This past week KZN Property Pages co-hosted a Property Conference at The Golden Horse – we had 300 odd attendees, and some really exciting business and property related speakers. The conference was aimed at Estate Agents and those involved in The Property Industry – however, there was one speaker who had a more general message, a motivational speaker (and I use the label loosely – he came more as a business speaker), whose energy on stage together with the way he was able to analyze and dissect ‘business’ certainly had the most cynical of attendee contemplating if they were doing enough with their lives and if there was more they could do to improve their business, improve their financial position and ultimately upgrade their lives?

His name is Andrew Smith (www.andrewsmith.co.za), and I recommend that you visit his website and see what he’s about, look out for his YouTube Channel as well.

I agree though, and fall victim to the same scenario - some days you just want to put your feet up, eat take-away, and watch Netflix - and not even good Netflix, but some movie that you're only watching because you've given up on being productive and are complicit in filling your brain with dim-witted, mind-numbing entertainment. But, sometimes that's what it takes to recharge your batteries. A nice little brain vacation.

Of course, when you've got a deadline looming, or a big presentation coming up, and your co-workers (and/or customers) are depending on you, taking a brain vacation isn't really an option. In such cases, when you can't afford to procrastinate, you need to be able to silence your inner couch potato and get your head in the game. You need to be able to dig down deep, find your inner strength, give 110%, and ... ok, motivational speeches are not my thing, (I’ll leave that to the experts),

So in lieu of writing one, I've found this little illustration to try and get my message across, help you get in the right frame of mind for tackling your next big challenge…

“There are these two young fish swimming along and they happen to meet an older fish swimming the other way, who nods at them and says “Morning, boys. How’s the water?” And the two young fish swim on for a bit, and then eventually one of them looks over at the other and goes “What the hell is water?”

This little story reminds us that we often forget, or take for granted, the most obvious things around us. It is challenging to stay aware of what’s happening in the world, especially when we are busy dealing with the voices in inside our head – often leading us to the couch along the path of least resistance.

I think we should all strive to wake up with motivation, and go to bed with satisfaction – that’s what life should be about. To quote Walt Disney, "All our dreams can come true if we have the courage to pursue them."

From a self confessed procrastinator, someone who finds it increasingly difficult to “get on and just get it done”, I have to keep reminding myself that good things come to people who wait, but better things come to those who go out and get them.

Have a fruitful week ahead…

gates from all over the province.

Delegates were held spell-bound by a lineup of national speakers including property trainer Trevor Gaw of Johannes-burg, “life enrichment specialist” Lynette Beer and business coach Andrew Smith of Pretoria. The event ended on a high note with an excited Underberg agent Sue Preston, winning a 4 night cruise on the MSC Sinfonia.Run under the auspices of the Pietermaritzburg branch of the Institute of Estate Agents, the event was hosted by well-known sporting commentator and ex radio personality, Dave Macleod.

SA Home Loans and Private Property SA’s biggest online portal, co-partnered the event along with sponsors Natal Property Consultants and Pam Golding Properties. Other sponsors included Opel dealer Key Pietermaritzburg and attorneys Shepstone & Wylie, along with Asad Ameen and Stowell & Co.

With the theme: “Unlock Your Potential for 2016…” the program was designed to provide agents with practical sales advice and inspiration and was aimed at helping them to improve their service levels to customers and become the “go to agent” in their area.

“Many agents fail to give clients the kind of service they deserve, because they have never learned to “read” clients personalities,” according to Lynn Beer. “They haven’t been given the “tools” they need to do the job. Her presentation explained the different personality types agents are likely to encounter and how to approach each, with view to better

meeting their expectations.

Trevor Gaw who has worked extensively overseas as a sales trainer, spoke on the importance of self-discipline in an agent’s life. Agents who are disciplined avoid time-wasting activities around the coffee machine or on their tablets playing “solitaire”. Gaw says by following his system of time management for just 66 days, a diligent agent will find himself consistently closing a minimum of eight sales every month, even in a downturn.

Business coach and “serial entrepreneur” Andrew Smith of Pretoria, is the owner of number of diverse businesses each started when he identified a particular opportunity. One of these is a highly successful solar power business which he has franchised. He attributes the success of his businesses to gaps created in the market by failing agencies like Eskom, as well as to relentless marketing on all available platforms, which he says every agent can and should be investing in, to build his or her “personal brand”. Smith uses social media as well as a streaming video website “chat program” called Car Talk, where he talks on camera, on business topics, on a daily basis on his way to the office, as a way of marketing himself and ultimately, the businesses he is involved in.

Private Property’s Mark Coetzee spoke on how online advertising provides a window on the property world, with buyers able to go online and enjoy a “virtual tour” of a property, before deciding which homes they would like to view. According to Coetzee, a new feature launching soon on Private Property is that of high resolution photography, both still and video, which will give buyers the ultimate, crisp technicolour, house-hunting experience, on their mobile or laptop viewed in the comfort of their own livingroom.

The conference was opened by National president of the IEASA, Lanice Steward of Cape Town.

In any communal scheme, there can be exceptions to any rule or rules depending on circumstances. Rules are generally as rigid as possible but are also quite often breached and those breaches can be tolerated permanently or for some time .Trustees do have a discretion in the application of any rules but that discretion must be exercised fairly and transparently as well as in accordance with our Constitution .Section 36 of the Bill of Rights is relevant here , as it requires balancing of interests when limiting rights , if this is reasonable and justifiable in an open and democratic society , that is based on human dignity, equality and freedom.

Many sectional title schemes are not ideal places for pets as there may be little communal space and even less general tolerance of pets as other owners have bought into a scheme expecting no pets to share “their” space with them. However, many people regard pets as companions or even as their children and consider they have a right to such companionship or relationship so there can be fertile grounds for dissension and expensive, highly emotional struggles which can involve protracted litigation and much personal antipathy between owners.

Communal living is about tolerance so there will be give and take on a continuing basis between the occupants of any such scheme although the registered rules are the foundation of any scheme’s character and the trustees are often placed in an invidious position when enforce-ment becomes necessary. They are unpaid volunteers and have to bear the brunt of the ire of unhappy owners when there is dissension so will sometimes even refer the issue to a general meeting of owners for directions to be given.

In our law, the principle of buyer beware is still important though modified to an extent by the Consumer Protection Act . It is still vital for anyone who wants to buy a unit in any sectional title scheme to insist on being given a copy of the current rules and to read them

carefully before making a final decision about purchase rather than simply blundering in and regretting it when the consequences of certain rules become apparent. Pets of many sorts, not always a dog or a cat, are often involved in such situations though this is certainly not always the case as there are ,for example, issues about conducting businesses such as a hairdresser, physiotherapy practice or a conve-nience store from a section or on the common property, which can be problematic .

Many schemes have the so called standard rules that are annexures to the Sectional Titles Act which were developed over a period of time by the South African Property Owners Association in conjunction with various interested parties such as banks . There are management and conduct rules and both must be studied carefully especially if they vary from the so called standard rules which do generally meet the requirement of Section 35(3) of the Sectional Titles Act that “Any management or conduct rule made by a developer or a body corporate shall be reasonable, and shall apply equally to all owners of units put to substantially the same purpose.”

These standard rules have a general prohibition against the keeping of any animal, reptile or bird in prescribed rule 1 of the conduct rules:

“(1) An owner or occupier of a section shall not, without the consent in writing of the trustees, which approval may not be unreasonably withheld, keep any animal, reptile or bird in a section or on the common property.(2) When granting such approval, the trustees may prescribe any reasonable condition.(3) The trustees may withdraw such approval in the event of any breach of any condition prescribed in terms of sub-rule (2).”

This rule allows the exercise of discretion and it is an example of an important rule to scrutinise and consider very carefully .Some

schemes have altered it so that there is ostensibly no discretion allowed and no pets of any sort are allowed whilst others allow particular pets subject to certain restrictions such as number, size or temperament as well as imposing duties on owners to clean up faeces, ensure the animal does not make untoward noise and so forth. In all schemes, feral cats or just stray animals in general can make their appearance and present their own difficulties especially as any such case can quickly become a social media sensation often involving others who do not even live in the scheme which adds yet another dimension to the difficulties in enforcing rules.

The likelihood of nuisance to other owners is also an important consideration when trustees consider a possible relaxation of a rule so they often attach conditions to any consent that should minimise or prevent nuisance. They must also take into account the distress and possible financial expense for an owner who is required to get rid of a cherished pet or even a legitimate service or therapy dog .It calls for Solomonic wisdom and careful consideration of all circumstances involved so a rigid and unthinking approach can ultimately be overturned by a court with long lasting consequences for the sectional title community involved. Since all rules must also be reasonable, any new rule involving pets must also take into consider-ation the vested rights of current owners who have pets at the scheme and should not make those who currently have pets get rid of them but it can provide that once those pets die theowners should not be entitled to replace them.

Always research a proposed purchase properly and do not assume “it’ll be alright on the night”, especially if your pets are involved and consult a property lawyer as necessary.
