According to the recent Knight Frank Global Residential Cities Index, Durban is listed as one of the top-performing South African cities (placed 14th out of 165 cities) with property prices increasing by 11.6% on average between the fourth quarter of 2014 and the fourth quarter of 2015.

While many consider Durban to be the more easy going counterpart to Johannesburg, it has in recent years become a major international tourist destination, having been recognised as one of the New7Wonders Cities in 2015. The Globalisation and World Rankings Research Institute has also declared Durban a Gamma City; there are Alpha Cities such as London and NY, Beta Cities like Berlin and Cape Town and Gamma Cities which include Durban, Charlotte, Georgetown and Valencia. Important economic complexThe growing tourism industry, combined with the construction of the Moses Mabidha Stadium, uShaka Marine World, the new Durban Waterfront development project, and efforts to clean up the CBD, have all contributed to making Durban an important economic complex – accounting for 15% of national output. As such, it’s not surprising that property prices have seen good growth in recent times.

“We’re experiencing quite a buoyant property market with property pricing increasing significantly over the last two years, especially in areas like Morningside with its close proximity to excellent schools such as the Clifton Preparatory School,” affirms Terence Hogben, principal of Leapfrog Property Group, Durban Central.

While Hogben agrees that the lower segment of the property market (R600,000 to R1,5m sectional title) is

performing extremely well, as in many other parts of the country, he does note that buyers are happy to purchase freehold properties in Glenwood for slightly higher prices – R1.2m to R2.5m. Properties from Essenwood to Morningside are also being bought for between R1.8m to R3.5 m on a regular basis. “Once we have sold a property, we keep on getting calls for weeks after. In fact, we could sell well-specified properties around R3m every day. Morningside is quite built up so older properties have to be knocked down to make space if one wishes to have new developments, and we’re finding that buyers are happy to pay the price for a property with modern finishes and increased security,” explains Hogben. “That being said, the demand is mostly for the older more solid homes built with good clay brick and higher standard builds of yesteryear.”

Who is buying?Continues Hogben, “We’ve also had a surprising number of enquiries from buyers working overseas who are planning to return to South Africa. In fact, a few of our sales over R3m have been made this way.” Apart from South Africans living overseas, Hogben finds that a lot of young families are buying – all the way from Glenwood through to Morningside for access to better schools and amenities. “Glenwood especially is also very community-driven which many young couples find appealing,” believes Hogben.

Sellers, on the other hand, are mainly selling to move to where their children have settled and are generally older people closer to retirement age.

“We’re excited by the sales we’re seeing in Durban and are confident that the area offers great returns on residential property investments – provided of course that the property is valued correctly,” says Hogben.

THE SALE OF IMMOVEABLE PROPERTY WITH ELECTRIC FENCE SYSTEMS

Most Sellers and Buyers of immoveable property are, by now, aware that on the sale of such property, it is a legal requirement that a certificate be provided (normally at the sellers cost ) which is to be issued by an accredited electrical contractor, and which is to provide that the electrical installation serving the property is reasonably safe, and complies with the specific requirements for such installations as set out in Regulation 7 of the Regulations framed under the Machin-ery and Occupational Safety Act No 85 0f 1993 .

Equally, most Sellers and Buyers of immoveable property are uncertain as to what the position is should the property sold have an electric fence system serving it. There has been a further promulga-tion under the Machinery and Occupational Safety Act, Regulation 12, which deals specifically with the issue of electric fences.

In the first instance, after 1st October 2012, no person may design, manufacture, sell, install, or, for the first time, use an electric fence/energizer , unless the entire system complies with the technical requirements set out in such Regulation ( These technical issues will not be discussed in this commentary ) This in layman’s terms requires that every user or lessor of an electric fence erected after 1st October, must have a certificate of compliance from an accredited contractor, which confirms that the system complies with the requirements of Regulation 12. These certificates, unlike the normal electrical compliance certificates, do not expire; provided there has been no alteration nor addition to the system (Normal electrical compliance certificates are valid for 2 years only). Further-more, the electric fence certificates are transferable from one user to another.

If ones electric fence was erected prior to 1st October 2012, these regulations do not affect one, UNLESS, as mentioned before, there has been an alteration or addition thereto, or there is a change in ownership of the underlying land on which the fence system has been erected. In either event, a Regulation 12 certificate is required.

Insofar as the sale of conventional land served by an electric fence

system after 1st October is concerned, the position is simple. The “user” must be in possession of a compliance certificate for the fence. As the issue of such certificate is not a prerequisite to registration, transfer in the buyer’s favour could occur without the required certificate having been issued; the unfortunate buyer now becomes the “user”, and it is his obligation to ensure that a certificate is secured.

Two areas of uncertainty do exist in regard to these certificates, however. The first is that the regulation imposes a duty on the “user” of the system to procure the certificate. Who then, is the user? It is not always certain that the landowner is the user. In a lease of property situation, the tenant could be said to be the user. If this be so, then the tenant of property served by an electric fence system is obliged to procure the certificate. This obligation might seem unduly harsh in the standard short term residential lease example.

Although this is not certain, there seems to be room to argue that in a short term lease, the Landlord is more the user of the system than the Tenant, in that he “used” the existence of the system as part of the property’s attraction to a potential tenant, and may do so again and again. The position of who the “user “ might be does, it would seem, appear far more clear in long term ( normally commercial or industrial ) leases. Here the argument that the Tenant is the user is far more compelling than is the case with short term leases

These pitfalls relating to the confusion as to whether the obligation to provide the certificate falls on the seller/buyer or the landlord/tenant can be avoided by making the issue of on whose shoulders the liability rests very plain in the relevant sale/lease document .

The second area of uncertainty arises in the sale of units within a Sectional Title Scheme. Originally, some commentators argued that the sale of a Section did not constitute a change in ownership of the underlying land on which the electric fence system had been erected. Thus, it was argued, the sale of a Section post 1st October 2012 did

not trigger the need for a certificate in respect of any perimeter electric fence serving the scheme. It is submitted that this view is incorrect Every owner of a Section within a sectional Scheme is issued a title deed to his section and to an undivided share in the common Property. It is this Common property which, in most instances, constitutes the underlying land on which the fence system is erected.

On the sale of a Section, the Seller simultaneously disposes of a share in the underlying land. There is therefore, a change in the ownership of the land on which the fence system is erected, and so a Regulation 12 certificate is required. If this obligation rests with a single person selling, the price could be horrendous. Consider the plight of the unfortunate seller of a section not on the perimeter of a scheme comprising hundreds of units. He cannot, on his own, be said to be the “User” of the system, it is used by all owners collectively. When Sectional Owners act collectively they are, in effect, the Body corporate, the answer then to the question “who is the user of an Electric fence System within a Sectional Scheme? “, is quite clear. The user can only be the Body corporate, and as user, the Body Corporate must procure the certificate.

Accordingly, Sectional Owners might wish to ensure that the Body Corporate DOES have a regulation 12 certificate for any electric fence serving the scheme. Once such certificate has been procured, it does not expire, and as it is transferable, future sales of sections will not trigger the need for further certificates.
