• Since Justices were appointed for life, Jefferson was powerless to change them

• Adams also appointed John Marshall as chief justice where he would serve for over 3 decades

Marshall seized new powers for the supreme court, but since it was used to the Democratic Republican’s benefit, Jefferson could not fight it

This decision would set up a lasting Checks and Balances system still in effect today
