Gwede Mantashe, provincial secretary-general of the African National Congress has hinted that a new small business ministry will be created shortly after the upcoming elections.

The ANC has hinted at the possible implementation of a new small business ministry after the elections. Financial commentators feel that this could just serve to create more red tape resulting in less people creating small and medium business enterprises (SME’s). The comments say that this would only increase unemployment. Not to mention that South African labour law will have to move swiftly along with the implementation setting out laws in alignment with the

governments new legislations in accordance with the new ministry. When the African National Congress (ANC) secretary-general Gwede Mantashe mentioned the creation of this ministry it was supported by the South African Institute of Tax Professionals. However there are conflicting views by the likes of the Free Market Foundation and others that the possible establishment of this ministry could set out to increase bureaucracy in this country.

Small business enterprises have been pinpointed as the optimal solution to curbing unemployment in South Africa.

Small businesses are considered to be a solution to the unemployment crises we find ourselves facing in South Africa. Changes in South African labour law, more red-tape and bureaucracy could hamper SMEs instead of help this sector of our economy. This year research company SBP compiled the 2014 SME growth index and it showed that 71% of companies who participated in this survey stated that it was becoming more and more difficult to operate a business in South Africa. There was a noted marginal improvement over 2012 however the statistics still remain negative. Our potential innovators and entrepreneurs are demotivated to investigate the possible starting up of their own company.

South African labour laws could be accountable for the lack of growth in the SME sector.

South African labour law is a challenge for SME’s out there. A number of laws in the Labour Relations Act are contrary to SMEs success in today’s business landscape. Free Market Foundation chairman Herman Mashaba said laws such as the South African Labour Relations Act that were "unfriendly" to SMEs were largely responsible for the country’s unemployment situation. It can be said that these laws are accountable for the fact that 7.8-million people are unemployed in South Africa today. SME’s cannot afford to enter into negotiations nor can they afford the conditions of employment and minimum wages that large employers and trade unions agree too.

If the laws and regulations were streamlined there would be a reduced level of regulation and we may be able to see positive developments in the future.

We need fewer and clearer statutes and regulations to be met. No single ministry has reduced the level of regulation in order to facilitate SME growth. In the case of setting up this new ministry the South African labour law would have to remove all laws that are specific to jurisdiction of range of different ministries. A complete review of the South African labour law would highlight where the SME’s are struggling and where they find it impossible to meet set out regulations.

First aid training should be top priority in the workplace

Employees often assume that first aid training has been implemented by management and that there is someone in the workforce who is competently trained to save their life should anything untoward occur and injure them. This assumption is a safe one if the labour law is anything to go by however every company is different. The importance of this training should rank as a top priority but unfortunately is often treated as an afterthought. The workplace is an inherently dangerous environment and the employees thereof should feel that they can and will be assisted should they find themselves in danger or hurt.

A sufficiently trained first aider must be available to assist and act immediately

The heavy industries in South Africa pose many a safety hazard to the employees. First aid training should be an essential and guided component of any company within these industries. Ideally a company would have an educated safety management team, a sufficiently trained first aider and visual guidance throughout the workplace to assist and act as a measure in place should an unfortunate and dangerous incident occur. An example of a visual guidance meant to assist the employees is the infographic from Trojan Health Connection that has been used to accompany this article.

Why First Aid training should be top priority in the workplace professional help has arrived at the scene. The goal is to preserve the life of the victim and prevent further injury or danger from occurring. The steps that the first aid training instructs are to guide the assisting person in an effort to promote recovery. These steps are not complicated and are focused on the three core areas of concern to save a life. There are three steps and they are known as the ABCs of first aid and represent Airway, Breathing and Circulation. There must be no obstruction to the airway to prevent choking, it is important to assist breathing if necessary and circulation must be promoted. The technique of using chest compressions in conjunction with mouth-to-mouth resuscitation promotes circulation simultaneously.

The labour law has implemented strict regulations to assist with workplace safety

The labour law in South Africa states that ''an employer shall take all reasonable steps that are necessary under the circumstances, to ensure that persons at work receive prompt first aid treatment in case of injury or emergency.'' It has strong regulations in place to ensure workplace safety and first aid training is up to scratch within all companies and organisations. In a company where there are more than ten employees in the workplace the employer must appoint a first aider who is readily available during normal working hours. In shops and offices there must be one first aider to every one hundred employees whereas in other workplaces there must be one first aider to every fifty employees. The first aider should be certified and accredited by a reputable first aid training company or organisation and the training should cover specific hazards that correlate to the workplace of the first aider. For example should the first aider work in an environment where there are hazardous chemical substances, pesticides, biological agents or be working in a processing or manufacturing plant, they must be trained in the specific first aid training to treat injuries from those specific environments. First aid facilities must be provided where there are five or more employees and these facilities must be available and accessible near the workplace. The regulation is most definitely worth some attention to ensure that first aid facilities within your organisation are on par with what is expected.

The first aider is responsible for all first aid facilities and necessary articles

Once the appointed employee has completed their first aid training they should immediately take responsibility for all the necessary articles used for first aid purposes. A checklist may be useful to ensure compliance with the prescribed minimum contents set out by the labour law. The first aid facilities must form a part of the overall inspection carried out by a health and safety representative of the workplace. Suggested good practice would include a formal first aid register to record all incidents.

Affirmative action, employment equity, positive discrimination and all things that are supposed to help us find balance.

By simple definition, affirmative action or positive discrimination is the policy of providing special opportunities for, and favouring members of, a disadvantaged g roup . The na tu re o f pos i t i ve discrimination policies varies from region to region. Some countries, such as India, use a quota system, whereby a certain percentage of jobs or school vacancies must be set aside for members of a certain group. In some other regions, specific quotas do not exist; instead, members of

minorities are given preference in selection processes. Affirmative action is intended to promote the opportunities of defined minority groups within a society to give them equal access to that of the privileged majority population. The stated justification for affirmative action is that it helps to compensate for past discrimination by the ruling class of a culture and to address existing discrimination. In South Africa we are very concerned with employment equity, in nature the same as affirmative action however it is focused on the job sector. We have an Employment Equity Act that has been revised numerous times. Recent proposed amendments have come under scrutiny this year and the comments are nothing short of an outcry.

In trying to undo damage from the past, the amendments to the Employment Equity Act are potentially reversing all of the progress achieved so far.

The Employment Equity Act began on a good footing with some positive objectives in mind. The idea was to undo the damage that Apartheid caused. This corrective action was to result in the categories of people who had been unfairly discriminated against finding balance in the employment sector. Nelson Mandela spearheaded the move towards eradicating any discrimination based on race and gender. The current proposed amendments have draft regulations that are being compared to the Job Reservation Act of the Apartheid era. The regulations hint at there being different shades of blackness and if you are of Indian or Coloured denomination you could end up worse off than if you were white.

The DA is convinced that these new regulations will have a profoundly negative impact on jobs in the Western Cape.

The draft regulations basically link affirmative action to demographics and the basis of whether you qualify for affirmative action depends on how many people in your denomination are represented as a percentage of the population in the said province. The Democratic Alliance (DA) commented on this proposition by stating that the new Employment Equity rules are racist. They feel that employment equity should be provisionally segmented because each province has a different distribution of races and this should be taken into consideration. Premier Helen Zille further warned that the new employment equity regulations will, if implemented, have a "profound" impact on jobs in the Western Cape. It is tough to find a job and tough to keep one in SA today.

In an economic climate that has taught us to feel lucky to simply have a job the word ‘retrenchment’ has become a scary and ugly word. Typically leaving the retrenched party feeling cursed and rejected. The reality is that in the economic climate of South Africa many companies are retrenching staff in an effort to simply keep their doors open. If retrenchment is the only option then the responsibility falls entirely on the employer to roll out their decision in a responsible way, in accordance with the Labour Relations Act (LRA). Retrenchment is covered in the LRA and has its own Code of Good Practice that explains exactly what is required and expected of the employer in this specific situation. Retrenchment is similar to a one-sided break-up without any good reason. The employer is essentially dismissing the employee but there is no fault to be found and this is purely the right decision for the company. The right decision for the company does however come at a cost and someone loses their job. This in mind, the LRA places particular obligations on the employer which are directed towards ensuring that every possible alternative to dismissal have been explored.

The retrenchment process is stringent and if not followed correctly it can prove costly to the employer.

The CCMA sees many cases of dismissal and if the retrenchment procedure is not followed correctly then the consequences can be costly to the employer. As soon as the retrenchment process is set to begin the employer must begin consulting with the candidates who have been selected for dismissal. All information regarding how the company settled on rolling out a retrenchment process must be disclosed to the employees and they are then invited to submit viable alternatives to consider that do not include retrenchment.

The retrenchment letter is necessary to inform the employees formally about the retrenchment process.

The correct criteria must be used when selecting which employees will be retrenched and most often the ‘Last in first out’ principle is utilised. There are exceptions to this principle that cannot undergo the retrenchment process such as employees who are a part of an affirmative action program or employees who are fundamental to the operation of the company, however there must be transparency surrounding this exception. The employees must be given the time frames of the retrenchment process, the outline of the retrenchment packages that will be paid and a record is to be made of this information. Part of recording the information is the drafting of a retrenchment letter which is the issue of a written notice of the intention to retrench. This is a requirement of the LRA. Here are ten things to remember when drafting a retrenchment letter:

1. The retrenchment letter should first and foremost give the reasons found that have driven the company to embark upon retrenchment. This formalises and legitimises the reasons for retrenchment.

2. The alternatives the employer had considered and the reasons why these alternatives were rejected must appear in the retrenchment letter.

3. The number of employees likely to be affected by the retrenchment process and their job specifications must be listed.

A different take: A controversial quote by Cosatu provincial secretary Tony Ehrenreich , “The sunset clauses in relation to jobs are gone, and so should continued white preference be gone.”

Most recently Tony Ehrenreich, Cosatu’s provincial secretary spoke out calling for more than half of the white senior civil servants in the provincial government to be fired within a year of the upcoming elections. He further claims that the soon jobless white people would be able to start their own businesses as they have the networks and the historical infrastructure to do so. Ehrenreich is convinced this plan would benefit all races. This reads as preposterous and labour lawyer Michael Baigram has commented to say that Ehrenreich’s call was “not only reckless, but illegal”. Baigram said, “The law is absolutely clear in that no business can retrench or dismiss for any reason in order to ensure that the equity targets are met.”

Right now the war is one of words regarding the employment equity amendments however the picture that is being painted is worrying.

The future of employment equity in South Africa right now looks grim and is creating an immense amount of discomfort in the media. The question remains as to whether it is a real possibility. Whether, should the African National Congress come into power in a province such as the Western Cape and fire senior white civil servants, we will experience a difficult transitional phase or an outcry claiming ethnic cleansing.

4. The retrenchment letter must also give reasons for the selected employees and job areas that are to be affected by the retrenchment process. It must include the criteria for selecting these specific employees and these job areas. The criterion that was agreed upon during the consultation period should be used and stipulated in the retrenchment letter. The ‘Last in first out’ principle is widely accepted and if applied it must be noted.

5. The time during which the dismissals are likely to place must be stated as warning to the employees. This will indicate when the conclusion of the retrenchment process will occur.

6. The retrenchment package must be outlined and proposed in the retrenchment letter. The employer needs to indicate the severance pay. According to the LRA the employees are entitled to one week’s pay for every completed year of service.

7. The employee likely to be dismissed must be made aware of the assistance the employer proposes to offer them. This includes letters from the employer to insurance companies confirming the employee’s retrenchment, time off from work in order to attend job interviews or assistance in applying for UIF.

8. The retrenchment letter should explain that should circumstances change and the company is in a position to re-employ the dismissed staff then it will do so. This underlines that retrenchment is not a process in which to get rid of undesirable employees but a last resort to save the company from closing its doors.

9. The number of employees currently in the company must be stated and must be accurate.

10. The number of employees up for dismissal and the reasons. These reasons must be stipulated as based on the operational requirements in the preceding 12 months.

Here are three questions to consider when making your selection.

1. Why are you installing the awning?If you simply want to enhance the appearance of your home, choose the awning that most appeals to you visually, and which best compliments the design of your home. However, if you have a specific reason for installing an awning, you’ll need to be a bit more selective.

If you wish to expand an outdoor area, choose a fold arm retractable awning that can be easily extended when needed, and easily pulled back again. This maximises shady areas when required, but still allows the light to enter when you want it to. If you require sun protection for yourself and your possessions, choose an awning that is going to block out harmful UV rays in your home. Bonus: This will also help you to optimise energy use in your home, by requiring less heating in winter and less cooling in summer.

2. Where are you installing the awning?Window awnings for homes are usually smaller than corporate awnings, and can be manually opened and closed with ease. In this case, you could choose a retractable awning that you can simply open or close manually, as often as you need to.

However, if you’re installing larger awnings, or awnings for shops, offices or business parks, you may wish to install motorised awnings that can be opened or closed at the touch of a button. Alternatively, you may decide that you don’t need a retractable awning at all. The design or specific building requirements may call for a permanent fixture that does not need to be adjusted.

3. What is your budget?With so many options to choose from, it’s easy to forget that you might have a specific budget to stick to! Work out how much you want to spend on the awning, and then consider the options available in this price bracket. This will help you to narrow your focus to a few specific styles.

While it’s important not to over-extend yourself financially, remember that when it comes to buying fabric awnings for homes or offices, you’re making a long-term investment in the property. While it may cost you a bit at first, it could reap great rewards when you decide to sell one day. Moreover, an attractive shop-front will catch customers’ eyes and attract more business.
