History shows that in the longer term, any real-estate investment is a good one – some prove to be better than others, sure, but unless you are really flippant in the way you invest, you can’t go wrong. It doesn’t take a genius to work out that a fair majority of the wealthiest people in the world created their wealth through real-estate. And, those that made their money elsewhere, to a large degree, now use real-estate to preserve and grow their wealth.

I say the longer term, because there are sometimes low-points, and in the shorter term, it is even possible to see negative growth. The latest house price index released by ABSA shows that there is some positivity in the current market.

House prices rose 7.1% on the year in April, accelerating from a 6.8% year-on-year increase in March, Absa’s monthly house price index shows.

Real house price inflation, however, was just 0.5% in March — though that was an improvement from February, when inflation-adjusted prices fell 0.6% from a year earlier.

“The uptick in house price growth was driven by the segment for small housing, with the categories of medium-sized and large housing showing relatively stable price growth in the first four months of the year,” Absa home loans property analyst Jacques du Toit said.

Absa bases its data on the middle segment of houses, with a price ceiling of R4.4m and up to 400m² in size.

Within that segment, the average price of small houses (80m²-140m²) increased a nominal 12.4% year on year in April, accelerating from 10.8% in March; the increase for medium houses (141m²-220m²) was 5.3%, almost unchanged from 5.2% in March; while for large houses (221m²-400m²) inflation was slower, dipping to 7.6% from 7.7%.

The average price of a small home was R951,000, a medium-sized home R1.268m and a large home R2.008m, according to applications for mortgage finance received and approved by Absa during April.

Subdivision of Urban Land Demystifiedlegal pages

In the past, the subdivision of land situate in urban Kwazu-lu-Natal, was governed by two Provincial Ordnances. Firstly, in the Cities of Durban and Pietermaritzburg, the governing ordnance was the Municipal Extended Powers Ordnance, and applications for subdivision of land within these cities were submitted to the relevant City Survey/City Engineer Sections. The city then canvassed the opinion of all its internal service supply departments such as roads, water, electricity, storm water and sewage disposal, and, where appropriate, outside agencies such as Provincial Education, Provincial Roads, Eskom and Telkom, to receive their comment on the application. The City would then issue conditions of approval, if it saw fit, which were to be complied with before the subdivision could be proceeded with. Typically, an applicant wishing to subdivide urban land had to employ a Town Planner, a Land Surveyor, an Engineer, Contractor and Attorney, in order to fully comply with the plethora of conditions of approval imposed. These applications were time consuming and costly.

Secondly, in the past, the applications for subdivision of urban land in Kwazulu-Natal outside the jurisdiction of Durban and Pietermaritzburg were dealt with in terms of The Provincial Town Planning Ordnance No 27 of 1949. Applications for subdivision in terms of the ordnance were dealt with by the Provincial Private Townships Board (PTB), not the relevant local authority. Subdivisional applications were divided into two categories, the so called larger townships, and a need and desirability declaration from the PTB was required before the application of such township could be proceeded with, and minor townships, where no such declaration was required.

In assessing both applications, the province was obliged to begin with the relevant local authority, to establish whether it was willing and able to provide the necessary service reticulation to site, and what conditions it would require if this were to be done.

Equally, the province had to work with other responsible bodies, such as those referred to in the case of Pietermaritzburg and Durban, and finally, the province imposed its own conditions of subdivision. As the provincial authorities were not directly familiar with the land, the province often applied the “one size fits all” philosophy to the conditions it imposed.

Once again, compliance with the conditions, necessitated the use of Town Planners, Land Surveyors, Engineers, Contractors and Attorneys, and compliance was necessary in order to have the subdivision proclaimed (by advertising on the Provincial Gazette) or declared (no advertisers required) an approved large or minor township. Generally applications under the old Town Planning Ordnance, which had been in use for nearly 60 years, were cumbersome, confusing, and generally outdated. Accordingly, the Kwazulu- Natal Planning and Development Act No 6 of 2008 (of the PDA) was promulgated. It applied solely to property situate in Kwazulu- Natal, and amongst other things, regulated the issue of urban land subdivision.

The single most significant factor in this legislation is that the Provincial Administrators had no role to play in approving or declining applications to subdivide. All applications were submitted to the relevant local authority, and it was the sole approval authority.

The PDA is a vast improvement on the prior legislation governing subdivision in that it lists the factors the Municipality must take into account when dealing with an application. In this brief version of subdivisional applications, it is not intended to detail these factors. Furthermore, in terms of the PDA, public participation in the decision making process is much greater than was previously the case. The application must be advertised in the local press, and notices advising of the application must be sent to all registered owners of land within 100 metres of the boundaries of the subject site, as well as prominently displayed on the site itself. The advertisements and notices must call for comment within 30 days, and advise where plans and details of what is proposed may be viewed. The applicant is offered an opportunity to respond to all comments received, and in considering the application, the local authority must consider such comment and response, and a number of other factors as referred to above. Once the Local Authority decides on an application, it must give written notice of its decision to all interested parties, and they have a right to object to the decision, and appeal against same, within 28 days. If no objection or notice of appeal is received within this period, the local authority decision stands.

As previously mentioned, the PDA of 2008, applied to Kwazulu Natal only. The national government, not to be outdone, introduced the Spatial Planning and Land Use Management Act (SPLUMA) in June 2015, which muddied the water somewhat, as SPLUMA also dealt, inter alia, with matters pertaining to the subdivision of Urban Land. Once again, in

Kwazulu Natal, two acts of legislation regulated a single activity. There is one redeeming feature of SPLUMA, however, in that the controlling authority in determining whether to approve an application to subdivide urban land was, yet again, the relevant local authority. We do not, therefore, have two potential controlling authorities as was the case prior to the PDA of 2008.

Generally, national provincial and municipal authorities need to evolve policies (with significant public participation) which take into account necessary growth and development objectives, the need of the previously dispossessed and disadvantaged for housing land, and which must give consideration to the likely future housing needs of other economic strata of society, in anticipation of likely growth in that area, and so on. Land development applications made must conform to the Municipal Land Use Policy, and such applications are to be dealt with by a municipal planning tribunal established for that purpose. In considering an application the tribunal must consider, inter alia, the public interest, the constitutional transformation imperative to redress past imbalances, the availability of suitable infrastructure, the concerns of all affected parties, and the like. Once again, interested parties must be informed of the decision, and a disaffected interested party may appeal the tribunal’s decision.

Despite the seeming conflict between the PDA and SPLUMA, they do provide a more suitable framework within which subdivisional or development applications may be made. Provided the application is made within the Municipal Land Use Management framework, an application will be considered under SPLUMA, and, provided the application is consistent with the factors to be considered in terms of the PDA, it is likely to be approved.Please note that this is a very brief overview of a relatively complex matter, and is no substitute for actual professional advice on the particularity of any application.

History shows that in the longer term, any real-estate investment is a good one – some prove to be better than others, sure, but unless you are really flippant in the way you invest, you can’t go wrong. It doesn’t take a genius to work out that a fair majority of the wealthiest people in the world created their wealth through real-estate. And, those that made their money elsewhere, to a large degree, now use real-estate to preserve and grow their wealth.

I say the longer term, because there are sometimes low-points, and in the shorter term, it is even possible to see negative growth. The latest house price index released by ABSA shows that there is some positivity in the current market.

House prices rose 7.1% on the year in April, accelerating from a 6.8% year-on-year increase in March, Absa’s monthly house price index shows.

Real house price inflation, however, was just 0.5% in March — though that was an improvement from February, when inflation-adjusted prices fell 0.6% from a year earlier.

“The uptick in house price growth was driven by the segment for small housing, with the categories of medium-sized and large housing showing relatively stable price growth in the first four months of the year,” Absa home loans property analyst Jacques du Toit said.

Absa bases its data on the middle segment of houses, with a price ceiling of R4.4m and up to 400m² in size.

Within that segment, the average price of small houses (80m²-140m²) increased a nominal 12.4% year on year in April, accelerating from 10.8% in March; the increase for medium houses (141m²-220m²) was 5.3%, almost unchanged from 5.2% in March; while for large houses (221m²-400m²) inflation was slower, dipping to 7.6% from 7.7%.

The average price of a small home was R951,000, a medium-sized home R1.268m and a large home R2.008m, according to applications for mortgage finance received and approved by Absa during April.

In the past, the subdivision of land situate in urban Kwazu-lu-Natal, was governed by two Provincial Ordnances. Firstly, in the Cities of Durban and Pietermaritzburg, the governing ordnance was the Municipal Extended Powers Ordnance, and applications for subdivision of land within these cities were submitted to the relevant City Survey/City Engineer Sections. The city then canvassed the opinion of all its internal service supply departments such as roads, water, electricity, storm water and sewage disposal, and, where appropriate, outside agencies such as Provincial Education, Provincial Roads, Eskom and Telkom, to receive their comment on the application. The City would then issue conditions of approval, if it saw fit, which were to be complied with before the subdivision could be proceeded with. Typically, an applicant wishing to subdivide urban land had to employ a Town Planner, a Land Surveyor, an Engineer, Contractor and Attorney, in order to fully comply with the plethora of conditions of approval imposed. These applications were time consuming and costly.

Secondly, in the past, the applications for subdivision of urban land in Kwazulu-Natal outside the jurisdiction of Durban and Pietermaritzburg were dealt with in terms of The Provincial Town Planning Ordnance No 27 of 1949. Applications for subdivision in terms of the ordnance were dealt with by the Provincial Private Townships Board (PTB), not the relevant local authority. Subdivisional applications were divided into two categories, the so called larger townships, and a need and desirability declaration from the PTB was required before the application of such township could be proceeded with, and minor townships, where no such declaration was required.

In assessing both applications, the province was obliged to begin with the relevant local authority, to establish whether it was willing and able to provide the necessary service reticulation to site, and what conditions it would require if this were to be done.

Equally, the province had to work with other responsible bodies, such as those referred to in the case of Pietermaritzburg and Durban, and finally, the province imposed its own conditions of subdivision. As the provincial authorities were not directly familiar with the land, the province often applied the “one size fits all” philosophy to the conditions it imposed.

Once again, compliance with the conditions, necessitated the use of Town Planners, Land Surveyors, Engineers, Contractors and Attorneys, and compliance was necessary in order to have the subdivision proclaimed (by advertising on the Provincial Gazette) or declared (no advertisers required) an approved large or minor township. Generally applications under the old Town Planning Ordnance, which had been in use for nearly 60 years, were cumbersome, confusing, and generally outdated. Accordingly, the Kwazulu- Natal Planning and Development Act No 6 of 2008 (of the PDA) was promulgated. It applied solely to property situate in Kwazulu- Natal, and amongst other things, regulated the issue of urban land subdivision.

The single most significant factor in this legislation is that the Provincial Administrators had no role to play in approving or declining applications to subdivide. All applications were submitted to the relevant local authority, and it was the sole approval authority.

The PDA is a vast improvement on the prior legislation governing subdivision in that it lists the factors the Municipality must take into account when dealing with an application. In this brief version of subdivisional applications, it is not intended to detail these factors. Furthermore, in terms of the PDA, public participation in the decision making process is much greater than was previously the case. The application must be advertised in the local press, and notices advising of the application must be sent to all registered owners of land within 100 metres of the boundaries of the subject site, as well as prominently displayed on the site itself. The advertisements and notices must call for comment within 30 days, and advise where plans and details of what is proposed may be viewed. The applicant is offered an opportunity to respond to all comments received, and in considering the application, the local authority must consider such comment and response, and a number of other factors as referred to above. Once the Local Authority decides on an application, it must give written notice of its decision to all interested parties, and they have a right to object to the decision, and appeal against same, within 28 days. If no objection or notice of appeal is received within this period, the local authority decision stands.

As previously mentioned, the PDA of 2008, applied to Kwazulu Natal only. The national government, not to be outdone, introduced the Spatial Planning and Land Use Management Act (SPLUMA) in June 2015, which muddied the water somewhat, as SPLUMA also dealt, inter alia, with matters pertaining to the subdivision of Urban Land. Once again, in

Kwazulu Natal, two acts of legislation regulated a single activity. There is one redeeming feature of SPLUMA, however, in that the controlling authority in determining whether to approve an application to subdivide urban land was, yet again, the relevant local authority. We do not, therefore, have two potential controlling authorities as was the case prior to the PDA of 2008.

Generally, national provincial and municipal authorities need to evolve policies (with significant public participation) which take into account necessary growth and development objectives, the need of the previously dispossessed and disadvantaged for housing land, and which must give consideration to the likely future housing needs of other economic strata of society, in anticipation of likely growth in that area, and so on. Land development applications made must conform to the Municipal Land Use Policy, and such applications are to be dealt with by a municipal planning tribunal established for that purpose. In considering an application the tribunal must consider, inter alia, the public interest, the constitutional transformation imperative to redress past imbalances, the availability of suitable infrastructure, the concerns of all affected parties, and the like. Once again, interested parties must be informed of the decision, and a disaffected interested party may appeal the tribunal’s decision.

Despite the seeming conflict between the PDA and SPLUMA, they do provide a more suitable framework within which subdivisional or development applications may be made. Provided the application is made within the Municipal Land Use Management framework, an application will be considered under SPLUMA, and, provided the application is consistent with the factors to be considered in terms of the PDA, it is likely to be approved.Please note that this is a very brief overview of a relatively complex matter, and is no substitute for actual professional advice on the particularity of any application.
