Practice Areas:Employment Based ImmigrationThe non-immigrant visa classification covers a broad range of visas used to enter the United States for work, pleasure or study. Some visas are considered 'dual status'; you may attempt to obtain permanent residency (a green card) while under that classification. Most non-immigrant visas, however, require you establish the demonstration of non-immigrant intent. This means you should demonstrate that you have a permanent residence in your home country that you have no intention of abandoning. The duration of time you may spend in the US can range from a few days to several years, depending on the visa. In most situations, your spouse and unmarried children under the age of 21 may accompany you on a derivative visa.

Richard M. Wilner
Richard Wilner is a founding member of Wilner & O’Reilly, APLC, and is Board Certified by the State Bar of California as a Specialist in Immigration and Nationality Law. He is admitted to practice law in the State of California and before the U.S. District Courts for the Central, Northern and Southern Districts of California, the Northern District of Texas, the U.S. Court of Appeals for the Ninth Circuit and the U.S. Supreme Court.
Mr. Wilner is best known for his work in advising Fortune 500 companies, middle and small market businesses and foreign nationals of extraordinary ability in athletics, arts and sciences in the complex area of U.S. Immigration and Nationality Law. Representative clients include: Fisher & Paykel Appliances, KSL Resorts, Affliction Clothing, Explosion Entertainment, LLC, Manny Pacquiao, Fedor Emelianenko, Gracie Barra, M-1 Global, Fabricio Werdum, The Black Eyed Peas, Cypress Hill, USA Triathalon and Team Subaru.
Given the firm’s expertise in all facets of U.S. Immigration Law, Mr. Wilner and his firm were designated as of counsel to Atkinson, Andeleson, Loya Rudd and Romo (“AALRR”). As such, the firm of Wilner & O’Reilly is AALRR’s immigration department. With 140 attorneys in seven California offices, AALRR’s public and private sector clients include California's K-12 school districts, community college districts, municipalities, state agencies, trade groups, nonprofit organizations, and many leading businesses and their owners in select industry groups.
Committed to public service, Mr. Wilner served as a Commissioner on the State Bar of California’s Immigration and Nationality Law Advisory Commission. Mr. Wilner is a board member of the Orange County Jewish Bar Association. He also provides pro bono representation to active-duty soldiers from the United States Armed forces and most law enforcement professionals in their immigration needs.
A native of Los Angeles, California, Mr. Wilner received his law degree (Juris Doctor) as well as a Master of Laws (LL.M.) in Transnational Business Practice from McGeorge School of Law, University of the Pacific and the University of Salzburg, Austria. He also received a Certificate in International Law from the National University of Singapore and Bachelors of Arts degrees in Philosophy and Religious Studies from the University of California in 1992. He has also worked in Thailand and Vietnam.
Mr. Wilner is married and the proud father of two boys. When not working, his time is spent with family and practicing martial arts, specifically Brazilian JiuJitsu, Wrestling and Muay Thai.
Kelly O’Reilly
Kelly O’Reilly is a founding partner with Wilner & O’Reilly, APLC, and is a former District Adjudications Officer for the U.S. Immigration and Naturalization Service in Los Angeles and Orange County. As an officer Mr. O’Reilly was given the responsibility for adjudicating Employment and Family based applications for Lawful Permanent Residency, Requests for Travel, Work Authorization and Waivers of Inadmissibility. He was also responsible for conducting Marriage Fraud Interviews and requests for Naturalization.
Mr. O’Reilly was part of a federal panel that was given charge to create imaginative solutions to various complex problems facing the Immigration Service. As a result, many of those solutions remain in effect and are used by today’s Immigration Service employee. Mr. O’Reilly’s unique background provides him with an ability to effectively navigate his client’s cases through the beureaucratic nightmare that can be the U.S. Immigration Service. He was also trained at the Immigration Service, Federal Law Enforcement Training Center (FLETC) in Glynco, Georgia, where he graduated with honors.
Mr. O’Reilly is admitted to the State Bar of California, U.S. District Courts for the Central, Eastern, Northern and Southern Districts of California; the U.S. Court of Appeals for the Ninth Circuit; and the U.S. Supreme Court. He is a member of the following esteemed organizations: Los Angeles County Bar Association; the American Bar Association; the American Trial Lawyers Association; the State Bar of California, Immigration Section; and the J. Reuben Clark Law Society of Orange County. Likewise, he presently serves as the Chair of the Immigration Law Section of the Riverside and San Bernardino County Bar Associations.
Given his experience, he is an expert in all facets of Immigration Law. Mr. O’Reilly has defended clients facing removal from the United States as well as those seeking refuge from persecution under international asylum laws. Having represented celebrities, athletes and businessmen, Mr. O’Reilly is most at home helping families achieve their American dream. His unusual success rates stem from his empathetic understanding of his client’s situation and his undeterred determination to make sure each and every client achieves his or her immigration goals. This zealous advocacy has caused entire communities of friends and families to retain the law offices of Wilner and O’Reilly.
A native of Fresno, California, Mr. O’Reilly received his law degree from the University of La Verne, College of Law and his Bachelor of Science degree from Brigham Young University. A former missionary in Hong Kong, Mr. O’Reilly has a great love of the Asian culture and is conversant in Cantonese. He is married with 5 children.
