I have the honor to send you herewith a copy of our Note No. 1631 of today's date to the MiniStry of Foreign Affairs of your country, together with the preparatory documents mentioned therein which have been prepared for the April 25 to 30, 1973, session of the Standing Subcommittee of the PCT Interim Committee for Technical Cooperation.

Document PCT/TCO/SS/IV/2 contains the draft forms to be employed by various PCT Authorities. It would no doubt facilitate the discussion of these forms if, whenever it is convenient, you would have a copy of any form marked up with any changes in it which you recorrmlend. The marking could be done by hand so that the proposed changes can be easily distinguished from the form as prepared by us. If you could then send us a copy of this marked-up form, we would reproduce a sufficient quantity of it and distribute it to the participants.

'rhis does not, of course, exclude the possibility of making comments in any other way you may desire, apart from marking up the forms, or of accompanying your markings by some explanatory text, if you wish. We should, in fact; be glad to receive such comments·and explanations in writing, so that they could also be circulated to the participants in a sufficient number of copies.

It would be appreciated if you could let us have any marked-up forms and any other text that you would wish us to reproduce for the participants at least one week in advance of the opening of the session.

Sincerely yours, Enclosures:

With reference to the above mentioned circulars, in

particular to \-JIPO-Circula.r no '1632, D.nd to the simplified

procedure therein proposed, I am forwarding you one copy

// each of the forms PCT/ISA/20'1 and PCT/ISA/2'10 marked with

the changes as recommended by the German Patent Office ..

As far as the changes under I) of the two forms are concerned,

I I refer to Chapter V of the 11 Guide to the Int,iernational

Classification of Patents 11 (especially to Note 60) which

provides for the use of several classification symbols.

In our opinion the forms should be prepared so as to allow

of the best possible filling in of all IPC symbols, and

it should moreover be easy to see from the form without

any doubt which clas.sification symbol has been considered

most relevant by the authority which effects the classi

fication.

The completion "t.J.ncler IV) of the Jorms is thought

necessary in vie'lfr of the experience made with isols.ted

searches at the German Paten·t; Office. This experience

which may be appiied directly to PCT searches has

shown that indication of certain references is re-

quired for determining the scope of protection of the

invention, even though such references do not relate to a specific claim. Since according to Article 33 par. (6) of the PC11 , the international preliminary

examination shall take into consideration all the

documents cited in the international search report,

the international search report on the other hand

has to identify references that are cited for the

above mentioned reason.

Further particulars on the subject will be given at the

session of the-standing SubcoiiL'TI.ittee.

l'1oreover, the Ger·man delegation reserves the right

of making f'urther comments· which cannot be made

clear enough by the marking of the forms.

Sin.cerely yours,

c~.n abbreviation of the: words "International Classification" in ac:corcb.nce with Article 3 (3) of the Convention, the abbreviation "Int. Cl." should prcfcn.bly be used, this having been intcrnatior:J.lly a[;recd, in ihe intere::;ts of uniforrnity, as a symbol for tliis purp.9s.c. only. It is desirable that the ;_~bbreviation "Int. Cl." should not be trans]j.er~tP.-d iJ;J.to ai1y ·other alphabet, in order that the international cla~;sification symbols may•~i.lways be readily picl~ed out.

GD. In t;\·:_::.:·y c:·.~e: ~.\'Le:~ e:: ~~n ·:ll"o'i.::ntio:1 ·~::~ cl;lz;siiiccJ in n~orc.: LLztn o;·te plCLCC, the syr.tJ"iJol of ihe place consic:crecl most relevant, t<tking: into account th~ considerations indicated in Chapter IV, should be pui first. This place wlll usu<J_lly be the one most closely rebted to the patent rights claimed, or, i.f this extends over tv10 or more fields of use and classification from a wider viev,1)0i.nt is not possible, the one dealing with the field of art which is regarded as the most relev~mt. In some cases the choice of the most relevant place may be more or less arbitrary, particularly as regards balance of invention.

61. The classification of a specification (in accordance with para. 44) may be represented by symbols relating to the invention units (which' must, according to Article 3 (1) of the Convention, be classified) and additional symbols (whether representing whole invention units or othc:r info::-::;:ction). To G"ivr:- ?! concise in~icati.on of the i~ve:r?J_i<JD.1:1':Jits, it is necess:uy to distinguish those symbols which together give a first clas~;ification of all the invention units from those symbols rel8.ting to ar:y other information; theJor.mex_.sym_bQL~-~h_o_uld pr~_c~de, ~m!=Lt:hf!.Jatter _symbolsfollow,a doubl_e obli.que_s~:r.ol\:e. ("/(''). The general rule for recording the c:lassifi.cation is thus as follows:

Put U.r,?.ttf!~_SYJ!11}ols..of .th.e .. mostin:lport?:nt place (see above). I£ a second invention unit 'is not covsred by that place, put.JJJ<:'.~YJill:l_ol$ of a place which covers that unit, and con-tinue thus _llJJtii __ ~Y.-~:r:Y..J!1Y~nti()n U!}.iiis ___ .<;:_o:v~r(Ocl]Jy_a plac.e. If any information remains to be covered, then put the double oblique stroke, followed by the symbols necessary to represent the classific8.tion of such information.

An example of the full classification of a specification might have the following appearance:

F 161 9/04,B 23 k 31/06// B 21 c 37/18, F 1619/16.

It. will be appreciated that this is an exceptional example, covering iwo invention units ancl additionally a further description (para. 42) of an invention unit as well as a piece of information not embodying the invention. In this example the symbols following the double oblique stroke are in alphabetical order, but any other order may be used.

62. Cases may arise, for cxarnple in opening 1.1p a new art, in ·which an invention is not at all satisfactorily covered by an existing group or even any e:.;:isting sub~class or class. Nevertheless, a place in the clas~;ifieation scheme must be found as indicated in Chapter IV and this place should normally be the group regarded as most ·nearly covering the invention; but in order to record ihe doubtful n3.ture of the cl<tssification, it is recommended that the: classifieation symbols adopted shot1lcl be follovled by the letter X. Where, however, no gro1Jp appears :in any v:<ty relevant to the invention (<md it is stressed that this should very rarely happen) a higher level of classification (sub-class, class or even Section) may be employed providing this is also followed by the letter X; for instance, an invention relating to the treatr::Hmt of textiles but cle2.rly having no relevance to any existing sub-class might be symbolised as D 06X.

The use of the letter X will thus indicate the doubtful or incomplete nature of the classification and, more importantly, will bring to the notice of those responsible for the next revision that a classification probler..1 exists which needs atteniion. To facilitate collect.ion of such problem cases, all c:::ses wF1ere the X notation is used should be notified to the Secretariat of the Classification Sub-Committee of the Committee of Ex:perts on Patents for Invention of the Council of Europe. ~

!'CT/R0/.118. The form as presently designed does no·t

provide check boxes for all information which may be transmitted;

for example, letters of withdrawal of applications or designa-

tions (Rule 32.l(c)) or listings of those numbers that will not

be used as international application numbers (Rule 20.7(ii)).

However, it is questionable whether the addition of two extra

check boxes \vould be worthwhile. In fact, the whole concept

of merely identifying the types of doduments by check boxes

is questioned. An identification of a. type of document is

only of value insofar as it relates to a particular inter-

national application. It is strongly suggested that the form

be ~ompletely revised so that the relationship between the

type of document and a given international application is

readily apparent in the cover letter itself.

PCT/ISA/201. In the interest of clarity and to conserve

space, it is suggested that both the "Citation" and "Appli-

cation of Ci·tations" sections of forms PCT/ISA/201 and PCT/ISA/

210 be combined into single sections on each form. PCT Rule

43.5 requires only a listing of the documents considered

relevant, togethe~ with an identification of the various claims

to which the listed documents relate. There is no need to

list all the documents under items 1 and 2 in the "Citation"

section and then repeat this listirig under items 1 and 2 in

the "Application of Citations" section when linking the docu-

ments to particular claims. A single section such as follows

would satisfy the Rule:

Adoption of the~Uggestion that an address
