INFLUENCE ON THE CONSTITUTION

Who would have thought that a simple piece of parchment created centuries ago would greatly inspire and influence the U.S. Constitution and the Bill of Rights that we know of today? Magna Carta – or the Great Charter – is believed to be one of the most famous and influential document that helped laid the foundations of the freedom and liberty that every free man ought to enjoy today. Embedded within the powerful document are a handful of fundamental principles and values that underline the limited power of a ruler.

Although the Magna Carta did not work out as a peace treaty between King John and his rebellious barons, it had robustly restructured the then inhumane and unjust dealings of the King to his people. This eighteenth-century understanding of the Magna Carta evolved and was taken up by the leaders of the American Revolution. The document asserted the fundamental rights of the free people against an oppressive ruler which sparked the concept of a supreme law that neither the executive mandate nor legislative acts can alter.

To put a stop to concentrated political powers, some fundamental values from Magna Carta were adopted in the Constitution’s supremacy clause. This political conviction is generated in the constitutional rights of individual citizens that protected them from federal government autocracy. The U.S. Bill of Rights embraced several protections and freedoms of and for the people against “unlawful searches and seizures, a right to a speedy trial, a right to a jury trial in both a criminal and a civil case, protection from loss of life, liberty, or property without due process of law”.

For centuries, Magna Carta's legacy has endured as it continues to influence the law that governs us today. The document that was conceived from the specific complaints of a group of rebel barons has developed through the years into a universal emblem of freedom and liberty. It continues to be the guiding voice that mandates every citizen, including government leaders, to obey the law. After 800 years, the values and principles of Magna Carta continue to echo in the constitutional rights of every person—and it is our sole responsibility to personally and bravely uphold the freedoms that we are entitled to.
