Since 2003 member “regular” (as opposed to “special”) assessments have risen by 54.7% over that decade, far faster than any other element of variable recurring real estate costs, like taxes or insurance. The current board has just announced that member assessments for the coming year will rise again, by 14% year-to-year, a rate roughly ten times the currently anticipated 2011 consumer price index (CPI), a widely referenced tool for comparing the cost-of-living. Here at home these skyrocketing KPOA assessments are driven by (among other factors) a clubhouse parking addition likely to ultimately cost at least $16,000 to $24,000 (if not more after dealing with storm runoff issues), and at least $35,000 as down payment in fees paid by everyone to study bluff erosion (a Puget Sound Rarity unique to KP) affecting a handful of owners that chose to develop on the bluff (and enjoy the resulting increased property values), as well as rising reserve allocations to recover from years of board reserves underfunding. Meanwhile we have undoubtedly the best compensated landscape labor on the Peninsula. (more on labor costs (our biggest expense) in upcoming articles) There are other articles on this topic elsewhere in this edition that more closely address some of these the issues in detail; but the focus in this writing is the big picture KPOA financial trends and

member affordability of historic and continuingboard spending. The trend is ominous,particularly for those on fixed incomes.

Given the need to replenish reserves afterdecades of board neglect with aginginfrastructure, and the ever rising salaries andbenefits we pay, despite a depressed labormarket, KPOA Directors continue the binge.Meanwhile state and county property taxes arerising, and assessed values are dropping like arock…but KPOA continues to spend like there isno tomorrow.

If the current trend continues will you be ableto afford your assessments in 3 more years,when they reach twice what they were in 2003?How do you think such assessment levels willaffect the salability of your property should needor want to sell? The $1000 KPOA assessmentappears to be just around the corner, as thispublication cautioned five years ago.

This is not a new problem. This publicationhas cautioned on rising assessments repeatedlysince 2006. An excellent background article canbe found at the following web link:www.ttpnewsletter.com/Newsletters/06-Nov.pdfPage 19. in which then CFO McNulty told theboard that he planned “to keep annual assessmentincreases under 15% so as not to alarmmembers.” This rate of regular increase,compounded, doubles your assessments everyfive years.

The last big year-to-year jump (9.4%)occurred in 2006 after outside capital reserveauditors found a $1.5 Million shortfall inrecommended reserves despite then FinanceCommittee Chair Bruno Richter assuringmembers that the reserves were fine. With thereturn of more recycled “old guard” faces to thecurrent board, reportedly Richter will again beassuming a leadership role on finances afterseveral years of low visibility. One boardmember, during the 2006 board financialpresentation by McNulty, can be heard on themeeting recording stating “So if this means a $250increase in regular annual assessments that wouldcertainly not be a hardship for most people.” Sobuckle up folks, or start looking harder at the annualbudgets.

KPNV wishes to thank all of the members whotook the time to respond to the survey that wasincluded with the October issue. So that theresults are properly framed, the total sample sizewas about 550 which excludes duplicatesubmissions from multiple property owners anddoes include about 110 members who receivethe KPNV electronically. There were a total of73 responses and that represents about a13.27% response rate.

For those unfamiliar with mail surveys that areintended to measure client (member) attitudeswithout any specific incentive, typically theresponse rates are less than a 10% of the samplesize. So the KPNV member survey was better thanthe typical response from such surveys. Keep that inmind as we look at the analysis and the detail.

The Analysis:Several key pieces of information came from thissurvey and it is unfortunate that the KPOA Board

has not taken the initiative to solicit membersentiment before proceeding with some of theirplans. Surveys provide a sample snapshot in timeand for about 13.27% of our members they feltcompelled enough to respond but it is what’s inthe response that reflects the strong memberattitudes about what the Board is doing.

On average, there is over an 85% agreementamong those who responded, which is statisticallysignificant. While there is only about 70% of therespondents who agree that the Bluffs should beprofessionally managed there is a 90% agreementabout the other three questions. For those threequestions there is no question regarding theresponders position!

Noteworthy is the first question whereapproximately 1/4 (24.66%) thought that the bluffsshould not be managed by professionals. Don’t be

too quick to think they feelBMAC should continue as ithas in the past, for at least sev-eral of those who responded“NO” were being consistentwith the answers to questionsthree and four. One memberprovided the following inputin his electronic response,which in essence said:“I live in the trees and get nodirect view benefit from theprofessional management ofthe bluffs.” Following thatthought was why should I beassessed so those on the bluffside, can have their waterfrontviews. There would be a costto me but no benefit. Thusothers may have that same

opinion and that could account for the largernumber of “No’s” on question 1.

In another email response which came from anon-resident owner who wanted to respond butfelt that the Board is not providing appropriateinformation (via the Kala Pointer) to understandthe issues. She just did not have a good sense ofhow critical bluff management was or should be.

Was it an issue of mitigation circumstances thatwould require certain actions? It just was notclear what direction or where the Board washeaded. Think of those who live here and sharethat same thought? Bottom line, is that the boardhas been derelict in its obligation to keep thecommunity informed of the ramifications and costto them if the current bluff management proposalis implemented.

Questions 2, 3 & 4 certainly make it clear fromthe 90% response that a line should be drawnbetween those who receive benefit or are liablefor certain costs and the rest of the community.The issue of who pays is clear and they havedemonstrated that costs associated with thesethree items should not be borne by theassociation.

A curious point of Question 4 is that 91.7% whoresponded felt that those who do not managetheir storm water should be liable for thecost of mitigation and repairs. President Schulteis on record as saying it would be too much of acost burden for those living along the bluff side,but it is OK for all of us to pay for it.

Undeniably the results of this member surveystrongly suggest that a different course should be

Continued from previous pageset from that of where the Board is steering theAssociation. Does the KPOA Board have the willto revisit their actions and get a better sense ofwhat the members want not what the Boardwants?

Some members who responded took the Surveyto task for not providing space on the form wherethey could jot a note about some issues that theyfelt should be addressed. Perhaps a twice a yearsurvey would provide an opportunity formembers to provide feedback to the Board. Whatyou hear from the chair of the Board is that he hashis finger on the pulse of the community and all iswell. This survey does lead you to believeotherwise.

It would be a wise Board to take the survey forwhat it is and that is snapshot of member attitudesregarding significant expenditures that are aboutto be undertaken. The Board is making decisionswith no data. The hard data from this survey leadsto a different conclusion of what the memberswant.

President Schulte is on record assaying it would be too much of a costburden for those living along the bluffside, but it is OK for all of us to payfor it.

You will soon have the opportunity to approve ordisapprove the 2012 budget. Meetings were heldon October 5th and 19th to discuss the budget indetail. The bottom line for homeowners is anestimated assessment of $811.09 compared to the2011 amount of $709.32. This increase of $101.77equals 14% and is, by almost anyone’s standard, alarge increase. Overall, the budget committee dida fine job in the preparation and presentation ofthe budget and the board acted responsibly intrying to hold the line on expenditure increaseswith two exceptions. Without going into muchdetail, there are several items in the budget thatcould reasonably be questioned by the typicalhomeowner.

One of the items in the 2012 budget is an increaseof 6-8 parking spaces at the clubhouse at a cost ofat least $16,000. I think that this expansion couldbe described as something that would be nice tohave but not really necessary. Most able-bodiedpeople can probably park on the street and walkto the clubhouse. If it’s a matter of providing forpeople who can’t walk very far, why not makeseveral of the existing parking spaces into thosefor the handicapped?

The second, and more contentious item, is anadditional $20,000 in the budget for the bluff study.This is in addition to $15,000 in the 2011 budgetfor a total cost of $35,000. The original total costof the study was $46,000. The purpose of the studyis to determine the condition of all of the bluff.

As you may recall, the Bluff Committee wrotetwo reports on sections of the bluff. To try todetermine the necessity of the new study, I askedat the October 5th meeting if any structures havebeen threatened by erosion of the bluff and wastold that was not the case. When I asked why all ofthe homeowners should bear the cost of the bluffstudy, the answer was “because it’s common area.”While that’s obviously true, the argument isspecious. Common area amenities such as thetennis courts, clubhouse and pool are available toeveryone. The bluff affects very few houses,primarily those with a view. The vast majority ofhomeowners have no view and no access to thebluff. If no houses are in danger on the bluff, thenpossibly this study is about trees and not muchelse. For those of you following the actions of theboard and the tree committee over the years,you know how contentious the bluff/tree issue is.Many people believe that the bluff, being exposedto natures forces, is going to do what it’s going todo, and that is to erode. As I understand it, thestudy will discuss the condition of the bluff butnot outline any steps to take to mitigate theerosion. Therefore, the cost of the study could beonly the start of dealing with the bluff.

Why should every homeowner be assessed forthe cost of dealing with the bluff when it affectsvery few of us? While it’s common area, so arethe storage yards, and people who store vehiclespay for that privilege. Why not setup a specialassessment district for the bluff? There is aprovision in the CC&R’s for an assessment againsta group of owners.

At a time when many people in the U.S. arefacing an extended period of diminishedexpectations, I believe that it’s more importantthan ever to distinguish between need and want.If homeowners affected by the bluff want to payfor a study and subsequent remedies for theerosion, they should assume the costs.

Surfaced in the relatively shallow Bay,several crew are visible topside on the finalapproach to the re-arming wharf at the nearbyNaval Magazine. While identifying marks are notshown, this “Super Stealth” sub was likely one ofonly four of these new conventionally-armed

weapons platforms specifically designed to support“war on terror” missions.

These converted cold-war-era boats includeThe USS Ohio (SSBN726), USS Michigan (SSBN727), USS Florida (SSBN728) and USS Georgia(SSBN 729). Rather than decommission thesesuper stealthy missile boats, capable of extendedtime-on-station, responsive to the START IImissile reduction treaty, they were repurposed for

the changed globalrealities post-USSR;taking special operatorsin close, and able tolaunch lethal salvos ofprecision cruise missilesin a fleet support role.

With a robustcombination of 154non-nuclear Tomahawkcruise missiles in rapid-fire rotary magazinesbeneath 22 of the oldTrident launch tubes,and complete on-boardprovisions for up to102 (though dedicatedfacilities support only 66)

MARSOC or Navy Seal Special Operators able toenter and exit the submerged boat undetected,they are a formidable weapon. Special Operatorsexit and enter via two converted Trident tubesusing a variety of underwater insertion platforms

such as the Seal Delivery System (SDV) mini subs. There are a variety of other undisclosed payloadsdeliverable via the vertical launch tubes, reportedly including both intelligence gathering as well as UAVprecision strike-capable systems.

The SSGN platform, combining super stealth, long dwell time, and highly lethal stand-offconventional weapons, is particularly well suited to today’s asymmetrical warfare, where more and

more sophisticatedsystems are deployedto detect and threatensurface warships,putting them athigh risk in coastalwaters, where theycould otherwise bestsupport small inlandoperations.

During the criticalearly days of a

regional conflict, such as that just concluded in Libya, Tomahawk Land Attach Missiles (TLAM), inconjunction with other land attack systems and tactical aircraft, denies or delays forward movementof enemy forces, neutralize the enemy’s ability to conduct air operations, and suppress enemy airdefenses. In addition, Tomahawk attacks high value targets such as electrical generating facilities,command and control nodes, and weapons assembly/storage facilities.

Thus, making Tomahawk the weapon of choiceto strike reinforced, hardened targets. An ability tolaunch large numbers of TLAMS from the SSGNplatform, and then immediately slip away unseen, istactically very useful.

Any connection between re-arming subs at IndianIsland and the recent heavily guarded container shipthat ran aground in recent weeks, only to continue onto Indian Island once freed, would be pure speculation,but Tomahawk missiles are similarly transported, and the level of security afforded those containers,both surface and air, is typically not expended on “dumb bombs” more likely transported by truck.The enforced 2000 yard blast perimeter suggests an unusual cargo.

Continued controversy surrounds the Indian Island mission and perceived threats to local residents,but nevertheless, we need a strong defense, and Naval Magazine Indian Island, as the principal Navyre-arming hub on the west coast, is our essential neighbor in that defense.

As you consider starting anarthritis exercise program,understand what’s within yourlimits and what level of exer-cise is likely to give you results.

The following information is from an article I readfrom the Mayo clinic; good stuff!

By the way, did you know (this is my ‘why we shoulddrink enough water’ fact for the month) that:Drinking at least 5 glasses of water daily decreasesthe risk of colon cancer by 45%, plus it can slashthe risk of breast cancer by 79% and one is 50%less likely to develop bladder cancer. Now onwith the article:

• Start slowly to ease your joints into exercise ifyou haven’t been active for a while. If youpush yourself too hard, you can overworkyour muscles. This aggravates your joint pain.

• Consider these tips as you get started:

• Apply heat to the joints you’ll be workingbefore you exercise. Heat can relax your jointsand muscles and relieve any pain you havebefore you begin. Heat treatments — warmtowels, hot packs or a shower — should bewarm, not painfully hot, and should be appliedfor about 20 minutes.

• Move your joints gently at first to warmup. You might begin with range-of-motionexercises for five to 10 minutes beforeyou move on to strengthening or aerobicexercises.

• Exercise with slow and easy movements. Ifyou start noticing pain, take a break. Sharppain and pain that is stronger than your usualjoint pain might indicate something is wrong.Slow down if you notice inflammation orredness in your joints.

Trust your instincts and don’t exert moreenergy than you think your joints can handle. Takeit easy and slowly work your exercise length andintensity up as you progress.

Don’t overdo itYou might notice some pain after you exercise ifyou haven’t been active for a while. In general, ifyour pain lasts longer than two hours after youexercise, you were probably exercising toostrenuously. Talk to your doctor about what painis normal and what pain is a sign of somethingmore serious.

If you have rheumatoid arthritis, ask your doctorif you should exercise during general or local flares.One option is to work through your joint flaresby doing only range-of-motion exercises, just tokeep your body moving.
