INTRODUCTION17.01 AUTHORITY.TheseregulationsareadoptedpursuanttotheAuthorization
containedinSection59.07(51),59.97,59.971,59.99,87.30,and144.26oftheWisconsinStatutes.17.02 PURPOSE. The purpose of this chapter is to promote and protect the public health, safety and
generalwelfareofthiscommunity.17.03 INTENT.Itisthegeneralintentofthischaptertoaidintheimplementationofacountylanduseplan
orplansasmightbeadoptedandamendedfromtimetotimebothpriortoandaftertheadoptionofthisordinance, promotepublichealth, safety convenience andgeneralwelfare, encourageplannedand orderly land use development, protect property values and the property tax base, permit thecareful planning and efficientmaintenance of highway systems, ensure adequate highway, utility,health, educational and recreational facilities, provide adequate light, air sanitation and drainage,preventovercrowding,recognizetheneedsofagriculture,forestry,industry,residentialdevelopmentand business in future growth, encourage uses of land and other natural resources which are inaccordance with their character and adaptability, protect the groundwater and surface waterresources, protect the beauty and amenities of landscape and man‐made developments, providehealthy surroundings for family life, promote the efficient andeconomicaluseofpublic fundsandmanagestormwaterrunofffromdevelopmentandpostdevelopmentsites.Itisfurtherintendedtoprovide for the administration and enforcement of this chapter and to provide penalties for itsviolations.
17.04 ABROGATION AND GREATER RESTRICTIONS. It is not intended by this chapter to repeal,
abrogate, annul, impair or interfere with any existing easements, covenants, deed restrictions,agreements,ordinances,rules,regulationsorpermitspreviouslyadoptedorissuedpursuanttolaws.However, wherever this chapter imposes greater restrictions, the provisions of this chapter shallgovern.
17.05 INTERPRETATION. In their interpretation andapplication theprovisionsof this chapter shall be
heldtobeminimumrequirementsandshallbe liberallyconstruedinfavoroftheCountyandshallnotbedeemedalimitationorrepealofanyotherpowergrantedbytheWisconsinStatutes.
17.06 SEVERABILITY. If any section, clause, provision or portion of this chapter is adjudged
unconstitutionalor invalidbyacourtofcompetent jurisdiction,theremainderofthischaptershallnotbeaffectedthereby.
17.07 REPEAL. AllotherordinancesorpartsofordinancesoftheCountyinconsistentorconflictingwith
thischaptertotheextentofinconsistencyonlyareherebyrepealed.17.08 TITLE. This chapter shall be known as, referred to or cited as the "Zoning Ordinance, County of
Jackson,Wisconsin."17.09 EFFECTIVEDATE.Thischapter,uponadoptionbytheCountyBoardas providedin59.09(1),Wis.Stats.shallbeeffectiveinanytownintheCountywhenapprovedbythe
townboardandwhenacertifiedcopyoftheapprovingresolutionisfiledwiththeCountyClerk.17.10 DEFINITIONS.Forthepurposeofthischapter,thefollowingdefinitionsshallbeused.Wordsusedin
thepresenttenseincludethefuture;thesingularnumberincludesthepluralnumber;andthepluralnumberincludesthesingularnumber.Theword"shall"ismandatoryandnotdirectory.
ACCESSORYUSEORSTRUCTURE.Auseordetachedstructuresubordinatetotheprincipaluseofa
structure, land or water and located on the same lot or parcel serving a purpose customarily

incidentaltotheprincipaluseoftheprincipalstructure.
AIRCRAFT.Amachineordevicecapableofatmosphericflight.
AIRPORT.Aclearedandleveledareawhereaircraftcantakeoffandland,usuallyhavinghard‐surfacedlandingstrips,acontroltower,hangars,passengerterminals,andaccommodationsforcargo.
ALLEY.Aspecialpublicright‐of‐wayaffordingonlysecondaryaccesstoabuttingproperties.
ANTENNA.Anydeviceorequipmentusedforthetransmissionorreceptionofelectromagneticwaves,whichmayincludeomni‐directionalantenna(rod),directionalantenna(panel)orparabolicantenna(disc).
APPROVED.AcceptabletotheDepartmentandZoningCommittee,basedonitsdeterminationasto
conformancewiththisOrdinanceandgoodpublichealthpractices. ARTERIAL STREET. A public street or highway used or intended to be used primarily for fast or
heavythroughtraffic.Arterialstreetsandhighwaysshallincludefreewaysandexpresswaysaswellasarterialstreets,highwaysandparkways.
BASEMENT.Thatportionofanystructurelocatedpartlybelowtheaverageadjoininglotgrade. BOARDINGHOUSE.Abuildingotherthanahotelorrestaurantwheremealsorlodgingareregularly
furnishedbyprearrangementforcompensationfor4ormorepersonsnotmembersofafamily,butnotexceeding12personsandnotopentotransientcustomers.
BUILDING.Anystructurehavingaroofsupportedbycolumnsorwallsusedorintendedtobeused
fortheshelterorenclosureofpersons,animals,equipment,machineryormaterials.a. Principal Building is the main building on a lot, intended for
primaryuseaspermittedbytheregulationsofthezonedistrictinwhichitislocated.
BUILDINGAREA.Thetotallivingareaboundedbytheexteriorwallsofabuildingatthefloorlevel,
butnotincludingbasements,utilityrooms,garages,porches,breezewaysandunfinishedattics. BUILDINGHEIGHT.Theverticaldistancemeasuredfromthemeanelevationofthefinishedlotgrade
alongthestreetyardfaceofthestructuretothehighestpointofflatroofs;tothemeanheightlevelbetweentheeavesandridgesofgable,gambrel,hipandpitchroofs;ortothedecklineofmansardroofs.
BUSINESS.Theoccupation,workortradeinwhichoneisengaged.
CENTERLINE.Alineequidistantfromtheedgesofthemedianseparatingthemaintraveledwaysof
anexistingorplanneddividedroadorhigh‐wayorthecenterlineofthemaintraveledwayofanon‐dividedroadorhighway.
CHARITABLEINSTITUTION.Anorganizationthatisdescribedinsection501(c)(3)oftheinternalrevenuecodeandthatisexemptfromtaxationundersection501(a)oftheinternalrevenuecode.
CLOTHING, REPAIR SHOPS. Shopswhere clothing is repaired, such as shoe shops, seamstress or
tailorshops,shoeshineshops,clothespressingshops,butnoneemployingover5persons.

CLOTHINGSTORES. Retailstoreswhereclothingissold,suchasdepartmentstores,drygoodsandshoestores,dress,hosieryandmillineryshops.
COLLEGE.Aschoolofhigherlearningthatgrantsthebachelor’sdegreeinliberalartsorscienceorboth.COMMERCIAL.Designatingproducts,oftenunrefined,madeanddistributedinlargequantitiesforindustrialorretailuse.COMMUNICATIONTOWER/CELLULARTOWER.Anystructurethatisdesignedandconstructedprimarilyforthepurposeofsupportingoneormoreantennas,includingguytowers,monopoletowersandself‐supportinglatticetowers.
CONDITIONALUSES. Uses of a special nature as tomake impractical their predetermination as a
principaluseinadistrict. CORNERLOT.Alotabutting2ormorestreetsattheirintersectionprovidedthatthecornerofsuch
intersectionshallhaveanangleof135oorless,measuredonthelotside.
CORRECTIONALINSTITUTE.Aninstitutionforconfiningindividualsconvictedofmajorcrimes. COTTAGE/CABIN. A seasonal dwelling, not including a mobile home, occupied not more than 8
monthsoftheyear. DEPARTMENT.TheJacksonCountyZoningDepartment. DIRECTORYSIGN.Asignwhichdisplaysthenameofaperson,home,farm,community,areaorkind
ofbusinessorserviceataspecificlocationmoreconspicuouslythanallgeneralbrands,tradenames,productsorservices.

radiological,biologicalorchemicalwarfare,fire,flood,windstorm,riotsandinvasions. ENDOFTAPER. Thepointof intersectionbetweentheouteredgesof theramppavementandthe
mainlinepavement. ESSENTIALSERVICES.Servicesprovidedbypublicandprivateutilitiesnecessaryfortheexerciseof
theprincipaluseorserviceoftheprincipalstructure.Theseservicesincludeunderground,surfaceor overhead gas, electrical, steam, water, sanitary sewerage, storm water drainage andcommunicationsystemsandaccessoriesthereto,suchaspoles,towers,wires,mains,drains,vaults,culverts,laterals,sewers,pipes,catchbasins,waterstoragetanks,conduits,cables,firealarmboxes,policecallboxes,trafficsignals,pumps,liftstationsandhydrants,butnotincludingbuildings.
EXPRESSWAY.Adividedarterialstreetorhighwaywithfullorpartialcontrolofaccessandwithor

FREEWAY.Anexpresswaywithfullcontrolofaccessandwithfullygradeseparatedintersections. FRONTAGE.Thesmallestdimensionofalotabuttingapublicstreetmeasuredalongthestreetline. GIFTSTORES.Retailstoreswhereitemssuchasart,antiques,jewelry,booksandnotionsaresold. HARDWARESTORES. Retail storeswhere itemssuchasplumbing,heatingandelectrical supplies,
sportinggoodsandpaintsaresold.
HIGHWAY.Amainpublicroad,especiallyoneconnectingtownsandcities.HOSPITAL.Aninstitutionprovidingmedicalorsurgicalcareandtreatmentforthesickandinjured.
HOUSEHOLDOCCUPATION.Anyoccupationforgainorsupportconductedentirelywithinbuildings
byresidentoccupants,whichiscustomarilyincidentaltotheprincipaluseofthepremises,doesnotexceed25%oftheareaofanyfloor,usesonlyhouseholdequipmentandnostockintradeiskeptorsoldexceptthatmadeonthepremises.Ahouseholdoccupationincludesusessuchasbaby‐sitting,millinery,dressmaking,canning,launderingandcrafts,butdoesnotincludethedisplayofanygoods,nor such occupations as barbering, beauty shops, dance schools, real estate brokerage orphotographicstudios.
INDUSTRY.Thecommercialproductionandsaleofgoodsandservices.
INTERCHANGE.AgradeseparatedintersectiononaStatetrunkhighwaywithoneormoreturning
roadwaysfortravelbetweenintersectionlegs. INTERSECTINGHIGHWAY.Ahighwayofanypoliticaljurisdiction,whichformsoneormorelegsof
aninterchangeandtowhichaccessisnotfullycontrolled.
KENNEL.Aplacewheremorethantwo(2)adultdogsareboardedforafeeonarecurringbasis,oraplacewheremorethanfive(5)adultdogsarekeptforanypurpose.
LANDUSEPERMIT/ZONINGPERMIT.TherequiredpermitissuedbytheJacksonCountyZoningDepartmentforanybuildingactivity,whichisregulatedbytheJacksonCountyZoningOrdinance.
LIVESTOCK. Means bovine animals, equine animals, goats, sheep, swine, farm raised deer, farm
raisedgamebirds,camelids,ratites,andfarmraisedfish.Inthisdefinition,“swine”doesnotincludepotbellypigs.
LIVINGROOMS.Allroomswithinadwelling,exceptclosets,foyers,storageareas,utilityroomsand
bathrooms. LOADINGAREA.Acompletelyoff‐streetspaceorberthonthesamelotfortheloadingorunloading
offreightcarriershavingadequateingressandegresstoapublicstreetoralley.

LOT. Aparcelof landhavingfrontageonapublicstreet,occupiedor intendedtobeoccupiedbyaprincipal structure or use and sufficient in size tomeet the lotwidth, lot frontage, lot area, yard,parkingareaandotheropenspaceprovisionsofthischapter.Forthischapter,thefollowingapplies:
a. Alotisconsideredamaximumofforty(40)acresinsize.b. Ifalotisdividedbyasectionorfortyline,forthepurposeofthis
chapter,itwillbeconsideredasonelot.
LOTLINESANDAREA.Theperipheralboundariesofaparceloflandonthetotalarealyingwithinsuchboundaries.
LOTWIDTH.Thewidthofaparceloflandmeasuredattherearofthespecifiedstreetyard. MACHINESHOPS.Shopswherelathes,presses,grinders,shapersandotherwoodandmetalworking
machinesareused,suchasblacksmith,tinsmith,weldingandsheetmetalshops,plumbing,heatingandelectricalrepairandoverhaulshops.
MANUFACTURED HOME1. Manufactured Home1 means a structure Certified and Labeled as a
ManufacturedHomeunder42U.S.C.Section5401to5426which,whenplacedonthesiteis:a. Aminimumof24'inwidthandaminimumof40'inlength.b. Isproperlyconnectedtoallutilities.c. IssetonafoundationinaccordancewithSection70.043(1),Stats,
andSubchapterIII,IV,andVofCH.DCOMM21,Wis.Adm.Code.d. Hasthetongueandwheelapparatusremoved.
MANUFACTURED HOME2. Manufactured Home 2 means a structure Certified and Labeled as a
Manufactured Home under 42 U.S.C., Section 5401 to 5426 and meets the definition in Section101.91(2)(a)Stats.andwhich,whenplacedonthesiteis:
a. Amaximumof16feetwideandaminimumof40feetinlength.b. Isproperlyconnectedtoallutilities.c. Isdesignedtobeusedasadwellingwithorwithoutapermanent
foundation. MINORSTRUCTURES. Any small,movableaccessoryerectionor construction, suchasbirdhouses,
toolhouses,pethouses,playequipment,arborsandwallsandfencesunder4'inheight. MOBILE HOME. A mobile homemeans a structure, which meets the definition as set in Section
101.90(1)Stats.andwhichwhenplacedonthesiteis:a. Amaximumof18'wideandaminimumof45'inlength.b. Isdesignedtobeusedasadwellingwithorwithoutapermanent
foundation.c. Isproperlyconnectedtoallutilities.
MOBILEHOMEPARK.Anyparcelofgrounduponwhichtwoormoreunits, occupiedfordwellingorsleepingpurposesarelocated,regardlessofwhetherornotachargeismade
forsuchaccommodations,butexcludingfarms,assetforthinSection17.38(11)(a). MOBILE HOME PARKMANAGEMENT. The person(s) legally responsible for the operation of the
park. MODULARHOME. "ManufacturedBuilding"meansabuildingcertifiedasamanufacturedbuilding
underSection101.70,Stats.whichwhenplacedonthesiteis:a. Amaximumof24'inwidthand40'inlength.
b. Isproperlyconnectedtoallutilities.

c. Issetonapermanent foundation inaccordancewithSubchaptersIII,IV,andVofCH.DSPS321,Wis.Adm.Code.
MOTEL. A series of attached, semi attached or detached sleeping units for the accommodation of
transientguests. NONCONFORMINGUSESORSTRUCTURES. Anystructure,landorwaterlawfullyused,occupiedor
erected at the time of the effective date of this chapter or amendments thereto, which does notconformtotheregulationsofthischapteroramendmentsthereto.Anysuchstructureconforminginrespecttouse,butnotinrespecttofrontage,width,height,area,yard,parking, loadingordistancerequirements,shallbeconsideredanonconformingstructureandnotanonconforminguse.
NON‐METALLICMININGANDPROCESSING.Operationsoractivitiesfortheextractionfromtheearth,forsaleorusebytheoperator,mineralaggregatessuchasstone,sand,gravelandnon‐metallicmineralssuchasasbestos,beryl,clay,feldspar,peat,taleandtopsoilrelatedoperationsoractivitiessuchasexcavation,gradingordredgingifthepurposeofthoseoperationsoractivitiesistheextractionofmineralaggregatesandnon‐metallicminerals,andrelatedprocessessuchascrushing,screening,scalping,dewateringandblending.Non‐metallicminingorprocessingdoesnotincludeorallowthefollowingactivitiesorusesbywayofillustrationwhichinclude,butarenotlimitedtothemanufactureofconcretebuildingblocksorothersimilarproducts,asphaltorhotblacktopmixing,andproductionofreadymixconcrete.Non‐metallicminingdoesnotincludethefollowingactivities:
a. Excavationorgradingbyapersonsolelyfordomesticuseathis/herdwellingunit.
b. Excavationorgradingconductedforhighwayconstructionpurposeswithinthehighwayright‐of‐way.
c. Gradingconductedforfarming,preparingaconstructionsiteorrestoringlandfollowingafloodornaturaldisaster.
d. Excavationsforthefoundationofstructuresprovidedthatsuchexcavationdoesnotexceedavolumeofmaterial1.5timesthevolumeofthepolyhedronboundedbythenaturalgrade,thebottomofthefootings,andtheexteriorofthefoundationwalls.
e. Minorlanddisturbancessuchastheinstallationofutilities,walksanddriveways,sanitarywastedisposalsystemsorfuelstoragetanks.
f. Anyminingoperation,thereclamationofwhichisrequiredinapermitobtainedunderSection293.01to293.93,WisconsinStatutes.
g. Anyactivitiesconductedatasoilorhazardouswastedisposalsiterequiredtoprepare,operateorcloseasolidwastedisposalfacilityunderSection289.05to289.33orahazardouswastedisposalfacilityunderSection291.001to291.97,WisconsinStatutes,provided,however,thatsectionappliestoactivitiesrelatedtosolidorhazardouswastedisposalwhichareconductedatanon‐metallicminingsiteseparatefromthesolidorhazardouswastedisposalfacilitysuchasactivitiestoobtainnon‐metallicmineralstobeused

PARCEL.Aportionorplotoflandusuallyadivisionofalargerarea.
PARKINGLOT.Astructureorpremisescontaining10ormoreparkingspacesopentothepublic. PARKINGSPACE. Agradedandsurfacedareaofnot lessthan280sq. ft. inareaeitherenclosedor
openfortheparkingofamotorvehiclehavingadequateingressandegresstoapublicstreetoralley. PARTIESININTEREST.Includesallabuttingpropertyowners,allpropertyownerswith100'andall
propertyownersofoppositefrontages. PERSON.Anyindividual,firm,trust,partnership,associationorcorporation. PRIVATESCHOOL.Asecondaryorelementaryschoolrunandsupportedbyprivateindividualsora
corporationinsteadofbyagovernmentorpublicagency. PROFESSIONAL HOME OFFICES. Residences of doctors of medicine, practitioners, dentists,
clergymen, architects, landscape architects, professional engineers, registered land surveyors,lawyers,artists, teachers,authors,musiciansorotherrecognizedprofessionsusedtoconducttheirprofessionswheretheofficedoesnotexceed1/2theareaofonlyoneflooroftheresidenceandonlyonenonresidentpersonisemployed.
PROTECTIVECOVANENT.Abindingagreementorformalcontractmadebytwoormoreindividualstokeepfromharm,lossorinjuryofproperty.
PUBLICSCHOOL.AU.S.elementaryorsecondaryschoolsupportedbypublicfundsandprovidingfreeeducationforchildrenofacommunityordistrict.
PUPPY. Thetermpuppyshallapplytocanineanimals,maleorfemale,five(5)monthsorunderinage.
REAR YARD. A yard extending across the full width of the lot, the depth of which shall be the
minimumhorizontaldistancebetweentherearlotlineandalineparalleltheretothroughthenearestpointoftheprincipalstructure.Thisyardshallbeoppositethestreetyardoroneofthestreetyardsonacornerlot.
RELIGIOUSINSTITUTION.Aninstitutionrelatingtoorteachingthebeliefinandreverenceforasupernaturalpoweracceptedasthecreatorandgovernoroftheuniverse.RESIDENCE.Theplaceinwhichonelives.RETAIL.Thesaleofgoodsinsmallquantitiestoconsumers.
RURALRETAIL.Includestheproductionandprocessingofitemsincludingbutnotlimitedto:bakedgoods,quilting,crafts,flooringproduction,furnituremaking,sawmilling,etc.

GENERALPROVISIONS17.15 JURISDICTION. The jurisdiction of this chapter shall include all lands outside the limits of
incorporatedareasoftheCounty.17.16 COMPLIANCE. Nostructureor landshallhereafterbeusedandnostructureorpart thereofshall
hereafter be located, erected,moved, reconstructed, extended, enlarged, converted or structurallyalteredwithout full compliance with the provisions of this chapter and all other applicable local,CountyandStateregulations.
17.17 ZONINGPERMIT.AZoningPermit(LandUsePermit)shallberequiredforallstructuresexceptfor
thoseinSub(3).
(1) ApplicationsforazoningpermitshallbemadeinduplicatetotheZoningAdministratoronforms furnished by the Zoning Administrator and shall include the following whereapplicable:(a) Names and address of the applicant, owner of the site, architect, professional
engineerorcontractor.
(b) Descriptionof the subject siteby lot, block and recorded subdivisionorbymetesand bounds; address of the subject site; type of structure; existing and proposedoperation or use of the structure or site; number of employees; and the zoningdistrictwithinwhichthesubjectsitelies.
(c) Plat of survey prepared by a registered land surveyor showing the location,
boundaries, dimensions, elevations, uses and size of the subject site; existing andproposed structures; existing and proposed easements, streets and other publicways; off‐street parking, loading areas and driveways; existing highway accessrestrictions;andexistingandproposedstreet,sideandrearyards.Inaddition,theplatofsurveyshall showthe location,elevationandtheuseofanyabutting landsandtheirstructureswithin40'ofthesubjectsite.
(d) Whenmunicipalsewerageserviceisnotavailable,theownershallcertifyinwriting
that satisfactory, adequate and safewater and sewage disposal is possible on thesiteinaccordancewithapplicablelocal,CountyandStateregulations.
(e) AdditionalinformationasmayberequiredbytheappropriatebodyoftheCounty.
(2) AzoningpermitshallbegrantedordeniedinwritingbytheZoningAdministratorwithin30
days.Thepermitshallexpirewithin6monthsunlesssubstantialworkhascommenced.Anypermitissuedinconflictwiththeprovisionsofthischaptershallbenullandvoid. (a) ThefeefortheLandUsePermitisestablishedbytheZoningandLandInformation
Committeeandcanbeamendedfromtimetotime.ThecurrentfeecanbeviewedinAppendixAofthisordinance.
(b) The JacksonCountyZoningDepartment staff shall have access topropertyduringreasonable business hours for the purpose of performing on‐site verifications fortheissuanceoftheLandUsePermit.

17.18 SITERESTRICTIONS. Nolandshallbeusedorstructureerectedwherethelandisheldunsuitable
forsuchuseorstructurebytheCountyZoningCommitteebyreasonofflooding,concentratedrunoff,inadequatedrainage,adversesoilorrockformation,unfavorabletopography,lowpercolationrateorbearingstrength,erosionsusceptibilityoranyotherfeaturelikelytobeharmfultothehealth,safety,prosperity,aestheticsandgeneralwelfareofthiscommunity.TheZoningCommitteeinapplyingtheprovisionsofthissectionshallinwritingrecitetheparticularfactsuponwhichitbasesitsconclusionthat the land is not suitable for certain uses. The applicant shall have an opportunity to presentevidencecontestingsuchunsuitabilityifhesodesires.Thereafter,theZoningCommitteemayaffirm,modifyorwithdrawitsdeterminationofunsuitability.
(1) Alllotsshallabutuponapublicstreetandshallhaveaminimumstreetfrontageasstatedin
theZoningOrdinance,exceptforlotsaffectedbySection17.81andSection18.75(5).
(2) All principal structures shall be located on a lot and only one principal structure shall belocated,erectedormovedontoalot.
(3) Nozoningpermitshallbe issued fora lot,whichabutsapublicstreet,dedicated toonlya
portion of its proposed width and located on that side thereof from which the requireddedicationhasnotbeensecured.
(4) Inanydistrictwherepublicsewerageservice isnotavailable, all lots shallbe sufficient to
permittheuseofanon‐sitesewagedisposalsystemdesignedinaccordancewithCh.DSPS385,Wis.Adm.Code.
(5) Lotsabuttingmorerestrictivedistrictboundariesshallprovidesideandrearyardsnotless
than those required in themore restrictive abuttingdistrict. The street yardson the lessrestrictive district shall bemodified for a distance of notmore than 60' from the districtboundarylinesoastoequaltheaverageofthestreetyardsrequiredinbothdistricts.
17.19 USERESTRICTIONS.Thefollowinguserestrictionsandregulationsshallapply:
(1) PRINCIPALUSES. Onlythoseprincipalusesspecified foradistrict, theiressentialservicesandtheusesprovidedforinsubs.(2)through(5)shallbepermittedinthatdistrict.
(2) ACCESSORY USES AND STRUCTURES. Accessory uses and structures incidental to the
permitted use shall be permitted subject to the requirements of this section and otherrequirements,asmaybedesignatedforthatzonedistrictinwhichtheyarelocatedandthefollowingrequirements:(a) Accessorystructuresandusesshallbecompatiblewiththeprincipalusesandshall
notbeusedforlounging,eating,sleeping,oranyformofhumanhabitation,occupancyorlivingpurposesevenifonatemporaryorincidentalbasis.
(b) Accessorystructuresandusesarepermittedinanydistrictbutshallnotbe
establishedpriortotheprincipalstructure/usebeingestablishedorunderconstruction.AnaccessorystructureanduseshallbeallowedwithouttheprincipalstructurebeingbuiltorunderconstructionifthelandownerorapplicantsubmitsadetailedplaninaccordancewithSection17.17ofthisordinanceandexecutesaverifiedaffidavitandrestrictivecovenantrunningwiththelandregardingtheuseoftheaccessorybuildingforlivingpurposes,meetingthefollowingrequirements:1. Thelegaldescriptionoftheproperty.2. Asubscriptionclause(notarizedaffidavit).

3. Thenamesofthepersons,firmsandcorporationshavinganinterestinthe

5. Astatementthattheaffidavitandcovenantisgivenbytheownerandall
interestedpartiesinthepropertyinordertoobtainaLandUsePermitfromtheCountyZoningDepartmentforthepurposesofconstructinganaccessorybuildingonthedescribedpropertyinaccordancewiththeprovisionsofthischapter.
6. Theaffidavitandrestrictivecovenantrunningwiththelandshallbindthe
propertyowners,grantees,successors,heirsorassigneesoftheproperty.7. Setforththeconditionthatshouldbuildingspermittedasaccessory
structuresbeusedforlivingpurposesasadwellingunderthischapterthatanyLandUsePermitissuedbytheCountyshallbenullandvoid.Theoccupancyofsuchdwellingforlivingpurposesshallbeconsideredtobeaviolationofthischapter.
SuchaffidavitandrestrictivecovenantrunningwiththelandshallberecordedintheRegisterofDeedsOfficefortheCountyandshallbeconsideredarestrictivecovenantrunningwiththelandandshallinsuretothebenefitoftheCounty,allabuttingandcontiguouspropertiestothatofthesubjectproperty,aswellastheresidentsoftheCounty.
(3) CONDITIONALUSES. Conditional uses and their accessory uses are considered as special
uses requiring review, public hearing and approval by the Zoning Committee. Anydevelopment within 660' of the existing or proposed rights‐of‐way of freeways,expressways,interstateandcontrolledaccesstrafficwaysandwithin1,500'oftheirexistingor proposed interchange or turning lane rights‐of‐way shall be deemed to be to beconditional uses. Such development shall be specifically reviewed and approved by theZoningCommitteeasprovidedin17.35‐17.42.
(4) UNCLASSIFIEDORUNSPECIFIEDUSES. Unclassifiedorunspecifiedusesmaybepermitted
bytheZoningCommitteeafteraPublicHearinghasbeenheld,providedthatsuchusesaresimilarincharactertotheprincipalusespermittedinthedistrict.
(5) TEMPORARYUSES. Temporary uses, such as real estate sales field offices or shelters for
materialsandequipmentbeingused in theconstructionofapermanentstructure,maybepermittedbytheZoningCommittee.
(6) PERFORMANCE STANDARDS. Performance standards listed in 17.85‐17.93 shall be
compliedwithbyallusesinalldistricts.17.20 REDUCTIONORJOINTUSE.Nolot,yard,parkingarea,buildingareaorotherspaceshallbereduced
inareaordimensionsoasnottomeettheprovisionsofthischapter.Nopartofanylot,yard,parkingareaorotherspacerequiredforastructureoruseshallbeusedforanyotherstructureoruse.
17.21 AIRPORTAPPROACHPROTECTION.
(1) Nostructureshallhereafterbeconstructed,alteredorlocatedandnotreesshallbeallowed

togrowtoaheightexceeding35' intheareasurroundingtheCountyAirport,definedasacircle having its center‐point at the crossing of the runways andmeasured outward to adistanceof1/2mile. Furthermore,nousemaybemadeoflandinanyzonewhichcreateselectricalradiointerference,makesitdifficulttodistinguishairportlights,impairsvisibilityinthevicinityoftheairportorotherwiseendangersthelanding,takingofformaneuveringofaircraft.
(2) SEWAGETREATMENTFACILITYISOLATION.Inordertominimizeanypotentialodor,noise
and nuisances caused by sewage treatment facilities and to enhance plant security andreliability,sewagetreatmentfacilitiesshallbeisolatedfromcommercialestablishmentsandfrom buildings occupied or intended for residential use, and from land, which is activelybeingdevelopedforcommercialorresidentialuse.Thefollowingseparationdistancesshallbemaintained:(a) 150 meters (500 feet) for mechanical treatment facilities, effluent holding and
polishingponds;
(b) 150meters(500feet)forseepagecells,ridgeandfurrowsystemsandoverlandflowsystems;
(c) 230meters(750feet)foraeratedlagoons;
(d) 305 meters (1,000 feet) for off‐site sludge holding facilities and spray irrigationsystems;and
(e) 460meters(1,500feet)forstabilizationlagoons.17.22 VIOLATIONS.
(1) Itshallbeunlawfultoconstructoruseanystructure,landorwaterinviolationofanyoftheprovisionsofthischapter.Incaseofanyviolation,theCountyBoard,ZoningAdministrator,Zoning Committee or any property owner who would be specifically damaged by suchviolationmayinstituteappropriateactionorproceedingtoenjoinaviolationofthischapter.
(2) TheJacksonCountyZoningAdministratororassigneeisauthorizedtopostanorderstoppingworkuponland,whichhashadapermitrevokedoronlandcurrentlyundergoingactivityinviolationofthisordinance.Noticeisgivenbybothpostinguponthelandwheretheviolationoccurswithastopworkplacardandbymailingacopyoftheorderbycertifiedmailtothepersonwhoseactivityisinviolationofthisordinance.Theordershallspecifythattheactivitymustceaseorbebroughtintocomplianceimmediately.
17.23 PENALTIES.
(1) Anyperson,firmorcorporationwhofailstocomplywiththeprovisionsofthischaptershallupon conviction thereof forfeit not more than $200 and costs of prosecution for eachviolation,and indefaultofpaymentofsuchforfeitureandcostsshallbe imprisonedintheCountyjailuntilpaymentthereof,butnotexceeding30days.Eachdayaviolationexistsorcontinuesshallconstituteaseparateoffense.
(2) Anypersonwhobeginsworkonastructureorrelocatesastructurepriortoobtainingthe
requiredLandUsePermitshallbecompelledtopayapenaltyoften(10)timestheeffectivepermitfee.

continuous series of points thatwhen taken together enclose all activities and operationsthatoccurattheminesiteonaregularorirregularbasis,includingallstructures,facilities,parkingareas,interiorhaulroadsthatareintegraltoordirectlyservetheminingoperationand all stockpiles, waste piles, settling ponds, retention ponds, detention ponds, and lay‐downareasthatareutilizedbytheminingoperation.
NON‐METALLIC MINERAL PROCESSING. To beneficiate, concentrate, screen, sort, clean,
wash,dry,package,containerizeorapplycoatingtoanon‐metallicmineralornon‐metallicmineralaggregate,byproduct,co‐product,wasteorwasteproduct.
NON‐METALLICMINING.Meansanyofthefollowing:
a. Extraction from the earth of stone, non‐metallic mineralaggregates, or non‐metallic minerals for off‐site use or sale,associated activities such as drilling, blasting, excavation, gradinganddredgingofsuchaggregatesandminerals.

Any buildings, facilities, permanent equipment orframework that is located on themine site. It includes but is not limited to,mining andprocessingequipment,storagefacilitiesandimprovements,constructedpondsandlagoons,mechanicalshops,pavedparkingsurfacesandotherspaces.(a) Principal Uses. Non‐metallic mineral extraction operations, processing of non‐
metallicmineralsandconcreteproductsmanufacturing,providedaconditionalusepermithasbeenissued.
(b) ConditionalUses. Extensionoralterationsof legallyexistingnon‐metallicmineral
extraction operations and the manufacturing of asphalt, concrete and concreteproductsorthecreationofnewextractionormanufacturingoperations.See17.41.

17.30 METALLICMINERALEXPLORING,PROSPECTINGANDMINING DEFINITIONS.InSection17.30,unlessthecontextdictatesotherwise,thefollowingdefinitionsshall

MINING or MINING OPERATION shall mean all or part of the process in the mining of metallicmineralsotherthanforexplorationorprospecting,includingcommercialextraction,agglomeration,beneficiation, constructionof roads, removalofoverburden, and theproductionof refuse, and thedisposalofminingwaste.MININGWASTEmeansanyrefuse,sludge,orotherdiscardedmaterial,includingsolid,liquid,semi‐solid or contained gaseous material, resulting from or used for metallic mineral prospecting ormining, or from the cleaning or preparation ofminerals duringprospecting ormining operations.Typical mining wastes include, but are not limited to, tailings, waste rock, mine overburden, andwastetreatmentsludges.Miningwastedoesnotincludetopsoilandmineoverburdennotdisposedof inawastesite,butplaced ina facilitypermittedunderCh.NR131or132, tobereturnedtotheminesiteorusedinthereclamationprocess,anddoesnotincludemerchantableby‐products.OPERATORshallmeanapersonorcompany,itssubsidiariesandparentcompanies,whichhavebeengrantedapermitunderthissectionformineralexploration,prospectingormining.OREshallmeanmineralsofalltypesofgeologicalorigin,whichcontainavaluablecomponent,suchasametal,whichisextractedtherefromandisworkedaccordinglyforsuchvalue.PROPERTYLINEshallmeantheexteriorboundariesof theparcelor lotonwhichminingactivitiesaretakingplace;howeverforthepurposesofapplyingthebufferzoneconcept, thatportionoftheright‐of‐wayofapublicstreetorhighwaywhichextendsontotheparcelorlotshallnotbecountedtowardthecalculationofthewidthofthebufferzone.PROSPECTINGshallmeanengagingintheexaminationofanareaforthepurposeofdeterminingthequality and quantity ofminerals, other than for exploration but including the obtaining of an oresample,bysuchphysicalmeansasexcavating,trenching,constructionofshafts,rampsandtunnelsandothermeans,other thanexploration,which theDNR,by rule, identifies,and theproductionofprospecting refuse and other associated activities. "Prospecting" shall not include such activitieswhen theactivities,are,by themselves, intended forandcapableofcommercialexploitationof theunderlyingorebody. However, the fact thatprospectingactivitiesandconstructionmayhaveuseultimately in mining, if approved, shall not mean that prospecting activities and constructionconstitutemining, provided suchactivities and construction are reasonably related to prospectingrequirements.PROSPECTINGSITEshallmeananidentifiedlotorparceloflandonwhichprospectingisproposedtotakeplacewithintheCounty.RESIDENTIALAREAshallmean twoormorehousesorbuilding lotsorparcels forresidentialuse,consistentwithminimumallowedcountylotsizeswhichareusedforresidentialpurposesorzonedforsuchuseandwhetherlocatedinthesamezoningdistrictasminingactivitiesornot.SULFIDEOREBODY,“Orebody"isacontinuouswell‐definedmassofmaterialcontainingenoughoreto make extraction economically feasible. "Sulfide" is a mineral compound characterized by thelinkageofsulphurwithametalsuchasgalena,Pbs,orpyrite,FeS2.(1) ProhibitedAreas: Metallicmineralexploration/miningactivitiesareprohibitedwithinany
ofthefollowingdescribedareas.Theareasincludeboththeabovegroundportionandtheunderground portion extending vertically from the site boundaries within the specifiedsetbackareas:
(a) Within1000'ofanyresidence,seasonaloryearround.

Thisdistrict shallbeemployedasanoverlaydistrict todescribeanareawhereexplorationmayoccurforaspecifiedperiodoftime. Whentheexplorationisfinished,theoverlaydistrictshallberemovedandtheusespermittedbytheunderlyingdistrictallowedtocontinue.Intheeventmetallicmineralsarefound,apetitionforZoningAmendmenttoaMiningDistrictshallberequiredforthespecifiedsiteonwhichtheminingistotakeplace.
(2) PermittedUses
(a) Any uses permitted in the underlying district during any time in which theexploration isbeingconducted. Theseusesmustmeettherequirementsasstatedfortheunderlyingdistrict.
(3) ConditionalUses

(4) StandardsforExplorationConditionalUse
(a) Theminimumareaneededtoestablishanexplorationdistrictshallbe160acresandthere shall be a 750' buffer between exploration activities and the explorationdistrict boundary. The buffer is an area left in its natural state and will remainundisturbedexceptforroads.
(b) The applicant shall obtain a Conditional Use Permit and provide a plan, which

(c) As part of the Conditional Use Permit application, the applicant shall submit an
approvedexplorationlicenseissuedbytheWIDepartmentofNaturalResourcesinaccordancewithNR130WisconsinAdministrativeCode.
(d) Theapplicationshallbeaccompaniedby:
1. Anapplicationfeeof$500.00.2. A bond, payable to the County, of $5000.00 conditioned on faithful
performance for the provisions of these regulations. Said bond shall besubjecttothesameconditionsfortheCountyasfortheStateaslistedinNR130.05(b)1,2,3,4.
3. Acertificateofinsurancecertifyingthattheexplorerhasinforce,aliability
insurancepolicyissuedbyaninsurancecompanyauthorizedtodobusinessin this state covering all exploration of the explorer in this County andaffordingpersonalinjuryandpropertydamageprotectioninatotalamountdeemedadequatebytheCounty,butnotlessthan$50,000.
4. Acopyofapplicant'smostrecentAnnualReportandForm10Kasfiledwith
theSecuritiesandExchangeCommission.Ifthesearenotavailable,theapplicantshallsubmitareportoftheapplicant'scurrentassetsand liabilitiesorothernecessarydatatoestablishthattheapplicant iscompetenttoconductexplorationinthisCounty.
(e) An explorerwishing to renew an exploration permit shall file an annual renewal
applicationwith theCounty. Therenewalapplicationshallbeaccompaniedbyall

requirementsasstatedinSection17.31(d)ofthisOrdinance.
(f) All conditions of the application shall be subject to NR 130 WisconsinAdministrativeCodeasapplicable. Intheeventthatanyoftheseconditionsdifferfromtheconditionsintheseregulations,themorerestrictiveconditionsshallapply.
(g) NothingintheseregulationsshallbeconstruedtomeantheZoningCommitteeshall
be required to approve an application for an exploration permit. The ZoningCommittee may deny a permit pursuant to NR 130.09 Wisconsin AdministrativeCode,andalsoiftheapplicationdoesnotsatisfythefollowingstandards:1. Provideprotectionofadjacentpropertiesfromnoise,dust,fumes,andother
nuisancesintheinterestofthepublic'shealth,safety,comfortandgeneralwelfare.
2. Provide for the protection of the County's natural resources including
surfacewater and groundwater, wetlands, air, topsoil and valued naturalareas.
(5) StandardsforProspectingConditionalUse
(a) An application for a Conditional Use Permit shall contain a description for allsignificant aspects of the prospecting, a description of all significant conditionswithin the prospecting area, and an analysis of all significant impacts on thesurroundingareas.Theapplicationshallcontain:1. Easementstosurfacerightsoruseofthelands.2. Alegaldescriptionofthelandsandmineralsbeingsearchedfor.3. Atopographicmap,outliningthelandstobeprospected.Contourintervals
tobespecifiedbytheCounty.4. A prospecting permit, issued by the Wisconsin Department of Natural
ResourcesunderNR131.06,WisconsinAdministrativeCode.5. MinimumareaandbuffersasinSection17.31(4)(a).
(b) The applicant shall provide a prospecting plan in accordance with NR 131.07
WisconsinAdministrativeCode. Itshallalsodescribethephasesofprospectingasfollows:

The Zoning Committee shall set theamounts of bonding sufficiently to insure full reclamation from theprospectingactivities.
3. A certificate of insurance certifying that the prospector has in force a
liabilityinsurancepolicyissuedbyaninsurancecompanyauthorizedtodobusiness in thisstate,or in lieuofacertificateof insurance,evidencethatthe prospector has satisfied State or Federal self‐insurance requirementscovering all prospecting of the prospector in this State and affordingpersonalinjuryandpropertydamageprotectioninatotalamountdeemedadequatebytheCounty,butnotlessthan$50,000.
(e) Nometallicprospecting,noranyprospectingrelatedbuildingsorstructuresmaybe
built, operatedormaintainedwithin an areawhere theWisconsinDepartment ofNatural Resources finds that there would be a probability that the prospectingwould violate groundwater and/or surface water standards set by the laws ofWisconsin, or any administrative rules adopted by the department pertaining togroundwaterandsurfacewaters.ThegroundwaterandsurfacewaterstandardsinJacksonCounty shall be standardsof non‐degradation. That is, no activity,whichresultsinadegradationofthepresentqualityorquantityofgroundwaterorsurfacewaters,shallbepermitted.Intheeventthatanyofthesestandardsdifferfromeachother,themorerestrictivestandardshallapply.
(f) All conditions of the application shall be subject to NR 131 Wisconsin
Administrative Code. In the event that any of these conditions differ from theconditionsintheseregulations,themorerestrictiveconditionshallapply.
(g) NothingintheseregulationsshallbeconstruedtomeanthatJacksonCountyshallbe
requiredtoapproveanapplicationformetallicprospecting.TheCountymaydenyapermitpursuanttoNR131.10WisconsinAdministrativeCode.
(h) AnapplicationforaConditionalUsePermitunderthissectionmayalsobedeniedif
thecommitteedeterminestheapplicationdoesnotsatisfythefollowingstandards:1. Provideprotectionofadjacentpropertiesfromnoise,dust,fumesandother
nuisancesintheinterestofthepublic'shealth,safety,comfort,andgeneralwelfare.
2. Provide for the protection of the County's Natural Resources including

17.32 MININGDISTRICT(M‐4)(1) Purpose. The purpose of this district is to provide for the conduct ofmining formetallic
materials.Thisdistrictasitappliestoactualminingandprocessingisintendedtobeabasicusedistrictandshouldincludeenoughlandareatoaccommodatetheprincipal(mining)useandtoaffordadequatebufferingandlandforaccessoryuse.
(2) ProhibitedAreas.Metallicminingshallnotbeconductedwithinanyofthefollowingareas:
(a) WithinareasspecifiedinSection17.30(1).
(b) WithintheCounty,thereshallbenodisposalofminingwastesfromamineoutsideofJacksonCounty.
(3) PermittedUses.Anyusespermittedinthedistrictspetitionedfromduringthetimeinwhich
theuses arebeing converted tomining. Agriculture andForestryuses are encouraged tocontinueduringtheminingphase.
(4) StandardsforPermittedUses.

(a) Theminimumareaneededtoestablishaminingdistrictshallbe320acresandthereshallbea1000'bufferbetweenminingactivitiesandtheminingdistrictboundary.Thebufferisanarealeftinitsnaturalstateandwillremainundisturbedexceptforroads.
(b) An application for a Conditional Use shall contain a description for all significant
aspectsof themining, adescriptionofall significant conditionswithin theminingarea,andananalysisofallsignificantimpactsonthesurroundingarea,and:
1. Proofofownershipandmineralrights. 2. Alegaldescriptionofthelands.
3. Atopographicmap,outliningthelandstobeusedfortheminingactivities.ContourintervaltobespecifiedbytheCounty.
4. ThefinalEnvironmentalImpactStatementasrequiredbyNR150,NR131,
andNR132ofWisconsinAdministrativeCode.
5. AminingpermitissuedbytheWisconsinDepartmentofNaturalResourcespursuanttoNR132.09WisconsinAdministrativeCode.
(c) Theapplicationshallbeaccompaniedby:
1. A fee of $20,000 to cover the estimated cost of evaluating the operator'sminingpermitapplication. Uponcompletionof its evaluation, theCountyshall adjust this fee to reflect theactual costof evaluation,which shallbepaidbytheapplicant.

2. Abondorothersecurity,payabletotheCounty,conditioneduponfaithful
performance of all requirements of Chapter 293.01 to 293.95 WisconsinStatutesandtheprovisionsoftheseregulations.SaidbondshallbesubjecttothesameconditionsfortheCountyasfortheStateaslistedinNR132.09(2)(a)1,2,3WisconsinAdministrativeCode.
3. ACertificateofInsurancecertifyingthattheoperatorhasin
force a liability insurance policy issued by an Insurance Companyauthorized to do business in this state, or in lieu of a Certificate ofInsurance, evidence that the operator has satisfied State or Federal self‐insurancerequirementscoveringallminingoftheoperatorinthisStateandaffordingpersonalinjuryandpropertydamageprotectioninatotalamountdeemedadequatebytheCounty,butnotlessthan$500,000.00.
(d) Theapplicantshallprovideaminingplan,whichshalldescribethephasesofmining
andinclude:1. A mining plan, submitted in accordance with NR 132.07, Wisconsin
AdministrativeCode. 2. Constructionof,andusesof,buildings. 3. Constructionandusesofshippingfacilities.
4. Alistofchemicalsandreagentstobeused,howshippedandstored.
(e) TheapplicantshallprovideaReclamationPlan,whichshalldescribeasaminimum:1. A plan submitted in accordance with NR 132.08 of Wisconsin
AdministrativeCode. 2. Usesoflandafterfullreclamation.
(f) The applicant shall provide any other pertinent data and necessary information,whichtheCountymayrequireinordertoproperlyevaluatethepermitapplication.
(g) TheapplicantshallfulfillthefollowingrequirementsbeforetheCountymayissuea
permit:1. Nometallicmining or anymining related buildings or structuresmay be
built,operatedormaintainedwithinanareawheretheDNRfindsthattherewould be a probability that the mining would violate groundwaterstandards set by the laws ofWisconsin or any other administrative rulesadoptedbytheDepartmentpertaining togroundwater. ThegroundwaterstandardoftheCountyshallbeastandardofnon‐degradation.Thatis,noactivity,whichresultsinadegradationofthepresentqualityorquantityofthe groundwater, shall be permitted. In the event that any of thesestandardsdifferfromeachother,themorerestrictivestandardshallapply.
2. A comprehensive testing of allwells, public and private,within a five (5)
mile radius of the proposed mine site must be preformed to establishbaseline conditions. This testing must include testing for all metals,including heavymetals, and all elements, including, toxic elements. Eachownerofawellintheaboveareasshallbegivenacopyoftheinformationrelevant to theirwell orwells and a copy of the full hydrological studies

uponrequest. TheapplicantisrequiredtoprovideacopyofthesestudiestotheCountyZoningOffice.
For a period of two (2) years prior to the commencement of the
constructionofanymine,andduringtheperiodofoperationofanymine,andforforty(40)yearsthereafter,anapplicantshallmonitoronacontinualbasis all private and public wells located within five (5) miles of theboundary line of the property of the applicant or any wells that thehydrologicalstudyshowsshouldbemonitoredinordertoprovidebaselinedata concerning quantity and quality of water adequate for all purposes,including but not limited to, determining the validity of anywell damageclaim.Thewellmonitoringintervalsshallbenegotiatedatthetimeofthepermitapplication. An independentconsultantagreeable to theapplicantand County shall do this monitoring. That consultant shall employ splitsample technique and shall make samples available upon request to theCounty or any person or consultant designated by the County to receivesuchsamples.
3. Theapplicantshalldepositintoaninterest‐bearingtrustaccount$5000.00
for each well within a five (5) mile radius of the boundary line of thepropertyoftheapplicantandforeachwelllocatedinanyotherareawhichstudieshave indicated that there is thepossibilityof adverseeffects fromminingrelatedactivities.
This money shall be first used to pay for replacing any contaminated or
damagedordepletedwellsand/or forprovidingwater toanywellownerwhosewellhasbeencontaminatedordamagedordepletedandwhosewelliswithinfive(5)milesoftheboundarylineofthepropertyoftheapplicant,or within any other area which hydrology studies have indicated can beadverselyaffectedbytheminingoperation.
The original deposit, any additional deposits and other accumulated
interestshall remain in the trustaccountevenafteranyminingoperationhas been completed and/or discontinued, to be used for replacing anycontaminated or damaged wells, the contamination or damaging ordepletionofwhichhadnotyetdevelopedorbeendiscoveredatthetimeofsuch completion or discontinuation; and/or for providing water for anywellownerwhosewellhasbeencontaminatedordamagedordepleted,thecontaminationordamagingordepletionofwhichhadnotyetdevelopedorbeendiscoveredatthetimeofsuchcompletionordiscontinuation. Intheevent that any well in the above‐described area is contaminated ordamagedordepleted, thewellownerwillbeprovidedwithwaterand/orthewellownerswellwillbereplaced.Theapplicantagreesnottoobjecttothedisbursementoffundsfromthetrustaccountforthesepurposes.
The applicant agrees to establish the said trust account at a bank orfinancial organization mutually agreeable to it and the Town and alsoagreestothedesignationofthewellfundadministrationlistedbelow.The County Zoning Committee is designated to supervise the activities ofthe well fund administration. It shall approve the distribution of moniesfromsaidfundtoownersofcontaminated,damagedordepletedwells. Inso doing, it shall be empowered to hold meetings for the purpose of

ascertainingwhethercomplaintsofwelldamageresultedfromtheminingoperationwhichhasestablishedtheparticularwellfundinquestion,anditshall also ascertain the amount of such damages and shall authorize thewell fund administrator to disburse such amount to the owner and/or topurchaseandprovidewatertotheowner.The County Clerk shall be designated to administer theTrustAccount onbehalfof theTownandshallbecalled theWellFundAdministrator. Saidperson shall perform their responsibilities as a fiduciary on behalf of theCounty,thewellownersandtheapplicant,andshalldischargetheirdutiesfaithfully.Amongtheresponsibilities,whichtheyshallpursue,shallbethefollowing:
a. SubjecttotheapprovalofwelldamageclaimsbytheCountyZoningCommittee, the administrator shall disburse monies to replacecontaminated, damaged or depleted wells and/or for providingwatertowellowners.
b. OnanannualbasisinthemonthofMarch,theAdministratorshall
issueareporttotheZoningCommitteeastothestatusofthefund,distributionsmadetherefrom,interestandprincipal,whichreportshallcovertheprecedingcalendaryeartoandthroughDecember31,thereof.
c. PursuanttoChapter177,Wis.Stats.theadministratorshall,absent
dispersalsunder(g)3aabove,duringagivencalendaryear,atleastannually contact the bank or financial organization holding thedeposit and communicate sufficient information with which tomeet the provisions of Sec. 177.02(1) and (2), Wis. Stats. andmaintaintheaccountonanactivestatus.
d. At the conclusionof the period commencingwith the time of the
initial deposit and ending with the passage of 100 years, theadministratorshalldisperseall remaining funds in theaccount totheCountyGeneralFund,forusebytheCountyinsuchamannerormannersastheCountyBoarddeemstobeappropriate.
4. TheCountyreservestherightto,atanytime,withorwithoutnotice,gain
access to the mining project in order to obtain water samples for thepurposeofcompliancemonitoring.
5. Itshallbetheresponsibilityoftheapplicanttoprovideforitself,adequateutilities,roads,drainage,trafficplansandpublicutilities.
6. The applicant shall submit a comprehensive description of all baselineconditionswithin theareasof theCountyexpected tobe impactedby theactivity,includinganestimateofsuchbaselineconditionsfromtheprojectlife of the proposed operation if the proposed operationwere permitted.Suchbaselineconditionsshallinclude,butnotbelimitedtothefollowing:a. Groundwaterb. Surfacewatersc. AirQualityd. Noiselevels
e. Wildlife

7. The cost of these studies is to be at the expense of the applicant. The
applicant shall provide the results of these studies to the County ZoningCommittee. The County reserves the right to have an independentverification of all baseline studies and/or to commission an independentstudy if the County deems this necessary. This independent study costwouldalsobetheresponsibilityoftheapplicant.
(h) All conditions of the application shall be subject to NR 132 Wisconsin
AdministrativeCode.Intheeventthatanyoftheseconditionsdifferfromanyoftheconditionsintheseregulations,themorerestrictiveconditionshallapply.
(i) Nothing in these regulations shall be construed to mean that the County Zoning
CommitteeshallberequiredtoapproveanapplicationforMetallicMineralMining.The Countymay deny a permit pursuant toNR 132.10Wisconsin AdministrativeCode.
(j) TheCountymayalsodeny a ConditionalUsePermit if theCommitteedetermines
theapplicationdoesnotsatisfythefollowingstandards:1. The mining activity (including and not limited to operations, waste
management,andreclamation)shallnotbeallowedtodegradethequantityandqualityofgroundwaterintheCounty.
2. The mining activity (including and not limited to operations, waste
management,andreclamation)shallnotbeallowedto impactany lakeorstreamssize,waterquality,orlevel.
(k) The initial grant to carry on mining activities shall be for a specified period as
determined by the County Zoning Committee. The Zoning Administrator shallreview the Annual Reports of review made by the DNR. If the reports indicatecompliancetotheprovisionsoftheConditionalUsePermit,theusesshallcontinue.IftheDNRrequiresmodificationoftheapplicant'smetallicminingpermit,whichinturn requires modification of the Conditional Use Permit, the Zoning Committeeshall review the permit. The Zoning Administrator, in conjunctionwith the DNRunderNR132.11 (3) (a)WisconsinAdministrativeCode,mayenterandmake thenecessary inspections to insure compliancewith theprovisionsof theConditionalUse Permit. The Zoning Committee may extend a Conditional Use Permit foradditionalperiodsoftime.Feesforanextensionshallbethesameasfortheinitialapplication. If an applicant desires to transfer the permit to another party, theZoningCommitteeshallreviewandapprovethetransferasitrelatestocompliancewiththeCodeStandardsandPermitConditions.

(l) ApprovalofaConditionalUsePermitunderthissectionissubjecttoandcontingent
onsatisfactionofallotherrequirementsoftheDNRforaMetallicMiningPermit.
(m) IfaCommitteeisappointedtonegotiatealocalagreementwithaminingcompany,the membership of that committee shall include members of the County ZoningCommittee. AlocalagreementshallnotbeapproveduntilthefinalEnvironmentalImpactStatementiscompletedbytheDNR.
(7) No person, firm, corporation or organization shall conduct any metallic exploration,
prospecting or mining within the affected municipalities of this Ordinance without firstobtainingapermitunderthissection.
(8) Prohibited Practices. No person, firm, corporation or organization shall do any of the
followingwithorwithoutapermit:(a) Constructbuildings,structuresorequipmentintheCountyforsmeltingorrefining
ofmetallicmineralores.
(b) UselandfortheplacementofmetallicminingwastedisposalfacilityorsitewithintheCounty.
(c) Use any equipment during the construction phase and/or mining phase of the
metallicminingoperation,whichwouldcauseairpollutioninviolationofstandardsor regulations promulgated pursuant to Chapter 285 Wisconsin Statutes or anyapplicable federal or local air quality standards. In the event, that any of thesestandardsdifferfromeachother,themorerestrictiveshallapply.
(9) If any section, clause, provision or portion of this Section of the Code is adjudged
unconstitutional or invalid by a Court of Competent Jurisdiction, the remainder of theSectionshallnotbeaffectedthereby.
17.33 AGRICULTURALDISTRICTS. (1) A‐1AGRICULTURE.

CONDITIONALUSES17.35 REVIEWANDAPPROVAL.
(1) TheZoningCommitteeshallreviewthesite,existingandproposedstructures,architecturalplans, neighboring uses, parking areas, driveway locations, highway access, trafficgeneration and circulation, drainage, sewerage and water systems and the proposedoperation.
(2) Any development within 660' of the existing or proposed rights‐of‐way of freeways,
expressways,interstateandcontrolledaccesstrafficwaysandwithin1,500'oftheirexistingorproposedinterchangeorturninglanerights‐of‐wayshallbespecificallyreviewedbythehighway agency that has jurisdiction over the traffic way. The Zoning Committee shallrequestsuchreviewandawait thehighwayagency'srecommendations foraperiodnot toexceed60daysbeforetakingfinalaction.
(3) Conditions, such as landscaping, architectural design, type of construction, construction,
commencement and completion dates, sureties, lighting, fencing, planting screens,operational control, hours of operation, improved traffic circulation, deed restrictions,highway access restrictions, increased yardsor parking requirementsmaybe requiredbytheZoning Committeeuponits findingthatthesearenecessarytofulfill thepurposeandintentofthischapter.
(4) Compliance with all other provisions of this chapter, such as lot width and area, yards,
height,parking,loading,traffic,highwayaccessandperformancestandardsshallberequiredofallconditionaluses.
(5) Anyuselisted,asaconditionaluseinthischaptershallbepermittedonlyuponapplication
totheZoningAdministratorandissuanceofaspecialusepermitbytheZoningCommittee.Aspecialusepermitshallbeissuedonlyuponsatisfactionoftherequirementslistedhereininadditiontoallotherrequirementsof thischapter. All suchusesareherebydeclared topossesssuchuniqueandspecialcharacteristicsthateachspecificuseshallbeconsideredasan individualcase. Before issuingaspecialusepermit, theZoningCommitteeshallholdapublichearing.Noticeofsuchpublichearingspecifyingthetime,placeandmatterstocomebeforetheCommitteeshallbegiveninthemannerspecifiedin17.96and17.97.
17.36PUBLICANDSEMIPUBLICUSES.Thefollowingpublicandsemipublicusesshall
beconditionalusesandmaybepermittedasspecified.(1) Airports, airstrips and landing fields in the A‐1 and A‐2 Districts, providing that these
facilitiesmeettheregulationscontainedinCh.114and135and136,Wis.Stats.
(2) Governmental and cultural uses, such as fire and police stations, community centers,libraries, public emergency shelters, parks, playgrounds and museums in all residential,businessandindustrialdistricts.
(3) Utilitiesinalldistrictsprovidedallprincipalstructuresandusesarenotlessthan50'from
anyresidentialdistrict lot line. This includesprivateandpublicwindenergyfacilitiesandotherrenewableenergyfacilities.
(4) Public passenger transportation terminals, such as heliports, bus and rail depots, except
airports,airstripsandlandingfields,inallbusinessdistrictsandtheM‐1IndustrialDistrictprovidedallprincipalstructuresandusesarenotlessthan100'fromanyresidentialdistrictboundary.

premises shall be properly graded so as to prevent the accumulation of stormorother waters. No unit or mobile home park shall be located in an area that issituatedsothatdrainageofcontaminated liquidsorsolidscanbedepositedon itslocationoradjacentproperty.
(b) Allmobilehomeparksshallbeseeded,orsodded,andshallbeproperlylandscaped.
Newmobile home parks and expansion of existing parksmust have an approvedconstructionsiteerosioncontrolplanpriortocommencementofanywork.
(2) SPACEANDSETBACKS.
(a) Eachspaceshallbeaclearlymarkedordelineatedareaofnotlessthan4000squarefeet.Theunitshallnotoccupyinexcessofone‐thirdoftheareaofthesite,andtheunit including all accessory structures shall not occupymore thanone‐half of theareaofthesite.Expansionandmodificationofexistingandoperatingmobilehomeparksshallbeinaccordancewithcurrentregulations.
(b) Nounitoraccessorystructureshallbelocatedcloserthan5'toanyotherspace.No
unit shall be located closer than the permitted setback, as established by statute,ordinance,orlocaljurisdiction,totheright‐of‐waylineofapublicstreet.
(3) STREETS.
(a) Allspacesshallabutuponastreet.Foratwo‐waystreet,thewidthmustbeatleast32'ifparkingistobepermittedonbothsidesofthestreet;24'inwidthifparkingispermittedononlyoneside;or18'inwidthifparkingonthestreetisprohibited.Aone‐waystreetshallbeatleast24'inwidthifparkingispermittedonbothsides;or18'wideifparkingispermittedononeside;and14'wideifparkingonthestreetisprohibited.One‐waystreetsshallbenolongerthan500'.
(b) Streetsshallbeadequatelygraveledforyearrounduseorbepaved.Theyshallbe
maintained in good condition, havenaturaldrainage andbe adequately lightedatnight.
(4) PARKING.
(a) Foreachspacethereshallbeagraveledorpavedparkingareaofatleast350squarefeet. There shall be additional parking spaces for automotive vehicleswithin theparktotalingnotlessthan11/4parkingspacesforeachmobilehomespace.
(b) Parking areas shall bemaintained in good condition andhave adequatedrainage.
Unlicensedvehiclesandcollectionofpersonalproperty,junkordebrisshallnotbe

allowed on a parking area or space or outside of a building anywhere in theboundariesofthemobilehomepark.
(c) Thereshallbeahardsurfacewalkwayatleast2'wideleadingfromtheparkingarea
tothemobilehomeentrances. (d) Thereshallbenoparkingonthelawninfrontofthemobilehome. (5) OTHERUSESPROHIBITED.
(a) Themanagementofthemobilehomeparkshallnotallowautomobilesales,repair,mobilehomesales,ormobilehomerenovation,oranyotherbusinessactivityinthepark.
(b) Laundries,washrooms,recreationrooms,maintenanceequipmentstorageandone
officearepermitted. (6) WATERSUPPLY.
(a) Municipalsupply. Whenamunicipalwatersupplyisavailabletothemobilehomepark,connectionandusearerequired.
(b) Private wells. A private owned well is permitted as a source of water when a
municipalwaterfacilityisnotavailabletothepremises.ThewellshallbelocatedonthepremisesandshallbeconstructedandthepumpinstalledinaccordancewithCh.NR111and112,Rulesgoverningwelldrillingandpumpinstallation.Wheneversafewater cannot be obtained consistently from a well constructed in apparentcompliancewith Ch. NR 112, as evidenced by unsafe laboratory reports, thewellmust be reconstructed or a new well constructed in accordance with therequirements of the Department of Natural Resources. However, if thereconstructionornewconstructionisdeterminedtobeimpracticalorisfoundtobeineffective, the use of the well shall be discontinued. The water supply shall besampledatleastquarterlyformicrobialcontamination. Chemicalsamplesshallbeanalyzed according to Ch. 109 ofWis. Adm. Code. Water sample resultsmust besuppliedtotheDepartment.
(c) WaterConnection.Aseparatevalvedwaterserviceshallextendtoeachsite.
(7) SEWAGEDISPOSAL.
(a) MunicipalSystem. Whenpublicsewagefacilitiesareavailabletothemobilehomepark,connectionandusearerequired.
(b) PrivateSystem.PrivatesewagedisposalsystemasdefinedinS.145.01(12)Stats.
arepermittedwhenapublicsewerfacilityisnotavailabletothepremises.Thesystemshallbelocatedonthepremisesandshallbedesigned,constructed,andoperatedinaccordancewithS.144.245Stats.andChs.DCOMM82and83.Plansandinstallationdetailscoveringthedesignandconstruction,alteration,orextensionofprivatesewagedisposalsystemsshallbeapprovedbytheDepartmentofCommerceandtheDepartment.Priortoconstruction,sanitarypermitsarerequiredforanyworkdonetoaprivatesewagesystem.
(8) PLUMBING.
(a) Allplumbingshallmeet the requirementscontained inCh.DCOMM82‐84andCh.HSS177,WisconsinAdministrativeCode.

(9) SOLIDWASTE.(a) Garbage.Allgarbageshallbekeptinseparate,leakproof,non‐absorbentcontainers
equippedwithtight‐fittingcoversunlessotherwiseprotectedfromflies,insectsandanimals, and the contents shall be disposed of as often as necessary to preventsmells,decompositionandoverflow.Garbageorrubbishpick‐upanddisposalmustbeprovidedbythemanagement. Themanagementshallalsoprovideanenclosedstructureforrecyclablematerials.ThemanagementisresponsiblefortheoperationandmaintenanceoftheRecyclingFacility.
(10) FARMS.
(a) Morethanoneunitmaybepermittedperoperatingfarm.Afarmmeansaparcelof35acresormoreofcontiguous landwhich isdevotedprimarilytoagricultureusewhich during the year preceding the permit application has provided gross farmprofits,asdefinedinS.71.58(4),Stats.ofnotlessthan$6000,orwhichduringthethreeyearsprecedingapplication,producedgrossfarmprofitsof$18,000.
(b) Thispermitmaybe issuedforoccupancybyafamilymemberoremployeeofsaid
operatingfarm.Saidemployeeshallbeactivelyemployedandreceive50%ofhisorherincomefromsaidoperatingfarm.Thefamilymembershallbeapersonrelatedtothefarmowner,asafather,mother,son,daughter,brotherorsister.
(11) MISCELLANEOUSPROVISIONS.
(a) USEOFSETBACKZONES. Nooccupiedorunoccupiedmobilehome,manufacturedhome, park unit, or recreational vehicle, shall be located between the establishedsetbacklinesforthezoningdistrictinwhichsuchstructureislocatedandthestreet,highway,lotline,streamorlake.
(b) SKIRTING. Skirting, specifically designed for mobile homes or other material to
enclose the area between the ground and the bottom of the home, is to be donewithintwo(2)weeksafterparking.
(c) FIRES. Open fires on the premises, except charcoal fires used for cooking, are
prohibited.Burningbarrelsareprohibited.(d) RECREATION AREA. Each park shall contain a relatively level, well‐drained
recreationarea. Aminimumofone‐halfacreofareaforsuchuseshallbeprovidedforeach50sites.Theminimumareainanyparkshallbeone‐halfacre.
(e) SCREENING. Each mobile home park shall be completely enclosed, except for
permitted entrances and exits, by a temporary planting of fast growing materialcapable of reaching 15' ormore or a permanent evergreen planting such that theindividualtreesareofsuchnumberandarrangementsothattheywillformadensescreenwithin 10 years. Other screening that is harmoniouswith the surroundingareacanbeapprovedbytheDepartment.
(f) CERTAINUNITSTOBEINPARKS.Allmanufacturedhomesoflessthan400square
feetoflivingspaceandallmobilehomescurrentlyinmobilehomeparksinJacksonCountycanonlybelocatedwithinlicensedmobilehomeparks.
(g) PRE‐EXISTINGPARKS. Allexpansionsofexistingparksmustcomplywith thisand
otherCountyOrdinances. AllexistingparksmustbelicensedandcomplywiththisOrdinance except for certain design requirements not previously in effect. AllreplacementunitsmustcomplywiththissectionoftheOrdinance.

(12) TRAILERCAMPS. Except as otherwiseprovided in this chapter, no trailer shall be located
except ina federal,State,Countyortowncampor inaprivatecampsite. Privatecampsitesshallmeetthefollowingconditions:
(a) Eachtrailersiteshallbeplainlymarkedandsurfaced. (b) Maximumnumberoftrailersitesshallbe10peracre. (c) All drives and parking areas other than those at individual trailer sites shall be
surfaced. (d) Centraltoilet,showerandwashingfacilitiesshallbeprovidedinsufficientquantity
asdeterminedbytheStateBoardofHealthrequirements. (e) ThewatersupplyshallbeapprovedbytheStateBoardofHealth. (f) ThemannerofsewerdisposalshallbeapprovedbytheStateBoardofHealth. (g) Notrailershallbelessthan50'fromfront,sideorrearlotlinesofthecamp. (h) Marshlandandshorelineareasshallnotbealtered.
(13) TEMPORARYLOCATION.(a) MobilehomesandtrailersshallbepermittedintheR‐2,R‐3,R‐4,A‐1,A‐2andC‐1
DistrictswithoutaConditionalUsePermitforaperiodnottoexceedtwenty‐five(25)totaldayswithinaoneyearperiod.
(b) Traveltrailers/campingunitsshallbepermittedintheR‐2,R‐3,R‐4,A‐1andA‐2
Districts,andtheR‐1District,unlessprohibitedbylocalSanitaryDistrictOrdinances,withoutaprincipalstructurebeingpresentunderthefollowingconditions:1. Traveltrailers/campingunitsareallowedonpropertyaslongaseachunit
isregisteredwiththeJacksonCountyZoningDepartment.2. Traveltrailers/campingunitsmustberegisteredwiththeDepartmentand
theappropriateregistrationfeeasestablishedbytheJacksonCountyZoningCommitteemustbepaidbyJanuary31ofeachyear.SeeAppendixAforcurrentfee.
3. Eachtraveltrailer/campingunitlocatedonanylotorparcelmustbe
separatelyregisteredwiththeDepartment.Thefollowingnumberofunitsarethemaximumallowedperparcelsize:a. 1.5to5.0acres–2unitsb. 5.1to20.0acres–3unitsc. 20.1to40acres–5units
4. Iffourormoretraveltrailers/campingunitsareproposedandthe
individualownersareunrelated,thenaConditionalUsePermitwillberequiredfortheoperationofacampground.ThiswillrequireapublichearingwiththeZoningCommittee.Theappropriatestatelicenseforoperationofacampgroundwillalsoberequired.

5. Approvedsanitaryprovisions,suchasstateapprovedPOWTSsystem,self‐containedunitsorcommerciallyavailabletoiletsshallbeutilized.AlltypesofsanitaryunitsmustbepermittedthroughtheDepartment.
6. Ifwaterunderpressureisintroducedattheproperty,acodecomplying
privateon‐sitewastewatertreatmentsystem(septic)mustbeinstalledbyfollowingallappropriatecodesandordinances.
7. Arrangementsaretobemadefortheproperhandlingandremovalofall
garbageandtrash.
8. Occupation of a travel trailer/camping unit by a person having no otherprimaryresidenceorabodeatthetimetheunitissooccupiedisprohibited,exceptinthefollowing:a. Thetravel trailer/campingunit isbeingutilizedas livingquarters
withintheCountyforaperiodofeight(8)monthsorless.b. The travel trailer/camping unit is located within a
building/structurelocatedontheproperty,iflocatedinaSanitaryDistrict.
c. The travel trailer/camping unit is served by public water andsewer utilities or private well and septic system facilities, whichmeettheJacksonCountySanitaryOrdinance.
d. Thetravel trailer/campingunit(s)areregisteredwiththeJacksonCountyZoningDepartment.
9. Alloccupiedsitesmusthavearesidentialaddress(firenumber)assigned
forthatlotorparcel.10. Afeeorregistrationisnotrequiredforatraveltrailer/campingunitwhich
isnotonpropertyforovertwenty‐five(25)daysinaoneyearperiod.11. Anyabandoned,dilapidated,unsafeorunsanitaryunitwillbeordered
removedbytheDepartment.Theremovalwillbeexpectedwithinthirty(30)daysfromthenoticereceivedfromtheDepartment.
12. Ifaprincipalstructureisconstructedormovedontotheproperty,thenthe
traveltrailer/campingunitwillneedtoberemovedormeettheprovisionsofSection17.38(13)(c).
13. TheJacksonCountyZoningDepartmentstaffhastherighttoaccess
propertyduringreasonablebusinesshoursforthepurposeofverifyingregistrationoftraveltrailers/campingunitsandforvisualchecksonthemaintenanceorupkeepofthepropertyandtheunits.
(c) Traveltrailers/campingunitsmaybestoredorparkedonpropertyunderthe
followingconditions:1. Thepropertycontainsaprincipalstructurebeingadwellingorresidence,
whichisoccupiedbytheownerofthetraveltrailer/campingunitatleast51%oftheyear.
2. Thepropertyiscorrectlyzonedfortheprincipalstructure.

3. Thetraveltrailer/campingunitcannotbeconnectedtoutilitiesnorcanitbeleveledandskirted.Thewheelsandtongueapparatusmustremainontheunit.
17.39 HIGHWAYORIENTEDUSES. Thefollowingcommercialusesshallbeconditionalusesandmaybe
permittedasspecified:(1) Drive‐in theaters in theB‐2BusinessDistrict,provided that aplanting screenat least25'
wideiscreatedalonganysideabuttingaresidentialdistrictandnoaccessispermittedtoorwithin1,000'ofanarterialstreet.
(2) Drive‐inestablishmentsservingfoodorbeveragesforconsumptionoutsidethestructurein
theB‐2BusinessDistrict.(3) MotelsintheB‐2BusinessDistrict.(4) Funeralhomes in theB‐1BusinessDistrict,providedallprincipal structuresandusesare
notlessthan25'fromanylotline.(5) Drive‐inbanksintheB‐1andB‐2BusinessDistricts.(6) TouristhomesintheB‐1andB‐2BusinessDistricts.(7) Vehicle sales, service,washingand repair stations, garages, taxi standsandpublicparking
lots inallbusinessdistricts,providedallgaspumpsarenot less than30' fromanysideorrearlotlineand20'fromanyexistingorproposedstreetline.
(8) Any development within 660' of the existing or proposed rights‐of‐way of freeways,
expressways,interstateandcontrolledaccesstrafficwaysandwithin1,500'oftheirexistingor proposed interchange or turning lane rights‐of‐way shall be deemed to be conditionaluses.Nostructuresshallbeerectedcloserthan100'totheirrights‐of‐way.
17.40 INDUSTRIALANDAGRICULTURALUSES. The following industrial and agricultural uses shall be
conditionalusesandmaybepermittedasspecified:(1) Animalhospitals intheA‐1andA‐2Districts,providedthelotareaisnot lessthan3acres
andallprincipalstructuresandusesarenotlessthan100'fromanyresidentialdistrict.(2) Dumps,disposalareas,incineratorsandsewagedisposalplantsintheA‐1andA‐2Districts.(3) The introduction of cattle or other livestock including horses and poultry is allowed as a
conditionaluseintheR‐2andR‐4Districts.Theminimumlotsizeistobethree(3)acresforsucharequest.
(4) Commercial butchering or rendering of animals or fowl and commercial raising or
propagatingofmink,dogsandfoxinA‐1andA‐2Districts.PeavineriesanddairyplantsintheA‐1andA‐2Districts.ThecommercialraisingorbrokeringofpuppieswithintheA‐1andA‐2Districts.Theminimumlotsizeistobethree(3)acresforsucharequest.
(5) Kennels. Establishment of kennels shall only be established in conformance with all
applicable state and local regulations, including any recommendations of the CountyHumaneOfficer,whoshallbenotifiedofanyconditionalusepriortothepublichearing.Inaddition, the following shall be considered asminimum standards in the development ofsuchkennels:

(a) KennelsareallowedasconditionaluseswithintheA‐1,A‐2orB‐2Districts.(b) Aminimumof five (5) contiguous acres either owned or rented by the applicant
shallberequiredonwhichtolocateadogkennel.(c) Where required, enclosures must be provided which shall allow adequate
protectionagainstweatherandextremes.Floorsofbuildings,runsandwallsshallbeofanimperviousmaterialtopermitpropertycleaninganddisinfecting.
(d) Adequateventilationshallbemaintainedtopromotehealthandodorcontrol.(e) All dog pens or enclosures shall be sufficiently large to permit freedom of
movementtothedogsconfinedtherein.(f) Whererequired,runsshallprovideanadequateexerciseareaandprotectionfrom
the weather. Runs shall have an impervious surface to allow for cleaning,disinfectionandodorcontrol.
(g) Allanimalsmustbequartered. Allanimalquartersandrunsaretobekeptclean,
dryandinsanitarycondition.(h) Thefoodshallbestoredinrodentproofcontainersandbefreefromcontamination.
Food supplies shall be wholesome, palatable and of sufficient quantity andnutritionalvaluetomeetthenormaldailyrequirementsfortheconditionandsizeoftheanimal.
(i) Allanimalsshallhavepotablewateratalltimes.(j) All kennels established under this chapter shall meet DNR well setback
requirements.(k) No repeated or continual barking, such as constitutes a noise nuisance, shall be
permitted.(l) These standards are to be considered minimum requirements. Additional
requirementsmay be established on a case by case basis at the discretion of theJacksonCountyHealthDepartmentandtheJacksonCountyHumaneOfficer.
(6) Outsidestorage,manufacturing,junkandsalvageyardsintheM‐1District:
(a) Permit Required: No person shall use any building or premises for the buying,selling,gathering,delivery,shipping,storingorsalvagingofoldiron,bottles,paper,rags, vehicles or other materials commonly included in the term "junk" withoutobtaining a land use permit for the operation of a junk yard and salvage yard.Storageofthree(3)ormoreunlicensedorinoperablevehiclesonthesamepremisesshallbeprimafacieevidenceofoperationofajunkorsalvageyard.
(b) Application: Application for a permit hereunder shall be made in writing to the
ZoningAdministratorstating: 1. Thelocationanddescriptionofthepremisestobepermitted. 2. Thenatureofthebusinesstobeconductedonthepremises.
3. Thetypeofconstructionofanybuildingstobeusedinconnectionwiththe

business.
4. Theapplicant'snameandaddress;andifafirmorcorporation, the namesandaddressesofallofficersthereof.
(c) PermitFeeandTerm:Thefeeforapermitissuedhereundershallbeintheamount
set by the County Board. Permits shall expire if the use of the property isdiscontinuedfortwelve(12)consecutivemonths.ThepermitmaythenberenewedonlyuponapprovalbytheZoningCommitteeandafterholdingapublichearing.
(d) Location:Nojunkorsalvageyardshallbelocatedwithinsevenhundredfifty(750)
feet of any residence, other than the owner of thepremises, or any residential orbusiness district; and within one hundred fifty (150) feet from a lake, river orstream.Nojunkorsalvageyardshallbecarriedonwithinfivehundred(500)feetofanyfederal,stateorcountyhighwayright‐of‐way;orwithinonehundredfifty(150)feetofanytownroad,highwayorstreetright‐of‐way.
(e) Screening Requirements: Junk and salvage yards shall be surrounded by a solid
fencewhich isconducive to thesurroundingareaoranevergreenplantingscreencompletelypreventingaviewfromanyotherpropertyorpublicright‐of‐ways.
(f) Operation: The operation of the yards shall complywith Section17.19(6) of this
ordinanceandalsowithSections84.31and175.25oftheWisconsinStatutes. ThenonconformingyardsshallcomplywithSection84.31(4),Wis.Stats.
(7) Commercialservicefacilities,suchasrestaurantsandfuelingstationsintheM‐1District.(8) Rural retailing, processing and production is allowed in the A‐1 and A‐2 Districts as a
conditionaluse.SeeSection17.10DefinitionsforuseswithintheRuralRetailingarea.
(9) WineriesandwinetastingfacilitiesareallowedasaconditionalusewithintheA‐1andA‐2Districts.
17.41 MINERALEXTRACTIONOTHERTHANIRONOREMINING,BENEFICATIONANDPROCESSINGOF
IRONORECONCENTRATES.Nonon‐metallicminingorprocessingoperationshallbelocatedintheCountyexceptinconformancewithaplanapprovedbytheZoningandLandInformationCommittee.A Conditional Use Permit is required for the expansion or alteration of any existing non‐metallicmining or processing operation. Non‐metallic mining and processing operations shall meet thefollowingrequirements:(1) InadditiontothesiteplanrequiredunderSection17.17,theapplicantshallfurnishaplanof
operationdescribingthedesign,managementandoperationofthefacility. Suchplanshallinclude:(a) Adescriptionof theminingprocess, sequenceof operations,operational schedule
(including years of operation and daily operational schedule), and estimatedvolumesofmaterialtoberemovedorprocessedonanannualbasisforthelifeoftheoperation.
(b) Alistofequipment,machineryandstructurestobeused.(c) Thesource,quantityanddispositionofanywaterwhichmaybeused.

(d) Atopographicmapofthesiteshowingtheexistingtopographyatmaximumverticalcontourintervalsoffive(5)feet.
(e) Thelocationoftreesandadescriptionoftheexistinggroundcover.(f) Amapatascaleofnot less than1 inchequals660 feetshowingtheextentof the
extraction area, and describing the direction, length, width and the depth of allexistingandproposedexcavations.
(g) The locationofexistingandproposedpublicoraccessroads,andatransportation
plandescribingtransportationroutes,trafficvolumesandfrequency, loadweights,scheduleandgeneralapproachforthereceiptand/ortransportofmaterials.
(h) The location of all existing buildings and structures within 300 feet of the site
boundaries.(i) Thenamesofallpropertyownerswithin300feetofthesiteboundaries.(j) RestorationofthepropertycomplyingwithallapplicableprovisionsofChapter24
of the County Code of Ordinances. This is the Non‐Metallic MiningRestoration/ReclamationOrdinanceforJacksonCounty.Siteswherethematerialtobe used or sold is generated incidentally to the primary purpose of the project,including but not limited to the creation of wetlands, ponds and sedimentationbasins shall be exempt from thisprovision. Required restorationof these sites islimitedtoarevegetationplan.
(k) Verificationthattheapplicanthasrequestedthataculturalresourcesitereviewbe
performed by the Department of Natural Resources or other agency or companycertified to do such a review by the WI‐DNR and that the site review has beencompleted.AcopyofthesitereviewreportmustbeprovidedtotheCountypriortotheissuanceofaconditionalusepermit.
(2) The Zoning and Land Information Committee shall consider the effects of the proposed
operation upon existing streets/roads, neighboring land uses, future land uses, drainage,water supply, soil erosion, natural beauty, character and land value of the locality. TheCommittee shall also consider the potential effects of increased dust, smoke, odor, noise,vibration,trafficandthepracticalityofrestoringthesite.
(3) No non‐metallic mining or processing operation shall be located within 300 feet of a
residence other than that of the landowner or applicant or within 50 feet to a school orinstitution.
(4) The Zoning and Land Information Committeemay require that the site be enclosed by a
suitablefencetopreventunauthorizedentry.(5) The Zoning and Land Information Committeemay require that the site be enclosed by a
suitable fence or vegetation screen so that materials are not visible from neighboringpropertyandpublicright‐of‐waysincludingroads,streets,highwaysandwaterways.
(6) Anywashpondsandsettlingpondsthathavechemicalsintroducedtothemshallhave5feet
of separation distance to bedrock and to the groundwater elevation, and shall have animpervious liner. Theoperator is responsible formaintainingall aspectsof thewashandsettlingponds,includingimperviouslinersandensuringthatreleasesfromthepondstothe

groundwatershallnotoccur.Anyportionofanypondtowhichchemicalswereintroducedthat existsatanelevationbelow theprojectedpost‐reclamationwater table, shallbe fullyexcavatedandremovedduringthereclamationandpriortoallowingthewatertabletorisetotheelevationofthepondbottom.
(7) Theoperatorshallperformthefollowingmonitoringandtestingattheoperator’sexpense
usinganindependent,licensed,third‐partyandusingacertifiedlaboratoryapprovedbytheJacksonCountyZoningandLandInformationCommittee:(a) Forminingoperations involvingextraction,processing, stockpiling,oroverburden
disposal, theoperatorshall installagroundwatermonitoringwellnetworkforthepurposes of establishing the actual baseline groundwater quality and elevation atthe facility site and formonitoring changes to the groundwater elevation, qualityandquantityovertime.Themonitoringnetworkshallhaveatleastonemonitoringwellattheboundaryofthesitethatisdowngradientofthegroundwaterflow.Thenetwork shall consist of sufficientmonitoringwells located in the down gradientdirection of groundwater flow to allow for the monitoring of groundwaterelevations. The Jackson County Zoning and Land Information Committee mayrequest additional monitoring wells based on hydrology, site conditions, andcharacteristics of theoperation. Theoperator shall takequarterly samplesof themonitoring well(s) for lead, arsenic, turbidity, total suspended solids, chlorides,nitrates,specificconductivityandanyothertoxicsubstancethatmayreasonablybebelievedtobepresentintheareaorinthetypeofdepositfromwhichtheextractionwillbemadeduringthefirsttwoyearsofoperationandtwiceayearinsubsequentyears.Themonitoringwellnetworkshallbedesignedbyaprofessionalhydrologistorprofessionalengineer specializing inhydrogeologyandreviewedandapprovedbytheJacksonCountyZoningandLandinformationDepartmentoritsdesigneesinadvance of well installation. Analysis of the monitoring well samples shall beconductedbyacertifiedlaboratorywithallgroundwatermonitoringactivitiesattheexpenseoftheoperator.
(8) The Zoning and Land Information Committee reserves the right to place additional
conditionsonnon‐metallicminingoperationstoinsurethehealth,safetyandwelfareoftheresidentsofJacksonCounty.
17.42RECREATIONUSES.
(1) Thefollowingpublicrecreationalfacilitiesshallbeconditionalusesandmaybepermittedasspecified: archery ranges, bathhouses, beaches, boating, camps, conservatories, drivingranges,firearmranges,golfcourses,gymnasiumshunting,iceboating,marinas,musichalls,polo fields, pools, riding academies, skating rinks, sport fields, stadiums, swimming poolsandzoologicalandbotanicalgardensinanydistrictprovidedthatthelotareaisnotlessthan3acresandallstructuresarenotlessthan50'fromanydistrictboundary.
(2) Commercial recreation facilities, such as arcades, bowling alleys, driving ranges,
gymnasiums,lodges,miniaturegolf,physicalculture,poolandbilliardhalls,racetracks,rifleranges,skatingrinksandtheatersareconditionalusesandmaybepermittedintheB‐1andB‐2BusinessDistricts.
(3) Commercial entertainment facilities such as exotic and cabaret‐type dance halls, Turkish
baths, adult entertainment, andmassage/masseuse facilities are conditionaluses andmaybepermittedintheB‐1andB‐2BusinessDistricts.

Radio or TV broadcasting studios and/or towers, personalwireless service facilities, telephone and communication antennas, transmitters and receiving stations andothersimilartypesofcommunicationfacilities.Homesatelliteserviceantennasanddishesarenotincludedinthisdefinition.WIRELESSCOMMUNICATIONFACILITY.NewstructuresandClassIco‐locationsmeanstheplacementand/orconstructionofafreestandingnewwirelesscommunicationtowerortheplacementofanewmobileservicefacilityonanexistingstructuresuchthattheownerofthefacilitydoesnotneedtoconstructafreestandingsupport structure for the facility but does need to engage in “substantial modification” of the existingstructuretoaccommodatethenewfacility.SUBSTANTIAL MODIFICATION. The modification of a mobile service support structure, including themountingofanantennaonsuchastructurethatdoesanyofthefollowing:
a. Forstructureswithanoverallheightoftwohundred(200)feetorless,increasestheheightofthestructurebymorethantwenty(20)feet.
b. For structures with an overall height of more than two hundred (200) feet,increasestheheightofthestructureby10%ormore.
c. Measuredattheleveloftheappurtenanceaddedtothestructureasaresultofthemodification, increases thewidth of the support structure by twenty (20) feet ormore,unlessalargerareaisnecessaryforco‐location.
d. Increasesthesquarefootageofanexistingequipmentcompoundtoatotalareaofmorethan2,500sq.feet.
WIRELESSCOMMUNICATIONFACILITY. Class2co‐locationsmeanstheplacementofanewmobileservicefacilityonanexistingsupportstructuresuchthattheownerofthefacilitydoesnotneedtoconstructafreestandingsupportstructureforthefacilityorengageinsubstantialmodificationstotheexistingstructuretoaccommodatethenewfacility.
(1) Alandusepermitisrequiredfortheplacementofallnewwirelesscommunicationfacilities,Class1co‐locationsandClass2co‐locations. Inadditiontotheotherrequirementsofthiscode.Acompleteapplicationshallcontainallofthefollowinginformation:
a. Thenameandbusinessaddressof,andthecontactindividual,fortheapplicant.b. Thelocationoftheproposedoraffectedsupportstructure.c. Thelocationoftheproposedmobileservicefacility,mobileservicefacility,hasthe
meaninginss.66.0404(1)(L).d. A construction plan which describes the proposed modification to the support
structure and the equipment and network components, including antennas,transmitters, receivers, base stations, power supplies, cabling and relatedequipment associatedwith the proposedmodifications, if the application is for aClass 2 co‐location or to substantially modify an existing support structure thatconstitutesaClass1co‐location.
e. If the application is to construct a new mobile service support structure, a
construction planwhich describes the proposedmobile service support structureand the equipment and network components, including antennas, transmitters,receivers,basestations,powersupplies,cablingandrelatedequipmenttobeplacedonoraroundthenewmobileservicesupportstructure.

f. If an application is to construct a new mobile service support structure, anexplanationastowhytheapplicanthaschosentheproposedlocationandwhytheapplicant did not choose co‐location on an existing facility, including a swornstatement from an individual who has responsibility over the placement of themobile service support structures attesting that co‐locationwithin the applicantsserviceringwouldnotresultinthesamemobileservicefunctionality,coverage,andcapacity is technically infeasible or is economically burdensome to the mobileserviceprovider.
g. Anynewmobilesupportstructuresshallbesetbackfromthenearestpropertylines
andanyotherstructureadistanceofnot less than75%of thetotalheight,unlessthe applicant provides an engineering certification that shows the new orsubstantially modified mobile service support structure is designed to collapsewithinasmallerareathantheaforementionedsetbacklimit.
h. Theapplicationshallindicatethatemergencycontactinformationshallbepostedat
the wireless communication facility and filed with the Jackson County Sheriff’sDepartment. This information shall be kept current with the ownership andmaintenanceofthefacility.
i. Allnewwirelesscommunicationfacilitiesthataretwohundred(200)ormorefeet
inheightshallbepaintedalternateaviationorangeandwhite,andshallbeoutfittedwith dual lighting mechanisms, including day time strobes and night time redincandescentlighting.
j. All towers that have guy wires shall be outfitted with large orange balls for
increasedvisibilitybysmallaircraftinaccordancewiththerecommendationsbytheFederalAviationAdministration(FAA).
k. Uponcessationoftheoperationofthetower,thetowerandotherimprovementsto
the property shall be removed. The applicant shall furnish sureties which willenablethecountytoremovesuchimprovementsiftheapplicant/ownerfailstodoso. TheamountofsuchsuretiesshallbedeterminedbytheZoningAdministratorbut shall not exceed $20,000.00. The form and type of such sureties shall beapprovedbytheJacksonCountyCorporationCounsel.Suchfiscalsuretyshallbeforaperiodnot toexceedfiveyearsandwillberenewedthereafterupona favorablereview of the operation and maintenance of the facility by the Jackson CountyZoningCommittee andCorporationCounsel. All local units of governmentwithinthecountyshallbeexemptedfromhavingtofurnishfiscalsureties.
(2) Iftheapplicationissubmittedunderthissection,butitisdeterminedthattheapplicationis
not complete, the Zoning Department shall notify the applicant in writing that theapplication is not complete within ten (10) days of the date of receiving the application,pertinentattachmentsandfee.
(3) Within90daysofthereceiptofacompletedapplicationforanewwirelesscommunications
facilityoraClass1co‐location,orwithin45daysofthereceiptofacompletedapplicationforaClass2co‐location,theZoningDepartmentshallcompleteitsreviewanddeterminationontheapplication,exceptthattheapplicantandtheDepartmentcanagreeinwritingtoanextensiontothe45or90dayperiod.

TRAFFIC,PARKINGANDACCESS
17.45 HIGHWAYSETBACKS. ForthepurposeofdeterminingthedistancebuildingsandotherstructuresshallbesetbackfromthestreetsandhighwaysoftheCounty,thehighwaysoftheCountyaredividedintothefollowingclasses:
(1) CLASSAHIGHWAYS.(a) AllStateandfederalhighwaysareherebydesignatedasClassAhighways.
(b) The setback line for Class A highways shall be 110' from the centerline of the
highwayor50'fromtheright‐of‐wayline,whicheverisgreater.
(c) Serviceroads toClassAhighwaysshallbeconsideredasClassChighways for thepurposeofdeterminingthesetbackalongsuchserviceroads.
(2) CLASSBHIGHWAYS.
(a) AllCountytrunksareherebydesignatedasClassBhighways.Forthepurposeofthissubchapter,anyroadwillbeconsideredasaCountytrunkafterithasbeenplacedon the County trunk systems by the CountyBoard and approvedby theHighwayCommission.
(b) ThesetbackforClassBhighwaysshallbe75'fromthecenterlineofsuchhighwayor
42'fromtheright‐of‐wayline,whicheverisgreater. (3) CLASSCHIGHWAYS.

(4) LESSERSETBACKS.LessersetbacksonClassAandClassBhighwayscanonlybeallowedby
theCounty’sBoardofAdjustment,evenifthereisanestablishedbuildinglinebyanadjacentstructure.OnClassChighwayslessersetbackscanbeallowedincasesofunusualtopographyorexistingpatternsofdevelopment,aslongastheadjacentstructuresaremainbuildings(ex.house,cabin,etc.).
17.46 VISION CLEARANCE AT INTERSECTIONS. In each quadrant of every highway intersection or
intersectionofaroadwitharailroadthereshallbeavisionclearancetriangleboundedbyastraightlineconnectingthem150'fromtheirintersection.
17.47 OBJECTS PERMITTED WITHIN HIGHWAY SETBACK LINES AND VISION TRIANGLES. No
structureshallbepermittedwithinasetbackline,except:(1) Openfences.(2) Telephone, telegraph and power transmission poles, lines and portable equipment and
livestockhousingsthatarereadilyremovableintheirentirety.(3) The planting and harvesting of field crops, shrubbery and trees, except that no trees or
shrubberyshallbeplantedwithinavisionclearancetrianglesoastoobstructtheview.
(4) Thosesigns,whichare,permittedelsewhereinthischapter.

17.49 LOADINGREQUIREMENTS. In all districts adequate loading areas shall be provided so that allvehiclesloading,maneuveringorunloadingarecompletelyoffthepublicwaysandallvehiclesneednotbackoutonanypublicway.
17.50 PARKINGREQUIREMENTS.Inalldistrictsandinconnectionwitheveryusethereshallbeprovided
atthetimeanyuseorbuildingiserected,enlarged,extendedorincreasedoff‐streetparkingstallsforallvehiclesinaccordancewiththefollowing:(1) Sizeofeachparkingspaceshallbenotlessthan180sq.ft.exclusiveofthespacerequiredfor
ingressandegress.

ownership or easement, not considered being part of the public road for the purpose ofgainingaccesstolandorimprovements.
(2) Allnewdrivewaysproposedtobeinstalledshallbesubjecttoaninspectionandapprovalby
theTownBoardorTownBoarddesignee.AnyexistingdrivewayservingopenlandwithoutimprovementsandproposedtobeconvertedtoadrivewaytoserveoneormorestructuresalsomustbeapprovedbytheTownBoardpriortotheBuildingPermitbeingissued.
(3) Theapplicantwhomaybetheowner,agent,orcontractorshallsubmitalocationplanwith
theirLandUseorBuildingPermitapplication.Theplanmustshowthewidth,length,slopeanderosioncontrolmeasures,ifrequired.
(4) AuthorizationforadrivewayissubjecttoTownBoardapprovalwhereinlocated.TheTown
Boardreserves theright tochargea fee for the inspectionand issuanceofpermits for theproposed driveway. The Town Board may require culverts to be installed at specificlocations. If culverts are required, theminimumdiameter shall be12". TheTownBoardmustbeconsultedontheinstallationofanyculverts.Illegalculvertswillberemovedattheowner'sexpenses.
(5) Thefollowingspecificationsapply: (a) Minimumof6'frompropertylines (b) Minimumof15'betweenalldriveways (c) Minimumroadsurfacewidth12'foroneandtwofamilydwellings. (d) Minimumroadsurfacewidthof24'forallcommercialorbusiness

the County’s Zoning Committee in caseswhere accessmay be limited due to topography,limitedhighwayaccesses,etc.
17.52 HIGHWAYACCESSREQUIREMENTS. Nodirectprivateaccessshallbepermittedtotheexistingor
proposed rights‐of‐way of expressways, or to any controlled access arterial street withoutpermissionof thehighwayagency thathasaccesscontrol jurisdiction. Nodirectpublicorprivateaccessshallbepermittedtotheexistingorproposedrights‐of‐wayofthefollowing:(1) Freeways,interstatehighwaysandtheirinterchangesorturninglanes,nortointersectingor
interchangingstreetswithin1,500'ofthemostremoteendofthetaperoftheturninglanes.(2) Arterial streets intersecting another arterial street within 100' of the intersection of the
right‐of‐waylines.(3) Streetsintersectinganarterialstreetwithin50'oftheintersectionoftheright‐of‐waylines.
Accessbarriers,suchascurbing,fencing,ditching,landscapingorothertopographicbarriersshallbeerectedtopreventunauthorizedvehicularingressoregresstotheabovespecifiedstreetsorhighways.
(4) Temporaryaccess to theabove rights‐of‐waymaybegrantedby theBoardofAdjustment
afterreviewandrecommendationbythehighwayagencieshavingjurisdiction.Suchaccesspermit shall be temporary, revocable and subject to any condition required and shall beissuedforaperiodnottoexceed12months.
17.53INTERCHANGEAREAOVERLAYZONE.
(1) PURPOSE. To supplement the controls of the underlying primary zoning districts byprovidingspecialregulationsasrequiredbytheuniquecharacteristicsoflanddevelopment,trafficgenerationandmovementininterchangearea.
(2) APPLICATION. The general standards set forth hereunder apply to all lands within the
delineated areas surrounding any existing or planned highway interchange and shall beoverlaidupontheprimaryzoningdistrictsalreadyappliedtothesamelands.Intheeventofconflicting standards between the underlying zoning and the interchange overlayregulations,themorerestrictivewillapply.
(3) DELINEATION. Minimumcoverage shall extendonemileoneachsideof the interchange;
i.e., 2 corridors onemile long and 1/2milewide, one along each side of the intersectinghighwaymeasuredfromthecenteroftheinterchange.
17.54STANDARDSFORINTERCHANGEAREAOVERLAYZONING.
(1) ACCESSCONTROLONINTERSECTINGHIGHWAY.(a) Duallanehighwayorfreeflowingramp,noaccesswithin1,000'ofmostremoteend

thevisiontrianglebetween2‐1/2and10'abovethehighwaycenterlineelevation.
(4) PARKINGANDLOADING.(a) Alltruckloadingareasshallbecompletelyoffthepublicstreetsandsodesignedthat
trucksneednotpark,back intoorback fromapublicway,norblockorendangerpedestrianorvehiculartrafficonstreets,sidewalksorprivateproperty.
(b) Off‐streetparkingareasshouldbesufficienttoaccommodateallforeseeableparking
demands.Parkingareasshallbedesignedtoallowon‐sitetemporarystorageareasfor vehicles entering and desiring to park, thus eliminating use of highwayrights‐of‐waybyvehiclesawaitingentrancetothesite.
(5) SIGNS.

MODIFICATIONS17.60 HEIGHT. Themaximumheight limitationsprovidedelsewhere inthischaptermaybeexceededin
accordancewiththefollowingstandards:(1) Agricultural structures, suchasbarns, silosandwindmillsshallnotexceed inheight twice
their distance from the nearest lot line. A Land Use Permit is not required for theconstructionofcorncribs,orsilos.Theheightrestrictionhoweverdoesapply.
(2) Publicorsemipublicfacilities,suchasschools,churches,hospitals,monuments,sanitariums,
libraries,governmentalofficesandstationsmaybeerectedtoaheightof60',providedallrequiredyardsareincreasednot lessthanonefootforeachfootthestructureexceedsthedistrict'smaximumheightrequirement.
17.61 YARDS.Theyardrequirementsstipulatedelsewhereinthischaptermaybemodifiedasfollows:

anycaseexceedaheightoften(10)feet.Residentialfencesareallowedtotheright‐of‐wayofanypublicroadbutshallnot inanycaseexceedaheightofsix(6) feetalongthepublicroadright‐of‐way.ALandUsePermitisnotrequired.
(4) Securityfencesarepermittedonthepropertylinesinalldistrictsexceptresidentialdistricts,
but shallnotexceed ten (10) feet inheight andshallbeofanopen type similar towovenwireorwroughtironfencing.Securityfencesandagriculturaltypefencingcanrunalongthepublicright‐of‐way.ALandUsePermitisnotrequired.

3,R‐4andC‐1Districts.Theycannotbeutilizedfortheadvertisingoranytrade,businessoroccupationinanydistrict.(a) Individualsorcorporationsactivelyengagedinanagriculturalpracticelistedasa
principaluseintheA‐1orA‐2Districtmayutilizesemi‐trailersforstorageunitsaslongastheyaregeneratingatleast80%oftheirincomefromtheagriculturaloperationandhaveaminimumofthirty‐five(35)contiguousacresofland.
17.62 ADDITIONS.Additionsinthestreetyardofexistingstructuresshallnotprojectbeyondtheaverage
oftheexistingstreetyardsontheabuttinglotsorparcels.17.63 AVERAGE STREET YARDS. The required street yards may be decreased in any residential or
businessdistrict to theaverageof theexistingstreetyardsof theabuttingstructuresoneachside,butinnocaselessthan15'inanyresidentialdistrictand5'inanybusinessdistrict.
17.64 NOISE.Sirens,whistlesandbells,whicharemaintainedandutilizedsolelytoserveapublicpurpose,
areexemptfromthesoundlevelstandardsofthischapter.17.65 REQUIREDMINIMUMLOTAREA.TherequiredminimumlotareasarelistedintheZoningDistrict
SectionofthisOrdinance.Ifanindividualwantstoreducetheminimumlotarea,theywouldneedtoapplyforaVariancethroughtheCounty'sBoardofAdjustment. ThiswouldfollowstandardPublicHearingprocedure.

SIGNS17.70 PURPOSE. This chapter is established to protect and promote health, safety, general welfare and
orderthroughtheestablishmentofcomprehensive,uniformstandardsandproceduresgoverningtheconstruction,usedandstyleofsignsorsymbolsservingasavisualcommunicationmedia,aimedatpersons upon public rights‐of‐ways or private properties. Hereafter, no sign shall be erected,constructed,alteredormodifiedexceptasregulatedherein.
17.71GENERALSIGNPROVISIONS.
(1) Hazardous Signs. No sign shall, by reason of its shape, location, lighting, size, color orintensity,createahazardto thesafe,efficientmovementofvehicularorpedestriantraffic.Noprivate sign shall containwords,whichmight be construedas traffic controls, such as"stop","caution",or"warning",unlesssuchsignisintendedtodirecttrafficonthepremises.
(2) Sign Maintenance. All signs and sign structures shall be properly maintained in a safe,
orderly condition, andparts and supports shall beproperly painted at all times. Signsorsignstructureswhicharerotted,unsafe,orwhichhaveotherwisedeterioratedorhavebeendefaced,shallberepainted,repaired,orreplacedbytheownerofthepropertyuponwhichthesignislocated,orbyhislicensee.
(3) Interference. Nosigns,oranyguides,staysorattachmentstheretoshallbeerected,placed
ormaintaineduponrocks,fencesortrees,orinsuchamannertointerferewithfire‐fightingequipmentorpersonnel,oranyelectric light,power, telephoneorcablewiresorsupportsthereof.
(4) SignsWithinRight‐of‐Way. Nosignsorother thangovernmental signsshallbeerectedor
temporarilyplacedwithinanypublicright‐of‐way.(5) IngressandEgress.Nosignorsignstructureshallbeerectedormaintainedsoastoprevent
ordeterfreemovementfromanydoor,windoworfirescape.Nosignorsignstructureshallimpede thevision triangleof adrivewayaccess toapropertybasedon the typeofpublicroadbeingaccessed.
(6) RequiredbyLaw.Allsignsrequiredbylawshallbepermittedinalldistricts.(7) ObsoleteSigns.Anobsoletesignorasignwhichadvertisesanactivity,product,orservice,
whichisnolongerbeingproducedorconducted,shallberemovedwithinninetydaysfromthelastdateuponwhichtheactivityorservicewasproducedorconducted.Responsibilityfortheremovalshallbevestedintheowneroftherealproperty.
(8) Illumination. All externally illuminated signs shall direct the source of light away from
adjacentproperties.
(9) FlashingLights.Flashing,revolvingandintermittentlylightedsignsarestrictlyprohibited.
(10) Shoreland.Nopermanentsignshallbelocatedcloserthan75'fromthenormalhighwatermarkofanynavigableorperennialbodyofwater,inthefloodwayofanystream,river,etc.,orinanyShoreland‐wetland.
(11) VehicleSigns. Allvehicles,whetheroperableorinoperableareprohibitedfrombeingused
fortheplacementofsignsforanykindofadvertisement.

17.72TYPESOFSIGNS.(1) Type1.Directorysignsadvertisingabusinessoractivityconducted,anareaofinterestora
serviceavailableataspecificlocation. Suchsignsshallbenotmorethan32sq.ft. ingrossarea. There shall not be more than 2 such signs relating to any one such use in theapproaching direction along any one highway. No such sign shall bemore than 10milesawayfromthelocationtowhichitrelates.Suchsignsmaybeplacedattheright‐of‐waylineofthehighway.AlargernumberofsignsmaybepermittedbytheBoardofAdjustmentiftheBoardshallfinditnecessaryfordirectingthetravelingpublic. Type1signsareallowedintheB‐1,B‐2,M‐1,M‐2,M‐4,A‐1,A‐2andC‐1districts.
(2) Type2. Signsadvertisingacustomaryhomeoccupationorprofessionaloffice. Suchsigns
shallnotexceed6sq. ft. ingrossarea,shallbeattachedtothebuilding,and if illuminated,shallbeindirectlylighted.Type2signsareallowedintheR‐1,R‐2,R‐3,R‐4,B‐1,B‐2,M‐1,M‐2,M‐4andA‐1districts.ApermitisnotrequiredforType2signs.
(3) Type3.Thefollowingsignsaretobeplacedinthefrontyardoftheeffectedproperties,and
areallowedwithoutapermit.(a) Government signs. Signs of a public, non‐commercial nature, including, but not
limited to, safety signs, trespassing signs, traffic control signs, scenic or historicalsigns,memorialplaques,andcommunityservicesigns.Signsshallnotexceed6sq.ft.
(b) Integralsigns. Signsattachedtobuildingsorstructures,whichnamethebuilding,
dateofconstructionandcommemorativeactions.
(c) Campaignsigns.Electioncampaignorreferendumsignsmaybeplacedonthefirstday for circulation of nomination papers or the period beginning on the day onwhichthequestionstobevoteduponaresubmittedtotheelectorateandshallberemoved within 24 hours after the day of election or vote on a referendum. Inresidentialdistricts,nosignmaybeelectrical,mechanicalorhaveanaudioauxiliary.Signsshallnotexceed6sq.ft.
(d) Nameplates. One sign, which states the owner’s name, address, and a home
occupationorfarm,relatedbusiness.Signshallnotexceed20sq.ft.
(e) Holidaysigns.SignsordisplayswhichcontainordepictonlyamessagepertainingtoaNationalorStateHoliday,displayedforaperiodofnottoexceedsixtydays.
(f) Construction signs. Non‐illuminated signs naming the architects, engineers,
contractors, and other individuals or firms included with the construction,alterationorrepairofastructureandthefutureuseofthesite.Suchsignsshallbeconfined to the construction site and shall be removed when the project iscompleted or occupancy of the structure, whichever comes first. Sign shall notexceed64sq.ft.
(g) RealEstatesigns.Signsadvertisingthesaleorrentofthepropertyuponwhichthe
signisplaced.Intheeventofasaleorrentalagreement,thesignmustberemovedwithin10days.Suchsignshallnotmeasuremorethan6sq.ft.intheR‐1,R‐2,R‐3,orR‐4district,normorethan20sq.ft.inallotherdistricts.
(h) Trespassingsigns.Signswhichindicatethealloweduseofprivateproperty,suchas
NoTrespassing;NoHunting;orHuntingbyPermissiononly;pertermsofStateLawastofrequencyandsize.

(i) SeasonalAgriculturalProductsigns.
(j) AgriculturalTestPlotSigns. Agriculturaltestplotsignsshallbeallowedunderthefollowingconditions:1. Onesignfacingeachdirection2. Signshallnotexceed32sq.ft.andarepermittedduringthegrowingseason
andshallberemovedafterharvest.3. Rowmarkersandvarietymarkerspermittedasnecessary.
(k) OccasionalYardSalesign. Onesign isallowed,shallnotexceed6sq. ft.,andshallnotbeplacedmorethanonedaypriortothesaleandremovedattheendofthesale.
(l) Subdivisionsigns.Signsareallowedfortractscontaining10‐50ormorelots.Signs
shallbe32sq.ft.insizeorless,andeachsubdivisioncanhaveamaximumof2suchsigns. The sign can be placed after the final plat has been recorded andmust beremovedafter90%ofthelotsaresold.
(m) Community events. Such as banners, which are printed by groups, including
Chamber of Commerce, local governments, church groups, etc., are permitted andmustconformtoStateAdministrativeCode.
Type3signsareallowedinallzonedistricts.(4) Type 4. Signs/Billboards advertising a general brand or product, an area of interest, a
businessconductedoraserviceavailable.Suchsignsshallbeerectedoutsideandparalleltotheright‐of‐wayline,andmeetthefollowing:
(a) Back‐to‐backsignsthatareparalleltoeachotherandwithin3feetareconsideredas
onesignandoneface.
(b) Ifthefacesarenotparallel,theangleshallnotexceed45degrees,andonepointofboth sides must be within the 3‐foot distance. If the angle is greater than 45degrees,theboardswillbeconsideredseparatefortotalareacalculations.Thesignmustbeorientatedonthesitesothatonlyonefaceisvisiblefromtheapproachingright‐of‐way.
(c) Advertisingsignsshallnotexceed288sq.ft.perfaceor576sq.ft.oftotalarea,nor
shalltheheightexceed35'.Noadvertisingsignshallexceed45'inlength.
(d) There shall be a minimum of 300 feet of separation between signs on the samestreetfacingthetrafficflow.
(e) Nopartofanadvertisingsignshallbecloserthanfive(5)feettothepropertylines.
Onlyincludessideyardandrearyardsetbacks.
(f) No advertising sign shall be erected ormaintainedwith 100 feet of a residential,agriculturalorforestrydistrictboundary,orwithin500feetofapublicpark.
Type4signsareallowedintheB‐1,B‐2,M‐1,M‐2,andM‐4districts.(5) Type5. Signsattachedtocommercialandindustrialadvertisingabusinessconductedora
serviceavailableonthepremises.Nosignshallexceed40sq.ft.ingrossarea;behigherthan4 feetabovethetopof theroofline,orexceedthemaximumheight limitationpermitted inthedistrict.Type5signsareallowedintheB‐1,B‐2,M‐1,M‐2,M‐4,andA‐ldistricts.

(6) Type6. On‐premises signs. Advertisingapublicor semi‐publicuse. Suchsignsshallnot
exceed32sq.ft.ingrossarea.Thereshallbenomorethanonesignforeachhighwayuponthepropertyfaces.Suchsignsmaybeplacedattheright‐of‐waylineofthehighway.Type6signsareallowedinallthedistricts.
(7) Type7. Recreationaldirectorysignsindicatingthedirectiontoacottage,resort,residence
orsimilaruse. Suchsignsshallbenotmorethan4sq. ft. ingrossarea. Whereacommonposting standard isprovided, all such signs shall be attached to the standard recreationaldirectorysignsandmaybeplacedattheright‐of‐waylineofthehighway.Type7signsareallowedinalldistrictsexcepttheR‐1orR‐2district.
17.73 PERMITS. Unless specifically stated in this Ordinance, permits are required for all signs erected,
constructed, enlarged or otherwisemodified. Application for a Sign Permit shall bemade to theZoning Department. Permits shall be issued if the proposed signmeets the requirements of thisChapter.
17.74 CONDITIONALUSE.AnyproposedsignwhichdoesnotmeettheprovisionsofthisChapter,willonly
beapprovedbyfollowingtheConditionalUseprocessinSection17.35ofthisOrdinance.17.75 NON‐CONFORMINGSIGNS.
(1) Legalnon‐conformingsignsmaynotbestructurallyalteredorenlargedexceptinaccordancewiththisChapterorreestablishedafterbeingbroughtintocompliance.
(2) NothinginthisChaptershallbeconstruedasrelievingtheownerofalegalnon‐conforming
signfromtheprovisionsofthisChapterregardingsafety,maintenance,andrepairofsigns.However,nochangeinthesignstructureorcopyshallbemadewhichmakesitmorenon‐conforming.

NON‐CONFORMINGUSES17.80NONCONFORMINGUSES.
(1) The following shall apply toall buildingsor structureswhichhouse anonconforminguse,exceptforsuchnonconformingusesareotherwiseregulatedandcontrolledbytheJacksonCountyShorelandOrdinanceandtheJacksonCountyFloodplainOrdinance.(a) Structuralalterationsorstructuralrepairsofanexistingbuildingorstructurewhich
housesanonconforminguseshallbeauthorizedbyalandusepermit.
(b) Additions to an existing building or an existing structure which houses anonconforming use shall be authorized only by a conditional use permit. Suchadditions shall comply with all applicable setbacks and other dimensionalrequirementsofthisordinance,unlessavarianceisgrantedbytheJacksonCountyBoardofAdjustment.
(c) If a structure which houses a nonconforming use is destroyed by fire, materially
damaged, explosion, storm damage, or other disaster, such structure may berestored and the nonconforming usemay be restored therein, upon issuance of alandusepermit. Such restoration shall not exceed the original building area andvolume, unless a conditional use permit is authorized. If the original structurewhichhoused thenonconforminguse is also a nonconforming structure, then theprovisionsofSection17.81shallalsoapply.
(2) Change of use. A nonconforming use shall not be changed to any use other than a usepermittedinthezoningdistrictinwhichitislocated.
(3) Discontinuance.Whereanysuchnonconforminguseisdiscontinuedforaperiodoftwelve(12)consecutivemonths,anyfutureuseofthebuilding,structureor landshallconformtotheregulationsofthedistrictinwhichitislocated.
17.81NONCONFORMINGSTRUCTURES.
(1) AlterationsandadditionsexceptthealterationsandadditionstostructuresregulatedbytheJackson County Shoreland Ordinance and the Jackson County Floodplain Ordinance shallmeetthefollowingprovisions:(a) Structuralalterationsorstructuralrepairsofnonconformingstructuresshallmeet
alltheprovisionsofthisordinance,exceptthatsuchalterationsorrepairsneednotcomplywiththesetbackoryardprovisionsofthisordinance,providedtheydonotresultinanincreaseinfloorareanorchangethefootprintofthestructure.
(b) Additionstoorextensionsofnonconformingstructuresarepermittedprovidedthatsuch additions or extensions comply with all the provisions of this ordinance.Additionsorextensionsofnonconformingstructuresalongpublichighwayswheresuch structure and public highway existed prior to the effective date of thisordinancearepermittedprovidedthatsuchadditionsorextensionsdonotextendfurthertowardthepublichighwaythantheexistingstructure.
(c) A conforming use in a nonconforming structure may be changed to anotherconformingusewithoutcomplyingwiththesetbackoryardrequirementsoftheseregulationsprovidedthenewconformingusedoesnotresultinanincreaseinfloorarea nor change the footprint of the structure, and provided that all parking andothersiterequirementsaremet.
(d) Highway projects. When a structure becomes a nonconforming structure as to

setbackfromahighway,becausethehighwaywaswidenedorrelocatedorchangedin jurisdiction by the County, a Township, or the Wisconsin Department ofTransportation, such structure shall not require a variance and shall not beconsidered a nonconforming structure in regards to setback from a highway.Howevernosuchstructureshallthereafterbeenlargedorrebuiltinsuchamannerthatitwillbeclosertotheright‐of‐wayofthehighway.
(2) Repairsandrestorationsexceptthealterationsandadditionstostructuresregulatedbythe
Jackson County Shoreland Ordinance and the Jackson County Floodplain Ordinance shallmeetthefollowingrequirements:(a) Anonconformingstructure that isdamagedordestroyedby fire,explosion, storm
damageorsimilarcalamity,mayberepairedorrestoredprovidedeither:1. The repair or restorationwouldbring the structure into compliancewith
thisordinance;or2. The repair or restoration of the nonconforming portion of the structure
occurs fullywithin the building footprint of the structure before damageandthere isno increase inthe floorareaof thenonconformingportionofthe structure and repair or restoration takes place within twelve (12)monthsofbeingdamaged.
(b) Exceptforhistoricbuildings,norepairsorrestorationofnonconformingstructuresshallbelocatedwithinanypublicright‐of‐way.
17.82SUBSTANDARDLOTS.
(1) USEOFSUBSTANDARDLOTSFORADWELLING.Alotwhichdoesnotcontainsufficientareatoconformto thedimensionalrequirementsof thischapter,butwhich isat least60'wideand7,200sq.ft.inareafortheR‐1ResidentialDistrictandatleast100’wideand20,000sq.ft. in theR‐2,R‐3andR‐4ResidentialDistricts,maybeusedasabuildingsite forasinglefamilydwellinguponissuanceofazoningpermitsubjecttotheconditionslistedinsub.(2).
(2) CONDITIONSATTACHEDTOUSEOFSUBSTANDARDLOTS.
(a) Suchuseispermittedinthezoningdistrict.
(b) ThelotisofrecordintheCountyRegisterofDeeds'officepriortotheeffectivedateofthischapter.
(c) The lot is in separate ownership from abutting lands. If abutting lands and the
substandardlotareownedbythesameowner,thesubstandardlotshallnotbesoldorusedwithoutthefullcompliancewiththetermsofthischapter.
(d) Allthedistrictrequirementsarecompliedwithinsofaraspractical.
(3) USEOF SUBSTANDARD LOTS FOROTHERPURPOSES. All other uses of substandard lotsshallrequireavariancefromtheBoardofAdjustmentsubjecttotheconditionslistedinsub.(2).

PERFORMANCESTANDARDS17.85 COMPLIANCE. This chapter permits specific uses in specific districts and these performance
standardsaredesignedtolimit,restrictandprohibittheeffectsofthoseusesoutsidetheirpremisesor district. No structure, land or water shall hereafter be used, except in compliance with theirdistrictregulationsandwiththefollowingrequirementsoftheStateofWisconsin.
17.86 AIRPOLLUTION. No activity shall emit any fly ash, dust, fumes, vapors, mists or gases in such
quantitiesastocausesoilingordangertothehealthofpersons,animals,vegetationorotherformsofproperty.
17.87 FIREANDEXPLOSIVEHAZARDS.Allactivitiesinvolvingthemanufacturing,utilization,processing
or storage of inflammable and explosivematerials shall be providedwith adequate safety devicesagainst the hazard of fire and explosion and with adequate firefighting and fire suppressionequipment and devices that are standard in the industry. Allmaterials that range from active tointenseburning shallbemanufactured,utilized,processedandstoredonly in completelyenclosedbuildingswhichhaveincombustibleexteriorwallsandanautomaticfireextinguishingsystem.
17.88 GLAREANDHEAT. No activity shall emit glare or heat that is visible ormeasurable outside its
premises, except activities in theM‐2District,whichmay emitdirect or sky reflected glarewhichshall not be visible outside their district. All operations producing intense glare or heat shall beconductedwithinacompletelyenclosedbuilding.Exposedsourcesoflightshallbeshieldedsoasnottobevisibleoutsidetheirpremises.
17.89 LIQUIDORSOLIDWASTES.Noactivityshalldischargeatanypointontoanylandorintoanywater
orpublicseweranymaterialsofsuchnature,quantity,noxiousness, toxicityor temperaturewhichcancontaminate,polluteorharmthequantityorqualityofanywatersupply,causetheemissionofdangerous or offensive elements, overload the existing municipal utilities or injure or damagepersonsorproperty.
17.90 NOISE. All noise shall be somuffled or otherwise controlled as not to become objectionable due
intermittence,duration,beatfrequency,impulsecharacter,periodiccharacterorshrillness.17.91 ODORS. No activity shall emit any odorousmatter of such nature or quantity as to be offensive,
obnoxiousorunhealthfuloutsidetheirpremises.17.92 RADIOACTIVITY AND ELECTRICAL DISTURBANCES. No activity shall emit radioactivity or
electrical disturbances outside its premises that are dangerous or adversely affect the use ofneighboringpremises.
17.93 VIBRATION. No activity in any district, except theM‐2 District, shall emit vibrations, which are
discerniblewithoutinstrumentsoutsideitspremises.

ADMINISTRATION17.95CREATION,POWERSANDDUTIES.
(1) ZONINGADMINISTRATOR.(a) The duties shall be to administer, supervise and enforce the provisions of this
chapter.
(b) TheZoningAdministratorshallmakeanannualreportofhisactivitiestotheZoningCommittee.
(c) The Zoning Administrator shall assist the applicant in preparing his application,
advise the applicant as to the provisions of this chapter, inspect each project forwhichapermithasbeengrantedandreportanyapparentviolationtotheDistrictAttorneyorCorporationCounsel.
(2) COUNTYZONINGCOMMITTEE.
(a) TheZoningandLandInformationCommitteeoftheCountyBoardshalloverseetheadministrationofthischapterinaccordancewith59.97(2)(a),Wis.Stats.andtothisendshallmeetatleastonceeachyear.
(b) Intheeventofavacancy,theChairmanofsuchBoardmayappointanymemberof
theCountyBoardtosuchCommittee,whosetermshallnotextendbeyondthenextregularorspecialmeetingoftheCountyBoard,whereupontheCountyBoardshallelectasmanyofitsmembersasmaybenecessarytofillsuchvacancies.Committeememberssoelectedshallperformsuchdutiesuntiltheirsuccessorsareelected.
17.96BOARDOFADJUSTMENT.
(1) POWERSOFTHEBOARD.TheChairmanoftheCountyBoardisherebydirectedtoappointaBoard of Adjustment according to 59.99,Wis. Stats. consisting of 5members,which shallhavethefollowingdutiesandpowers:(a) It shall hear and decide appeals where it is alleged there is error in any order,
requirement, decision or determinationmade by an administrative official in theenforcementoradministrationofthischapter.
(b) It may authorize upon appeal in specific cases a variance from the terms of this
chapter as will not be contrary to the public interest, where owing to specialconditions a literal enforcement of the provisions of this chapter will result inunnecessaryhardship and so that the spirit of this chapter shall be observed andsubstantialjusticedone.Novarianceshallhavetheeffectofallowinginanydistrictusesprohibitedinthatdistrict.
(2) APPEALSOFTHEBOARD.AppealstotheBoardofAdjustmentmaybetakenbyanyperson
aggrieved or by an officer, department, board or bureau of themunicipality affected by adecisionofanyotheradministrativeofficer.SuchappealshallbetakenwithinareasonabletimeasprovidedbytherulesoftheBoardbyfilingwiththeofficerfromwhomtheappealistakenandwith theBoardofAdjustmentanoticeofappealspecifyingthegroundsthereof.TheofficerfromwhotheappealistakenshallforthwithtransmittotheBoardallthepapersconstitutingtherecorduponwhichtheactionappealedfromwastaken.
(3) HEARINGAPPEALS.
(a) TheBoardofAdjustmentshall fixa reasonable time forhearingof theappealandpublishaClassIInoticethereofunderCh.985,Wis.Stats.specifyingthedate,timeandplaceofhearingandthematterstocomebeforetheBoard,aswellasgivedue

notice of hearing to such party at the last known address and decide the samewithin a reasonable period of time. Upon the hearing, any party may appear inperson,byagentorbyattorney.
(b) The Board of Adjustment shall adopt such rules, as it deems necessary for the
conductofbusinessandmayexerciseallofthepowersandisvestedwithallofthedutiesconferredonsuchboardsby59.99,Wis.Stats.
17.97CHANGESANDAMENDMENTS.
(1) TheCountyBoardmay fromtime to timeamend,supplement,orchangebyordinancetheboundariesofthedistrictsorregulationshereinestablished.Anyproposedchangeshallfirstbe submitted to the Zoning and Land Information Committee which shall hold a publichearingthereon.NoticeofthetimeandplaceofsuchhearingshallbegivenbypublicationintheCountylegalpaperasaClassIInoticeunderCh.985,Wis.Stats. Acopyofeachnoticeshall be mailed by registered mail to the town clerk of each township affected by theproposedamendmentatleastten(10)dayspriortothedateofsuchhearing.
(2) An application for a rezone petitionwhich has been afforded full due process of the lawcannotberesubmittedorreappliedforunlessthefollowingconditionsaremet:(a) Thepetitionwas legallywithdrawn from either the Zoning andLand Information
Committee’s or County Board’s agenda prior to a recommendation or vote beingtaken.
(b) Anapplicantmustdelayarezoningreapplicationforsix(6)monthsfromthetimeoflegalwithdrawalfromalegallypublishedagenda.
17.98FAIRANDOPENHOUSING.
WHEREAS,JacksonCountyrecognizesitsresponsibilitiesunderSection106.04,WisconsinStatutes,asamended,andendorsestheconceptsof fairandopenhousingforallpersonsandprohibitionofdiscriminationtherein;
THEREFORE,BEITORDAINEDTHAT:
1) The Board of Supervisors of Jackson hereby adopts Section 106.04, WisconsinStatutes,asamended,(1996)andallsubsequentamendmentsthereto.
2) The officials and employees of Jackson shall assist in the orderly prevention and
removalofalldiscriminationinhousingwithintheJacksonCountybyimplementingthe authority and enforcement procedures set forth in Section 106.04,WisconsinStatutes,asamended.
3) The County Clerk shall maintain forms for complaints to be filled under Section
106.04, Wisconsin Statutes, as amended, and shall assist any person alleging aviolation thereof in Jackson to file a complaint there under with the WisconsinDepartmentofWorkForceDevelopment,EqualRightsDivision,forenforcementofSection106.04,WisconsinStatutes,asamended.
106.04EqualRights
(1) INTENT.Itistheintentofthissectiontorenderunlawfuldiscriminationinhousing.Itisthedeclared policy of this state that all persons shall have an equal opportunity for housingregardlessofsex,race,color,sexualorientation,disability,religion,nationalorigin,maritalstatus, family status, lawful source of income, age or ancestry and it is the duty of thepoliticalsubdivisionstoassistintheorderlypreventionorremovalofalldiscriminationin

housing through thepowersgrantedunderss.66.432and66.433. The legislatureherebyextends the state law governing equal housing opportunities to cover single‐familyresidences, which are owner‐occupied. The legislature finds that the sale and rental ofsingle‐familyresidencesconstituteasignificantportionofthehousingbusinessinthisstateandshouldberegulated. Thissectionshallbedeemedanexerciseofthepolicepowersofthe state for the protection of thewelfare, health, peace, dignity and human rights of thepeopleofthisstate.
(1m) DEFINITIONS.Inthissection:
(ad) ADVERTISEmeanstopublish,circulate, issueordisplay,orcausetobepublished,circulated,issuedordisplayed,anycommunication,notice,advertisementorsigninconnectionwiththesale,financingorrentalofhousing.
(am) AGE,inreferencetoamemberofaprotectedclass,meansatleast18yearsofage.
(b) AGRIEVED PERSON means a person who claims to have been injured by
discrimination in housing or believes that he or she will be injured bydiscriminationinhousingthatisabouttooccur.
(c) COMPLAINANT means a person who files a complaint alleging discrimination in
housingorpublicplaceofaccommodationoramusement.
(d) CONCILIATIONmeans theattemptedresolutionof issuesraisedbyacomplaintorby the investigationof the complaint, through informal negotiations involving theaggrievedperson,thecomplainant,therespondentandthedepartment.
(e) CONDOMINIUMhasthemeaninggivenins.703.02(4).
(f) CONDOMINIUMASSOCIATIONmeansanassociation,asdefinedins.703.02(lm).
(g) DISABILITYmeansaphysicalormentalimpairmentthatsubstantiallylimitsoneormore major or life activities, a record of having such an impairment or beingregardedashavingsuchan impairment. "Disability"doesnot include thecurrentillegal use of a controlled substance, as defined in s. 961.01 (4), or a controlledsubstanceanalog,asdefinedins.961.01(4m),unlesstheindividualisparticipatinginasuperviseddrugrehabilitationprogram.
(h) DISCRIMINATEmeanstosegregate,separate,excludeor treatapersonorclassof
personsunequally inamannerdescribed in sub. (2), (2m)or (2r)becauseof sex,race, color, sexual orientation, disability, religion, national origin, marital status,familystatus,lawfulsourceofincome,ageorancestry.
(i) DWELLINGUNITmeansastructureorthatpartofstructurethatisusedorintended
tobeusedasahome, residenceor sleepingplacebyonepersonorby2ormorepersonswhoaremaintainingacommonhousehold,totheexclusionofallothers.
(j) FAMILYincludesonenaturalperson.
(k) FAMILY STATUS means any of the following conditions that apply to a personseekingtorentorpurchasehousingortoamemberorprospectivememberoftheperson'shouseholdregardlessoftheperson'smaritalstatus:1. Apersonispregnant.

2. Apersonisintheprocessofsecuringsoleorjointlegalcustody,periodsof

or her legal custody or physical placement or with whom he or she hasvisitationrights.
5. Aperson'shouseholdincludesoneormoreadultsorminorchildrenplaced
in his or her care under a court order, under a guardianship orwith thewrittenpermissionofaparentorotherpersonhavinglegalcustodyoftheadultorminorchild.
(km) HARDSHIPCONDITIONmeansasituationunderwhichatenantinhousingforolder
personshaslegalcustodyorphysicalplacementofaminorchildoraminorchildisplaced in the tenant's careunder a court order, under a guardianshiporwith thewrittenpermissionof a parentorotherpersonhaving legal custodyof theminorchild.
(l) HOUSINGmeansanyimprovedproperty,oranyportionthereof,includingamobile
homeasdefinedins.66.058(1)(d)orcondominium,thatisusedoroccupied,orisintended, arranged or designed to be used or occupied, as a home or residence."Housing" includes any vacant land that is offered for sale or rent for theconstructionorlocationthereonofanybuilding,structureorportionthereofthatisusedoroccupied,orisintended,arrangedordesignedtobeusedoroccupied,asahomeorresidence.
(m) HOUSINGFOROLDERPERSONSmeansanyofthefollowing:
1. Housing provided under any state or federal program that the secretarydetermines isspecificallydesignedandoperatedtoassistelderlypersons,asdefinedinthestateorfederalprogram.
2. Housingsolelyintendedfor,andsolelyoccupiedbypersons62 yearsofageorolder.
3. Housing primarily intended and primarily operated for occupancy by atleastoneperson55yearsofageorolderperdwellingunit.
(mm) INTERED PERSONmeans an adult relative or friend of amember of a protected
class,oranofficialorrepresentativeofaprivateagency,corporationorassociationconcernedwiththewelfareofamemberofaprotectedclass.
(n) LODGINGESTABLISHMENTmeansanyofthefollowing:
1. Abedandbreakfastestablishment,asdefinedins.254.61(1).2. Ahotel,asdefinedins.254.61(3).3. Atouristroominghouse,asdefinedins.254.61(6).4. Acampground.

(nm) MEMBEROFAPROTESTEDCLASSmeansagroupofnaturalpersons,oranaturalperson, who may be categorized based on one or more of the followingcharacteristics:sex,race,color,disability,sexualorientationasdefinedins.111.32(13m), religion, national origin, marital status, family status, lawful source ofincome,ageorancestry.
(om) POLITICALSUBDIVISIONmeansacity,village,townorcounty.
(p) 1. PUBLICPLACEOFACCOMMODATIONORAMUSMENTshallbeinterpreted broadly to include,butnotbe limited to,placesofbusinessor recreation;
lodging establishments; restaurants; taverns; barber or cosmetologist,aesthetician, electrologist or manicuring establishments; nursing homes;clinics; hospitals; cemeteries; and any place where accommodations,amusement, goods or services are available either free or for aconsideration,subjecttosubd.2.
2. PUBLICPLACEOFACCOMMODATIONORAMUSEMENTdoesnotincludea
place where a bona fide private, nonprofit organization or institutionprovidesaccommodations, amusement, goodsor servicesduringaneventin which the organization or institution provides the accommodations,amusement,goodsorservicestothefollowingindividualsonly:
a. Membersoftheorganizationorinstitution. b. Guestsnamedbymembersoftheorganizationor institution. c. Guestsnamedbytheorganizationorinstitution. (q) RELATIVEmeansaparent,grandparent,great‐grandparent,stepparent,step
grandparent, brother, sister, child, stepchild, grandchild, step grandchild, great‐grandchild, first cousin, 2nd cousin, nephew, niece, uncle, aunt, stepbrother,stepsister, half‐brother or half‐sister or any other person related by marriage,consanguinityoraffinity.
(r) RENTmeanstolease,tosublease,toletortootherwisegrantoraconsiderationthe rightofatenanttooccupyhousingnotownedbythetenant.
(s) RESPONDENTmeans thepersonaccused ina complaintoramendedcomplaintofdiscrimination in housing and any other person identified in the course of aninvestigationasallegedlyhavingdiscriminated inhousingor inprovidingapublicplaceofaccommodationoramusement.
(t) SEXUALORIENTATIONhasthemeaninggivenins.111.32(13m). (u) SIGNIFICANTFACILITIESANDSERVICESSPECIFICALLYDESIGNEDTOMEETTHE
PHYSICALORSOCIALNEEDSOFOLDERPERSONSincludessocialandrecreationalprograms; continuing education; information and counseling; recreational,homemaker, outside maintenance and referral services; an accessible physicalenvironment; emergency and preventive health careprograms; congregatediningfacilities;transportationtofacilitateaccesstosocialservices;andservicesdesignedtoencourageandassistresidentstousetheservicesandfacilitiesavailabletothem.
(1s) DEPARTMENTTOADMINISTER.Thissectionshallbeadministered

by the department through its division of equal rights. The department maypromulgate such rules as are necessary to carry out this section. No rule mayprohibit theprocessingofanyclassactioncomplaintor theorderingofanyclass‐based remedy, or may provide that complaints may be consolidated foradministrativeconvenienceonly.
(2) DISCRIMINATIONPROHIBITED.Itisunlawfulforanypersontodiscriminate:
(a) Byrefusingtosell, rent, financeorcontract toconstructhousingorbyrefusingtonegotiateordiscussthetermsthereof.
(b) Byrefusingtopermitinspectionorexactingdifferentormorestringentprice,terms
orconditionsforthesale,lease,financingorrentalofhousing.(c) Byrefusingtofinanceorsellanunimprovedresidentiallotortoconstructahome
orresidenceuponsuchlot.(d) By advertising in a manner that indicates discrimination by a preference or
limitation.(e) Forapersoninthebusinessofinsuringagainsthazards,byrefusingtoenterinto,or
by exacting different terms, conditions or privilegeswith respect to, a contract ofinsuranceagainsthazardstoadwelling.
(f) Byrefusingtorenewalease,causingtheevictionofatenantfromrentalhousingor
engagingintheharassmentofatenant.(g) Inprovidingtheprivileges,servicesorfacilitiesthatareavailableinconnectionwith
housing.(h) Byfalselyrepresentingthathousingisunavailableforinspection,rentalorsale.(i) Bydenyingaccessto,ormembershiporparticipationin,amultiplelistingserviceor
otherrealestateservice.(j) Bycoercing,intimidating,threateningorinterferingwithapersonintheexerciseor
enjoyment of, or on account of his or her having exercised or enjoyed, a rightgranted or protected under this section, or with a person who has aided orencouraged another person in the exercise or enjoyment of a right granted orprotectedunderthissection.
(k) Inmakingavailableanyofthefollowingtransactions,orinthetermsorconditions
of such transactions for apersonwhosebusiness includes engaging in residentialrealestate‐relatedtransactions:1. The making or purchasing of loans or the provision of other financial
assistance for purchasing, constructing, improving, repairing ormaintaininghousingorthemakingorpurchasingofloansortheprovisionofotherfinancialassistancesecuredbyresidentialrealestate.
2. Selling,brokeringorappraisingresidentialrealproperty.
(l) Byotherwisemakingunavailableordenyinghousing.(2m) REPRESENTATIONSDESIGNEDTOINDUCEPANICSALES.Nopersonmayinduceorattempt

to induce a person to sell or rent housing by representations regarding the present orprospective entry into the neighborhood of a person of a particular economic status or amember of a protected class, or by presentations to the effect that such present orprospectiveentrywillormayresultinanyofthefollowing:
(a) Theloweringofrealestatevaluesintheareaconcerned.(b) Adeteriorationinthecharacteroftheareaconcerned.(c) Anincreaseincriminalorantisocialbehaviorintheareaconcerned.(d) Adeclineinthequalityoftheschoolsorotherpublicfacilitiesservingthearea.
(2r) DISCRIMINATIONAGAINSTPERSONSWITHDISABILITIESPROHIBITED. (a) Definitions.Inthissubsection:
1. ACCESSIBLEmeansabletobeapproachedenteredandusebypersonswithdisabilities.
2. ACCESSIBLEROUTEmeansacontinuous,unobstructedpath connecting accessible elements and spaces in a building, within a site or
fromasitetoavehicularroutethatcanbenegotiatedbyallpersonswithadisability.
3. ANSI A117.1means the 1986 edition of the American national standards
institute's code for buildings and facilities providing accessibility andusabilityforphysicallyhandicappedpeople.
4. COVEREDMULTIFAMILYHOUSINGmeansanyofthefollowing:
a. Housing that is first ready for occupancy on or after October 1,1993,consistingof3ormoredwellingunitsifthehousinghasoneormoreelevators.
b. Grade‐level dwelling units, in housing without elevators that are
firstreadyforoccupancyonorafterOctober1,1993,consistingof3ormoredwellingunits.
5. REMODELLINGmeanstosubstantially improve,alter,extendorotherwise
changethestructureofabuildingorchangethelocationofexits,butshallnot include maintenance, redecoration, reroofing or alteration ofmechanicalorelectricalsystems.
6. VEHICULARROUTEmeansarouteintendedforvehiculartrafficincluding, butnotlimitedto,astreet,drivewayorparkinglot. (b) Typesofdiscriminationprohibited.Inadditiontodiscriminationprohibitedunder subs.(2)and(2m),nopersonmaydoanyofthefollowing: 1. Segregate,separate,excludeortreatunequallyinthesaleorrentalof,or
otherwisemakeunavailableordeny,housingtoabuyerorrenterbecauseofadisabilityofthatbuyerorrenter,adisabilityofapersonresidinginorintendingtoresideinthathousingafteritissold,rentedormadeavailableoradisabilityofapersonassociatedwiththatbuyerorrenter.
2. Segregate, separate, exclude or treat unequally a person in the terms,

conditions or privilege of sale or rental of housing, or in the provision ofservicesorfacilitiesinconnectionwithsuchhousing,becauseofadisabilityofthatperson,adisabilityofapersonresidinginorintendingtoresideinthat housing after it is sold, rented ormade available or a disability of apersonassociatedwiththatperson.
3. Refuse to permit, at the expense of a personwith adisability, reasonable
modificationsofexistinghousingthat isoccupied,or is tobeoccupied,bysucha person if themodificationsmaybenecessary to afford thepersonfullenjoymentofthehousing,exceptthatinthecaseofrentalhousingthelandlordmay,where it is reasonable to do so, conditionpermission for amodification on the tenant's agreement to restore the interior of thehousing to the condition that existed before themodification, other thanreasonablewearandtear.Thelandlordmaynotincreaseanycustomarilyrequiredsecuritydeposit.Whereitisnecessarytoensurethatfundswillbeavailabletopayfortherestorationsattheendofthetenancy,thelandlordmay negotiate as part of a restoration agreement a requirement that thetenant pay into an interest‐bearing escrow account, over a reasonableperiod, a reasonable amount of money not to exceed the cost of therestorations.Theinterestinanysuchaccountshallaccruetothebenefitofthetenant.Ifescrowedfundsarenotusedbythelandlordforrestorations,theyshallbereturnedtothetenant.
4. Refusetomakereasonableaccommodations inrules,policies,practicesor
servicesthatareassociatedwiththehousing,whensuchaccommodationsmaybenecessarytoaffordthepersonequalopportunitytouseandenjoyhousing, unless the accommodationwould impose an undue hardship ontheownerofthehousing.
(bm) Animalsassistingpersonwithdisabilities.
1. Ifanindividual'svision,hearingormobilityisimpaired,itisdiscriminationfor a person to refuse to rent or sell housing to the individual, cause theevictionoftheindividualfromhousing,requireextracompensationfromanindividualasaconditionofcontinuedresidenceinhousingorengageintheharassment of the individual because he or she keeps an animal that isspecially trained to lead or assist the individual with impaired vision,hearingormobilityifallofthefollowingapply:a. Upon request, the individual shows to the lessor, seller or
representative of the condominiumassociation credentials issuedby a school recognized by the department as accredited to trainanimalsforindividualswithimpairedvision,hearingormobility.
b. The individual accepts liability for sanitationwith respect to, and
damagetothepremisescausedbytheanimal.
2. Subdivision1. doesnot apply in the case of the rental of owner‐occupiedhousingiftheowneroramemberofhisorherimmediatefamilyoccupyingthe housing possesses and, upon request, presents to the individual acertificate signed by a physician which states that the owner or familymemberisallergictothetypeofanimaltheindividualpossesses.
(c) Designandconstructionofcoveredmultifamilyhousing.Inaddition
todiscriminationprohibitedunderpars. (b) and (bm)and subs. (2) and (2m),no

personmaydesignorconstructcoveredmultifamilyhousingunless itmeetsallofthefollowingstandards:1. Thereisatleastoneaccessibleentranceforeachbuildingandthatentrance
isonanaccessibleroute.Allotherentrancesthatareatgradelevelshallbeaccessibletothegreatestextentfeasible.Thedepartmentshallpromulgaterules that define "to the greatest extent feasible" to ensure maximumaccessibilityinawaythatisnotdisproportionatetotheentireproject'scostandscope. Ifthecoveredmultifamilyhousingunitsareatgradelevelandareservedbyseparateentrances,eachunitshallbeonanaccessibleroute.If the units have aminimumnumber of required exits, as determined byrulesthatshallbepromulgatedbythedepartment,allrequiredgrade‐levelexitsshallbeaccessible.
2. Publicandcommonuseareasareaccessibletopersonswithdisabilities.
3. Interiorandexteriordoors, and interiorpassages,aresufficientlywide to
allowpassagebypersonswithdisabilitieswhousewheelchairs.
4. Light switches, electrical outlets, circuit controls, thermostats and otherenvironmental controls are all located in accessible locations;reinforcementsinbathroomwallsareinstalledtoallowlaterinstallationofgrabbarsaround the toilet, tub, showerstallandshowerseat,whensuchfacilities are provided; kitchens and bathrooms allow an individual in awheelchairtomaneuveraboutthespace;and,upontherequestofarenterandwithoutcosttoarenter,leverdoorhandlesareonalldoorsandsinglelever controls, or other controls that are approved by the department byrule,areonallplumbingfixturesusedbyresidents.
(d) Remodeling.
1. Ifmore than50%of the interior square footageofanyhousingwith3ormoredwellingunitsistoberemodeled,theentirehousingshallconformtothestandardsinpar.(c),regardlessofwhenthehousingwasfirstintendedforoccupancy.
2. If25%to50%oftheinteriorsquarefootageofanyhousingwith3ormore
dwelling units is to be remodeled, that part of the housing that is to beremodeledshallconformtothestandardsinpar.(c),regardlessofwhenthehousingwasfirstintendedforoccupancy.
3. If less than 25% of the interior square footage of any housing with 3 or
moredwellingunitsistoberemodeled,theremodelingisnotsubjecttothestandards in par. (c) unless the alteration involves work on doors,entrances,exitsortoiletrooms,inwhichcasethedoors,entrances,exitsortoilet roomsshall conformto thestandards inpar. (c) regardlessofwhenthehousingwasfirstintendedforoccupancy.
4. The department may grant a variance or waiver from the requirements
under thisparagraphrelating toexterioraccessibilityusing thestandardsandproceduresunderpar.(e).
(e) Permitandvarianceprocedures.
1. Plansandspecificationsforallcoveredmultifamilyhousingsubjecttopar.(c) andproposed remodelingsubject topar. (d) shallbe submitted to the

departmentor itsauthorizedrepresentativeforexaminationandapprovalbefore commencing work. The department shall promulgate rules thatspecifythematerialstobeincludedinthesubmittal, theprocedurestobefollowed upon receipt of a submittal, reasonable time limitations forreviewingsubmittalsandissuingordenyingpermitsandqualificationsforauthorizedrepresentatives.
2. The department may grant a variance from the requirements relating to
exterioraccessibilityunderpar. (c)1.or (d),or fromadministrative rulespromulgated under sub. (1s), if the person designing, constructing orremodeling the housing shows that meeting those requirements isimpracticalbecauseoftheterrainorunusualcharacteristicsofthesite.Thedepartment shall use a slope analysis of the undisturbed site for coveredmultifamilyhousingunderpar.(c)ortheexistingsiteforremodelingunderpar.(d)todeterminetheminimumnumberofaccessibleentrancesateachsite,withaminimumgoalof exterioraccessibilityof50%of thedwellingunits of covered multifamily housing at one site. The department mayimpose specific conditions in granting a variance to promote exterioraccessibilityofthehousingtopersonswithdisabilities. If thedepartmentfinds that exterior accessibility is impractical as to all dwelling units at asite,itmaygrantawaiverfromtherequirementsunderpar.(c)1.or(d).
(f) Safeharbor.
1. Exceptasprovidedinsubd.2.,coveredmultifamilyhousingandremodeledhousingareaccessible forpurposesof thissubsection if theycomplywithoneofthefollowing:a. TheapplicablerequirementsofANSIA117.1.b. Final guidelines issued by the federal department of housing and
urbandevelopment,published in the federal registeronMarch6,1991.
c. Anotherstandardthataffordspersonswithdisabilitiesaccessthat
is essentially equivalent toor greater than that requiredbyANSIA117.1.
2. Subdivision1.doesnotapplytoremodeledorcoveredmultifamilyhousing
for which a building permit is issued on or after the first day of the 7thmonth beginning after the effective date of administrative rulespromulgated by the department under this subsection establishing theaccessibilitystandardsfordesignandconstructionunderpar.(c).
(g) Generalpowersanddutiesofdepartment.
1. The requirements under this subsection are in addition to, and do notsupplant, the requirements under s. 101.13 relating to the use of publicbuildingsbypersonswithdisabilities.Anyconflictbetweenthissubsectionands.101.13ortherulespromulgatedunders.101..13shallberesolvedinfavor of theprovision providing the greatest degree of access by personswithdisabilities,asdeterminedbythedepartment.
2. Thedepartmentshallpromulgaterulesestablishingminimumaccessibility
requirements for design and construction of coveredmultifamily housingandtheremodelingofhousingthatareconsistentwiththissubsection,that

incorporatetheapplicablestandardsunderANSIA117.1andthatsetforthpermitandvarianceproceduresforpurposesofpar.(e).
3. Thedepartmentshallpromulgaterulescreatingstandardsforinteriorand
exterior accessibility of grade level portions of multilevel dwelling unitswithout elevators in any housing consisting of 3 or more dwelling unitswith separate exterior entrances. The rules shall ensure that access to agrade‐levelfloorisprovidedtoatleast25%ofthedwellingunitsfirstreadyforoccupancyonoraftertheeffectivedateoftherule.
(5m) EXEMPTIONSANDEXCLUSIONS.
1. Nothing in this section prohibits discrimination based on age or familystatuswithrespecttohousingforolderpersons.
1e. Under this paragraph, housing under sub. (1m) (m) 3, may qualify as
housing for older persons only if the owner of the housing provides thedepartmentwithwrittencertificationthatallofthefollowingfactorsapplytothehousing:a. Thereexistssignificantfacilitiesandservicesspecificallydesigned
tomeet the physical or social needs of older persons under sub.(1m)(m)3.
b. At least 80% of the dwellings units under sub. (1m) (m) 3. are
occupiedbyatleastoneperson55yearsofageorolder.c. Policies are published and procedures are adhered to that
demonstrate intent by the owner ormanager to provide housingundersub.(1m)(m)3.forpersons55yearsofageorolder.
1m. No personmay discriminate by refusing to continue renting to a person
livinginhousingforolderpersonsundersub.(1m)(m)3.whoissubjecttoahardshipcondition.
2. Under this paragraph, housing may qualify as housing for older persons
withrespecttopersonsfirstoccupyingthehousingonorafterSeptember1,1992, regardlessofwhetherapersonwhohadnotattained theageof62resided in thehousingon thatdateorregardlessofwhetheroneormoredwelling units were unoccupied on that date, if the persons who firstoccupythehousingonorafterthatdatehaveattainedtheageof62.
a. Nothinginthissectionshallprohibitapersonfrom
exacting different or more stringent terms or conditions forfinancinghousingbasedon theageof the individualapplicant forfinancing if the termsor conditions are reasonable related to theindividualapplicant.
b. Nothing in this section shall prohibit thedevelopment of housing
designedspecificallyforpersonswithdisabilitiesandpreferenceinfavorofpersonswithdisabilitiesinrelationtosuchhousing.
c. Nothinginthissectionrequiresthathousingbemadeavailableto
anindividualwhosetenancywouldconstituteadirectthreattothesafety of other tenants or persons employed on the property or

whosetenancywouldresult insubstantialphysicaldamagetothepropertyofothers,iftheriskofdirectthreatordamagecannotbeeliminated or sufficiently reduced through reasonableaccommodations. A claim that an individual's tenancy poses adirect threat or a substantial risk of harm or damage must beevidenced by behavior by the individual which caused harm ordamage, which directly threatened harm or damage or whichcaused a reasonable fear of harm or damage to other tenants,personsemployedonthepropertyortheproperty. Noclaimthatan individual's tenancy would constitute a direct threat to thesafety of other persons orwould result in substantial damage topropertymaybebasedonthefactthatatenanthasbeenormaybethevictimofdomesticabuse,asdefinedins.813.12(1)(a).
d. It isnotdiscriminationbasedonfamilystatustocomplywithany
reasonable federal, stateor local government restrictions relatingto the maximum number of occupants permitted to occupy adwellingunit.
(em) 1. Subjecttosubd.2.,nothinginthissectionappliestoadecisionbyan individualastothepersonwithwhomheorshewill,orcontinuesto,share adwellingunit,asdefinedins.101.71(2)exceptthatdwellingunitdoes notincludeanyresidenceoccupiedbymorethan5persons.
2. Any advertisement or written notice published, posted or mailed in
connectionwiththerentalorleaseofadwellingunitundersubd.1.maynotviolate sub. (2) (d), 42 U.S.C. 3604 (c), or any rules or regulationspromulgatedunderthissectionor42U.S.C.3601to3619,exceptthatsuchanadvertisementorwrittennoticemaybeforapersonofthesamesexastheindividualwhoseeksapersontosharethedwellingunitforwhichtheadvertisementorwrittennoticeisplaced.
(f) Nothing in this section prohibits an owner or agent from requiring that a person
whoseekstobuyorrenthousingsupplyinformationconcerningfamilystatusandmarital, financial and business status but not concerning race, color, physicalcondition, disability, sexual orientation, age, ancestry, national origin, religion orcreed.
(6) FAIRHOUSINGADMINISTRATIVEENFORCEMENT.
(a) Complaints. 1. The department may receive and investigate a complaint charging a
violation of sub. (2), (2m) or (2r) if the complaint is filed with thedepartment not later than one year after the alleged discriminationoccurredorterminated.
2. The complaint shall include a written statement of the essential facts
constituting thediscrimination that ischarged,andshallbe signedby thecomplainant.
3. Thecomplaintmaybefiledbyanaggrievedperson,by
aninterestedperson.orbythedepartmentunderpar.(b).Thedepartmentshall,uponrequest,provideappropriateassistanceincompletingandfilingcomplaints.

4. Thedepartmentshallservenoticeontheaggrievedpersonacknowledging
the filingof thecomplaintandadvisingthecomplainantof thetime limitsandchoiceofforumsprovidedunderthissubsectionandtherighttobringaprivatecivilactionundersub.(6m).
5. Uponthefilingofaninitial,amended,finalorsupplementalcomplaint,the
department shall promptly serve a copy of the complaint upon therespondent,exceptwheretestingmaybeconducted.Theinitialcomplaintshall be reserved before the commencement of the investigation by thedepartment, exceptwhere testingmaybe conducted. Thenotice shall besent by certified mail, return receipt requested. The notice to therespondentshallincludeawrittenstatementfromthedepartmentdirectingthe respondent to respond in writing to the allegations in the complaintwithin20days after thedate of thenotice and further stating that, if therespondent fails to answer the complaint inwriting, the departmentwillmake an initial determination as towhether discrimination has occurredbasedonlyonthedepartment'sinvestigationandtheinformationsuppliedbythecomplainant.
6. The department may dismiss the complaint if the complainant fails to
respondtothedepartmentwithin20daysfromthedateofmailingofanycorrespondence from the department concerning the complaint, if thedepartment's correspondence requests a response and if thecorrespondence is sent by certifiedmail, return receipt requested, to thelastknown‐addressofthecomplainant.
(b) Powersanddutiesofdepartment. Thedepartmentand itsdulyauthorizedagents
mayholdhearings,subpoenawitnesses,taketestimonyandmakeinvestigationsasprovided in this subsection. The department may test and investigate for thepurposeofestablishingviolationsofsub.(2),(2m)or(2r)andmaymake,signandfile complaints alleging violationsof sub. (2), (2m)or (2r). Thedepartment shallemploy examiners to hear and decide complaints of discrimination under thissection,andtoassistintheadministrationofthissection.Theexaminersmaymakefindingsandissueordersunderthissubsection.Thedepartmentshalldevelopandimplementaninvestigationmanualforuseinconductinginvestigationsunderpar.(c).
(c) Investigationandfindingofprobablecause.
1. The department shall investigate all complaints that allege a violation ofthissectionandthatarefiledwithinthetimespecifiedunderpar.(a).Thedepartment may subpoena persons or documents for the purpose ofinvestigation.Ifduringaninvestigationitappearsthattherespondenthasengagedindiscriminationagainstthecomplainant,whichisnotallegedinthe complaint, the department may advise the complainant that thecomplaint should be amended. If the complaint is amended, thedepartmentshallalsoinvestigatetheallegationsoftheamendedcomplaint.
2. At the conclusion of the investigation of the allegations, the department
shallmakeadeterminationastowhetherprobablecauseexiststobelievethat discrimination has occurred or is about to occur. In making adetermination of probable cause, the department shall consider whetherthefactsconcerningtheallegeddiscriminationaresufficienttowarrantthe

initiationofacivilaction.Ifthedepartmentdeterminesthatprobablecauseexists, the department shall immediately issue a charge on behalf of theaggrieved person. Service of copies of the charge shall be made on thecomplainant, the respondent and the aggrieved person by certified mail,return receipt requested. When a charge is filed, a complainant, arespondentoranaggrievedpersononwhosebehalfthecomplaintwasfiledmayelecttohavetheclaimsassertedinthatchargedecidedinacivilactionunder sub. (6m) in lieu of a hearing under par. (f). The election shall bemade no later than 20 days after the receipt by the electing person ofservice of the charge, along with information about how to make theelection. If anelection ismade, thepersonmaking theelectionshall givenotice of doing so to the department and to all other complainants andrespondents towhom the charge relates. Thedepartment shall notify theaggrievedpersonsthatanelectionismade.
3. No charge may be issued regarding alleged discrimination after the
beginning of the trial of a civil action commenced by the aggrieved partyunder sub. (6m) or 42 U.S.C. 3613, seeking relief with respect to thatdiscriminatoryact.
4. If the department initially determines that there is no probable cause to
believe that discrimination occurred as alleged in the complaint, it maydismiss those allegations. Thedepartment shall, by anotice tobe servedwith the determination, notify the parties of the complainant's right toappealthedismissaloftheclaimtothesecretaryforahearingontheissueby a hearing examiner. Service of the determination shall be made bycertifiedmail,returnreceiptrequested.Ifthehearingexaminerdeterminesthatnoprobablecauseexists,thatdeterminationisthefinaldeterminationofthedepartmentandmaybeappealedunderpar.(j).
(d) Temporary judicial relief. At any time after a complaint is filed alleging
discrimination in violation of sub. (2), (2m) or (2r), the department may file apetitioninthecircuitcourtforthecountinwhichtheactofdiscriminationallegedlyoccurred or for the county in which a respondent resides or transacts business,seeking a temporary injunction or restraining order against the respondent toprevent the respondent from performing an act that would tend to renderineffectualanorder that thedepartmentmayenterwithrespect to thecomplaint,pendingfinaldeterminationofproceedingsunderthissection.
(e) Conciliation.
1. Upon the filing of a complaint alleging discrimination in violation of sub.(2), (2m) or (2r), the department may endeavor to eliminate thediscriminationbyconference,conciliationandpersuasion.Thedepartmentshallnotifythepartiesthatconciliationservicesareavailable.
2. Conciliation efforts may be undertaken by the department during the
period beginning with the filing of the complaint and ending with thedismissal of the complaint under par. (c) 4. or the issuance of a chargeunderpar.(c)2.
3. If conciliation resolves thedispute, awritten conciliation agreement shall
bepreparedwhichshallstateallmeasurestobetakenbyeachparty.Theagreementmay provide for dismissal of the complaint if the dismissal is

without prejudice to the complainant's right to pursue the complaintagainst any respondent who fails to comply with the terms of theagreement. The agreement shall be signed by the respondent, thecomplainant and the aggrieved person and is subject to approval by thedepartment. Aconciliationagreemententeredintounderthissubdivisionis a public record and is subject to inspection under s. 19.15, unless thepartiestotheagreementrequestthattherecordbeexemptfromdisclosureand the department finds that disclosure is not required to further thepurposesofthissection.
4. Whenever the department has reasonable cause to believe that a
respondent has breached a conciliation agreement, the department shallreferthemattertothedepartmentofjusticewitharecommendationthatacivilactionbefiledforenforcementoftheagreement.
(f) Hearingprocedures.
1. Afterthedepartmentissuesachargeunderpar.(c)2.,thedepartmentshallserve the charge, along with a written notice of hearing, specifying thenature and acts of discriminationwhich appear to have been committed,andrequiringtherespondenttoanswerthechargeatahearingbeforeanexaminer.Thenoticeshallspecifyatimeofhearing,notlessthan10daysafter service of the charge, and a place of hearing within the county inwhichtheviolationisallegedtohaveoccurred.
2. Ifanelectionisnotmadeunderpar.(c)2.,thehearingshallbeconducted
by a hearing examiner. A person, who is aggrieved, with respect to theissuestobedeterminedatthehearing,mayberepresentedbycounsel.
3. The department or a party's attorney of recordmay issue a subpoena to
compel the attendance of a witness or the production of evidence. Asubpoena issuedbyanattorneyshallbe insubstantiallythesameformasprovidedins.805.07(4)andshallbeservedinthemannerprovidedins.805.07(5). Theattorneyshall,at thetimeof issuance,sendacopyof thesubpoena to the hearing examinerwho is responsible for conducting thehearing.
4. The testimony at the hearing shall be recorded by the department.
Discovery shall be conducted as expeditiously and inexpensively aspossible,consistentwiththeneedofallpartiestoobtainrelevantevidence.Thehearingunderthisparagraphshallbeconductedasexpeditiouslyandinexpensively as possible, consistent with the needs and rights of thepartiestoobtainafairhearingandacompleterecord.Theburdenofproofisonthepartyallegingdiscrimination.
5. If after the hearing the examiner finds by a fair preponderance of the
evidence that the respondent has violated sub. (2), (2m) or (2r), theexaminer shall make written findings and order the respondent to takeactions thatwill effectuate thepurposeof sub. (2), (2m)or (2r),andmayorderotherpenalties, damages andcosts asprovided inpars. (h) and (i).Thedepartmentshallserveacertifiedcopyofthefinal findingsandorderon the aggrieved party, the complainant and the respondent. The ordershall have the same force as other orders of the department and beenforcedasprovidedinthissubsectionexceptthattheenforcementofthe

orderisautomaticallystayeduponthefilingofapetitionforreviewunderpar.(j).
6. Iftheexaminerfindsthattherespondenthasnotengagedindiscrimination
asalleged in thecomplaint, thedepartment shall servea certifiedcopyofthe examiner's findings on the aggrieved party, the complainant and therespondent together with an order dismissing the complaint. If thecomplaint isdismissed,costs inanamountnottoexceed$100plusactualdisbursementsfortheattendanceofwitnessesmaybeassessedagainstthedepartmentinthediscretionofthedepartment.
(g) Timelimitations.
1. Thedepartment shall commenceproceedingswith respect toa complaintbeforetheendofthe30thdayafterreceiptofthecomplaint.
2. The department shall investigate the allegations of the complaint and
complete the investigation not later than 100 days after receipt of thecomplaint.Ifthedepartmentisunabletocompletetheinvestigationwithin100days, it shallnotify thecomplainantandrespondent inwritingof thereasonsfornotdoingso.
3. Thedepartmentshallmakefinaladministrativedispositionofacomplaint
within one year after the date of receipt of a complaint, unless it isimpracticabletodoso. Ifthedepartmentisunabletodoso,itshallnotifythecomplainantandrespondentinwritingofthereasonsfornotdoingso.
(h) Damagesandpenalties.
1. Ifthehearingexaminerfindsthatarespondenthasengagedinorisaboutto engage in adiscriminatory act prohibitedunder sub. (2), (2m)or (2r),thehearingexaminershallpromptly issueanorder forsuchreliefasmaybe appropriate,whichmay include economic and non‐economic damagessuffered by the aggrieved person, regardless of whether he or sheintervened in the action, and injunctive or other equitable relief. Thehearingexaminermaynotorderpunitivedamages.
2. In addition to anydamagesorderedunder subd.1., thehearing examiner
mayassessaforfeitureagainstarespondentwhoisnotanaturalpersoninan amount not exceeding $10,000, unless the respondent who is not anatural person has been adjudged to have committed any priordiscriminatoryactundersub.(2),(2m)or(2r).Ifarespondentwhoisnotanatural person has been adjudged to have committed one otherdiscriminatoryactundersub.(2),(2m)or(2r)duringthepreceding5‐yearperiod, based on the offense date of the prior discriminatory act, thehearing examiner may assess a forfeiture in an amount not exceeding$25,000.Ifarespondentwhoisnotanaturalpersonhasbeenadjudgedtohavecommitted2ormorepriordiscriminatoryactsundersub.(2),(2m)or(2r)during thepreceding7‐yearperiod, basedon the offensedate of thepriordiscriminatoryact,thehearingexaminermayassessaforfeitureinanamountnotexceeding$50,000.
3. Inadditiontoanydamagesorderedundersubd.1.,theadministrativelaw
judgemayassessaforfeitureagainstarespondentwhoisanaturalpersoninanamountnotexceeding$10,000,unlesstherespondentwhoisanatural

personhasbeenadjudgedtohavecommittedanypriordiscriminatoryactundersub. (2), (2m)or (2r). Ifa respondentwho isanaturalpersonhasbeenadjudgedtohavecommittedoneotherpriordiscriminatoryactundersub.(2),(2m)or(2r)basedonanoffensedatethatisbeforeSeptember1,1992,theadministrativelawjudgemayassessaforfeitureinanamountnotexceeding $25,000. If a respondent who is a natural person has beenadjudgedtohavecommitted2ormorepriordiscriminatoryactsundersub.(2),(2m)or(2r)basedonanoffensedatethatisbeforeSeptember1,1992,the administrative law judge may assess a forfeiture in an amount notexceeding$50,000.
(i) Attorneyfeesandcosts.Thehearingexaminermayallowaprevailingcomplainant,
includingthestate,reasonableattorneyfeesandcosts.Thestateshallbeliableforthose fees and costs if the state is a respondent and is determined to havecommittedadiscriminatoryactundersub.(2),(2m)or(2r).
(j) Judicial review. Within 30 days after service upon all parties of an order or
determination of the department under this subsection, the respondent, thecomplainantor theaggrievedpartymayappeal theorderor thedetermination tothecircuitcourtforthecountyinwhichtheallegeddiscriminationtookplacebythefilingofapetitionforreview.Thecourtshallreviewtheorderordeterminationasprovidedinss.227.52to227.58.
(6m) CIVILACTIONS.
(a) Any person, including the state, alleging a violation of sub. (2), (2m) or (2r)maybring a civil action for injunctive relief, for damages, including punitive damages,and,inthecaseofaprevailingplaintiff,forcourtcostsandreasonableattorneyfees.
(b) An action commenced under par. (a)may be brought in the circuit court for the
countywheretheallegedviolationoccurredorthecountywherethepersonagainstwhom the civil complaint is filed residesorhas aprincipalplaceof business, andshall be commenced within one year after the alleged violation occurred orterminated.Theone‐yearstatuteoflimitationsunderthisparagraphshallbetolledwhileanadministrativeproceedingwithrespecttothesamecomplaintispending.
(c) The courtmay issueapermanentor temporary injunctionor restrainingorder to
assuretherightsgrantedbythissection.Thecourtmayorderotherreliefthatthecourt considers appropriate, including monetary damages, actual and punitive,forfeitureasprovidedinsub.(6)(h)andcostsandfeesasprovidedinsub.(6)(i).
(d) Iftheattorneygeneralhasreasonablecausetobelievethatanypersonengagedina
patternorpracticeofdiscriminationinviolationofsub.(2),(2m)or(2r)orthatanypersonhasbeendeniedanyoftherightsgrantedundersub.(2),(2m)or(2r),andsuchdenialraisesan issueofgeneralpublic importance, thedepartmentof justicemaycommenceacivilaction.
(8) DISCRIMINATIONBYLICENSEDORCHARTEREDPERSONS.
(a) Ifthedepartmentfindsreasonablecausetobelievethatanactofdiscriminationhasbeenorisbeingcommittedinviolationofthissectionbyapersontakinganactionprohibitedundersub.(2),(2m)or(2r),orprobablecausetobelievethatanacthasbeen or is being committed in violation of sub. (9), and the person is licensed orcharteredunder state law, thedepartment shall notify the licensing or charteringagency of its findings, andmay file a complaintwith such agency togetherwith a

request that the agency initiate proceedings to suspend or revoke the license orcharterofsuchpersonortakeotherlessrestrictivedisciplinaryaction.
(b) Upon filingacomplaintunderpar.(a), thedepartmentshallmakeavailable to the
appropriate licensingor charteringagencyallpertinentdocumentsand files in itscustody,andshallcooperatefullywithsuchagencyintheagency'sproceedings.
(9) PUBLICPLACEOFACCOMMODATIONORAMUSEMENT.
(a) Nopersonmaydoanyofthefollowing:1. Denytoanotherorchargeanotherahigherpricethantheregularratefor
the full and equal enjoyment of any public place of accommodation oramusementbecauseofsex,race,color,creed,disability,sexualorientation,nationaloriginorancestry.
1m. Denytoanadultorchargeanadultahigherpricethantheregularratefor
the full and equal enjoyment of a lodging establishment because of age,subjecttos.125.07.
2. Givepreferentialtreatmenttosomeclassesofpersonsinprovidingservices
orfacilitiesinanypublicplaceofaccommodationoramusementbecauseofsex,race,color,creed,sexualorientation,nationaloriginorancestry.
3. Directlyorindirectlypublish,circulate,displayormailany
writtencommunicationwhichthecommunicatorknowsistotheeffectthatany of the facilities of any public place of accommodation or amusementwillbedeniedtoanypersonbyreasonofsex,race,color,creed,disability,sexual orientation, national origin or ancestry or that the patronage of aperson is unwelcome, objectionable or unacceptable for any of thosereasons.
3m. Directly or indirectly publish, circulate, display or mail any written
communicationwhichthecommunicatorknowsistotheeffectthatanyofthefacilitiesofalodgingestablishmentwillbedeniedtoanadultbecauseofage,subjecttos.125.07.
4. Refuse to furnish or charge another a higher rate for any automobile
insurance because of race, color, creed, disability, national origin orancestry.
5. Refuse to rent, charge a higher price than the regular rate or give
preferentialtreatment,becauseofsex,race,color,creed,sexualorientation,national origin or ancestry, regarding the use of any private facilitiescommonlyrentedtothepublic.
(b) Nothing in this subsection prohibits separate dormitories at higher educational
institutions or separate public toilets, showers, saunas and dressing rooms forpersonsofdifferentsexes.
(c) Nothing in this subsection prohibits separate treatment of persons based on sex
with regard to public toilets, showers, saunas and dressing rooms for persons ofdifferentsexes.
