2 Background context:

Human Trafficking is one of the most heinous crimes against human where it is treated as items and goods by of traffickers. It is the 2nd highest growing profitable illegal business in the world.

Bihar, due to its geographical structure and socio-political condition, like sharing its border internationally with Nepal and Bangladesh and migration due to poverty and employment opportunities, is always on the highest threat of Human Trafficking. Due to its socio-political condition, all districts of Bihar including districts at border Bihar are the major source point for trafficking nationally and internationally. Due to open international borders as a result of foreign policies and security, there are always chances of cross border trafficking also. Illegal entrance of people from Nepal and Bangladesh is also creating problem in maintenance of its economy and harmony within the community. Rational: As the districts of North Bihar are known as the source and destination for human trafficking, there is big chance of trafficking of human. Adjoining international border of Nepal, poor economic and violent political condition in Nepal also add chances of trafficking of women from Nepal to the various parts of India through Bihar.

Bihar as well Nepal has been identified as a source, transit and destination point in the international circuit; large numbers of children are also trafficked within the country. Intra state/inter district trafficking is high in the states of Rajasthan, Assam, Meghalaya, Bihar and Uttar Pradesh, Andhra Pradesh, Karnataka, Tamil Nadu and Maharashtra. Trafficking of women and children from the North-Eastern states of India and the bordering countries in the north-east is a serious issue but has so far not drawn public attention.

The study reports that 378 of the 593 districts in India are affected by human trafficking. India’s porous border with Nepal, Pakistan and Bangladesh are the major reasons citied for the prevalent high levels of children being trafficked every year.

Children are trafficked for several reasons including sexual exploitation; adoption; entertainment & sports (for example, acrobatics in circus, dance troupes, beer bars; as camel jockeys); marriage; labour; begging, organ trade drug peddling and smuggling. Trafficking of children usually happens through well organized networks. Family, relatives, friends, community leaders, brokers, the pimps and owners of brothels, the police, political connections and the criminal nexus: all or any of these have been found to be involved in the process of child trafficking. Following data and figures also support the serious condition of trafficking in India as well as in Nepal:

Objectives of the workshop: • To Develop a draft documentation for strategy formulation to combat cross border human

trafficking • To discuss current status of Trafficking in cross border areas (Indo- Nepal) through

Identification of various kinds of trafficking and challenges • To know current status of Anti-trafficking works in cross border areas (Indo- Nepal)

through sharing of Case studies and best practices. • To develop strategies to combat trafficking with different stakeholders like Police, border

security forces, NGOs, INGOs, religious priests. • To finalize a Declaration paper to battle with human Trafficking in Cross border areas of

Indo- Nepal.

Situation analysis through the proceeding of workshop: In the presence of different participants from different departments of Governments of both Bihar and Nepal as well civil society organizations of both sides.

The workshop was inaugurated by Mr. Ram Deo Prasad, Chairman, State Child Labour Commission, GoB, State Program Manager Mr. Akash, Plan International, Bihar, Mr. Sabin Gurung, S.P.O., ATSEC- Nepal, Sr. Rosita, Secretary, NIRPF, Bihar Mufti Safullah, Secretary, IRPF, Motohari and Mr. Satendra Singh, Secretary, Berojgar Sangh, Balmikinagar by lightening of holy lamp.

4 ATSEC, Bihar was coordinating the workshop to identify process of combat trafficking in

persons via educational, socio-economic and political empowerment of disadvantaged sections specially women and children. After self-introduction by participants Mr. Y. K. Gautam, State Convener, ATSEC- Bihar welcomed all participants, guests and media for their valuable presence in this 2-day workshop for sharing their experience, work and identification of more strengthened strategies to combat trafficking. Mr. Gautam said that a system is needed to address and combat cross border human trafficking. By introducing the workshop for its

objectives and purpose Mr. Gautam detailed the activities of ATSEC- Bihar from the very beginning from its formation. He said that ATSEC is an international network started in Dhaka, Bangladesh. Presently it is functional in different countries of South East Asia like India, Nepal, Bangladesh, Pakistan, Afghanistan and Sri Lanka. The office of national chapter of ATSEC for India is situated at Kolkata. Out of 26 state chapters in India including Bihar Chapter, ATSEC- Bihar is the state chapter of Bihar which was initiated in November 2001. ATSEC, Bihar, a network of NGOs working in all 38 districts of Bihar is taking steps forward to crusade against unprecedented increase in human trafficking in partnership with government, judiciaries, police, PRI representatives, opinion makers and community. In Bihar, ATSEC chapter is focusing to curb illicit and clandestine movement of persons across national and international borders in name of trafficking. He also said that ATSEC, Bihar is initiating programmes to combat trafficking in persons via educational, socio-economic and political empowerment of disadvantaged sections specially women and children. Further Mr. Gautam said that this was the Balmikinagar from where first campaign against human trafficking in Bihar started and moved to all districts sharing their border with Nepal. He also told that Child Marriage as the purpose of trafficking identified from Nepal and so to combat trafficking for the purpose of child marriage, IRPF (Inter-religious Priest Forum) is formed in all districts. Emergence of IRPF Nepal, IRPF Bangladesh, IRPF Bihar and IRPF U.P came out from this activity. Hindu Maha Sabha in Nepal emerged out as lead organization for this movement where as Madarsa Teacher Training Centre in Dhaka is leading the combat against trafficking for child marriage. Mr. Gautam said that Maiti Nepal; an organization in Nepal is working very genuinely but in small part of Nepal. Labour Department, Department of Social Welfare should visit centres of Maiti Nepal to learn its rehabilitation work as model. He concluded his speech with request for a common platform to identify work of both sides, which is needed for joint work against human trafficking.

To start the discussion on current status of Trafficking in cross border areas (Indo- Nepal) through Identification of various kinds of trafficking and challenges and to know current status of Anti-trafficking works in cross border areas (Indo- Nepal) through sharing of Case studies and best practices, participants expressed their views as follow:

Mr. Ganesh Prasad Singh, Executive Secretary, Adithi said that they are working on this issue of trafficking since 1996 but that time it was not a big issue. But what they worked for that was awareness on trafficking and women empowerment. He said that Adithi provides training and rehabilitation programme for trafficked and rescued women and children and credit of all work of Adithi goes to women only.

5 Mr. Raj Kumar Pandey, Treasure, IRPF, Raxaul said that IRPF works for the cause of

humanity without favouring any particular religion. He said that IRPF is working very closely with Seema Suraksha Bal, Rail Police and thus they are identifying 4-5 cases of trafficking daily. They are in regular touch with Maiti Nepal and it is very cooperative in repatriation. Through IRPF, different religious leaders and priests are attached in this campaign and before performing any marriage; they are identifying and verifying age of brides and grooms. Thus they are working towards prevention of child marriage. Being priests and religious leaders they

also believe that Goddess Laxmi is also female and where there is no respect for a female, Laxmi (wealth) will not survive there. They are working towards motivation among Dalits for child education.

Mr. Narendra Kumar Jha, Executive Officer, Mandan Bharti Jagriti Samaj said that they started work on anti-trafficking without knowing what it is because by that time it was not a big issue. It was there in the society but seriousness and problem in present shape was not there. So they started working at preventive mode. They started forming Vigilance Cell at 100 villages in Saharsa and Supaul to prevent trafficking, but no case was found. This was because they could not define trafficking at community level and community was unable to understand the meaning of trafficking. So they started community level meeting and discussion on the issue. In this way they got 6 cases of trafficking in 2005. Further they identified 53 cases of trafficking out of which 27 FIR registered. Mr. Sabin Gurung, S.P.O, ATSEC Nepal said that they are working since 1993 in Nepal and they have worked towards combat cross-border trafficking.

Mr. Akash Kumar, Programme Manager, Plan International (India) said that works on combat trafficking is going good but records and data are not available or it is in very limited stage. We have to keep check on filed cases and have to keep records for the future need. After resque, work on rehabilitation is much needed for the victims and rescued person of trafficking and for that we have to learn from interventions of Maiti Nepal’s on rehabilitation and resettlement of the victims in proper way.

Mr. Manabendra Mandal, Chairman, ATSEC South Asia said that trafficking is not an issue of India alone but it is a global issue. He said that as Bihar has international border with Nepal and Bangladesh, more than 5000 Nepali women come to India everyday. Siliguri is one place where these women are being trafficked for their exploitation and around 25% of these women are below age of 15 years. One thing is needed to combat trafficking and that is work together with unanimous visionary effort from civil society, law re-enforcement agencies and Government of Indo- Nepal side.

6 Sister Rosita, Secretary, NIRPF, Bihar said that there is need to empower women and youths

to combat trafficking. The root cause of trafficking is poverty. Girl education needs more attention. Due to our continuous work towards women and children, there is decreasing trend in child labour, domestic violence but not in trafficking. Reasons for trafficking must be other than child labour. To identify various reasons of trafficking we cannot work alone, so time to come together to combat trafficking.

Mr. S. Nautiyal, Commandant, SSB, Balmikinagar told a successful case of anti-trafficking in

2008 where they got huge support from Maiti Nepal for women’s rehabilitation and support. He said that SSB is a force of 12000 soldiers and all they need a qualitative and meaningful training on anti-trafficking from ATSEC to identify victims and traffickers in the area and do some immediate and necessary action for removal of this evil of society. He also focused on need of more initiatives from civil society of both India and Nepal side.

Mr. P. Stobdan, DIG, SSB, Muzaffarpur said that in North- East part of our country mainly

Sikkim, entry is not easy, but crossing Nepal is very easy. This is because we have friendly relationship between India and Nepal. He said that crossing border is the problem of almost all countries and it is more in context of Nepal because we have open border. But to control illegal cross-border human trafficking SSB needs information from community and for this social awareness and their responsibility is much required. NGO people can be deputed at border points so that SSB soldiers could learn process of counseling and identification of traffickers and victims of trafficking. One thing is most important for SSB and that is Information on Time

Ms. Suman Singh, Secretary, Sakhi started her words referring some case studies. She said that while intervening in such trafficking cases, we should have legal documents. For any successful anti-trafficking intervention, we should have strong follow up of victims, otherwise there is a big chance of re-trafficking. There is also need to work with Law Enforcement agencies because there is still lack of awareness and laws supporting victims of trafficking. Cases should be booked under ITPA if such case of trafficking comes to the police. Rehabilitation should be prioritized. Search and inquiry should be strong mainly at border area so that no any girl can be left out with any

unknown person. She also suggested to funding organizations that any project against trafficking should be long term because trafficking is a bundle of system and an organized crime so it takes time to intervene in it. In reply of question from Mr. Ramdeo Prasad about women group to prevent trafficking, Ms. Suman Singh said that there are many SHG working in the villages. They need empowerment and awareness to work as women group to combat trafficking. So system is there at grass root

7 level. Mr. Jha of MBJS said that CBO and SHG at village are being empowered as Women Vigilance Group. In every Panchayat cases are being identified and child marriage and fake marriage are being stopped. Then Ms. Suman Singh also agreed and said that Janakpur model to prevent trafficking are being replicated in Madhubani by support of youth and girls. Ms. Chitrali Bhattacharya, Chairperson, Lakshya also shared her experiences, learning on

human trafficking and said that Community Vigilance Group is working in Vaishali to stop trafficking. Lakshya is regularly coordinating with community vigilance groups in the area. Besides this, young girls and women are meeting and sharing regularly on and discussing on the issues of trafficking. She also focuses on the current status of trafficking in the Bihar and needs of concrete steps for the complete eradication of trafficking.

At the end of this Session, Mr. Ram Deo Prasad, Chairman, State Child Labour Commission, Bihar said that it is clear from various spokespersons that joint work is needed to combat cross-border human trafficking. He said that this meeting can be named as International Workshop because representatives from various organizations and departments of two nations

are taking part in this “Joint Strategy Formulation on combat Cross Border (Indo-Nepal) Human Trafficking”. Human Trafficking is a big issue for society and it affects not only women, so combat against trafficking should be focused on both gender and without considering any age. He also quoted history and said that whenever a woman is abused, there was war. But in today’s circumstances, mindset of people is totally changed for women’s issues. Women are badly treated in the present society. Being a human being we all lives in relationships. So we have to develop relationship

from our heart, then only we can think about welfare of all vulnerable sectors. Mr. Prasad also said that poverty is the main reason behind trafficking. He appraised work of Maiti Nepal, which not only provides rehabilitation to victims of trafficking, but it also supports in marriage and job placement. Government also cannot do all developmental works and NGO works differently. So there is need of joint collaboration work. At last, Mr. Ramdeo asked all stakeholders to start their works from grassroots i.e. at Panchayat and village level.

Methodology: Proceeding of the discussion: To get a clear idea on current status of Trafficking in cross border

8 areas (Indo- Nepal) through identification of various kinds of trafficking and challenges and current status of Anti-trafficking works in cross border areas (Indo- Nepal) by sharing of case studies and best practices, all participants formed four groups to discuss the issues before presentation. These four groups divided as 2 groups from India and 2 groups from Nepal so that at least one group from each side could discuss each topic. The suggested topics from Group number one from each side was:

Various kinds of trafficking and challenges in the area, and From Group number two from each side was:

Anti-trafficking work and best practices. Process of cross border restoration of victims and rescued person.

Following were the outcome of presentation of Group One from Nepal: o Trafficking in the name of Fake marriage o Trafficking in the name of traveling o Trafficking by luring employment in foreign countries o Trafficking by luring employment in India o Use of innocent person by local commodity carrier o In disguise of visiting a temple, traffickers starts exploitation o Use of Child labour in Circus o For supporting visit to India, traffickers exploit visitors o Traffickers also use the false words to visit relatives in India and thus exploitation

starts o In the name of visiting for medial checkups in India.

Group One of India presented as followed: Kind of Trafficking:

o Child Labour- Bonded and domestic o Organ trade o Sexual exploitation o For the purpose of entertainment and games like Camel Jockey o Beggary o For use in Smuggling of drugs and all illegal works o Sex tourism

Challenges: o Attitude of society and community o Poverty (Need for implementation of livelihood programme) o Illiteracy o Population o Vulnerability of Children and women (Need of empowerment) o Tracking system (need of upgrade and technical system to track the cases) o Culturally affected community (Child marriage, Devdasi system, etc.)

Best Practices: o Rehabilitation Centre o Women Cell/ Community Service Center o Community Safety Net Programme

Following were the outcome of presentation of Group Two from India: o Mass mobilization and awareness generation through community meeting and

massive IEC intervention o Cross border dialogue with all possible stakeholders. o Formation and periodic meeting of Anti-trafficking vigilance committee. o Sensitization of law enforcement machinery o Education of community and officials in light of ITPA, child rights and universal

human rights. o Capacity building exercises for key stakeholders and players. o Policy advocacy, formulation and proper implementation of schemes and

programmes for victims and rescued persons. o Publication and distribution of directory for both sides of border. o Regular follow-up to trace the victims and rescued persons for their proper

rehabilitation and reintegration with creation of effective infrastructure. o Gender sensitization.

10 Combined Groups’ presentation: It was a really good exercise to know the process and problem from both sides. After this

separate groups’ presentation, group One and Group Two of both sides sit together and finally they arrived to following more précised outcome:

Group One: Various kinds of trafficking and challenges in the area:

- International restoration (repatriation) o By authorized organization like Maiti Nepal. o Help lines- National level for women and children. o Women support by Social Welfare Department at national and state level both. o Home department o Media

- Support system (transport, shelter, emergency kit, provision of government) - Follow up: Role of NGO, community security, PRIs - Development of rescue directory

Group Two:

Anti-trafficking work and best practices, process of cross border restoration of victims and rescued person:

- Mass mobilization and awareness through community meeting massive IEC intervention - Cross border dialogue with all possible stakeholders - Formation and periodic meeting of anti-trafficking vigilance committee - Sensitization of law enforcement machinery - Education of community and official in light of ITPA, child rights and universal human

Cross border initiatives: - A proper networking should be established between a. NGOs/INGOs, b. Lawyers, police

and c. political parties. - Publication of directory of key stakeholders. - Establish and run Information and Action centres.

action legally. - Survey and identification of interventional point and seat for joint action group. - IEC intervention - Cross border exposure visit. - Quarterly experience sharing meets of Joint Action Group. - Formation of Panchayat level/ block level vigilance committee and its half yearly

meeting. - Capacity building training of entire project team members, stakeholders. - Deployment of lady constable, female volunteers at all check post/ entry points. - Yearly meeting at different area in Nepal and India. - Documentation in Hindi, English and Nepali.

Action points/ recommendation/ Balmiki Nagar Declaration: There are many good examples of practices and suggestion arisen from the workshop. On the base of presentation and discussion following actions and suggestions has been decided to accept by all partners/ participants to combat cross-border human trafficking (Indo-Nepal):

1. Awareness generation programme among all stakeholders on trafficking. 2. Process for women empowerment through livelihood programmes and training. 3. Training and rehabilitation programme for trafficked and rescued women and children. 4. Formation of Vigilance Cell at village level. 5. Community level meeting and discussion on the issue. 6. Identifying and verifying age of brides and grooms to stop child marriage. (Role of IRPF has been

assigned in this activity) 7. Update records and data related to trafficking around the area. 8. Training and empowerment of women and youths of villages. 9. Work together to combat trafficking by sharing and supporting. 10. Training of forces deputed on borders on anti-trafficking from ATSEC to identify victims and

traffickers. 11. Community meeting and awareness generation programme to motivate them towards their

responsibility and information sharing/ dialogue with law enforcement agencies. 12. Placement of NGOs workers on border points. 13. Work at grass root level. 14. Follow up of victims and rescued person to avoid re-trafficking 15. Prioritization of rehabilitation. 16. Generation and motivation for strong search and inquiry practice among forces at borders for

identification of victims of trafficking and traffickers. 17. Long-term intervention programme. 18. Empowerment and awareness among women SHG 19. Formation of a Joint Action Group. 20. Cross border exposure visit. 21. Quarterly experience sharing Meet of Joint Action Group. 22. Yearly meeting at different area in Nepal and India. 23. Publication of directory of key stakeholders. 24. Documentation/ IEC materials in Hindi, English and Nepali.

Conclusion:

Mr. Manabendra Mandal gave vote of thanks to all participants. He thanked all Nepali participants who were representing almost all stakeholders from Nepal. He thanked Mr. Gautam for organizing such a good joint consultation on the matter of combat trafficking. He said that due to activities of all of us, MWCD has recognized ATSEC India at national level and has honoured us as Nodal organization for anti-trafficking work. In September of last year ATSEC Bihar supported MWCD in finalizing report for presentation at Brazil Convention. There is need of development and update of website of ATSEC Bihar. E-News Letter could be developed for circulation among all members of ATSEC around the world. ATSEC has worked very hard to organize this workshop. It is a good learning from Nepal that almost all stakeholders has participated in the workshop. We should follow this practice so that our presentation also could be ensured.

Mr. Shiva Prasad Lamsal, Administrative Officer, Nepal also thanked to ATSEC Bihar and all participants from his country. He also thanked to all participants from NGO from Bihar for sharing of their work on anti-trafficking. He said that it would be good and in the benefit of victims and rescued person from trafficking when we work jointly to combat trafficking. Mr. Upadhyay, a Media person from Ghatna Vichar translated speech of Mr. Shiva in Hindi.
