BOCW Act,1996, Section 44-Responsibility of Employers
An employer shall be responsible for providing constant and adequatesupervision of any building or other construction work in his establishmentas to ensure compliance with the provisions of this Act relating to safetyand for taking all practical steps necessary to prevent accidents.

Section 32(b) of Factories Act,1948there shall, so far as is reasonably practicable, be providedand maintained safe means of access to every place atwhich any person is at any time required to work;

Section 32 (c) of Factories Act,1948
when any person has to work at aheight from where he is likely to fall,provision shall be made, so far as isreasonably practicable, by fencing orotherwise, to ensure the safety of theperson so working.
Rule 42(6) of WB BOCW Rule,2004Wherever building workers at abuilding or other construction work areexposed to the hazards of falling fromheight while emploed on such work,they shall be provided by the employerwith adequate equipment or means forsaving them from such hazards.Suchequipment or means shall be inaccordance with the nationalstandards
