•Es una ley aprobada por el Congreso de Estados Unidos en 2016 que establece una Junta de Control Fiscal con el propósito de garantizar el pago de la deuda a los bonistas y devolverle a Puerto Rico el acceso a los mercados de capital. •Is a federal legislation that establishes a Fiscal Control Board with the purpose of guaranteeing the payment of the debt and returning Puerto Rico’s access to capital.

•Debt Audit: A compre-h e n s i v e and forensic audit of the debt to determine the legal, moral and ethical debt. (A Multisectoral Commission was created that has determined that more than half of the debt is illegal. Currently the governor has the Commission inoperative.)

•Debt restructuring: After auditing the debt, we should negotiate the debt directly outside the judicial forum on equal terms with the bondholders. The government must have as its main duty to guarantee the rights and ensure the welfare of citizens.

•Progressive Tax Reform: Establish a rate of contribution on income that increases as income increases, while attacking the problem of tax evasion.

•Economic Development Plan: A decolonization process for the is-land is necessary in order to establish free trade with other na-tions, customs control, the repeal of the coastal trade laws, and PROMESA that together limit and confiscate our resources. In summary, we propose:

•Protectionist legislation that allows the development of lo-cal industries and reduces capital flight from the megas-tores.

•Development of a sustainable agricultural industry, elimi-nating the unfair competition of the products of the United States.

•Export of goods and services and recruitment of local talent where 30,000 university degrees are awarded annually.

•Puerto Rico’s geographical location, road and port infra-structure allows the island to become a distribution cen-ter of merchandise and passenger traffic between the Caribbean, Americas and Europe and with privileged natural resources is an asset for the development of tour-ism.

Our Solution

•Auditoría de la deuda: Una auditoría integral y forense de la deuda para determinar lo legal, moral y ético de la deuda. (Se creó una Comisión Multisectorial que ha determinado que más de la mitad de la deuda es ilegal. Actualmente la Comisión está inoperante.)

•Reestructuración de la deuda: Luego de auditarla, negociar direc-tamente la deuda fuera del foro judicial en igualdad de condi-ciones con los bonistas. El gobierno debe tener como norte su deber principal de garantizar los derechos y procurar el bienestar de los ciudadanos.

•Reforma Contributiva Progresiva: Establecer una tasa de contribu-ción sobre ingresos que aumente según aumenta el ingreso, ata-cando a la vez el problema de la evasión contributiva.

•Plan de Desarrollo Económico: Es necesario la descolonización de la isla para poder establecer libre comercio con otras naciones, control de aduanas, la derogación de las leyes de cabotaje, y de PROMESA que limitan y confiscan nuestros recursos. A grandes razgos proponemos:

•Legislación proteccionista que permita el desarrollo de in-dustrias locales y reduzca la fuga de capital en las mega-tiendas.

•Desarrollo de la industria agrícola sustentable, eliminando la competencia desleal de los productos de Estados Uni-dos.

•Exportación de bienes y servicios y reclutamiento del tal-ento local donde 30,000 títulos universitarios anualmente se otorgan.

•La ubicación geográfica, la infraestructura vial y de puertos permite a Puerto Rico convertirse en un centro de dis-tribución de mercancía y tránsito de pasajeros entre el Caribe, Las Américas y Europa y con recursos naturales privilegiados para el desarrollo del turismo.

Contexto / Context

•El gobierno ha operado por más de dos décadas tomando préstamos sobre deudas anteriores con garantía de pago constitucional.

•La relación política de Puerto Rico con Estados Unidos ha llevado a Puerto Rico a implementar políticas de exenciones e incentivos convirtiendo a la isla en paraíso fiscal para grandes empresas estadounidenses.

•Debido a las exenciones, la falta de transparencia en el gobierno y el trato desigual de Estados Unidos con 3.5 millones de ciudadanos estadounidenses, la isla tiene una alegada deuda de más de $73 mil millones.

•The government has operated for more than two decades borrowing on previous debts which payment have a constitutional guarantee. •Puerto Rico's political relationship with the United States has led Puerto Rico to implement exemption and incentive policies, making the island a tax haven for large US companies. •Due to exemptions, lack of transparency in government and unequal treatment of the United States with 3.5 million US citizens living in Puerto Rico, the island has an alleged debt of more than $73 billion.

¿Cómo opera? / How it works?

Se establece una Junta de Control Fiscal pagada por el pueblo de Puerto Rico con inmunidad absoluta y poderes amplios para actuar por encima del gobierno cuyos miembros, nombrados por el Presidente y el Congreso de Estados Unidos, pueden recibir regalos y donaciones. La Junta recomienda medidas de recortes presupuestarios y eliminación de derechos relacionados a la salud, educación, trabajo, mayores impuestos y reducción de jornada laboral para poder tener liquidez y pagar a los bonistas. El Gobernador de Puerto Rico debe entregar un Plan Fiscal que cumpla con las demandas de PROMESA. La Junta tiene poder para revocar política pública y legislación del Gobierno de Puerto Rico si entiende que va en detrimento de su objetivo de garantizar el pago de la deuda. Sin realizar una auditoría, la Junta es quien negociará en última instancia el pago de la deuda.

A Fiscal Control Board is established, paid by the people of Puerto Rico with absolute immunity and broad powers to act above the government whose members, appointed by the President and Congress of the United States, can receive gifts and donations. The Board recommends measures of budget cuts and elimina-tion of rights related to health, education, labor rights, higher taxes and reduction of working hours in order to have liquid-ity and pay the bondholders. The Governor of Puerto Rico must deliver a Fiscal Plan that meets the demands of PROMESA. The Board has the power to revoke public policy and legisla-tion of the Government of Puerto Rico if it understands that it is detrimental to its objective of guaranteeing the payment of the debt. Without auditing the debt, the Board is the one who will ultimately negotiate the payment of the debt.

•DERECHOS LABORALES

•No aumento salariales hasta el 2021. (No ha habido aumento por más de 3 años)

•Reducción de días de enfermedad y vacaciones.

•Reducir 30% la nómina de empleados del gobierno.

•Inmediatamente reducir 4 días de trabajo al mes a los empleados del gobierno.

•SALUD:

•Eliminación de beneficios y cubierta de Medicaid. Aumentar el co-pago.

•Cierre y venta de centros y servicios de salud.

•Aumentar criterios y requisitos para acceder al sistema de salud del gobierno.

•Reducción de 2 días de trabajo al mes a los empleados proveedores de salud.

•EDUCACIÓN:

•Cierre de más de 150 escuelas.

•Reducción de 2 días de trabajo al mes a los maestros.

•Recorte de $450 millones a la Universidad de Puerto Rico, aumento de matrícula, despido de profesores y personal administrativo, eliminación de ofertas académicas.
