so obviously you were given your rights to counsel and that… 10 BOURQUE: Uh huh. DEVEAU: …caution, I’m gonna do it formally and do it again. Ah so you’re under

arrest ah, I’m arresting you today here for three counts of first degree murder on police officers ah and two counts of attempted murder on police officers 15 as well so five, five infractions in total. Before you say anything Justin it is my duty to inform you that you have the right to retain and instruct legal counsel without delay. Do you understand that?

BOURQUE: Mmhmm. 20 DEVEAU: Yeah. You have the right to telephone a lawyer of your own choice, you can

also have the right to free legal advice from Legal Aid lawyer. If you are later charged with an offense you may apply to Legal Aid for assistance. You have the right to speak to a lawyer in private. If you wish to speak to a lawyer you 25 can call a lawyer of your own choice or you can call Duty Counsel at no cost for free legal advice. Do you understand that?

with that. BOURQUE: Oh I have no idea. 10 DEVEAU: So do you want to call a lawyer, I, with the charges I read to you and the uh,

the offenses that you’re facing I’d seriously consider that. It’s pretty serious yeah.

BOURQUE: Well isn’t it life either way? 15 DEVEAU: Well that’s, that’s totally uh irrelevant for me at this point but I want, do you

want to call a lawyer of your choice or Legal Aid or? BOURQUE: uh like I said if I called my parents they’d find somebody more suitable I’d 20

think. DEVEAU: Okay is there anybody that you can think of like a lawyer or? BOURQUE: Oh no, I’m the least bureaucratic guy you’ll ever meet. 25 DEVEAU: Okay. Uh we can call Legal Aid then to see if you’re satisfied with that and

then…, your choice. BOURQUE: uhh I think I’ll stick with my option there. I think my folks would find me 30

have nothing to hope from any promises or favor and nothing to fear from any threat whether or not you say anything. Anything you say may be given as evidence. Do you understand that?

BOURQUE: (Nods affirmatively). 15 DEVEAU: You’re answer is? BOURQUE: Yes. 20 DEVEAU: Yes. What, what do you understand by me saying that? BOURQUE: Well that if I say something that could you know point to another crime I

committed in the meantime it could be used against me. 25 DEVEAU: Okay so you understand. Now because you spoke to other police officers I’m

just gonna read you this as well. umm, you must understand Justin that anything you said, anything said to you previously by other officers should not influence you nor make you feel compelled to say anything at this time. Whatever you felt influenced or compelled to say earlier you’re not now 30 obliged to repeat nor are you obliged to say anything further but whatever you do say may be given as evidence. Do you understand that?

BOURQUE: Yup. 35 DEVEAU: Okay that’s just because you spoke to a member before you spoke to me. So

The only lesson that can be learned from this is don’t home

saw how people would come out of public school, they don’t let you have any personality and… 10

DEVEAU: True. BOURQUE: Yeah, Well it’s what they’re trying to bread right. 15 DEVEAU: Some merits, right. BOURQUE: Yeah. DEVEAU: So she’s gonna check if your folks uh have a parents, ah lawyer that they 20

suggest, if not ah then we can call Legal Aid. Who did you speak with prior? BOURQUE: Her name was Denise LEPAGE or LEBLANC I think maybe. DEVEAU enters the room 25 DEVEAU: Where were these guys from, the officers that brought you in? BOURQUE: I have no idea actually. All I know is that Fredericton SWAT is a bunch of

torturous assholes. (Laughs) Wow! 30 DEVEAU: Did you do all grade one to twelve, home school? BOURQUE: Yup. DEVEAU: How does that work then? Does that get recognize though like for college 35

or? BOURQUE: Yeah we do standardize tests… DEVEAU: Oh yeah. 40

schools well up til, I think it was 2006 and they stopped doing it. DEVEAU: Cause you have siblings too right, yeah. 15 BOURQUE: I have five sisters and… DEVEAU: Did they all do home school? BOURQUE: Yup. 20 DEVEAU: Okay. So your mom would probably learn from one to the other. Like what,

what worked well and… BOURQUE: Yeah. 25 DEVEAU: …what. It’s interesting. I’m not sure I’d home school my kids. BOURQUE: No you don’t want… 30 DEVEAU: I, I wouldn’t be smart enough to be a teacher. BOURQUE: …you don’t want them to develop a free mind, it’s dangerous. DEVEAU: Yeah. 35 BOURQUE: Like I’m just gonna tell you from person to person and they only reason I did

this is because I see myself as a you know a fish with his hook, a hook in his mouth you know. You either get work at a call center, go to college put yourself in further debt or…either you fight for your freedom with couple of 40

afford a private lawyer. He said he’d rather you talk to Legal Aid. BOURQUE: All right then. 15 DEVEAU: Okay. So I’ll just call the number. It’ll probably be the same lady. You spoke

to before. I’m gonna call that number here. Could you ask the guard if we have a call back number for that phone?

presently in Sackville New Brunswick. I have a person in custody that needs 25 to speak to a Legal Aid lawyer. Ah, just one second.

Hi Lise. Is it

Lise? Lise it’s Corporal DEVEAU with the RCMP in Sackville, New Brunswick. Umm I have a person here by the name of Justin BOURQUE who would like to speak with you. I’m not sure what he gave you for charges before, I can read reiterate if you want. He’s under arrest for three charges of, 25 three counts of first degree murder and two counts of attempted murder. I’ll give him the phone right now. No. Ah we’ll have to verify that I’m, not sure I assume Moncton court. Just one second. the RCMP uh based out of Bathurst attached to Major Crime Unit and 30 today is uh the 6th, June the 6th it is presently 5 minutes passed three o’clock in the morning I am presently in the uh interview uh suit in the cells block of the Sackville RCMP in New Brunswick uh here for the file 2014-646828 in reference to the shooting of the five members of the RCMP which occurred uh June 4th around 7:30. Uh Mr. BOURQUE has 35 been uh arrested shortly past twelve o’clock and is presently in cells and um I will be interviewing him umm shortly. LEVESQUE leaves the interview room 2:54:45.

Justin BOURQUE 2014-06-06 2:55:56 LEVESQUE returns to the interview room and rearranges the chairs. 2:56:10 LEVESQUE leaves the room and takes out one of the chairs from the room. 5 2:56:15 LEVESQUE returns to the interview room and rearranges the chairs. 2:56:27 LEVESQUE leaves the room again. 2:57:49 LEVESQUE returns to the interview room and rearranges the chairs again. 2:58:06 LEVESQUE leaves the room again. 10 2:58:47 LEVESQUE returns to the interview room, LANDRY also enters the room and changes the chairs once more then they both leave the room 2:59:04 3:21:00 LEVESQUE enters the interview room. 3:21:09 LEVESQUE leaves again. 3:21:21 LEVESQUE stands at the entrance of the door then comes into the room 3:21:21 waiting 15 for BOURQUE to be brought into the interview room. but these guys got it here uh they took off my military pouch, which had baby powder and gas masks, a space blanket, an extra shirt and extra pair of socks 20 uh what else was there a pair of binoculars and yeah I think that was it.

LEVESQUE: So hearing this stuff you why did you have baby powder? BOURQUE: Trench foot it takes care of, or prevents it anyways. 25 LEVESQUE: Okay, now all those items that you’ve listed to me okay how long had you

been planning this? BOURQUE: I just always had a kit that was kind of ready you know in case a disaster did 30
