A000-callwasreceivedat00:37on07June2008fromEmilyElliott,statingthatshehadjustfoundherflatmate,JulieAnnSmith,lyingacrossanarmchairinthefrontroomoftheirsharedrentedflatat30ARailwayStreetAnywhereton,theapparentvictimofaseriousassault–anapparentshooting.Policeofficersandparamedicswereimmediatelydispatchedtothataddress,andarrivedatapproximately00:45.ParamedicsindicatedJulieAnnSmithwasdeadandmayhavebeenforsomehours.Thedutymedicalexaminerwassummonedtothescene,andlifewaspronouncedextinctat00:50(08June2008).

TheSeriousCrimeUnitunderDSManningwasalsosummonedandattendedfrom00:55.SCUfurthersummonedtheScientificSupportUnitandHomeOfficePathologist.SSUattendedfrom01:30andHOPProfDeniseFigginsfrom02:10.InitialexaminationofdeceasedattheScenebyHOPindicatedprobablehomicide,possiblecauseofdeathshooting,withprobablesexualmotive,andpossibletimeofdeathbetween20:00and00:00ontheeveningof07June2008.

ExtensiveexaminationoftheScenebySSUdidnotyieldsignificantevidentialmaterial,althoughtherewereobvioussignsofastruggle.However,therewasnosignofforcedentryintotheresidence.

InitialidentificationfromphotographsindicatedthedeceasedtobeJulieAnnSmith,andthiswasvisuallyconfirmedbyherfather,JamesEdwardSmithof15OceanviewAvenueAnywhereton,asthenext-of-kin,on09June2008at13:30.JulieAnnSmithwasapermanentresidentof30ARailwayStreetAnywhereton,wasaged24years(Date-of-Birth10July1983),andwaspermanentlyemployedatJones&CoPrintersofAnywhereton.

Post-mortemexaminationofthedeceasedwascarriedouton10June2008at10:00,andshowedthefollowing.Thedeceasedwasfullyclothed.Thisclothingitemwasrecoveredforforensicexamination.Thedeceasedwasanadultfemale,caucasoid,probablyaged19-22years,withnosignofdisease,andwell-nourished.Thereweresignsoftraumaonthelowerbackthatwereprobablyduetofingernailscratchingpriortotheassaultthatledtoherdeath.Mechanismofdeathwasdeterminedasasinglegunshottothelefttemporallobe.Therewasextensivebruisingtoneckofdeceasedconsistentwithattemptedmanualstrangulation.Therewascrushingtotracheaofdeceasedalsoconsistentwithmanualstrangulation.Therewasnoothertraumalikelytobe,orcontributeto,thecauseofdeath.Thuscauseofdeathwasconfirmedasmanualstrangulation.Therewasbruisingtothegenitalareaofthedeceasedconsistentwithaggravatedsexualintercourse.Therewaspossibleseminalfluidhighinthevaginaofthedeceasedconsistentwithsexualintercourseoccurringsometimeinthe24-hourperiodbeforedeath.

Therewasbruisingaroundtheanusofthedeceased.Bodilyswabswerecollectedfromthehighvaginaandanusofthedeceasedforforensicexamination.Therewasbruisingonthehandsofthedeceasedconsistentwithhermakingdefenceblowsuponanassailant.Mannerofdeathwasconfirmedashomicide,probablybyshooting.

InterviewofEmilyElliottbySCUgavethefollowing.MsElliottwasacloseandlong-timefriendofthedeceased,andhadsharedthe30ARailwayStreetflatwithJulieAnnSmithforthepasttwoyears.Thedeceasedwashealthyandhappy,withnoapparentenemiesorworries.

MsElliottreportedthatthedeceasedhada“steadyboyfriend”forthepast18months,FrankJonesof3OldwayCloseAnywhereton(Date-of-Birth24April1978),buthadsplitfromhimeightdaysbeforeafteraparticularlynastyargument.ItseemsthatthereweresomefinancialissuesbetweenthevictimandMrJones.MrJones’spolicerecordshowstwomotoringconvictionsforspeedinganddrugspossession.MrJoneswasdivorcedin2001,livesalone,andownstheFit’n’HealthysportsshopinAnywhereton.

MsElliottalsoreportedthatthedeceasedhadbeen“bothered”recentlybytheresidentoftheflatabovetheirs,CarlHenryPiggottof30BRailwayStreetAnywhereton(Date-of-Birth01September1984).ApparentlyMrPiggottwasromanticallyinterestedinthedeceased,butthesefeelingswerenotreciprocated.MrPiggottwasharassingthedeceasedattimesoverthepasttwomonths,andonlyafewdaysagothedeceasedhadremarkedonhow“thatlittlecreepfromupstairskeepsonatme”.MrPiggott’spolicerecordshowsthreeconvictionsforpettytheftfromshops,twolastyearandonepending,andaconvictionforcommonassaultearlierthisyearfollowinganaffrayoutsideapublichouseinAnywhereton.MrPiggottlivesalone,andisregisteredunemployed.

TheinitialassessmentofthiscasebytheSCUmadeMrPiggottprimesuspectforthisrapeandhomicide,althoughtheassailantbeinganunknownthirdpartycouldnotberuledout.MrJonesandMrPiggottwereaskedtoattendAnywheretonPoliceStationat09:30on11June2008.MrJonesdidsovoluntarily,MrPiggottdeclined.AwarrantwasdrawnupandMrPiggottwasarrestedontheafternoonof11June2008andtakentothestation.

MrJonesadmittedspeakingtothedeceasedbytelephoneseveraltimeslastweek,butdeniedpersonalcontactsincetheirargumenton30May2008,andalsodeniedanysexualcontactbetweenthedeceasedandhimselfsincethatdate.Inquiriessofardonotcontradictthis.Ontheeveningof07June2008,MrJonessaidhestayedathomewatchingvideos,butthereisnowitnessverificationofthis,noristherelikelytobe.NeighboursofMrJonescouldnotrecallseeinghimleaveorreturntohishomeduringthatevening.OfficersnotedMrJones’snoseseemedredandinflamed,andMrJonesattributedthistoaheavycold.MrJonesemphaticallydeniedtherapeandhomicideofJulieAnnSmith.OfficersnotedthatMrJonesseemedgenuinelyupsetatthedeathofhisformerlover.

MrPiggottclaimedthatthedeceasedwasa“goodfriend”,andthathespoketoherinpersonseveraltimeslastweek,butdeniedanysexualcontactbetweenthedeceasedandhimselfatanytime.Inquiriessofardonotcontradictthis.However,ontheeveningof07June2008,MrPiggottsaidhewentdownstairstotalktothevictim,JulieAnnSmith,andthenleftat2200whenhemadehiswaytohisshiftatthelocalpetrolgarage.MrPiggottclaimsthathehasonlycommencedworkingatthepetrolgarageinthelastweek,hencehisstillbeingregisteredunemployed.Thereisyettobeverificationofthis.MrPiggottdidnotseeorhearanythingunusualthatevening,certainlynosignsofdistressorviolenceintheflatbelow,whichheattributedtohisbeingasleepaheadofhisnightshiftatthegarage.OfficersnotedbruisingtoMrPiggott’slefteyeandcheekwhichheattributedtoafracasthepreviousevening.Thereissofarnowitnessverificationofthisfracas.

MrPiggottemphaticallydeniedtherapeandhomicideofJulieAnnSmith.OfficersnotedthatMrPiggottdidnotseemupsetatthedeathofhisneighbour,butratherseemedveryagitatedandwasalsoaggressivetoofficers,constantlyswearingatthemandaccusingthemof“tryingtofit[him]up”.Hewasprimarilyworriedaboutlosinghisnewjob.

SCUrequesteddonationofbuccalscrapesandpubichairsfromMrJonesandMrPiggottbeforetheyleftthestationontheeveningof11June2008.MrJonesgavethesesamplesvoluntarilyandwasreleased.MrPiggottdeclined,andwasdetainedovernight,beforethesesamplesweretakenonthemorningof12June2008consequentuponanOrderofCourtbeingobtained.

Furtherquestioningofotherpotentialwitnesseshassofarnotyieldedanymoreusefulinformationorfurtherleads.FurtherinquiriesaretobemadewithMsEmilyElliottandlocalneighboursandalsoMrPiggott’semployersatthepetrolgarage.Notethattheflatnextdoorfromcrimescene,ie,31ARailwayStreetAnywhereton,hasbeenunoccupiedsinceJuly2007.

Theinquirycontinues.

SCUare,therefore,requestinganurgentforensicexaminationofsuchevidentialitemsthatthereare,withaviewtodelineatingbetweenthetwosuspects(MrJonesandMrPiggott),andpotentiallyanunknownthirdpartyassailant.Dependentupontheoutcomeofthisexamination,SCUmayeitherbringanindictmentformurderagainstoneofthetwosuspects,ormaywidenandintensifytheinquirytofindathirdparty.

Crown Case Summary

MsJulieAnnSmithwasrapedandmurderedonthenightof07June2008,betweenthehoursof1900and2200.Acondomwasretrievedatthesceneofthecrime.ThesemeninthecondomwasDNAprofiledandcomparedagainsttheNDNADwhereuponitmatchedwithaCarlHenryPiggott.

Themurderweapon,aBrowning9mmgunwasalsolocatedatthecrimescene.FingerprintsretrievedfromtheweaponwerecomparedwiththeNAFISandamatchwasmadewithCarlHenryPiggott.

MsEmilyElliot,theflatmateofthevictim,confirmsthattherewasnoongoingsexualrelationshipbetweenMrPiggottandMsSmithandthatindeed,MrPiggotthadbeen“hassling”thevictimforamatterofweeks.Hewasinterestedincommencingaromanticrelationshipwiththevictim,whichwasspurned.MsElliotconfirmedthatuntilapproximately10daysbeforehermurder,MsSmithwasinvolvedinarelationshipwithaMrFrankJones.Thisrelationshiphadrecentlybrokendown,apparentlyoverfinancialdisagreements.

Aneighbour,MsSarahSmith,hasgivenastatementthatshewitnessedMrPiggottleavingno.30RailwayStreetat2200on07June2008.SheconfirmsthatshehadnotseenMrPiggottleavehisflatatthistimeregularly.

ItistheCrown’scontentionthatMrPiggottcontinuedhisattemptstocommenceasexualrelationshipwiththevictim,andontheeveningherapedandsubsequentlymurderedMsJulieAnnSmith.

Evidence Crown intend to rely upon:

1. DNAprofilefromthesemensamplefromtheinsideofthecondomrecoveredfromthecrimesceneandsearchedagainsttheNDNADwhereahitwasobtainedwithCarlHenryPiggott.

2. Fingerprintsobtainedfromthebarrelofthegunrecoveredadjacenttothedeceased.Animpressionofaleftthumbandleftforefingerobtained.TheseweresubjectedtoasearchontheNAFISandahitwasobtainedandafterverificationwasmade,apositiveidentificationwasmadetoCarlHenryPiggott.

3. PolicestatementobtainedbyMsEmilyElliot,theflatmateofthevictim,shortlyaftertheincidentwhichimplicatedCarlHenryPiggott.Inthisstatement,MsElliotstatedthatCARLHENRYPIGGOTThadbeen“bothering”thevictimrecentlyandwasromanticallyinterestedinthedeceased;feelingswhichwerenotreciprocated.

4. PolicestatementobtainedbyMsSarahSmith,aneighbouracrossthestreet,whowitnessedCARLHENRYPIGGOTTleavingthepremisesat10pmon7thJune2008.

Statement of Sarah Eileen Smith – DOB 29/6/1938

On the night of 7th June 2008 I went upstairs to my bedroom at the front of my house on Railway Street at 10pm. I know that it was 10pm because that is the time that I always go up to my bedroom. Before I changed into my nightdress, I drew the curtains. As I was drawing the curtains I looked out of the window across the street. I saw a man of average height with brown hair, aged approximately 30 leaving the house opposite. I recognised the man as being Carl Henry Piggott. I know this man to live in one of the flats across the street. I have seen him on several occasions but have never had occasion to speak with him. As he left the house, he looked up and down the street, before crossing the road and walking up the street towards the Railway Station. I have not seen Mr Piggott leave his house at this time on any night previously. He did not look back and I proceeded to close the curtains and went to bed. I did not see or hear anything else that night that was out of the ordinary.
