the approval of the Engineer.

5)The minimum insurance covered for loss and damages to physical property, injury and death shall be 40% of the contract cost per occurrence with number of occurrences as 4 (four) . After each

occurrence the contractor shall pay additional premium necessary so as to keep the insurance policy valid always till the defect liability period is covered.

6)No payment will be released to the contractor until the insurance coverage with Govt. insurance fund, Maharashtra State is provided and unless the proof of insurance coverage is produced by the contractor to the Engineer in charge.

G E N E R A LG E N E R A L C O N D I T I O N SC O N D I T I O N S

1. Unless otherwise specifically provided for either in tender items or in specification or

in the schedule of supply of materials, all items in the tender are exclusive of cost all

materials required for the execution of the items and these, are to be provided as per

relevant ISS or standard specification.

2. All the materials used in the work shall be of best quality and any materials rejected

shall be removed from the site within 24 hours.

3. All items to be executed in the course of the work have to be executed by the contractor

as per specification in the P.W.D. Hand-books, the books of standard specification,

published by the public works Department of Government of Maharashtra, relevant I.

S. specifications (Latest editions) and practice in vogue, at the rates as per rules of the

MJP and conditions of agreement in this respect.

The contractors shall be responsible and liable to pay of damage to public property

caused by him. He should keep the accounts of such materials in suitable book which

would be available for inspection to the Engineer-in-charge. The contractor shall be

responsible for proper handling and safe custody of all material delivered by him or

supplied by Dept. use on work. The material including pipes shall be procured by the

contractor as per requirement of work and no excess material shall be procured. Only

used material (with permissible wastage) shall be paid to the contractor. The excess

material, remaining if any and if not required by MJP shall be purchased back by the

contractor at purchased rate.

4. For all accident on the contracted works, the contractor shall be responsible to pay the

compensation to the sufferer or his legal dependents as per legal compensation Act in

force.

5. The contractor shall engage an authorised agent or an experienced qualified supervisor

for the work capable of managing and guiding the work on his behalf. He shall take

such orders as may be given to him by the Engineer-in-charge from time to time and

shall be responsible to carry out them promptly.

6. A work order book shall be maintained at the works site. The contractor shall sign the

orders given by the engineer-in-charge and Sub-Divisional officer and shall carry them

promptly. After completion of the work, the work order book shall be surrendered to

the MJP.

7. Quantities given in the tender are approximate and are liable for variation. Excavation

of the trenches/its will be according to actual strata met with. The contractor shall have

no claim for compensation on account of any variation in the quantity sand also for any

variation in the depth for trenches/pits shown in the drawings.

8. The contractor shall at his own expenses make all necessary provisions for housing,

water supply and sanitary arrangements for his employees and shall pay direct to the

authorities concerned all taxes and other charges. The contractor shall also comply

with all requirement of the Health Board in regard to anti-malaria.

9. It must clearly understood that the conditions of the contract and specifications are

intended to be rigidity enforced and no relaxation on the ground of conditions

prevailing is to be allowed.

10. The contractor will be entirely responsible for breach of laws of local bodies,

Government etc. While using private or public conveyance procuring and stacking of

materials, Employment of labour etc. and he will meet out all expenses in this contract

without any claim whatsoever on the Board and the Board shall not take any

responsibility on this account.

11. Before entering any property, plot, land, premises or areas, etc. the contractor shall

make his own independent investigation through the collector or Inspector of Land

Records etc. on his own about the ownership of the plot etc. and he will be liable for

action for act of encroachment, trespass etc. committed by him or his labour or for the

steps taken by the party concerned.

12. The contractor shall have to clear the site of work before the commencement of work

and after the completion of the work without any extra cost. The contractor shall

construct at his cost a temporary shed of about 20 sq. mtr. carpet area as per

specification, use as office and provided within fifteen days from the date of receipt of

work order. It will be maintained properly till the work is completed. The shed and

furniture will be allowed to be taken a back by the contractor after the work is

completed. The department shall not pay any rent, charges for the shed etc. and no

MJP's materials will be issued by the MJP's for this shed.

13. A jeepable service road, wherever necessary shall be provided and maintained by the

contractor at his cost till the completion of the work.

14. The contractor shall arrange for final lineout of work, at his own cost and under

supervision of responsible representatives of the MJP.

15. All cement concrete shall be machine mixed vibrated unless otherwise instructed by the

Executive Engineer.

16. The contractor shall furnish a list of machinery in his possession which he purposes to

use on the work.

17. The contractor shall follow the instructions in general under notes for guidance of page

I and II of the P.W.D. hand Book Volume I.

18. Labour Regulation :

The contractor will have to abide by the provision made under the contract labour

(Regulations and Abolition ) Act 1970 and Rules made thereunder by Government of

Maharashtra. License shall have to be produced prior to starting of work.

19. All item occurring in the work & as found necessary in actual execution shall be carried

out in workmanship & like manner as per specification given in P.W.D. Hand book &

as per current specification prevalent in MJP as per orders of Engineer-in-charge as

stated above.

1) Payment against excess Quantities of various Items :-

A. Before making payment of excess quantities as per rules, the concerned Executive

Engineer should get himself satisfied regarding genuineness of the claim and he should

also exercise a compulsory check of minimum 10% on measurements for a particular

item.

Executive Engineer shall make payment of such excess quantity limited to Rs. 3

Lakhs. Beyond the aforesaid limit the proposal shall be submitted to Superintending

Engineer’s office. After approval of the same the required payment will be made.

B. For executing any quantity excess over the quantity specified in the tender, the

contractor should be authorised by the Executive Engineer in writing.

C. While asking the contractor to execute such excess quantity, the concerned Executive

Engineer, should inform the contractor in writing specifically that the payment in

excess of quantities specified in the tender will be made as per directions given in MJP

Circular.

2) General :

1. The quoted rate shall be the total rate for the completed item of work as per

specification and shall be inclusive of all incidental charges such as lifts, leads for

materials, water for construction etc. The rates for excavation are inclusive of final

edge of excavated pit beyond foundations.

2. The tenderer must obtain on his own responsibility and at his own expenses all the

information which may be necessary for the purpose of making a tender and for

entering into a contract and must consider and satisfy himself with all local conditions,

site sand quarries, means of accesses, the nature of rock, materials to be met with in all

execution and all materials pertaining to work.

3. Specification of item stipulated for other sub work, shall be made applicable, where

relevant.

3) Outline of Works :

1. The work will be done on the lines of hydraulic design & drawings

attached to the tender documents. The drawings are, however, liable to be changed as

per structural design requirement and strata as shown there is approximate.

2. The Subworks of work are given in Schedule – B of the tender.

4) Unit :

The rates quoted for each item are for unit mentioned in schedule-B against each item.

5) Site Conditions :

1. It shall be presumed that the contractor has satisfied himself as to the nature and

location of the work, general and local conditions, particularly those bearing on

transport handling, storage of materials, availability of labour, weather conditions and

has estimated the cost and quoted his rates accordingly. Pradhikaran will bear no

responsibility for lack of such acquaintance with site conditions and consequences

thereof.

2. Set of tender documents as and conditions (up to a maximum of three sets) at the

discretion of the Executive Engineer, will be supplied to the contractor after acceptance

of tender.

6) Extras, Omissions and Discrepancies :

In all cases of the omissions, doubts or discrepancies in the dimensions in the drawing

and items of works, reference shall be made to the Executive Engineer, whose

elucidation and elaboration shall be considered final.

7) Supply of Material by the contractor :-

1) The contractor should supply all material mentioned in schedule 'B'. This

shall be conforming to relevant ISS as enclosed herein. All types of pipes, valves

will be accepted only after due inspection of SGS/RITES. The charges for the

same shall be borne by the contractor.

2) Other material such as cement, HYSD steel, etc. shall be conforming to

relevant ISS. Testing charges for cement tor steel shall be borne by the contractor.

L&T cement shall preferably be used for water retaining structure. The contractor

must produce manufacture’s certificate before use of material.

3) Sample of steel cement shall be tested from standard institutes like

VNIT/Govt. Polytechnic. 80% of procurement price will be paid to the contractor

on receipt of pipes, valves etc. with due inspection by SGS/RITES manufacture’s

Test certificate. 5% of procurement price will be paid after lowering & laying and

15% remaining amount will be released after giving satisfactory hydraulic testing.

4) The contractor shall provide, at the site of work satisfactory storage for not

less than one month's average consumption of works and shall keep the cement

stored in a manner that will satisfy the Executive Engineer. The arrangement of

storage and utilisation of cement in the order of its arrival at the stores and the

contractor shall maintain satisfactory records. Which would at any time show the

dates of receipt and proposed utilisation of cement lying in the storage.

5) The Executive Engineer-in-charge shall at the times have access to the

stores and sites, method of storage records, and security provided by the contractor.

The contractor shall comply with instructions that will be given by executive

engineer, in this behalf.

6) The contractor shall further at all times satisfy the Executive Engineer on demand

by production of books, of submission of returns in Proforma as directed, other

proofs, that the cement supplied is being sued for the purpose for which it is

supplied and the contractor shall at all times keep his records up-to-date and

available to the Executive Engineer.

8) Conditions relating to Insurance

Contractor shall take out necessary Insurance Policy so as to provide adequate

insurance cover for execution of the awarded contract work from the "Directorate of

Insurance, Maharashtra State, Mumbai – 400 051" only. It's postal address for

correspondence is "264-First Floor, MHADA, Opp. Kalanagar, Bandra (East),

Mumbai – 400 051, (Tel No. 6438406 / 6438690, (Fax) 6438461). Insurance

policy/policies taken out from any other insurance company will not be accepted.

However, if the contractors desire to effect insurance with the local office of any

insurance company , the same should be under the co-insurance-cum-servicing

arrangement (with G.I.F.'s 60% and Insurance Company's 40%) approved by the

Directorate of Insurance. If the policy taken out by the contractors is not on co-

insurance basis the same will not be accepted and the amount of premium

calculated by the Directorate of Insurance will be recovered directly from the

amount payable to the contractors for the executed contract work which may be

noted.

9) Payment for excavation for pipe trenches

No payment will be made for partial excavation, payment will be made only after

excavation for 1 m. or designed depth is completed.

10) Royalty Clause

The contractor shall pay the royalty charges to Govt., if the point is raised by

District Collector for which no reimbursement will be made by M.J.P., during the

valied time of contractor, certificate to that extent shall be furnish by the contractor.

Failing to which his final bill payment will not be paid. If the point is raised after

the defect liability period the burden of payment of royalty to Govt. will rest on the

owner of scheme.

8) Design and drawings supplied by the department and work carried out as per

drawings and design supplied by the department.

Time bound execution and planning of work to be submitted by the contractor.

The contractor must submit the monthly execution schedule of each sub work (which shall

not exceed the time limit mentioned in the tender) and which is obligatory on the part of

the contractor at the time of submission of tender. It should invariably be in the form of

Bar chart.

On acceptance of tender, the contractor must submit the detailed execution programme

based on the Bar chart attached in the tender at the time of submission.

If the deviation in the execution schedule at any stage of work is found to be more than

10% the Competent Authority shall have the right to terminate the tender of such contract.

Time of completion of work :

1. If at any stage of work, it is found that the execution of work is not as per the

programme given in the Bar chart, a fine shall be imposed on the contractor as per the

condition of Clause 2 of the contract document.

Dues :

The outstanding dues against contractor of any other work will be recovered from the

payment of this work. The right to recover is reserved with MJP.

Mode of payment :

1. This work is taken by MJP as Full deposit work from Muniipal Council Gondia as

such the payment to the contractor against this work will be made by MJP.

2. The payment of R.A. Bill is subject to the availability of funds released by concern

Muniipal Council Gondia.

3. No compensation will be paid in case of delay in making of payment against the

bills produced by contractor.

Persons tendering for the work covered by the schedule will be required to complete the work within the period as specified below.NAME OF THE OWNERIn all the contents mentioned anywhere in this tender, owner is Maharashtra Jeevan Pradhikaran and or the competent authority of the M.J.P. at appropriate level. The use of the word " Government" anywhere in the contents , to mean the owner of work shall have by similar and same meaning as in use Maharashtra Jeevan Pradhikaran unless otherwise so required.1) COMPETENCY TO TENDERThe work will be awarded only to those contractors who are considered to be responsible bidders, capable of performing the class of work to be completed. Before passing the final award, any or all bidders may have completed. Before passing the final award, any or all bidders may have to show that he has necessary experience, facilities, abilities, manpower and financial resource to execute the work in satisfactory manner and also within the stipulated time. 2) PAYMENTS The tenderers must understand clearly that the rates quoted are completed

in the texty of the documents are herewith will be allowed and any such erase

or any alteration will be disreguarded. If there is ad error in writing, no over

writing should be done but the wrong won! or figures should be struck out

and the correct one written above q near it in an unambiguous way. Such

corrections should be initialed and dated.

4) ACCEPTANCE

Intimation of acceptance of tender will be given by a letter sent by registered

post to the address given below the signature of the tenderes in the tender.

The tenderers who do not fulfill any of the above conditions or those in the

form and which are incomplete in an} respect shall be liable for rejection.

5) ADDITIONAL PRECAUTIONS TO BE TAKEN BY THE

CONTRACTOR TO PREVENT ACCIDENT

1) These are in addition to over and above those mentioned elsewhere in the

contract document. No live electric lines should be allowed to run along the

ground in the blasting zone and they should be at lead about 3.3 mm above

ground.

2) The wiring cable should not be taken near the live electric line and" should

preferable shot firing cable as supplied by the supplier explosive. If such

cable is not available a substitute cable recommended by the explosive suppliers should only be used. Under no circumstances should cable made up several pieces jointed and taped be used.3) The blasting shed form where the exploder is to be finally operate should be at least 175 m. away from the area to be blasted. It should have a strong roof which can withstand the impact of the flying stones at this range.Only trained hands should be allowed to handle explosive cables, detonators etc.6) CONTRACTOR TO UNDERST AND HIMSELF FULLYThe contractor shall be deemed to have carefully examined the work and site conditions including labour, the general and the special conditions, the specifications schedules and drawings and shall be deemed to have visited the site of the work and to have fully understand himself regarding the local conditions and carried out his own investigations to arrive at the rates quoted in the tender. In this regard he will be given necessary information to the best of knowledge of Department but without any guarantee about it.If he shall have any doubts as to them meaning of any portion of these general conditions or the special conditions to the scope of working of the specifications and drawings or any other matter set forth the particulars thereof and submit them to the Engineer in writing in order Contractor No.of Correction Executive Engineer

that such doubt may be clarified authoritively before tendering . Once a tender is submitted the matter will be decided in accordance to the tender conditions in absence of such authentic clarification. ERRORS OMISSIONS AND DISCREPANCIES

A) In case of errors, omissions and /or disagreement between written and scaled dimension in the drawings or between the drawing and specifications etc. the following order of preference shall applyi) Between actual sealed and written dimensions or description on a drawing the letter shall beii) Between the written or shown descriptions or dimensions in the drawing and the corresponding one in the specifications, the letter shall apply arrived at from the drawing the idler shall be preferred iv) In all eases of omissions and / 01 doubts ox discrepancies in m dimensions or descriptions of any item or specifications, a reference shall be made to the Engineer shoes elucidation, elaboration I decision shall be considered as authentic. desired accuracy, quality and progress which shall be binding on the contractor . No claim on account of such change in method of execution be entertained by Maharashtra Jeevan Pradhikaran so long as specification of the item remain unaltered.B) PROGRESS SCHEDULEThe contractor shall furnish within the period stipulated in writing before the Engineer-In-Charge order to start the work, progress schedule m quadruplicate indication the date of actual, start the monthly progress expected to be achieved and anticipated completion date of each major item of work to be done by him as so indication dates of procurement and setting up materials, plants and machinery.C) The contractor shall employ sufficient plant equipment and labour 4 may be necessary to maintain the progress schedules. The work and shift hours restricted to one shift a day for operations to be do once the Maharashtra Jeevan Pradhikaran supervision shall be such as may 1 e approved by Engineer-In-Charge. They shall not be varied with our ,-prior approval of Engineer-In-Charge Night work requiring supervision shall not be permitted excepted when specifically allowance by Engineer on each item if requested by contractor. The contractor shall provide necessary lighting arrangement etc. for night work as % directed by Engineer without extra cost.4. TREASURE TROVEIn the event of discovery by the contractor or his employees during the progress of the works of any treasure. Fossils, minerals or any other articles, the contractor shall give immediate intimation thereof to the Engineer-In-Charge or his representative. Such treasure or things shall be property of Govt / Maharashtra Jeevan Pradhikaran.6.5 The contractor shall himself engage an authorized all time agent on the work capable of managing and guiding the work and understanding the specifications and contract conditions. Engineer shall be engaged by the contractor as his agent for technical matters. In case the Engineer -In-Charge considers , this is essential for the work and so he directs the contractor, he will take orders as will be given by the Executive Engineer or his representative and shall be responsible for the Executive Engineer and his representative on the work site. The Engineer-In-Charge have the unquestionable right to ask for changes in the quality land strength of contractor's supervisory staff. The contractor shall comply with such orders and effect replacement of the satisfaction of the Engineer-In-Charge.The work order book shall be maintained on site and it shall be property of Maharashtra Jeevan Pradhikaran and the contractor shall promptly sign orders given therein by the Executive Engineer or his representative and his superior officer, and compty with them. The compliance shall be reported by contractor to Engineer in good time so that it can checked. The blank work order book with machine numbered pages will be provided by the Department free of charge for this purpose. The contractor will be allowed to copy out the instructions therein from time to time.6.6 INITIAL MEASUTEMENT OF RECORDWhere for proper measurements of the work it is necessary to have an initial set of levels or other measurements taken the same as recorded in the authorized field nook or M.B. of Maharashtra Jeevan Pradhikaran by the Engineer or his authorized representative and the same will be signed by the contractor who will be entitled to have a true copy of the same made at his cost. Any failure on the part of the contractor to get such levels etc. recorded before starting the 9 will tender him and to accept the decision of the Engineer aijfl base of taking measurements. Likewise the contractor will not any work which render its measurements difficult or impossible first getting the same jointly measured by himself and the auth representatives of the Engineer. The record of such measurement the department side will be signed by the contractor and Contractor No.of Correction Executive Engineer

he will signed by the contractor and he will be entitled to have a true copy the same made at his cost. 6.7 HANDING OVER OF WORK All work and material before taken over by Maharashtra JB Pradhikaran will be entire responsibility of the contractor guarding, maintaining and making good, any damage off magnitude. Interim payments made for suck work will not alter position. The handing over by the contractor and taking over by Executive Engineer or his authorized agent will be always in w» copies of which will go to the Executive Engineer, signed authorized representative of Maharashtra Jeevan Pradhikaran and contractor. It is however understood that before taking over of m work Maharashtra Jeevan Pradhikaran will not put the system into regular use district form casual or incidental one, except! specifically mentioned elsewhere in this contract or mutually agreed to6.8 ASSISTANCE IN PROCURING ON PRIORITIES, PERMANENTThe Engineer, on written request by contractor, will if in opinion request is reasonable and in the interest of work and its progress assist the contractor in securing, the priorities for deliveries, transport permits for controlled materials etc. where such are needed . 1 Maharashtra Jeevan Pradhikaran will not, however be responsible I the non availability of such facilities or delays on this behalf and claim on account of such failure or delays shall be allowed 1 Maharashtra Jeevan Pradhikaran . The contractor shall have to ma his own arrangement for machinery required for the work. However if same is conveniently available with the Department it may spared as per rules in force on recovery of necessary security deposit and rent at the rates approved from time to time by the Executive Engineer (Mech) with agreement in the prescribed form. No contractor shall take or cause to be taken any steps or action that may cause disruption discontent or disturbance to work, labour or arrangements etc. <m other contractors in the project localities. Any action by all contractor which the Engineer in his opinion may consider as a break of the contract conditions and shall be dealt with accordingly. In case of any dispute or disagreement among the various contractor the Engineer's decisions regarding the co-ordination co-operation aJ facilities to be provided by any of the contractors shall be final am binding on the contractor concerned and such decision shall be vitiate any contract nor absolve the contractor of his obligations und« the contract nor from ground for any claim or compensation. 7.3 TEMPORARY QUARTER The contractor shall at his own expense maintain sufficient experienced supervisory staff etc. required for the work and shall make Contractor No.of Correction Executive Engineer

his own arrangement s fro housing , such staff with all necessary amenities. General layout plan for such structures shall be got approved from the Engineer-In-Charge. It will be the responsibility of the contractor to obtain permission from the local competent authority.7.4 PATENTED DEVICE

PATENTED DEVICES, MATERIALS AND PROCESSWhenever the contractor desire to use any designed device, materials or process covered by letter of patent or copy right, the right for such use should be secured by suitable legal arrangement and agreement with patent owner and the copy of their agreement shall be filed with the Engineer-In-Charge if so desired by the latter.8) SAFETY MEASURES AND AMENITIES

8.1 SAFETY MEASURESThe contractor shall take all necessary precautions for the safety of the workers and preserving their health while working on such jobs as required specials protection and precautions wherever required. The following are some of the requirements listed though not exhausting. The contractor shall also comply with the directions by the Engineer on this behalf from time to time and at all times.and maintained in accordance with the Govt. Rules applicable in that behalf. The contractor shall at his own expense obtain such licensed licenses as may be necessary for storage and using explosives. K« with standing that the locations etc. of storage of explosives are approved by the Engineer. The Maharashtra Jeevan Pradhikaran shall not incur any responsibility what so ever in connection with the storage and use of explosive on the site or any accident or occurrence whatsoever in connection therewith. All operations of the contract in or for which explosives employed being at the risk of the contractor and upon his sole responsibility and the contractor are thereby given to the Maharashtra Jeevan Pradhikaran and absolute indemnity in respect thereof. 8.4 DAMAGE BY FLOODS OR ACCEDENTS The contractor shall take all precautions against damages by floods og from accidents etc. No compensation will be allowed to the contractor" on this account for correcting and repairing any such damage to work during plant or material belonging to ht Maharashtra Jeevan Pradhikaran lost or damaged by flood or from any cause while in his charge.8.5 RELATION WITH PUBLIC AUTHORITIESThe contractor shall comply with all rules regulations bye-laws and directions given from time to time by any local or public authority connection with this work and shall himself pay all charges which are leviable on him without any extra cost.8.6 FOR MAJOR WORKS, POLICE PROTECTIONFor the special protection of the camp of contractor's work, the Department will help the contractor as far as possible to arrange for such protection with the concerned authorities . The cost shall be borne by the contractor.8.7 INDEMNITYThe contractor shall indemnity the Govt. Against all actions, suits, claims and demands brought or made against it in respect of anything done or committed to be done by the contractor in execution of or in connection with the work of this contract and against any loss damage to the Maharashtra Jeevan Pradhikaran in consequence to any action or suit being brought against the contractor for anything done or committed to be done for the execution of work of this contract.i) Providing protective footwear to workers in situations like mixing and placing of mortar or concrete to V quarries and places where the work is to be done under too much wet conditions as also for movements over surfaces infested with oyster growth.Contractor No.of Correction Executive Engineer

ii) Providing protective footwear to workers working in quarries etc. to protect them against accidental fail of materials from above.iii) Taking such normal precautions like providing handrails to the edges of the floating platforms of barrages, not allowing rails of metal parts or useless timber to spread around etc.

8.2 AMENTITIES1) Supply workmen with proper belts, ropes, etc. when working on any masts, crane circle hoist, dredger etc.2) Taking necessary steps towards training the workers concerned of the use of machinery before they are allowed to handle it independently and taking all necessary precautions in and around the areas where machine hoist and similar units are working.3) Avoiding bare live wires etc. as would electrocute workers.4) Making all platforms, staging and temporary structures sufficiently strong and not causing the workmen and supervisory staff to take undue risks.5) Providing sufficient first-aid, trained staff and equipment to be available quickly at the work site to render immediate first-aid treatment in case of accident due to suffocation, drowning and other injuries.6) Providing full length gum-boots, leather hand gloves, leather jackets with fireproof aprons to cover chest and back reaching up to knees and plain goggles for the eyes to the labour working with hot asphalt, handling vibrators in cement concrete and also where use of an or all these items is essential in the interest of health and well being of the labourers in the opinion of the Engineer.8.3 EXPLOSIVESThe contractor shall at his own expense construct and maintain proper magazine of such are required for the storage of explosives for use in connection with the works. Maharashtra Jeevan Pradhikaran may at its discretion and entirely at the cost of the contractor defend such suit either jointly with the contractor or single in case the latter chooses not defend the case.8.8 MEDICAL AND SANITARY ARRANGEMENT TO BE PROVIDED FOR

LABOUR EMPLOTED IN THE CONSTRUCTION BY THE CONTRACTOR

a) The contractor shall provide an adequate supply of pure and wholesome water for the use of labourers on works and in camps.b) The contractor shall construct trenches, semi permanent latrines for the use of labourers , Separate latrine shall be provided for men and women.C) The contractor shall construct sufficient number of huts on a suitable plot of land for use of the labourers according to the following specifications.i) Hut of Bomboobs and Grass may be constructed.ii) A good site not liable to submergence shall be selected on high ground remote from jungle but well provided with trees shall be chosen wherever it is available. The neighborhood of land, jungle s trees or woods should be particularly avoided . Camp should not be established close to large cutting of earth work.iii) The lines of huts shall have open space of at least 10 meters between rows. When a good natural site is not available in this case. Particular attention should be given to the drainage.iv) There should be no over crowding , floor space at the rate of 3 sqm. (30 sq.ft) per head shall be provided . Care should be taken to see that the huts are kept clean and in good order.v) The contractor must find his own land and if he wants Govt. land he should apply for it. Assessment for it if demanded will be payable by contractor. However the department does not bind itself for making available the required land.

d) The contractor shall construct a sufficient number of bathing places. Washing places should also be provided for the purpose of washing clothes.e) The contractor shall make sufficient arrangement for draining away the surface and sullage water as well as water from the bathing and washing places and shall dispose off this waste water in such a way* not to cause any nuisance. f) The contractor shall engage a medical officer with a travelling dispensary for a camp containing 500 or more persons, If there is M Govt. Or other private dispensary situated within 8 kilometers from the camp. In case of emergency the contractor shall arrange at his cost free transport for quick medical help to his sick workers. g) The contractor shall provide the necessary staff for erecting the satisfactory conservancy and cleanliness of the camp to that satisfaction of the Engineer-In-Charge. At least one sweeper per 201 persons should be engaged. h) The Assistant Director of Public Health shall be consulted before opening a labour camp and his instructions on matters such as Water Supply, sanitary, convenience for the camp site accommodation and food supply be followed by the contractor etc. i) The contractor shall make arrangement for all antimalrials measures to be provided for the labourer employed on the work. The anti measures shall be as directed by Assistant Director of public health. 1j) In addition to above all provisions of the relevant labour Act pertaining to basic amenities to be provided to the labourer shall be applicable which will be arranged by the contractor.9. MISCELLANEOUS9.1 For providing electric wiring or water ling etc. Recesses shall be provided if necessary through walls, slabs, beams, etc. and later-on refilled it who out any extra cost.Contractor No.of Correction Executive Engineer

9.2 In case it becomes necessary for the due fulfillment of contractor for the contractor to occupy land outside the department, limits the contractor will have to make his own arrangements with the land owners and pay such rents if any, which are payable as mutually/agreed between them.9.3 The contractor shall duly comply with provisions of the Apprentices Act 1961 (III of 1961) and the rules and order made there under from time to time under the said rules and on this failure or neglect to do so he shall subject to all the liabilities and penalties provided by the said Act and Said Rules.9.4 It is presumed that the contractor has gone carefully through the standard specification (Vol I and II 1981 edition) and the schedule of rates of the Division, and studies of site condition before arriving at rates quoted by him. The special provisions and detailed specification of wording of any item shall gain precedence over the corresponding contrary provisions (if any) in the standard specification given without reproducing the details in contract. Decision of Engineer in charge shall be final in case of interpretation of specification.9.5 If the standard specifications fall short for the items quoted in the schedule of this contract, reference shall be made to the latest Indian standard specifications, I.R.C. code, if any of the item of this contract do not fill in reference quoted above the decision and specification as directed by the Engineer-In -Charge. Shall be final.9.6 The stacking and storage of building materials at site shall be in such a manner as to prevent deterioration or inclusion of foreign material and to ensure the preservation of the quality. Properties and fitness of the work. Suitable precautions shall be taken by contractor to protect the materials against atmospheric action, fire and other hazards. subsidence of soil, heavy ,materials shall be stored on paved platforms. Suitable separation barricades and enclosure as directed shall be provided to separate materials brought by contractor and material issued by Govt. To contractor under Schedule- A. Same applies for the materials obtained from different source of supply.10) DEFINITIONSUnless excluded by or repugnant to the contentsa) The expression 'MJP' as used in the tender document s shall mean the Maharashtra Jeevan Pradhikaran.b) The expression 'The Chief Engineer' as used in the tender papers shall main that officer for the time being of the Maharashtra Jeevan Pradhikaran who is designated as such.C) The expression 'Superintending Engineer' as used in the tender papers, shall mean the officer of Superintending Engineer's rank (by whatever designation he may be known) under whose control the work lies for the time being. d) The expression 'Engineer or Engineer-In-Charge' as used in the tender paper shall mean the Executive Engineer in charge of the work. e) The expression 'Contractor' as used in the tender paper shall main the successful tenderer that is the tenderer whose tender has been accepted and who has been athorized to proceed with the work. f) The expression 'Contractor' as used in the tender papers shall meal the deed of contractor together with all its original accompaniment and those later incorporated in it by mutual consent. g) The expression 'Plant as used in the tender papers shall mean every temporary and accessory means necessary or considered necessary b| {he Engineer to execute, construct, complete and maintain the work! and all altered, modified substituted and additional works ordered iq the tine and the manner herein provided and all temporary materials and Contractor No.of Correction Executive Engineer

specials and other articles and appliance of every sort/king and discretion whatsoever intended or used therefore.11) REQUIREMENT OF STRENGTH OF CONCRETE11.1 The contractor shall make field arrangement s for testing of all materials for cement concrete i.e. slumps test, compression test etc.The concrete cube moulds 3 Nos. ofl5xl5xl5cm size shall be kept during concreting operation. Three cubes shall be prepared from at site during concreting to be used in work for compression test, for each concreting to be used in work for compression test, for each concreting of the structures. One cube shall be tested for test at 7 days age and two at 28 days in Regional Testing Laboratory at Govt Polytechnic/Visvessvaraya National Institute of Technology! Nagpur or at any approved laboratory, by Engineer -In-Charge. ALL THE TESTING CHARGES SHALL BE PAID BY CONTRACTOR. The entire responsibility of the testing of materials will be borne by the contractor.11.2 Mixing of concrete shall be done with Concrete Mixers.11.3 a) The contractor will make his own arrangement for receiving all materials, tools, etc. required for the work.b) No extra charges for the carriages of water will be allowed.c) The rates for all items are inclusive of all charges such as carting, lifting etc. No extra payment for any lead and lifts will be paid for any item.d) The contractor should not be subleted without written permission of the Engineer-In-Charge.e) The conditions in the tender notice will be binding on the contractor §r and the Tender Notice will form a part of agreement.f) The material required for carrying out the work for which the tender is offered shall be brought by the tenderer.

ACQUAINTANCE WITH SITE CONDITIONS AND WORK CONDITIONS

1. The contractor shall study the site conditions, general conditions and data included

in the tender papers and get it verified from actual inspection of the site etc. before

submitting the tender. In case of doubts about any items or data included in this

tender or otherwise, it shall be got clarified by applying in writing to the Executive

Engineer, 15 days in advance before date of submission of tender. Once the tender

is submitted, it shall be considered that the contractor has verified and made himself

conversant with all the details as required for quoting the rates and completing the

work as per tender conditions and specifications.

2. Contractor shall not sell or otherwise dispose off or remove except for the purpose

of this contract, the rubble, stone metal, sand or other material which may be

obtained from any excavation made for the purpose of the contract. All such

materials shall be MJP's property and shall be disposed off in the manner and at

place as may be directed by the Engineer-in-Charge. Contractor may with the

permission of the Engineer-in-charge. Contractors may with the permission of

Engineer-in-charge in writing and when directed by him, use any of the materials

free of cost.

3. Other unforeseen items to be done in the course of work will have to be done by the

contractor as per specifications in P.W.D. Hand book Volume I and II and will be

paid at mutually agreed rates, ISS and standard practice in vogue. Extra charge of

claims in respect of extra work shall not be allowed unless the work to which they

relate are in the spirit and meaning of the specifications or unless such works are

ordered in writing by the Engineer-in-charge and claimed for in the specified

manner before the work is taken in hand.

MATERIALS

4. The contractor shall make his own arrangements for obtaining rubble, khandki,

headers, metal, sand, murum etc. from MJP's or Private quarry. Application of the

contractor for reasonable area of Government land required for this purpose can be

recommended to Revenue Authorities without any guarantee of making the land for

quarry available.

All the materials involved in the construction shall be of best quality and

specifications and shall be got approved from the Engineer-in-charge before use. If

necessary, materials shall be got tested from the Laboratory at his cost. Samples

requiring approval shall be submitted by the contractor to the Engineer-in charge in

good time before the use of each material. The samples shall be properly marked to

show the name of the materials place.

5. For all the accident on the contractor's works, the contractor shall be responsible to

pay the compensation to the sufferer of his legal descendants as per the legal

Compensation Act in force.

6. The contractor shall engage authorised agent or an experience qualified supervisor

for the work, capable of managing and guiding the work on his own, shall take such

order from time to time and shall be responsible to carry them out promptly.

7. Quantities given in the tender are approximate and liable for variation. Excavation

of the trenches will be according to actual strata to be met with.

8. The contractor shall at his own expenses make all necessary provisions for housing

water supply and sanitary arrangements for his employees and shall pay direct to

authorities concerned all taxes and other charges. The contractor shall also comply

with all requirement of the Health Board in regard to anti malaria.

9. The contractor shall provide all labour, skilled as well as unskilled,

pages, lime, strings, site-rails (wooden as well as steel etc.) as and when required as

per approved design and make available such other materials for surveying, lining

out, setting out, checking of work, taking measurements, testing of hydraulic and

other structures, without any payment by the MJP to him. He will also provide

proper approach and access to all his works and stores without any extra cost over

his tendered rates for the items to be inspected.

10. All the columns should be filled in ink and one full entry in the last

column should be struck by the contractor under his signature.

11. Rates quoted include clearance of site ( Prior to commencement of work and its

closure) in all respects and hold good for work under all conditions of sites,

moistures, weather etc.

12. Failure to comply with any of the above instructions will result in the MJP's doing

the needful at the risk and cost of the contractor. These conditions are for all items

and as such no extra payment shall be made for observing these conditions.

13. The contractor shall make his own arrangement for quarrying of rubble, stone,

murum, sand, lime, metal etc.

14. Overburden in a quarry will have to be removed by the contractor at his own cost.

15. Unless a separate item is provided in schedule 'B' minor de-watering of foundations

in excavation and during the constructions of foundation masonry if required shall

be done by the contractor without claiming extra cost.

16. Masonry shall be kept wet for at least 15 days and concrete work shall be kept wet

for at least 28 days commencing from the date of its final laying in position. In

case during execution curing is found inadequate, it will be carried out by

MJP and the cost thereof shall be recovered from the contractor. The contractor

shall make his own arrangements for getting water at site at his own cost.

17. a) All cement concrete shall be machine mixed and machine vibrated unless

otherwise permitted by the Executive Engineer.

b) The proportions of cement concrete specified in the Schedule 'B' are nominal and

are only an indications of approximate proportion of cement, fine aggregate and

coarse aggregate which may have to be altered suitably at site to obtain the desired

strength & work-ability. However, quantity of cement shall not be less than the one

specified below.

Nominal Mix :-

1 : 1.0.50 (M 300) 7.90 Bags/one cum of cement concrete.

1 : 1 : 2 (M-250) 6.27 Bags/one cum of cement concrete

1 : 1.1/2:3 (M 200) 7.90 Bags/one cum of cement concrete.

1 : 2 : 4 (M-150) 6.27 Bags/one cum of cement concrete.



In case of major items of concrete for RCC works the contractor shall prepare test

blocks as per IS specifications for testing its tensile and compressive strength at his

own cost. These blocks will be tested in any of the Government Test Laboratories

at the cost of the contractor. The number of Test blocks, frequency etc. shall be

directed by Engineer-in-charge.

18) DAMAGE BY FLOODS OR ACCIDENT

The contractor shall take all precautions against damage by floods and from

accidents. No compensations will be allowed to the contractor for his plant,

material and work etc. lost or damaged by floods or from other causes. The

contractor shall be liable to make good any part of material which is in charge of

the contractor and which is lost or damaged by floods or from any other cause. If

the work executed is damaged, trenches/pits filled due to any reason, contractor

shall have to make it good at his cost only.

19) TESTING OF STRUCTURE

In the case of work which creates reasonable doubts about the quality of work-

manship or of materials used in the construction, the Superintending Engineer, may

order the contractor to satisfy the Pradhikaran by carrying out a suitable load test or

test of the structure or parts thereof, in the manner as prescribed in I.S. The Indian

standard code of practice for, plain and reinforced concrete for general building

construction or as may be approved by him, in regard to the sufficiency being

noticed as a result of the test, the contractor shall carry out necessary strengthening

or dismantling as may be directed by the Superintending Engineer.

The load test and strengthening or dismantling whenever directed shall be carried

out by the contractor entirely at his risk and cost and to the entire satisfaction of

Engineer-in-charge or his authorised agent and till then the work shall not be

considered to have been completed. No payment for dismantled work shall be

made.

20) SUPPLY OF RATE-ANALYSIS IN CASE OF EXTRA ITEMS

In case of the EIRL the contractor shall supply Rate Analysis based on labour and

material in case he is called upon to do so.

21) WATER REQUIRED FOR CONSTRUCTION

The contractor has to make his own arrangements at his cost for water required for

constructions, testing, filling, structures, etc. either from local bodies or from

elsewhere, by paying the charges directly and arranging tankers etc, as per

necessity. No claim for extra payment on account of non-availability of water

nearby, or extra lead for bringing water shall be entertained. All required

arrangements and pumping if required for water shall be made by the contractor at

his cost.

If contractor fails to pay the water charges to local bodies or private parties these

shall be recovered by the MJP from his bills. In case MJP's water supply is

available, a connection at a suitable place may be sanctioned but all further

arrangement of pumping if required, piping etc. shall be done by the contractor at

his cost, and water charges in such a case, shall be paid by the contractor at the rates

as decided by the Executive Engineer, which shall be final and binding on the

contractor.

Whenever Schedule "B" Provides for any de-watering item, payment shall be

admissible under that item, but apart from that item no extra claim for de-watering

required for executing various tender items, and for executing such items in wet

condition shall be entertained as all these expenses are deemed to be included in the

dewatering item.

22) LEADS AND LIFTS

Unless otherwise specifically mentioned in the tender item, the tendered rate for all

items in tender shall cover all lifts and leads encountered for the execution of the

work as directed and no extra claims for additional lifts and leads shall be

entertained.

23) Unless otherwise specifically provided for in the tender or a separate item is

provided in Schedule "B", all the sides of excavated trenches after the work is

completed or in progress are to be filled by the contractor to the original ground

level from excavated stuff at no extra cost to the MJP.

24) Unless otherwise specifically mentioned in tender items, the net dimensions of RCC

or CC Members actually cast are only admissible for payment under RCC or Plain

CC items. No increase in dimensions due to plastering or finishing shall be

admissible for payment under RCC or plain CC items.

25) Cement that will be supplied by the contractor shall be in Jute/PVC bags.

26) No claims for any desilting of trenches, foundation etc. filled due to floods,

untimely rains, or any other reasons whatsoever shall be entertained and contractor

shall have to do this desilting operation together with de-watering, operations

entirely at his cost.

27) Electric supply required for construction of work/labour camp shall be arranged by

the contractors at his own cost.

28) Brakages of Telephone /Electric cable during execution the charges thereof shall be

borne by the contractors at his own cost.

Guarantee Period :

The contractor shall stand guarantee for satisfy the structure & work executed by

him for a period of 60 months after compilation of the structures/work as certified

by Engineer-In-Charge. During this period any defects and short -comings due to

faulty design and defective construction will have to be made good by the

1. The person or firm submitting the tender should see that the rates in the above schedule

are filled up by the Executive Engineer-in-charge on the issue of the form but prior to

submission of the tender.

2. The rates mentioned in schedule 'A' are not applicable to the material consumed on the

quantity of work for which the payments are to be regulated under E.I.R.L. Clause 38

of the agreement. The rates for such materials will be the rates as provided in the rate

analysis of current D.S.R. according to which payment for the excess quantity as

specified in Clause 38 of agreement is to be made.

3. Materials indicated in the schedule A above will only be supplied by the MJP at the

issue rates shown them and only on production of unstamped receipt thereof.

4. Materials will be issued at the place of delivery to the site of work will have to be done

by the contractor at his own cost.

5. Contractor shall maintain account of material received from MJP stores and its

consumption. The account shall be produced for review of the inspecting Officer as

and when demanded.

6. Contractor shall at the site of work provide a leak proof pucca shed, with proper

locking arrangement to store the materials issued by the MJP.

7. The stores shall be accessible for checking by the MJP Officer whenever desired.

8. The contractor shall procure the material, other than Schedule “A” which is required at

site only after written permission from Engineer-in-charge. The contractor shall submit

an account of material bought by him. Balance materials other than Schedule “A”will

not be taken back from the contractor after completion of work, unless it is required.

The cost of balance materials will be recovered from contractor.

9. If after completion of work, material issued by the MJP (i.e.mentioned in Schedule

“A”) are found surplus and unused, such surplus material in good condition only shall

be returned to the MJP at its place of delivery indicated in the schedule. Transport

required therefore will be at contractor's cost. For such material, rate allowed will be

the rates as indicated in the Schedule 'A' minus (-) storage charges 3%. The contractor

shall, therefore be cautions in getting the material issued.

10. If surplus material provided by M.J.P. as per Schedule “A” is misused or is not

returned by the contractor, recovery at double the issued rate indicated above or market

rate whichever is higher, will be made.

NOTES ON SCHEDULE – 'B'NOTES ON SCHEDULE – 'B'

1. Rates mentioned in schedule 'B' are inclusive of the following.

a) Carting of material including loading and unloading etc. of the same of the site of the

work.

b) Dewatering, during entire excavation, construction and diversion of flow of water, till

the completion of work.

c) All type of taxes etc. for providing the materials to be paid by the contractor at site.

d) Keeping safe custody of materials procured by him and payment received for such

delivery, till the completion of work.

2. All the work shall be carried out as per red book of standard specification 1972 edition

and or as directed by the Engineer-in-charge and of latest edition and also as per

detailed specification.

3. The work is inclusive of clearance of site prior to the commencement of the work and

on its completion in all respect and shall hold good for all condition of whether and

approach road construction etc.

4. The quantities indicated are likely to vary on plus or / minus side for which no extra

claim shall be entertained, subject to the provision of clause 38 of agreement.

5. Water for construction and testing purposes will be arranged by the contractor at his

own cost. The MJP will neither supply nor take any responsibility there of.

6. The payment due to change in strata in respective lifts other than as mentioned in

respective sub work shall be regulated by adding or subtracting lifts rate based on DSR

on which accepted tender is based with percentage above or below as per offer

whichever is less.

7. In case of contractors supply for all types of materials, manufactures test certificates

should invariably be presented when materials brought on site of work and all materials

brought on site of work should confirm to relevant I.S. specification latest editions.

8. PAYMENT

A) In case of providing R.C.C./C.I./D.I./M.S./. piped specials NP2 pipes, valves etc. 80%

payment will be released on receipt of materials along with manufacturers test

certificates and third party inspection RITES/SGS, CI/D.I. special shall be inspected

by EE/SDO and necessary certificate of inspection shall be recorded before payment.

B) 5% payment will be released after lowering, laying jointing is completed.

C) 15% payment will be released on completion of satisfactory hydraulic testing, Test

certificate is recommended.

i) 5% amount of payment of all R.C.C. Items will be kept till the receipt of

satisfactory cube testing results from Govt. Laborator.

ii) Payment of excess quantities in various items of tender will be regulated as per

MJP's Circular at that time and as per prevailing circular.

APPENDIX – A

SPECIFICATIONS FOR CIVIL ENGINEERING WORKS

CES-1 : GENERAL :

The following specification shall be applicable to all the civil engineering works under this

contract. Items, which are covered under the following description, shall be carried out as

per relevant specifications in ISS or book of standard specifications latest edition

(Government of Maharashtra Publication and as mentioned in the proceeding pages.).

CES-2 MATERIAL :

ii) All the materials shall be of best and standard type as laid down in PWD hand book

volume I and II. Red book of public works department, I. S. specifications and

shall have to be approved by the Engineer in charge.

iii) LABOUR :

All skilled and unskilled labours, supervisors, site engineer, etc. shall be provided

as directed by the Engineer in charge.

All structures shall be provided with a 10 cm. Thick levelling course of P.C.C. M-100

proceeding the floor slabs of foundation slabs. This course shall have an offset of 15 cms.

On all sides and it shall rest on strata of appropriate bearing capacity as per design.

REFILLING OF EXCAVATED STUFF :

Sides of the structures below G. L. shall be refilled, wherever, necessary with selected

moorum from the excavated stuff duly watered and rammed in 15 cms. layers.

CES – 4 : PLAIN AND REINFORCEMENT CEMENT CONCRETE :

A) R.C.C. works :

I) NOT IN CONTACT WITH WATER :

As per ISS 456-1978 with C.C. 1:2:4 (M-150) and 12 mm to 20 mm guage metal.

II) R.R.C. WORK IN CONTACT WITH WATER AND OR ALL WATER

RETAINING STRUCTURES :

As per I.S.S. 3370 Part – I to IV with C.C. 1:1:2 (M-250) with 12 mm to 20 mm

size metal with water face & outside face side of the structure finished with 20 mm

thick cement plaster in C.M. 1:3 mixed with water proofing compound.

B) MASS CONCRETE WORKS :

MATERIAL

A) CEMENT :

GENERAL

APPORVAL FOR THE MATERIALS TO BE USED :

The cement, sand and aggregate shall be confirming to I. S. 269, 1542, 383 and 515

respectively. Sample and descriptive data of the materials equipment etc. shall be

submitted by the contractor to the Engineer-in-charge in good time before the use of

such materials, equipment etc. to permit inspection and testing, Failure of the sample to

pass the test will be a sufficient cause for refusal to consider be on exhibition at all

times, properly stored and prevented form deterioration for purpose of comparison

with the materials brought at the site of work from time to time for use on work. If

necessary, the materials shall be got tested from the laboratory by the contractor at his

own cost.

The contractor shall use fresh L & T cement procured at his own cost confirming to IS

169-175. The contractor shall have to produce manufacturer's test certificate,

pertaining to specific batch of production which has been procured from time to tome.

The board authorities will have rights to depute the services of departmental authority

at the factory while delivery of the cement to be used for the above purpose. The

testing at laboratory at the discretion of the Engineer, shall perform such tests as are

deemed necessary at the cost of contractor. Cement bags or bulk soils shall be tagged

for identification at location of sampling. Testing will include tensile tests and

weighting the cement supply to check the net weight received at site and used in the

works.

On arrival at the site, cement shall be stored in weather proof soils designed for the

purpose or in dry weather-tight and properly ventilated structures with floors raised 15

to 20 cms. Above ground level, 30 cms away from walls and with adequate provision

to prevent absorption of moisture or flooding. All storage facilities shall be such as to

permit easy inspection and identification. Each consignment of cement shall be kept

separately and the contractor shall be use the consignments in the order in which they

are received. Not more than 15 bags shall be stacked vertically in one pile. Cement

shall be stored in double locking arrangements, so that cement transaction can be with

the knowledge of supervisory staff. Daily account of cement shall be made available to

inspecting authorities for store verification.

The contractor shall provide from consignment of cement delivered to the site such

sample as the Engineer may required for testing. If the Engineer thinks it necessary, he

may ask the contractor to pass it through to much screen before use, and contractor

shall do the needful without any extra cost to the Board. Any cement which is in the

opinion of the Engineer, lumpy or partially set shall be rejected and contractor shall

promptly remove such cement form the site.

The cement used for the work shall be bresh. Cement which has been stored on the

site for more than sixty (60) days and cement which, in the opinion of the engineer, is

of doubtful quantity shall not be used in the works until it has been retreated and test

sheets shoring that it complies in all respects with the relevant standard, have been

delivered to the Engineer.

B) FINE AGGREGATE :

It aggregate shall confirm to either I.S. 383-1963 & relevant portion of I.S. 515-1969

and should be as specified in I.S. 1978 as directed by the Engineer-in-charge.

C) COARSE AGGREGATE :

All aggregate shall confirm to either I.S. 383-1963 & I.S. 515-1969 and should be as

specified in I.S. 1978 vide clause 4.2 m Gauge and metal to be used shall be decided

according to the type of work by the Engineer-in-charge.

D) STORAGE OF MATERIALS :

Sand and course aggregate shall be properly and separately stored on site on hard

ground so as to keep them safe from admixture of foreign materials such as clay, grass,

etc. It shall be as per I.S. 456-1978.

E) REINFORCEMENT :

The steel shall be H.Y.S.D. type conforming to I.S. 1786-1979 or IS-1139. For round

mild steel bars of 6 mm. dia I.S. 226 (latest edition) shall be applicable plain round

mild steel bars confirm length and cover in compliance with I.S. 2502-1963 and in

confirmation to the approved design. Binding wire shall be provide for to produced

from time to time. The testing at laboratory at the description of the Engineer shall

perform such test as are deemed necessary at the cost contract.

F) FORM WORK :

Steel centering will be preferable. If wood form work is used it shall consist of planks

of not less than 40 mm thickness and strong proposed etc. This shall be provided as per

I.S. 458-1978. The timber for forms shall be best hard wood and got approved by the

Engineer-in-charge. The item is covered in the rate either for plain or R.C.C. Items.

G) SEPARATORS :

For bottom covers of beams, slabs, etc. separators of precast cement mortar blocks of

suitable size with wire embedded as directed will be used and tied to the reinforcement

by wires. Between layers of reinforcement separators consisting of pieces of bars of

suitable diameter shall be used. In each case the required cover to the bars will be

ensured as per I.S. 456-1978.

H) WATER :

The water used shall be as per I.S. 456-1978. Not more than 20 Liter of water will be

used for, batch one bag of cement. Approved measures for water will be provided by

the contractor. The amount of water to be used will be decided by the work ability and

strength consideration which will be assured by the contractor.

I) CONCRETE MIXING :

The concrete shall be only materials mixed. Mixing shall be continued for at least 2

minutes after all materials and water is placed in the drum. The drum shall revolve for

14 to 18 revolutions per minute or as specified by the maker. The capacity of the mixer

will be such that a whole bag of cement is used in each batch. As a result of break

down of machine, if hand fixing has to be resorted to, only such quantity of further

work as is absolutely essential in the opinion of Engineer-in-charge will be carried out.

Hand mixing shall be done on a water platform of sufficient large size. the required

quantity of sand cement shall be mixed dry together by turning the mixture at least 3

times when the mixture is of uniform colour, this will than be spread over opeate

quantity of course aggregate and mixture again turned over at least 3 times. The

specific quantity of water will then be added slowly through a hose attached to the

watering can, while the process of turning the mixture is being carried. The mixing

shall be continued until the whole batch is of uniform consistency for hand mixture the

quantity of cement will be 10% extra.

J) PLACING :

The form will be first just moistened before placing of concrete. The concrete shall be

placed in position within 20 minutes after adding water to the concrete. It shall be

slowly deposit in its place in uniform layers. It should generally comply with I.S. 456-

1978.

K) TAMPING :

While the concrete is being placed in position it shall be vigorously rolled and tamped

by bars of appropriate size and shape and by other means to assure dense and complete

filling of the forms all round and in between the reinforcement.

The efficiency of tamping and consolidation will be judged by complete absence of air

pockets and honey combing after removal of forms and any deficiency in this respect

will entail pulling down and redoing of the affected work at the cost of the contractor.

For work of any magnitude or importance, mechanical vibrators of both immersion and

surface type will be used as a rule and no work without them will be permitted.

When concrete is so vibrated the water cement ratio will be the least practicable.

L) CURING :

All R.C.C. work will be watered and kept constantly wet for at least 20 days after

casting, by means of wet gunny bags and ponding as directed by the engineer in charge.

This operation shall start immediately after initial set of concrete.

M) REMOVAL OF FORMS :

Removal of forms will be generally as below subject to the prior approval of the

engineer in charge in writing.

a) Walls, columns and vertical 24 to 48 hrs.

N) INSPECTION :

The work at each stage of operation i.e completion of form work, completion of

assembly and placing reinforcement, concreting, removal of forms, must be got

inspected by the Engineer-in-Charge or Sub Divisional Officer, In charge of the work

before commencing succeeding operation in the process of R.C.C. work. Concreting of

R.C.C. members will be commenced without the written approval of the engineer in

charge or the sub divisional officer in charge of the work who will record the necessary

certificate to the effect in the work order book, The concreting of R.C.C. form start to

finish, will be done in the presence of the Engineer-in-charge at site and for important

works by the Sub-Divisional Officer.

O) FINISH :

All R.C.C. work will be finished as provided in the items concerned. Surface not in

contact with form work and not subjected to and further finish, will be finished

smoothly by a float to present a uniform appearance. Surface to receive plaster or

rendering will immediately on removal of forms be roughened by extensive backing for

bond by a pointed tamping tool. In all case where it will be specified or not the finish

will be such as to match with rest of the structure and present a harmonious appearance

to be decided by the Engineer-in-charge. All such finishing will stand included in the

rate for concrete but will not be measured.

P) TESTING :

a) Cubes :

On any day when concreting of M-150 and richer six is done for 4 hours of 11 Cms.

And more 3 concrete cubes of 15 cms. will be filled per day, equally spread over i.e

period of concrete. As a rule one cube of that three will be tested for crushing

strength at 7 days and one at 28 days age. The third cube will be kept as reserved to

be tested immediately after 28 days in case one of the cubes tested at 7 and 28 days

show unsatisfactory results. The filling and curing and testing of cubes will be the

cost of the contractor.

b) Testing of Materials :

The contractor shall test the materials required for R.C.C. work at his own cost and

submit the results to the Department of according necessary approval for the same.

1. GENERAL :

Following specifications are in amplification OR in addition to the specifications

for other respective items given in P.W.D. Hand Book Volume I and II (Latest

Edition). Red Book of Government of Maharashtra and shall be strictly adhered to

Relevant IS shall also be referred.

1.1 ALIGNMENT :

Alignments and line out for the work is to be given by the M.J.P's officials and the

work shall be carried out as per the M.J.P.'s line out and alignment for which

contractor has to provide at his cost all materials such as site-rails, honing rods,

pegnails, chunnam flages, etc. and also the required labour for line outs. The cost

of constructing pillars, platforms for temporary bench marks is also to be borne by

the Contractor.

1.2 EXCAVATION : Standard Specification – B1,B2, P. No. 24-28

1.2.1 Site Clearance :

The area to be excavated shall be cleared off all trees, bushes, rubbish and other

objectionable matter and the materials removed shall be burnt or otherwise disposed

off as directed by the Engineer, The cost of such clearing and road cutting shall not

be payable and it shall be deemed to have been included in the rates, accepted for

the different items under excavations. Surplus excavated materials after refilling

the trenches/ pits will have to be disposed off by the contractor to suitable place as

will be directed by the deptt.

1.2.2 GENERAL :

The work to be done under these items shall consist of furnishing all plant, labour

and materials and performing the all work required to carry out excavation,

conveyance and disposal of spoil and maintaining the excavation in line, grade and

alignment, profile as per drawing or as directed by the Engineer.

1.2.3 Drainage and Dewatering :

No distinction shall be made as to whether the material being excavated in dry,

moist or wet, Diversion of all storm water and pumping out or all storm and

seepage water to keep the trenches/pit reasonably dry for all further works of

construction of well, ESR, lowering, laying, jointing and testing, of the pipes i.e till

the completion of the work.

1.2.4 Shoring and Strutting :

The item includes all shoring and strutting that may be required. On no account

profile of well, ESR and the width of trenches more than these mentioned herein

after shall be measured, If excavation more than the specified, is required for the

purposes of keeping pumping machinery, stepping due to loose fill materials or for

any other reasons, the same will be at the Contractor's Cost.

1.2.5 Shoring :

Open cutting shall be suitably shored, sheeted and braced, if required by the

Engineer, or by site conditions or to meet local laws, for protecting life, property

adjoining work site.

Adequate shoring and strutting shall be provided by the contractor at his own cost,

warped or deformed timber shall not be used. The shoring shall project at least 150

mm above ground level and shall extend to a suitable depth below and bottom.

Wherever necessary the planks or struts shall be driven by compressed air pile

drivers. The planks shall be fixed close enough to avoid any running in of sand or

earth through the joints. The shoring materials shall not be of size less than those

specified below, unless steel sheet piling is used or unless approved by the Engineer

in writing.

a) Planks 5 cm thick

b) Walling pieces 10 cm x 20 cm

c) Struts 15 cm x 20 cm

For walling pieces round timber shall not be allowed in a vertical plane, there shall

be at least three struts or more as directed by the Engineer. They shall rest on

walling pieces. The spacing of the struts shall be as per the requirement. At the

bottom, extra struts shall have to be provided if ordered by the Engineer-In-Charge.

1.2.6 The excavated material shall be transported by the contractors and stacked at

suitable places as directed by the Engineer-In-Charge. The stacks shall be made

outside the area of excavation and shall not endanger the work in any way and shall

avoid the obstruction to footpaths, road-driveways, hydrants, access to the

propertied and work sites. Gutter shall be kept clear. Natural water courses shall

not be obstructed.

Separate stacks shall be formed for :

a) Rubble considered suitable for masonry work or road work :

b) Rubble of inferior quality and boulders :

c) Soft rock, earth murum :

d) Road spoils upto 150 mm size :

1.2.7 Lightening, Barricading and Guarding :

These items also include necessary lighting at night at night at site of work and at

intervals of 150 m. along the excavated trenches, and at all crossings and

barricading the same by fencing so as to avoid any accident. A Chowkidar must be

employed at site of wok and places where the trenches, cross over any traffic roads,

to caution the vehicles and pedestrians etc. These arrangements, shall be maintained

till the completion of work and at the cost of the Contractor.

1.2.8 Alignment and levels :

Before the trenches excavation is commenced, sight rails shall be erected at every

30m. and at all points of changes of direction, gradient and at ends. The excavation

works shall be proceeded by joint survey along with alignment of the mains to

obtain ground levels, at every 30m or less distance. Temporary bench mark shall be

constructed at every 300m. distance along the alignment and shall be maintained till

the completion of the work. all labour and materials required for the survey work

and fixing bench marks etc. shall be provided by the contractor at the his own cost.

1.2.9 Depth and Grades of Trenches :

The trenches shall be excavated to the grade and depth and on the line as shown on

the approved drawings. The depth of excavation and the levels of the pies inverts

shall be checked by means of boning rods, of suitable lengths. The final

measurements of the depth of excavation shall be taken as difference between the

levels of the pipe top and the corresponding ground levels added by the total outer

diameter of the pipe. Depth of murum bedding / sand bedding wherever provided

will be added to the above measurements for arriving at the total depth of

excavation. Thus the depth of excavation to be paid for shall be finalized only after

the pies are laid and jointed. Additional depths required to be excavated t sockets,

collars, specials, joints and for any other working facilities shall not be measured

nor paid for. The depth, to be considered shall be the average inspection of 30m.

length along the axis of the trenches and as directed by the Deptt.

1.2.10 Width of Trenches :

The maximum width to be measured for payments for different diameters of

pipeline shall be as under.

Any width excavated more than above shall not be measured and paid for.

Thus the maximum permissible width or the actual width excavated whichever is

less shall be recorded and paid for. Extra width at Sockets, collars, specials joints

and also for working facilitates shall not be measured nor paid for.

In case of pipe trenches, the engineer in charge may reduce the width of trench

wherever a hard strata is met with, if he feels adequate and just sufficient to lay the

pipe line in order to reduce the hard quantity. In such cases the contractors will be

paid on the actual measurements.

1.2.11 Dressing and Consolidation of the Trenches :

The bed of the trenches shall be well rammed before laying P.C.C. Hollows if any

shall be filled with murum duly rammed without extra cost. The whole bed of the

trenches shall be so dressed in grade and line that the pipes are given continuous

bearing for their whole lengths except at the sockets, or collars and specials, joints

etc. Necessary pits for sockets, collar and specials, joints etc. shall be provided in

approved manner without any extra cost and as directed by Engineer.

1.2.12 Filling in Excess Depths :

Depths of pit/trenches excavated in excess of requirements shall be refilled by C.C.

for S/Room, ESR and by selected hard murum well rammed & water for trenches to

the required level and grade at the cost of the Contractor.

chopan yellow soil etc. depth at a time. Any obstructions such as tree, rots,

boulders, rock pieces, shrubs or any other than the normal stuff to be excavated,

shall be removed carefully by the contractor at his own cost. Extra dewatering if

required to take out such objects shall also be borne by the Contractor.

1.2.14 Hard Murum :

Include all kinds of disintegrated rock or shale or indurate clay free from boulders

larger than 0.03 cum. and can be removed with pick and shovel.

1.2.15 Hard Murum and Boulder :

This shall includes all kinds of disintegrated rock or shale or indurate clay

interspersed with boulder larger than 0.03 cum. and less than 0.1 cum. which do not

need blasting and can be removed with pick, bar, wedges and hammer.

1.2.16 Soft Rock :

This shall include hard shale, soft rock, big boulders larger than 0.1 cum. size. All

decomposed and weathered rock, highly fissured rock, old masonry which normally

be removed with pick, crowbars, sedges and hammer with some difficulty.

1.2.17 Hard Rock :

This shall include all rock occurring in masses or boulders bigger than 0.5 cumt.

each which can be removed by blasting. Manjrya rock shall be considered as hard

rock, Blasting shall be carried out only, with the written permission of the Engineer.

Blasting is permissible in isolated areas. The excavation of hard rock inhabited

areas will be done by chiseling after approval of the Engineer-in-charge. The

payment for Chiseling will be made at D.S.R. on which this tender is based.

1.2.18 Static water level

It is obligatory to record the static water level encountered during course of

excavation, while taking measurement of earth work static water level implies such

average water level which is attained by overnight. (i.e within a period starting

from closure of work on an earlier day to starting of work on next day)

1.2.19 Providing Temporary crossing over the Trenches

Where the trenches are excavated across the roads or along roads in a village or

town area; suitable and safe temporary crossing duly approved by the Engineer

shall be provided so as the case may be such crossing shall be maintained in proper

condition till the completion of the work. As far as possible trenches across roads

shall be excavated in such a way that at least 5.0 M. clear width of the road is

available for the traffic. In case this is not possible, adequate diversion shall be

provided at contractors cost, such cost being deemed as included in the unit rates

for these items of excavation. All crossing and diversion shall be suitably

barricaded with railing on either side of the roads and lighted at Night.

The contractor should produce a manufacturers test certificate at the time of

delivery in absence of which the steel so provided shall not be acceptable for work

and payment.

1.2.20 Testing :

After receipt of steel of various diameter a sample form each dia.

(Random sampling) Shall be taken out and tested at authorised testing Laboratory.

(Results should conform to IS 226 of latest IS specification for Grade-II Steel.

This item includes R.C.C. works for foundation, below G.L. and structure below G.

L. & above G. L. which includes well staining, columns, beams, slab, landing, Roof

slab, Chajjas etc.

2.1.2 C.C. M-150 :

Shall be used for foundation, and chamber and as directed by the Engineer-in-

Charge wherever necessary.

2.1.3 Metal of approved quality of 10 mm to 20 mm shall be used (i.e Black Basalt)

2.1.4 The contractor shall take concrete cubes for concrete works as specified in B-C-12

of standard specification book. The result of the cube tests be submitted as soon as

prescribed time period of curing is over form the date of casting 5% amount shall

be deducted from R.A. Bill for non-submission of cube test results.

2.1.5 MURUM BEDDING

The murum to be used shall be of approved quality soft murum to be laid in 15 cm

average thickness to the grade as directed by the Engineer-in-charge. The width

admissible for payment shall be the same as per excavation trench width admissible

under excavation item. The murum bedding shall be provided where there is black

cotton soil or hard material below pipes or wherever directed and it shall be well

tamed so as not to sink the pipe line extra excavation for murum bedding. Wherever

required as above shall be admissible for payment under excavation tender items.

2.1.6 BAILING OUT WATER DURING EXCAVATION AND

CONSTRUCTION

Standard specification No. DR-4 page 97 to 98

Aim of dewatering is to provide open working platform at excavation level for

labours.

Contractors should provide and erect minimum sets either driven by Diesel

Petrol/Electrically operated so that the water from percolation should be removed

from site of work and Labour get clear working platform for excavation.

If at any time during excavation till its completion, the work is filled with water or

debris either due to untimely rains or due to underground sprigs being struck during

excavation, side slips or dye to any cause whatsoever the Contractor shall have to

dewater and remove the debries, filled up material etc. at his cost and no claims for

extra rates shall be entertained. Similarly if the coffer dam is constructed for water

diversion and is broken, washed away due to any reason, the Contractors shall make

it good at his cost and no claim thereof shall be entertained.

If the work is continued for more than one working seasons, or beyond the

stipulated time limit, due to any reason whatsoever, the contractor has to do all the

dewatering and removing and pit/trench clearing operations entirely at his cost if

any accident occurs during dewatering operation or due to coffer dam etc. on

account of any reasons whatsoever, the contractor shall be fully responsible for and

shall have to shoulder or responsibility of compensation etc. at his cost.

2.1.7 ALL MACHINERY, PIPING, FUEL AND LUBRICATING OILS AND

ELCTRICITY

Consumption charges, electrical connection charges, etc. required fore pumping

machinery and together with erecting, labour and running charges are to be born by

the contractor under this item. The trenches shall be kept free of water during the

entire construction and arrangement to dispose off the bailed out water shall

properly made by the contractor. The job also includes removal of muddy and

muddy paste etc.

2.1.8 STANDBYE SETS

Contractor should provide stand bye set at every set of operation minimum number

and maximum 25% of total BHP installed on any set of operation. So in case of

sudden failure of dewatering set. Standbye set could be immediately started and

work shall continue smoothly without any interruption.

2.1.9 LOWERING, LAYING & JOINTING OF D.I.. PIPES.

STACKING :

All pipes and specials shall be laid along the side of the trenches, with proper

orientation. Where the trench, crosses a road or place where such distribution is not

possible the pipes shall be stacked in heaps at each end. The contractor shall

ascertain for himself the details of the storage, space and other facilities available at

site of work for stacking of pipes, transport and movement of pipes along the length

of the trenches. The rates accepted for providing, lowering, laying, jointing &

testing etc. shall includes cost of transportation of pipes and specials to the site of

work and stacking in position as described above and safe guarding the pipes and

specials.

INSPECTION OF PIPES & SPECIALS :

Before lowering, the pipes into trenches dimensions of the finished pipes and

specials shall be checked again. This shall also be examined for damages, if any to

the pipes.

The inside of the pipes and specials shall be carefully cleaned. The inside of the

sockets and the outside of spigots shall be scrapped. Clean if the hydraulic tests

taken afterwards, reveal any flows either in pipes or in joints, the extra work and

cost of the pipe involved in replacing the pipes or in repairs, shall be done by the

contractor at his cost.

LOWERING, LAYING & JOINTING :

Only standard equipment such as chain pulley blocks, shear legs or racks gunners

etc. of adequate capacity shall be used for lowering, pipes and specials into the

trenches. In no case they shall be allowed to be rolled and dragged on ground or

moved other wise in the trenches. Pipes and specials shall be laid in line and grade

as required and shall be hold in the correct position till the jointing is over. All

spigots shall fit in properly into the sockets upto its full depth and shall supported,

concentric to the sockets or collars in which they are jointed. The pipes shall be

given continuous bearing on the trench bed for their whole length except at sockets

or collar pits, laying, shall commence from the lowest point of the valley. The

position of all washouts and Air valves and other specials fittings, such as branch

tees, bends and expansion joints etc. shall be previously approved by the Engineer-

in-charge.

2.1.10 D.I. PIPES :

All equipment, labour for lowering, laying and jointing shall be provided and

maintained at the contractors cost. The tender item covers providing, lowering,

laying, jointing and testing of D.I.. pipes pipes as well as C.I./M.S./D.I. specials

Cut pipe pieces etc. as per requirement and as directed by the Sub Divisional officer

by C.I.D. joints with rubber rings.

2.1.11 MAKING C.I.DETACHABLE JOINTS

The C.I. detachable joint consists of two rubber rings, a cast iron collar, two cast

iron flanges and a set of bolts and nuts per joint. Number of nuts and bolts varies

with the diameter of pipes to be jointed.

Before assembly of the C.I. detachable joint the following preparation to be made.

a) Check the elearance under the free end of the last pipe laid.

b) Clean this end It must be perfectly dry and free from any trace of sand, earth

clay etc.

c) Check and clean the different parts making up the joint, loosen the nuts of the

bolts.

d) Slip onto the free end of the last laid pipe one of the flanges, a rubber ring and

finally the east iron collar.

e) Move the pipe to be jointed nearer after slipping on the end the other flange &

rubber ring. The position of the rubber ring on the pipe ends must be such that

the distance of the gauge is half the length of the central collar less 2.5 mm.

f) Carefully insert end of the pipe into the central collar, leaving automatically

about 5mm. space between the pipe ends to allow for the expansion.

A person, lacking in experience of placing the rubber rings in its correct position on

pipe can be given a site gauge to enable him to place them with the required

clearance of 5mm between the ends of pipes.

While assembling of the C.I. detachable joint move the two flanges so as to bring

then against the corresponding rubber rings. Adjust the position of the flanges so

that no bolt is under the pipes as it will be difficult to tighten it. Insert the bolts and

tighten the nuts, first by hand, then with the spanner gradually, as final tightening

will be done during testing of the pipe line. the order of tightening of the bolts must

be 1,3,5—2,4,6—1,3,5…..

All the cut ends must be wrapped when it is necessary to cut a pipe on site for

assembly of C.I. detachable joint.

The rates for laying, jointing &testing of pipes includes laying, jointing & testing of

all the specials including cut pieces if requires to make neat connections and

wrapping etc, necessary for cut pipe ends, the cost of jointing material & labour etc.

complete. Jointing C.I. specials with lead joints/flanged joints will be paid

separately.

To facilitate laying of the pipes in a curve, the two pipes to be assembled must be

held in straight alignment while making the joint. It is only after tightening the bolts

of the joint is finished, that the required deflection can be given by moving the free

end of the last pipe laid. Necessary clearance must be allowed in the trench, which

gives displacement a free end of the pipe from straight for different angles,

however, the displacements will necessarily depend on the length of pipes used for

curvature.

2.1.12 FLANGED JOINTING

For jointing metal flanges and flanges fitting, the same shall be fitted by using soft

rubber gasket to the full face of the flange, Suitable nuts, bolts should be fitted to

flanges for interconnections and shall be tightened diametrically opposite each other

to avoid breaking of P.V.C. tail pieces and also flanges. For making flanged joints

payments shall be done separately.

All the exposed faces of pipes and fitting shall be covered with cloth or similar

polythene wrapper.

2.1.13 HYDRAULIC TESTING

Standard specification No. Bd-V-2.6, Page No. 544

Suitable section as directed by the Engineer-in-charge shall be taken for such

testing from time to time during progress of the work and satisfactory test given for

that section. All testing apparatus, gauges, connections, etc. and water required for

testing shall be arranged by the contractor at his cost. The MJP does not undertake

any responsibility to supply water for testing. Which the contractor has to arrange

from the municipality otherwise by paying the required charges directly. The MJP

shall have the right to recover such charges thereof. If there is delay in testing, the

contractor shall refill the trenches for the time being and reopen them at time of

testing at his own and reopening of trenches at the risk and cost of the contractor. If

the trenches are filled due to any reasons whatsoever before testing the contractor

shall have to open them for testing at no extra cost.

After a convenient section of the pipe line is jointed, the same shall be tested for

water tightness under the specified head.

The length of section to be tested shall be not more than 300 meters at a time. All

the joints at the time of testing shall be wiped dry with fine dust or powder of Brick

to check each and every joint for leakage of water. The test pressure shall be

normally 50% higher then the highest working pressure for that particular section.

The test pressure shall be maintained for thirty minutes without working the test

pump. There shall be absolutely no leakage throughout the pipe length under test.

If the pressure does not remain steady all the section and particularly the joints shall

be inspected and repaired and section shall be tested hydraulically. The process

shall be repeated till the specified pressure is maintained as per specification. After

completion of the test, pressure in the pipeline shall be retained to the working in

the section and maintained there till refilling of the trenches is over.

The results shall be recorded in the register showing the section under test with

chainages, working pressure, test pressure recorded, date etc. & signed by the

contractor & Representative of the Department not below the rank of Sub-

Divisional Officer/Engineer. Such results shall be recorded at site only at the time

as soon as test is conducted.

If during the test, it is found that any portion of the joints or the pipes or specials

have developed such defects which can not be repaired, then those pipes specials

etc. shall be removed at contractors cost.

No extra payment shall be made to the contractor for relaying and jointing the pipe

if the pipes are found damaged or burst during the hydraulic test. 10% payment of

respective subwork shall be withheld till hydraulic test is given which shall be

released only on giving satisfactory test and certificate recorded in Measurement

book by the Sub-Divisional officer/Engineer.

2.1.14 MODE OF MEASUREMENT

Standard specification No. Bd-V-1,7, Page No. 509

No payment shall be made for Tyton joints, Coupler joints (PVC) and detachable

joints. Making of lead joints & flanged joints will be paid for separately.

The risk of handling, loading, unloading and fixing the pipes, specials and valves

etc. and their maintenance upto the completion of the contract period will be the

entire responsibility of the contractors. The damage shall be set right at his cost and

by him only.

2.1.15 PROVIDING, LOWERING, LAYING AND JOINTING, C.I.D.F. SLUICE

VALVES

Red Book : Bd – V – 1, Bd – V – 3, Page No. 507 & 510.

Unless otherwise specifically mentioned in the tender items the required sluice

valve, scour valve, air valves etc. shall be supplied by contractor.

Contractor should produce a manufacture’s test certificate as well as E.I.L.

inspection report for the material brought on site should conform to is specification

780–1984, IS 2906–984 or latest edition and IS 2885 – 1971 or latest edition. The

material supplied shall be inspected by E.L.I, S.G.S. or RITES at the cost of the

contractor and only certified good shall be accepted. The valves should be fixed in

proper position and alignment as directed by Engineer- in-charge.

specials shall be withheld for hydraulic testing.

2.1.19 PROVIDING AND CONSTRUCTING B. B. MASONRY CHAMBER :

Standard specification No. Bd-V-43, Page No. 533 and 534.

This item is to be executed as per description of tender item and as per detailed

specification given above. The sizes mentioned of the chamber in the tender item

are internal dimensions of the chamber. The cost of extra excavation which is

beyond the pipe line trench measurement is included in this item and no extra

payment shall be admissible under respective tender item.

Sizes of chambers mentioned in tender item are the internal dimensions of the

chamber.

The tender item covers 1:3:6 CC bedding 15 cms thick on the well rammed bottom

cms thick BB Masonry wall in CM 1:6 cement plaster 12 mm in CM 1:3 from

inside and cement pointing 1:2 from outside 1:2:4 CC either plain or RCC as

required 10 mm thick for coping and providing and fixing M.H. frame and cover 1

M x 0.5 M. This completed item and any incidentals not mentioned above but are

necessary as per design as per deemed to be included in this item.

The finished top of the chamber shall be flush with road surface and shall not cause

any hindrance to the traffic. Heavy duty C.I. man hole cover and frame with

necessary locking arrangements, painting etc. as included in this item of tender shall

have to be provided by the contractor without extra cost. The finished top of the

chamber shall be flush with the road surface and shall not cause any hindrance to

the traffic inhabited area.

Before laying and jointing of mains, chamber shall be constructed upto the bottom

of the pipes. Further walling and other works shall be constructed at a later stage.

All the breaking, redoing of the chamber for making pipe connection will be done

by the contractor without any extra claims.

The payment shall be on the basis of completed chamber for each number.

Addition/deduction for every depth of 0.15 mt. or part there of beyond specific

depth in description of item will be paid / deducted as per D.S.R. on which this

tender is based.

2.1.20 PROVIDING AND FIXING ROAD SURFACE BOXES AND CHAMBER

The cast iron surface boxes shall be of heavy duty type and of the following size for

different types of sluice valves.

1) Clear opening at top - 100 mm. dia.

2) Inside bottom - 200 mm. dia. for circular

3) Depth - 300 mm. dia.

or

4) Size of 230 x 230 mm x 300 mm. depth for square.

The contractor shall produce sample of road box and get it approved and then

procure entire number as per approved sample.

The cover of the surface boxes should be hinged to body and the surface box should

be neatly supported on brick masonry and embedded firmly in concrete to the

satisfaction of the Engineer-in-charge. The surface box should be given three coats

of anticorrosive approved paint. The weight of the road surface box should not be

less than 18 kgs.

2.1.21 REFILLING THE TRENCHES OF PIPELINE

After laying, jointing and testing the pipeline to ensure leak proof joints, the

trenches shall be refilled in layers and manually rammed. The excavated stuff shall

be used in filling such that the filling shall correspond to the original natural layers.

Surplus stuff shall be dumped over the trench for subsequent settlement.

In no case the contractors shall be allowed to refill the trenches in hard excavated

portion to be refilled by the boulders of the excavated stuff. This portion of trench

shall be refilled by the soft murum or soft strata from excavated stuff from distant

place. No extra cost shall be paid.

The 15 cm. thick layer immediately in contact on or under pipe shall have no stones

or chips but only soil or soft murum selected from the excavated stuff after refilling.

If it is sunk below the road level after some time till completion of work the

contractor shall have to make it good at his cost.

Before lowering of all pipes in trenches a layer of murum selected from excavated

stuff shall be provided below pipe line for proper grading and to act as cushion etc.

2.1.22 MODE OF MESUREMENT & PAYMENT

The contract rate shall be for a unit of one cum of refilling.

The volume of the constructed structure, pipeline and sand bedding / boxing shall

be deducted from total excavated quantity.as per item 17 in general note of

C.S.R.2010-11

5.3.1 TEST AND TRIAL

On completion of all the sub-works of the scheme including Testing, the contractor

shall have to give uninterrupted trial run for a period of three months to its rated

capacity including cost of material and labour for above period till the time the

concerned village Panchayat takes over the scheme whichever is earlier. The period

may extend if the village Panchayat dies not take over the scheme. The running

charges exclude the cost of Power Supply chemicals and other materials.

The contractor should employ necessary staff such as Operator Valavemen.

Chowkidar etc. It shall be the responsibility of the contractor to see that regular

supply is maintained in the village which should be disinfected by TCL and the

village panchayat is made aware of day today maintenance. The contractor shall

have to train the G.P. staff for the day-to-day maintenance without any extra cost.

the defects, noticed during this period, arising out of defective workmanship should

be attended by the Contractor without any extra cost.

Necessary Power supply and required materials viz. T.C.L. Powder for running the

scheme shall be provided by the deptt.

The Contractor should maintain necessary log book of pumping and chemical dose

etc. upto date. If the village panchayat accept the scheme earlier than three months

the joint inspection of the committee members shall be arranged as decided by the

Executive Engineer and regular handing over note shall be signed by the concerned

authorities. The responsibility of Contractor shall cease only after signing of such

documents.

I hereby declare that, I have made myself thoroughly conversant with the local

conditions regarding all materials such as stones, murum, sand availability of water etc.

and labour, on which I have based my rates for this work. The specifications and

requirements of lead for this work have been carefully studied and understood by me

before submitting the tender. I undertake to use only the best materials, to be approved by

the Executive Engineer in charge of the work or his duly authorised representative, before

starting the work and also to abide by his decision.

I hereby undertake to pay the labours engaged on the work as per minimum Wages

Act, 1984 applicable to the zone concerned.

I/We Guarantee that :

1) I/We will replace, repair and adjust free of all charges, to the employer, any part of

the work which fails to comply with the specifications or amendment to such

specifications as referred to in our specifications attached to tender, fair wear and

tear accepted until the completion and for a period of 12 months from the date of

Acceptance Certificate issued under Article 20 of General conditions of contract.

2) All the work will be reliable.

3) All the work be of a type which has been proved in service, to be suitable for the

duty required by the specifications and will be manufactured and tested in

accordance with the appropriate standard specifications approved by the Engineer-

in-charge.

4) I/We accept and abide by the clause relating to quality and guarantee of work.
