AustralianConsumerLawislikeanationalregime,comingintoeffectasofthe1January2011and

itreplaced17differentlawsonconsumerprotection,infederallawsandstatelaws.Priortothat,

themainpiecewastheTradePracticesAct1974,consumerprotectionbeingunderPart5.TheAct

wasRENAMED(notrepealed).Priorto1974however,consumerprotectionwasnon-existent.The

firstpieceofcompetitionlegislationcameintoeffectin1906,namedtheAustralianIndustries

PreservationsAct-protectingAustralianprimaryproducersagainstcartelsfromtheUSandtariff

leviesimposed.However,3yearsafterthelegislationcameintoeffect,therewasacaseHuddart

Parker&CoPtyLtdvMoorehead[1909]HCA36;(1909)8CLR330whereitwasfoundthatthe

AustralianIndustriesPreservationActexceededitspowersfromtheAustralianConstitutionand

thuswasultravires.Asaresult,thelegislationwasrepealed.Fromthen,competitionlawwentinto

the“darkages”wheretherewerescatteredpiecesoflegislation,sucha.Therethenwasabigpush

inthelate60’sandearly70’sforanewprotectionforcompetitionandconsumerlaw.
