Globally, house prices increased by 3.4% on average in the year to March 2016, but top-performing countries such as Turkey and Australia are seeing their rate of annual price growth slow.

The Knight Frank Global House Price Index, established in 2006, allows investors and developers to monitor and compare the performance of mainstream residential markets around the world.

Kate Everett-Allen, International Residential Researcher for Knight Frank, says Turkey, which leads the annual rankings for the fourth consecutive quarter, has seen its rate of annual growth decline from 18% last quarter to 15%.

Security concerns, Russian sanctions and mounting pressures on the government are curtailing investment in Russia, despite high demand and low supply characterising the wider property market.

Everett-Allen says other strong performers such as Australia and New Zealand have also seen price growth moderate.

“Despite Australia’s recent rate cut to 1.75%, prices are unlikely to keep growing at the same rate given mortgage debt is at a record high relative to income, and December 2015 saw the introduction of new fees for foreign buyers,” she says.

House prices in New Zealand increased 11% year-on-year, but have slipped from their peak in Q3 2015. Weaker economic growth and regulatory changes in the form of higher deposits for investors have dampened demand.

The US and the UK are largely treading water, with price growth in the first three months of 2016 equated to 0.9% and 1.6% respectively, linked in part to political worries, notably a potential Brexit in the UK and the US presidential election.

Aside from Turkey, emerging markets have seen prices enter

a period of flat or low growth since mid-2014. The BRIC nations recorded annual price growth of 3% on average in the 12 months to March 201 - four years ago this figure was closer to 11%. Capital flight, currency shifts, partly due to US rate rise, volatile equity markets and slowing wages are hampering demand.

Although Europe is no longer the weakest-performing world region - a title now held by Russia and the CIS, Everett-Allen says economic headwinds still persist in the Eurozone. Twelve of the bottom 20 rankings are occupied by European countries, and of these, nine are members of the Eurozone.

South Africa was ranked 13th in the index, showing an annual price growth of 6.8% for the year to March 2016.

Property remains the key pillar in the investor's armament, offering long-term growth coupled with rental income in the medium-term. The question on whether that investment should be in South African property or globally is one of personal choice and subject to personal circumstances. The barrier to entry into the international market is high – and only the wealthiest of South Africans would be able to consider full title ownership internationally. For the less well heeled South Africans, consider listed property funds which give you access into the international markets.

The Knight Frank Global House Price Index, established in 2006, allows investors and developers to monitor and compare the performance of mainstream residential markets around the world.

The index is compiled on a quarterly basis, using official government statistics or central bank data where available. The index’s overall performance is weighted by GDP on a Purchasing Power Parity basis, and the latest quarter’s data is provisional pending the release of all the countries’ results.

The message cannot get simpler: Get a Will!

The obvious acclamation here is: If you have a will you can give what you own to exactly who you want – simple.

Strangely though, people do not realise the serious implications of dying intestate (without a will). Here are some critical reasons you should have a will and why you should keep it updated:

Intestate Estates take longer to wind up!

There are a series of additional requirements in the event that there is no will. For one, the heirs will have to agree on an executor (this can be subject to disputes and sometimes results in lengthy and expensive legal battles) resulting in undue delays with the administration of your estate causing your dependants to be without access to funds or assistance for a longer period of time.

Assets are not divided in the manner you want!

The assets in the Estate then need to be distributed in exact portions in accordance with the Intestate Succession Act. If the heirs cannot come to a resolution, certain assets might have to be disposed of. For example: that beautiful family home you dearly love is sold and the proceeds divided into appropriate shares. Not only have you lost something of sentimental value but you have deprived your heirs of an appreciating asset (houses increase in both sentimental and economical value whereas money might not have either of the perks)

You could leave your children without a proper financial guardian!

Say you and your spouse die simultaneously (car accident; plane crash; etc) leaving minor children (persons under 18). Your will normally prescribes what must happen to your estate in such circumstances and it further appoints a guardian and even trustee for your minor heirs. This person controls finances on behalf of the minors and acts in good faith for the benefit of the minors. If you have no valid will, then all inheritances due to these heirs must be paid to a state institution called the Guardian’s Fund which controls and manages funds on behalf of your minor heirs.

–sounds ok? Then you have clearly never dealt with the Guardian’s Fund!

We don't mean this to be an attack on a noble and hardworking institution BUT for all their good work, the Guardian’s Fund deals with thousands of cases each year (generally one Guardian’s fund deals with an entire province) and it is reasonable to expect significant delays in the processing of any payments they make on their part. Realistically you can expect to wait around 6 months before any initial funds are released. From there you need to produce vouchers for any money paid out (be it school fees or even a pair of shoes) this in itself is a long administrative process.

Additionally, the Guardian’s fund makes no profits but funds paid to the institution earn a minimal interest rate paid to the Depart-ment of Justice (See DOJCD website for rate). This means that money which could be invested for your child’s future is instead growing at a lower rate than it would in a bank, or an appropriate financial institution. So your minor heir's money will never really grow until he/she reaches majority (turns 18). Even on majority there is another long administrative process to release the remaining monies held.

You cannot exclude the joint estate!

Say your daughter is married and she did not sign an antenuptial contract (In the case of a marriage in community of property), legally speaking half of what is hers also belongs to her spouse. Let’s say for instance you want to leave her a house. But if you leave her the house and you don’t have a valid will (in terms of which you can legally exclude the joint estate), then 50% of that house belongs to her spouse! Should they divorce, the house will be sold and each of them takes 50% of the proceeds. Even if they stay happily married, creditors to his business will have a claim for that house should he fall into debt.

Avoid this by simply having a will!

So... imagine you are dead – your heirs are fighting over your estate while the remaining capital is getting eaten away by legal fees. Your minor heirs are starved, awaiting the Guardian’s fund to process their payments and you have lost the beautiful family home that you’ve worked so hard for, forever. All because YOU DID NOT HAVE A WILL!!!!!

We hope these few examples are sufficient to convince you that you need a will and remember that death waits for no-man and the best time to get a will is yesterday!

What remedies are available? In the event of one/more of the co-owners defying the other co-owners by proceeding to act without the consent of his/her/their co-owners, the aggrieved co-owners can approach the Court for an order interdicting the defiant co-owner/s from proceeding to act. In a decided case it was held that, in the event of an interdict being sought; “the Court would consider whether the conduct complained of constitutes an unreasonable use, inconsistent with the use to which the property was destined and to the detriment of the rights of the other co-owner...”

Agricultural LandAgricultural land is a special case. In terms of the Subdivision of Agricultural Land Act No 70 of 1970, from the inception of such Act in 1970, co-ownership of agricultural land without the permission of the National Minister of Agriculture was prohibited.
