Another Mystery Solved:
LOSS ASSESSMENT Hopefully you read the article in the last Lake Meader where I detailed where our dues money goes and the amount of assets that our association owns. This time I am tackling another topic that was admittedly fuzzy to me, loss assessment and the mystery surrounding it.
What is loss assessment? If a lawsuit against LMPOA is settled with a payout that exceeds the associations’ insurance limits (currently $11,000,000), then individual lot owners could be assessed the difference. Let’s look at an example:
Lawsuit awarded: $19,000,000LMPOA Insurance Pays: $11,000,000Balance Due from Lot Owners: $8,000,000
The balance due in this example would be divided by the total number of lots in Lake Meade (1,309). This example would result in lot owners paying $6,111.54 per lot owned.
What can you do? Protect yourself by ensuring your
homeowners insurance already has coverage or add a rider to your homeowners insurance that would protect you from
a loss assessment. Coverage for $50,000 is estimated to be under $20 per year, but will vary by insurance
carrier. Please contact your insurance carrier to
determine if you are covered!
Is $50,000 of coverage enough? While we can’t guarantee what amount of coverage is enough to protect individual lot owners, the Balance Due from Lot Owners in the example above would need to exceed $65,000,000 before one lot would be assessed more than $50,000.
Mystery solved? I hope the information above helps take the mystery out of loss assessments. I still need to contact my insurance carrier to verify coverage and encourage you to do the same. I also encourage you to join me and the rest of the finance committee at the next finance committee meeting.

LEAF DROP OFF AT LAKE MEADE
ENTRANCE
For those Lake Meaders who have lots of leaves and nowhere to put them, there is a solution! Empty your bags of leaves at the leaf collection dumpsters located at the entrance across from the bulletin board. The dumpsters will be at this location through November. Place your name, address and the number of bags you empty on the tally sheet at the dumpster (Board requires for statistical purposes). When the dumpster is full it will be transported to a composting facility.

Leaves on the road and inclement weather could make for slick road conditions.
• Drivers in the left lane must yield to the right lane.
• NO Right Turn from the left lane. If travels take you to McClellen Drive and other roads to the right of the entrance area, you need to go to the bottom of the hill and turn right.
Please place a call to the gatehouse (259-0823) IF GUESTS are expected between midnight and 6:00 a.m. The guest may be authorized by the resident to come in and all it takes is a call just prior to the time of entry, or you may call ahead to inform the gate employee that a guest is coming. If there has been no pre-approval and the employee cannot reach you, your guest will be turned away.
Also, if a towing company is scheduled to arrive at your residence, please call the gatehouse. Most times they arrive at the request of the owner, but there are times that towing companies attempt to come in to repossess. If there is no prior notification and the gate employee can’t reach you to confirm admittance the towing company may be turned away.

Budget Approval: The proposed 2016-2017 Operating Budget will be reviewed with the members on Monday, December 14, 2015 at the Finance Committee meeting held in the Community Center starting at 7:00 p.m. Take advantage of this opportunity to review and ask questions of the budget.
Safe Boating Course: Typically the Safe Boating Course from PA Fish and Boat Commission is scheduled for January. The course has not been finalized to date. ASSISTANT MANAGER’S CORNER: The Lake Level will be lowered beginning November 1st this year. It takes approximately two weeks to draw down the lake to its winter level. The LMPOA Rules and Regulations state the following: “The lake will be drawn down to 494 feet above sea level (lowered six feet) on November 1st in years ending in 5 and 0 and November 15th in other years. This level will be maintained by opening and closing of the valve. The valve may be opened after February 1st only by approval of the Board of Directors.” NOTE: Please be sure to remove your watercraft before the lake level starts to drop. Lake Meade Rules and Regulations IV, 2. Docks, d. states, “All boats must be removed from docks, boat racks, and launches by November 15 and cannot be moored at docks or put on boat racks and launches until March 1.”
Lakefront property owners – The time to do shoreline work is while the lake level is down. Prevent soil erosion into the lake by using concrete, rock or heavy stone that is environmentally safe, especially to aquatic life. Riprap must extend a minimum of 12” above the normal high water mark and at least 12” below low water mark or to the bottom of the lake. Construct docks to be able to withstand ice. Property owners considering any type of shoreline, seawall or dock projects should plan well in advance. Department of Environmental Protection (DEP) approval is required, and the process takes time to complete. Each project is different. Dealing with the property owner one-on-one, DEP-WWP can better assist you with figuring out which permit you will need for your project. The lake was stocked with hybrid striped bass, large-mouth bass and walleye.The leaf collection dumpsters are back! Please remember to only
dump leaves and small sticks no more than 1” diameter and 12” length. No bags or trash are permitted in the leaf collection dumpsters.
Dam Improvements – The Lake Management Committee continues its arduous task of determining the best engineering firm to hire for making improvements to the dam.
Republic Services (York Waste Disposal) weekly trash pick-up includes one bulk item. With the automated trucks, bulk items cannot be lifted up and into the trash truck, so York Waste sends a separate truck with a lift gate on the back that picks up bulk items. If the trash truck driver can lift the item over his head, he picks it up. If he cannot lift the item, he calls the bulk driver who comes later in the day to pick up the bulk item. Residents can also call York Waste Disposal (800-210-9675) the Friday prior to trash day to inform them of a bulk item being placed out on Monday for pickup.
ELECTRONICS DISPOSAL – Adams Rescue Mission is no longer accepting electronic items for recycling. Act 108 of 2010 is the Covered Device Recycling Act which requires certain recycling responsibilities and a disposal ban for covered devices. Act 108 affects landfills, trash haulers and transfer stations. Trash haulers are not permitted to pick up TV’s, computers, computer peripheral devices or other computer devices (printers, hard drives, scanners, tablets, etc.) Adams County’s recently updated recycling brochure can be found online at www.adamscounty.us Best Buy locations will accept TV’s and CRT’s (monitors) up to a maximum size of 32”. Staples located in Hanover and Gettysburg accepts computer equipment. The Washington Township Transfer Station, located in Waynesboro, accepts TV’s, computers and other electronics. PAZ Metals, Inc. (757-1298) located in York accepts metals including computer towers, laptops, printers, etc. They do not accept TV’s or CRT’s (monitors).

Reading Township residents cast their ballots at the Hampton Fire Company just south of the Stoney Point Road and Rt. 94 intersection. Latimore Township voting place is at the Latimore Township Office. Take Rt. 94 North to Rt. 15 North until you pass the convenience store/gas station and then make the first right turn to the Township Office.

SAFETY & TRAFFIC WATCHTraffic Safety Mythconceptions
Myth - State law prevails when enforcing traffic control rules on Lake Meade roads.
Reality - Since all of Lake Meade is private property, including our roads, police have no authority to enforce any of LMPOA’s traffic rules and regulations (See PA Title 75, Part V, Section 6113). The exception is if the property owners - you and me - invite them to enter and help en-force our traffic rules. Upon entry, police may also enforce any non-LMPOA driving rules such as DUI. LMPOA has extended such an invitation to the Townships. This assistance is provided on an as-available basis.
Myth - LMPOA likes to use traffic fines to increase revenue.
Reality - No, we don’t. LMPOA does not depend on the proceeds from fines to supplement our operations and services to members. Fines are all about encouraging individual members to alter their driving behavior to adhere to our speed limit and traffic sign directions. Doing so will
improve safety for all: driving, cycling or afoot.
Myth - It’s unfair to hold property owners responsible for the behavior of their guests.
Reality - Possibly, but absent this rule any non-member could ignore the speed limit, Stop signs, directional signs and the ‘No Passing’ restriction with impunity. Do you want to expose your children or yourself when driving or walking to such unaccountable and potentially irre-sponsible behavior?
The rationale is that individual property owners can bring much more pressure to bear on their invited guests (including family, friends, hired contractors and service providers, etc.) than LMPOA to adhere to our rules and regulations. In doing so, property owners work in concert with each other to maximize safety on our roads. Providers of group services, such as school buses, trash collectors, FedEx/
UPS and the like are handled differently. LMPOA notifies the provider of any infractions and asks them to take appro-priate administrative or disciplinary action regarding the violation and to minimize or preclude such violations by their employees in the future. Such providers have been very cooperative with LMPOA’s requests.
Myth - Appeals of infractions to the Board of Directors will fall on deaf ears.
Reality - All appeals are considered carefully on a case-by-case basis. The Board is highly sympathetic to extenuating circumstances, especially when you have some tangible evidence you can present during the appeal.
We recognize First Responders with LMF&R must report for duty expeditiously, but even so both LMPOA and LMF&R require them to refrain from reckless driving behavior enroute. –Your Safety & Traffic Watch Committee
Since the last Lake Meader article, I’ve received several calls from people concerned about swales. Thanks for reading friends! The committee will be focusing on storm water issues in the coming months. I’ve requested additional funding to repair some roadway swales. This will not be cheap and will take several years. If our maintenance guys do the work, estimated costs are 2-5 dollars per foot. Do the math, we have about 32 miles of roadway swales. We also have only Keith and Terry and they have other work, too. I’m asking my committee members to each survey an area that represents 1/5 of the lake neighborhoods and identify priority runoff problems. We’ll then develop a multiyear repair plan. We’ve requested our engineering consultant to do a study on the Sedgwick Drive area and other runoff issues and we’ll develop plans based on his recommendations with an eye toward work next year. I’ve gotten a number of requests to asphalt pave some roads. As we’ve said in the past, we plan to pave Lake Meade Drive only. All other roads will be tar and chipped
(also referred to as oil and chip). The reason for this is the relative cost. Tar and chips cost a fraction (1/5) of the cost of asphalt. If the roadway base needs repair, the cost is much higher, about $32-$40 per square yard. The cost to repair the entry/exit roads was roughly $200,000 a mile. The estimate to pave the small parking lot near the gatehouse was over $46,000. We decided not to pave it this year. With our 18 miles of roadways, we would need more than $3 million to do paving only, which we don’t currently have. We are trying to avoid a large increase in dues and assessments, so we’re trying to contain costs and use our (and your) money wisely. If you haven’t noticed, PennDOT is using tar and chip on some heavily traveled roads such as Stony Point and Route 94. Fall is here and we’ve completed our planned work for the year. Winter is coming and forecasts are that it will be warmer and wetter than usual. Last year was hard and we used quite a bit of money on snow removal. We’re hoping this winter will be better, but we’re preparing.

LMPOA roads are private property belonging to LMPOA and maintained exclusively through LMPOA funds, including snow plowing, paving, etc. NO tax revenue supports LMPOA roads.
Lake Meade Fire and Rescue (LMF&R) is entirely separate from Lake Meade Property Owners Association (LMPOA). They have separate governance and budgets.
The initiation fees paid by new LMPOA members are used to fund capital investments and their repairs and replacements. Capital items include major items that last many years, such as buildings, equipment, pool, roads, bridges, and the dam.
The Community Property Appearance Committee, known as CPAC, is a sub-committee of the Building Committee. The purpose of the Committee is to encourage all property owners to maintain the appearance of their properties, thereby preserving and enhancing property values throughout the community. The committee is made up of a group of community volunteers who meet the second Tuesday of every month. The properties discussed are referred to LMPOA management from community members regarding specific violations. Members are encouraged to first discuss concerns with the property owner. However, if this is not feasible, a form can be obtained through the office or on the Lake Meade website and submitted to the office. In order for the committee to follow-up on a concern, a form must be received. CPAC reviews the property and determines whether a violation of the rules and regulations exist. If so, a letter is sent to the property owner asking him/her to rectify the situation. The reason for this article is twofold: (1) To inform the community about the purpose and process of CPAC and (2) to remind members that LMPOA is a private homeowners association that requires upkeep of one’s property to preserve property value. With that said, the majority of concerns the committee receives relate to unkempt lawns and the storage of various items on properties. Let’s all do our part by maintaining our lawns and storing items in their proper place.

Hopefully, by next summer Marina Building C which is operated by Mac’s Pizzarina will have a new feature that will not only enhance the look of the building, but provide those sitting inside enjoying the good food that Mac’s Pizzarina offers with a gorgeous view of the lake. At the last Board meeting, the Board of Directors approved the installation of a 4x10 window at the front of Marina Building C. I know what most of you reading this are thinking, “I can’t believe the Board approved spending member’s money to install a window at Marina Building C when there are other financial projects that are pressing!” The good news is the money being used for this project comes from the Management Agreement fees, which means the rent money LMPOA receives each month pays for the project, therefore this is at no cost to the members.

The PA Department of Environmental Protection, Wetlands and Waterways Program (DEP-WWP) requires lake front properties planning shoreline, seawall or dock projects to first obtain a general permit from the DEP-WWP office prior to starting the project. These types of projects also require LMPOA Lake Committee review and approval by the LMPOA Building Committee. When the Building Committee approves the project, a Letter of Compliance is issued to the member. Depending on the scope of the project, the property owner may then be required to submit the plans to the township for a building permit and also obtain an Adams County permit. Property owners considering any type of shoreline, seawall or dock projects should plan well in advance, as the approval process with the various entities will take time to complete. PROCESS: Before starting your next building project, pick up the LMPOA Building Regulations from the office or find them on the website, LakeMeade.org. This packet includes the building regulations, the application process, and the forms for approval and inspections.
PERMITS: Regarding permits, LMPOA is mainly concerned with easements, appearance (such as height and materials), and water flow between properties and into the lake. The townships are concerned with compliance to the Uniform Construction Code, the Township Building Code, and other applicable codes (electric, plumbing, and residential). A DEP permit is required to build a dock or boathouse. Be aware that approval may take 2 – 3 months. All necessary permits or approvals must be obtained before any excavation, demolition, or construction may take place.
INSPECTIONS: LMPOA may enter the job site at any time to inspect the work for compliance with regulations. Two to three inspections occur depending on the project—(1) after installation of footers and other site preparation, (2) after the roof is framed or trusses are set for a boathouse, and (3) upon project completion. Additional inspections may occur, especially when the structure is located very close to an easement. Applications and inspection sheets are included in the Building Regulations packet. In the end, the “buck stops” with the property owner, who is responsible for making sure that the approved plans and elevations are followed as well as for all work performed at the job site.

Inquiries from the floor included concerns regarding recent unusual sewage spillages, wakes created by ski boats, compliments about the entrance and exit roads paving, the swimming pool and the tennis courts, dismay about the Guide to Robert’s Rules of Order for LMPOA and an inquiry regarding the Building Regulations.
Letters of Compliance was issued for one addition, one deck, one enclosed porch, one house and one garage; and approval given for one deck railing, one storm water excavation, one fence, one window/door replacement, one driveway overlay and two storage sheds. The total number of homes with permits issued is 1,071. The Executive Committee reported fourteen new members since the last report.

If you are having a party or gathering at your home, you should submit a party list to the gatehouse so they can admit your guests smoothly. The form is available on the web site, at the gate, or at the office.
LMPOA has three types of governing documents: Declaration of Covenants that are “attached” permanently to the property as part of the deed, By-Laws that define how LMPOA is organized and governed, and Rules and Regulations that spell out the details of what is permitted within Lake Meade.
Lake Meade Ski Club • Winter 2015-16(Nov. 4th Deadline for discounted Ski Roundtop rates online; rates increase at midnight.)
The Lake Meade Ski Club is open for membership to the community. Ski season is just around the corner! The purpose of the club is to offer enthusiasts and interested beginners of the skiing and snowboarding sport, an affordable way to get involved in winter sports. Ski Roundtop offers special rates and packages that are only available to organized clubs and cannot be purchased over the counter.
This year, the club is offering three basic options. 1) The Night Club Card program is available only through
a club and is the very best value for winter fun at all three area resorts, Roundtop Mountain Resort, Liberty Mountain Resort, and Whitetail in Mercersburg. The Night Club Card is still UNLIMITED use from 4:00 -10:00 PM every night of the season, and on Sunday it is good from 3:00-10:00PM beginning Jan. 3rd 2016. Tickets can be picked up 30 minutes prior to start time.
2) Again offered this year and a great value is the NIGHT SEASON PASS. The Night Season Pass can be used once the facilities open & the season begins. No need to wait until January 3rd.
3) Multi Visit Card - 4 Visit program will remain intact this season. Multi - visit participants will receive a photo ID card similar to the Night Club Card for the 4-visit program. 4 Visit programs can be used anytime after January for ANY four hour session, weekdays, weekends, and holiday periods. Participants will take their card to the ticket windows and have it swiped to receive their lift, lesson and /or rental ticket for their session. One session
will be deducted for each visit. Advantage card options are available with the Multi visit card as well.
For over 16 years, Lake Meade families have come together to take advantage of the close proximity of these local ski areas. Skiing and snowboarding with family, friends, and fellow Lake Meade neighbors, is a great way to pass the winter in a fun and wholesome atmosphere just 25 minutes from our doorsteps! Keeping our Lake Healthy Ask Bill Kirkpatrick how long he’s been helping to keep Lake Meade healthy and you get a long pause… followed by, “Gee, it’s been a while. I think we started in the early 1990s.” Bill heads Aquatic Environment Consultants (www.aeclakes.com), and he’s been our biologist on call ever since. We caught up with Bill just prior to his periodic “fish count” at the lake—a half day process that involves a jon boat, a generator, long poles, a big net, and a sharp-eyed assistant. The fish count provides important data on the balance among fish species in the lake—a guide for the stocking that helps keep our populations of aquatic critters in balance. We asked Bill what it takes to keep lakes healthy. He replied that there’s no one simple formula. “Lakes,” he said, “are like people. No two are alike, and you have to pay attention to their individual quirks and situations.” Lake Meade, Bill noted, sits in the midst of very fertile farm land, and its fertile surroundings make for a fertile lake. Translation: stuff will grow in it very easily. That makes management of nutrients and invasive species—both plants and animals—important. Our lake also has a fully-developed shoreline, much of it surrounded by concrete bulkheads. That combines with the amount of recreational boating to create a pretty turbulent aquatic environment. Over 90% of the water entering the lake comes from Mud Run, which drains a comparatively small area of farms, a school complex, and a few residences. That water source also contributes to the management issues around keeping the lake healthy. Bill’s annual routine includes regular checkups to ensure that bacterial, oxygen, and chemical levels remain in balance.
During the summer months, there are periodic treatments to combat growth of algae, hydrilla, and other plant species that can “bloom,” throwing off the nutrient balance of the aquatic environment. Bill sums it all up by saying, “Just as with people, you can’t make a lake something it’s not. What we do is designed to keep the impoundment as healthy as possible given the environment in which it sits.” For a community whose lake defines its character, that’s an important job at which Bill continues to excel.

Your communications committee has been busy over the past two months, working on rules and regulations changes as well as the possibility of forming an ad hoc committee to celebrate our 50th anniversary! We are currently seeking volunteers for the formation of this ad hoc celebration committee! Would you have time or interest in serving in this committee for this Lake Meade milestone? In our wonderful lake community, we have several other committees that are currently seeking volunteers. These committees include the nominations committee, lake, safety and traffic watch, recreations, buildings, and so on. COMMUNICATIONS COMMITTEE Responsibilities for Lake Meade Property Owners Association (LMPOA) and Members
WHAT LMPOA DOES:• Plan, budget, and manage all costs of
maintaining the common areas and facilities. Such facilities include but are not limited to: roads, Community Center, recreation and common areas, maintenance facilities, two bridges, pool complex, sports complex, marina facilities, entrance area, rec area docks, the lake including buoys.
• Facilitate communication within the community regarding POA actions and concerns
• Administer and keep records of finances and association membership
• Make every reasonable effort to maintain the safety, operation, and value of common properties and facilities
• Make reasonable efforts to enforce the rules and regulations of the association
• Count on all members to assist in education and enforcement regarding rules and regulations
WHAT LMPOA DOES NOT DO:• Mediate between neighbors• Replace personal responsibility for ownership
and maintenance of private property• Provide legal representation for property
owners• Advocate or speak for individual property
owners in dealings with governmental agencies or entities
• Provide police protection• Enforce laws of the township, commonwealth
or federal government, including trespassing laws
• Mitigate or repair damage or destruction of private property caused by acts of nature or acts of others
WHAT LMPOA MEMBERS DO:• Recognize that LMPOA IS its members and
is only as strong as its members’ collective support
• Educate themselves and their neighbors about the rules and regulations of the association and comply with same
• Support the association by attending meetings and/or reading minutes
• Recognize the need for balance between personal and community interests
• Volunteer in support of the community and our shared interests
• Avoid actions that place financial burdens upon the association—i.e. all of us
• Respect LMPOA common properties and facilities, making an effort to leave them in the same or better condition than they found them

Mailboxes are placed within LMPOA’s road right-of-way. LMPOA recognizes that the Post Office has placement requirements for the benefit of mail carriers. LMPOA’s mission throughout winter weather months is to maintain safe and passable roads within the community. Keeping roads passable during snow storms requires plowing snow to the edge of the roads. Snow plow operators are instructed to maintain the lowest speed possible that allows for the truck to push the snow, slush, or ice off the road. Occasionally damage to mailboxes occurs due to the weight of the snow, slush, ice being pushed. The force of a plow pushing a heavy amount will cause a “throwing” action that can damage mailboxes and/or posts. LMPOA does not replace mailboxes or posts damaged during snow plowing operations. Since the mailboxes are placed within LMPOA’s legal right-of-way it is up to the property owner to ensure their mailbox and post can withstand the weight of the snow, slush, or ice being thrown from the plow. Generally if a mailbox is placed as far beyond the edge of the road as is allowed by the Postal Service the force of the plowing will not affect its stability.
Tips to avoid mailbox damage during snow plowing operations:1. Make sure the mailbox is firmly
supported in the ground.2. Keep the area around your mailbox
cleared.
3. Do not throw snow back onto the road.
4. Consider installing a cantilever mailbox support that allows a mailbox to “swing.”
5. Place reflective tape on your mailbox. This will assist snow plow operators to see the mailbox.
Tips on proper mailbox placement from the East Berlin Post Office:1. The height should be approximately
42” from the ground to the bottom of the box.
2. You must maintain the area between the paved surface and the box so the carrier can pull in and out. You don’t want the box too far away from the road.
3. Please consider the snow plows and don’t put your box too close to the road.
4. For safety, the carrier should be able to stop at the box without obstructing the driveway.
Lake Meade Property Owners Association, Inc. is not liable for damages to mailboxes, invisible fencing, shrubbery, trees, or any other objects or landscaping within the road right-of-way, caused by snow removal or any other maintenance operations where the same are located within the limits of the road right-of-way. Your cooperation is important to ensure visibility and stability of mailboxes during snow plowing operations in Lake Meade.

There are 18 miles of roadways in Lake Meade. The roads are plowed in one direction at a time turning 18 into 36 miles. When it snows, sleets, or is icy, please do not park vehicles along the roadway as this slows down road clearing operations.
PLEASE NOTE: LMPOA will not be responsible for damage to mailboxes when our employees are trying to clear roadways. LMPOA’s focus is to clear all the community roads as quickly as possible for the safety of all our members. Inhibiting the process only prolongs the wait for some members. Our plows inadvertantly push snow on the ends of some driveways—this cannot be avoided—please do not shovel snow back out onto the roadway.
