La Casa HOA Board Meeting – Abbreviated Minutes Wednesday August 10, 2011 1. Meeting called to order by M. Amos - 2:00 p.m. Attendance 44 Pledge & Roll Call (4 directors present 5 via teleconference) 2. Proposed Agenda adopted 3. May 18, 2011 HOA meeting minutes approved 4. Shareholders Requests to Speak: No requests 5. Open Forum on Agenda Items Only: No requests 6. President’s Report: M. Amos Motion: to approve the prospective Homeowner’s request for underage caregiver to reside in home for primary care. Rationale: Per Legal advise: if the justification for the caregiver has been established, the reasonable accommodation must be granted. The fact that caregiver is only 20 yrs old is not relevant. The liability concerns are no different from those that are raised by allowing any other minors to visit the community or attend community events (such as grandchildren). The resident has the responsibility to ensure that his guests/caregiver abides by community rules and laws while in the community. The caregiver would not be treated any differently from any other minor in terms of potential liability and insurance coverage. La Casa can certainly require the caregiver to leave the community when the need for a reasonable accommodation ceases just as you can require him to abide by community rules. Failure to process this request would be in direct violation of Federal Laws (Fair Housing Act, HUD & ADA), and not a recommended course of action for the HOA Board or it’s community. MMC 7. Director’s Reports R. Burlison – no report B. Calnan – Motion: to approve Lawson Courts contract to repair cracks and resurface #2 and #3 tennis courts for $13,750 Rationale: CRC has reviewed the matter and the finances were available from the reserves. MMC K. Farrar – Motion: to approve the installation of a new home on Lot # 181, 340 LaCosta. Rationale: Details were provided. The new home meets all the applicable restrictions; drawings were distributed. MMC J. Freeman- Motion: to approve garage-screen conversion at Lot #963, 257 Vistoria. Rationale: The conversion would be in compliance with park rules. MMC J. Lewandowski- no report Joe (Skip) Libby – no report B. Loftus – no report L. Morris – no report 8. Unfinished Business - none 9. New Business- President Amos noted the request to purchase new Bingo equipment. It will be on the September 21, 2011 meeting agenda. 40 Acre Update: La Casa is selecting a surveyor to determine where to relocate the 20’ easement to the 40 acres. 10. Open Forum - Bob Hermes, 211 Estrada - questioned the approval of an "underage" care giver residing in our community Cheryl Crawford, 112 LaPaloma - questioned the approval of the underage caregiver and the disposition of this residency when the disabled person dies Clint Van Tassell, 469 Loma Linda - on behalf of his wife, Betty, informed the assembly that the firm that publishes the LaCasa news is being sold. A new company will be publishing the news and as of September it will be available on the internet. 11. The meeting was adjourned at 2:30 pm. The next meeting is September 21, 2011 @ 2:00 PM Joseph M. Lewandowski, Secretary
