S h e h as a ma st er 's d egree i n c i n em at o g rap h y an d h as w o rk ed w i t h n u m ero u s A cad em ya w a r d - w i n n i n g c i n e m a t o g r a p he r s a n d directors. She is a seasoned p ro fess i o n al w h o h as ex cel l ed o nc h a l l e n g i n g projects both in this country and abroad.

    2. The t r e a t m e n t Pl a i n t i f f received w h i l e w o r k i n g with Casey Aff l eck i n cl u d i n gr o u t i n e i n s t an ces o f sex u al h a r a s s m e n t w a s b y far t h e mo st t rau m at i z i n g of h er career.

    3. In December 2008, Plaint i ff entered into a n agreemen t w i t h Aff l eck to serve as theD i rec t o r o f Ph o t o grap h y fo r t h e t h e n - u n t i t l e d d o cu men t ary ab o u t t h e e f fo r t s o f ac t o r Jo a q u i nP h o e n i x ("Phoenix") to res t y l e h is career as an en t er t a i n er a n d gi v e u p act i n g to b eco me es t ab l i sh eda s a performer o f rap m u s i c . U n d e r th e terms o f h er agreemen t w i t h D efen d an t s , P l a i n t i f f w as t oreceive a per-day fee for shooting and a deferred fee that would be paid upon execution of ad is t r ib u t io n agreemen t fo r t h e f i l m.     6. In m i d - D e c e m b e r 2008, Pl a i n t i f f traveled with other crew members to N ew Y o rk toshoot scenes i n v o l v i n g Ph o en i x .     comments , innuendo and unwelcome advances by crew memb e r s , wi th in th e presence and wi th theactive encouragement of Affleck. Plaintiff w as berated and verbally attacked by Affleck after sherefused his sexual advances in New York, and was cri t icized constantly for refus ing to be subm issivein response to his rants and der is ive comments .

    15. Plain tiff objected to Defendants ' harassing conduct and could no t cont inue to w o r k insuch a host i le and o f fen s ive wo rk env i ronm en t . Plaint i f f w as ul t im ate ly forced to resign from th ePro jec tfo r th e second t imeaf te r mon th s of work as Director of Photography because of theharassment and abuse.

    16. In re ta l ia t ion , Defend ants refused to honor the te rms of the agreemen t , i n c l u d i n g herr ight to defer red paym ent upon execut ion of a dis t r ibu t ion agreement , as well as a "Director ofPhotography" cred i t on the f i lm.

    17. Dur ing he r 16 years work ing in the en ter ta inm ent indu st ry, Plaint i ff has neveraccused anyone of sexua l harassment . She has never filed a lawsuit against anyone for any reason.A nd she struggled with th e decision to f ile th is l awsu i tshe i s jus t i f ia bly concerned about the effec tth is lawsu i t wi l l have on her career.

    18. Pla in t i f f i s aware tha t Aff leck w i l l use h is ce lebr ity and w eal th to in t imida te her , j u s tas he has done in response to the Compla in t f i led by M s. White . However , Pla in t i f f decided tha t herstory needs to be told, and tha t she is strong enough to withstand th e a t tacks mounted by Aff l e ck ' shigh-pa id publ ic is ts in New York and h is "bul ldog" attorneys. Pla in t i f f decided to speak out in orderto prevent this from happen ing to o the r young wom en w ho a r e s imp ly t r y ing to make a l iv ing in theen ter ta inment indust ry and expect and deserve a non -hos ti l e w o rk ing env i ronmen t .

    19. W ith th is ac t ion , Pla in t i f f seeks to recover compensatory and pun i t i v e damagesre la t ing to Affleck 's assau l t and inf l ict ion of emotional distress, as wel l as constructive discharge inv io l a t i on of public policy, breach of oral contract , un jus t en r i ch m en t , n eg l igen t inf l ic t ion o fem ot iona l d is tress and negl igence .

    38. One afternoon , Plaintiff shot a scene at the Palazzo Hotel where Phoenix performed aset as a rap artist. Following th e set, Plaintiff learned that Aff leck and Phoenix wanted to shootanother sequ ence in the ir hotel suite that eve ning . Several prostitutes, includin g male transvestites,were present for the evenin g shoot. Plaintiff was not aware of what Aff leck planne d for that shoot.

    39. Plaintiff, White and the rest of the nearly all-male crew went to A f f l ec k ' s an dPhoenix 's hotel sui te . Aside from the crew, there w ere appro ximately 35 people at the hotel suiteinc lud ing th e prosti tutes.

    40. Later in the evening, other mem bers of the production team began ma king offen sivecomments to Plaintiff and sug gesting that she engage in some of the beha vior exhib ited by theprosti tutes. Spec ifically, Langdon ma de the crude comment that Plaintiff should have "been a bodydoub le for the tranny so we can all go home." Instead of intervening to protect Plaint iff, Aff leckstood by and let Pla in t i f f be subjected to offensive comments and innuendo.

    41. Plain tiff is inform ed and believes that none of the cond uct that occurred in the hotelsuite is in the version of the film that will be released to the publ ic . Plaintiff bel ieves that Aff leckorchestrated th e shoot in the hotel suite for his ow n twisted personal gratif ication and unfairlysubjected Pla in t i f f to the conduct inv olving the prostitutes for reasons hav ing noth ing to do with thepurpose of the Project.42. A f t e r the shoot in Las Vegas, bec ause Affleck had done n oth ing to protect Plaintifffrom his own outrageous and offensive conduct (and the conduct of others) , Plaint iff requested thatWh i te be physically present fo r every rem aining shoot on the f i lm.The Costa Rica Shoot.

    43. In Costa Rica, Aff leck continue d his abusive tactics towards Plaintiff . As the on lywomen on the shoot in Costa Rica, Plaintiff and Wh ite shared a bedroom at the production team'sl iv ing quarters. O ne evening, Aff leck , Phoenix, Plaintiff and Whi te went to d inner with other crewmember s an d Phoenix's father at a restaurant several miles from the house where th e crew w asstaying.

    44. After dinner , Plaintiff and White returned home to learn that Phoenix and Affleck hadlocked themselves in Pla in t i f fs bedroom with tw o women. They were told by a third individual as70447.3 COMPLAINT

    w e l l as one of the crew members that Affleck and Phoenix were engaging in sexu al ac t iv i ty in thei rb e d r o o m . A l t h o u g h A f f l ec k had his own room, he chose to invade P l a i n t i f f s privacy and violate herp e r sona l space. T his was a l l a par t of Af f leck 's campaign of abuse and harassment .

    4 5 . In another incident , Gork a was exposed to so mu ch degradat ion and exh au st ion thatshe vomited whi le shoot ing.P l a i n t i f f Leaves T he Proj ec t For The Second Time.

    4 6. A f t e r th e Costa Rica trip, A f f l ec k called Plaintiff and W h i t e to a m eet ing a t h is housein Los Angeles. Du ring the mee ting, Affle ck berated Pla intiff for her performan ce in Costa Rica.

    4 7. Pl a i n t i f f tried to respond professionally to A f f leck 's cr it icism but was not w i l l i n g tosuccumb to h is v ic ious personal attacks. Plain tiff had endu red enou gh abu se and harassm ent on theProject and was not w i l l i n g to subject herself to any f ur ther d isparagement by A f f l e c k . Aff le c kstopped at n o t h i n g in his a t t e m p t to belittle a nd in t imidate Pl a i n t i f f into accepting h is misplacedcriticism and prof ani ty- laced t i rade. On A pril 3 , 2009, P l a i n t i f f s agent sent a resignation letter toAff le c k on he r behalf .

Pl a i n t i f f is inf ormed an d believes that A f f l e c k ref used to compensate P la i n t i f f asagreed because she objected to his harassing and abusive conduct, i n c l u d i n g his sexu al advances inN e w Y o r k . A f f l e c k encouraged and participated in the harassment of Pl a i n t i f f for his own sickdesire to dominate and control Plaintiff .

    4 9 . Pl a i n t i f f only endured th e harassment as long as she did because s he wa s p r o u d of herwork on the Project and wanted to receive fair credit for her work. Pl a i n t i f f has not received all thecompensat ion du e t o he r f rom Def endants .     54. As a d i rect and proximate resul t of the wron gful cond uct of Defendan ts , the ir agentsand/or employees , Plaintiff w as harmed. Defendants ' conduct w as extreme and outrageous and hascaused Plaintiff in jury, damage , loss and harm inc lud ing loss of income, medical expenses,humi l ia t ion , embarrassment , severe mental and emotional distress and discomfort based on thesexual harassment experienced, th e precise amount to be determined at tr ial.

    55 . The conduct described herein w as m al i c ious , fraudulent , and /o r oppressive, and donewith a wil l fu l and conscious disregard for Pla in t i f f s r i g h t s .     57 . Defendants intent iona l ly c rea ted and encouraged se xua l harassment in viola t ion of theFair E m p l o y m e n t and Housing A ct (FEHA ) , r e su l ti ng in an i n t imida t i ng , hos t i le , offens ive andabus ive workplace envi ronment .

    58. P la int i f f s working condi t ion s were so intole rable and aggravated a t the t ime of theresignation of Plaintiff that a reasonable employer would have realized that a reasonab le person inth e posi t ion of Plaintiff wo uld be compel led to res ign.

    59 . Plaintiff was, in fact , compelled to resign her employment because Defendants ' ac t sof sexual harassm ent and fai lure to prevent sexual harassment , as well as retal iat io n in the form ofrefusal to pay any agreed- to comp ensa t ion, crea ted an intole rable work ing envi ron men t .

    60. A reasonable person under th e same circumstances, faced with th e same or similarconduc t , would have felt compel led to resign.

    61. The fundam ent a l r igh t s embodi ed by FEHA inure to the benef i t of the public , no t jus tthe private interests of the employer and emp loyee, because al l indiv idu als w ithin the State ofCa l i fo rn i a are a fforded these rights.

    62. C onseq uently, Defen dants ' construct ive discharge of Pla in t i f f as a re sul t of theirvio l a t i ons of FE HA i s a v i o la t i on o f Cal i forn ia pub l ic pol icy.

    63. As a direct and proximate resul t of Defendan ts ' cons t ruc t ive discharge , Plaintiff hassuffered damages , th e precise amount to be proven at trial.T HI R D C A U S E OF A C T I O N
