AWARDS 1. That pursuant to Section 90(2) of the Local Government Act, 1999 the Council orders that
the public (except staff on duty) be excluded from the meeting to enable discussion on the 2020 City of Tea Tree Gully Australia Day Awards.
2. That the Council is satisfied that pursuant to section 90(3) a of the Act, the information to
be received, discussed or considered in relation to this item: Relates to information the disclosure of which would involve the unreasonable
disclosure of information concerning the personal affairs of any person (living or dead). o On the basis that details regarding nominees personal attributes and merits of the
nominations may be discussed, which are details that should not be released outside the official ceremony that recognises their contribution to the City.
3. In addition, the disclosure of this information would, on balance, be contrary to the public
interest. The public interest in the public access to the meeting has been balanced against the public interest in the continued non-disclosure of the information. The benefit to the public at large resulting from withholding the information outweighs the benefit to it of disclosure of the information.
4. The Council is satisfied that the principle that the meeting be conducted in a place open to
the public has been outweighed in the circumstances on the basis that the disclosure of details regarding the merits of the nominations may be prematurely released before the successful award recipients have been announced at the Australia Day Awards Ceremony, and could therefore result in the inappropriate release of information outside of the official ceremony that recognises their contribution to the City.

RETENTION OF CONFIDENTIAL DOCUMENTS
1. That having considered the agenda item entitled 2020 City of Tea Tree Gully Australia Day Awards and dated 21 January 2020 in confidence under section 90(2) & (3) a and Section 91(7) of the Local Government Act 1999:
information the disclosure of which would involve the unreasonable disclosure of information concerning the personal affairs of any person (living or dead)
the Council pursuant to section 91(7) of the Act orders that the minutes relevant to this item be retained in confidence until:
the public announcement of the City of Tea Tree Gully Australia Day Awards has occurred on 26 January 2020.
2. That the Council gives the power pursuant to Section 91 of the Local Government Act 1999 to the Chief Executive Officer to revoke the order made under Section 91 (7) of the Local Government Act 1999 subject to the Chief Executive Officer consulting with the Mayor and reporting to the Elected Members of the revocation.

1. BACKGROUND
Each year the City of Tea Tree Gully calls for nominations for Council’s Australia Day Awards. The winners of the 2019 awards were: Outstanding Citizen: Christine Houlson Outstanding Community Group: Tea Tree Gully Toy Library Categories for the 2020 awards are: 1. City of Tea Tree Gully Outstanding Citizen
This award recognises individuals for their:
Contribution to the community including significant individual voluntary contribution to our local community over the past 12 months and/or outstanding service to our local community over a number of years
OR
Individual sporting achievements over the past 12 months and/or over a number of years.
2. City of Tea Tree Gully Outstanding Community Group
This award recognises community groups and/or sporting clubs for their:
Contribution to the community including significant and beneficial voluntary contribution to our local community over the past 12 months and/or outstanding service to our local community over a number of years
OR
Outstanding group sporting achievements over the past 12 months and/or over a number of years.
The eligibility criteria for the awards can be found in Attachment 2.
2. DISCUSSION
A total of 11 eligible nominations were received across the two award categories.
A summary of the nominations can be found in Attachment 3, with the original (unedited) submissions attached as Attachment 4.

5. RISK – IDENTIFICATION AND MITIGATION There is a risk that the chosen winner(s) are notified prior to the ceremony, hence this report and the decisions of Council will remain confidential until after the Australia Day Ceremony. It is recommended that in order to have a discussion that is not restricted by meeting procedures and regulations, that meeting procedures be suspended for a set period of time to allow discussion between Elected Members regarding details and merits of individual nominations. Once this detailed discussion occurs, it is recommended that the Council meeting resume in order to debate the matter and nominate the preferred award

1 recipient(s). It is also proposed that each award be considered individually as separate motions to allow for debate on the merits of each award category.
6. PEOPLE AND WORK PLANS
The recommendations within this report and the subsequent Australia Day Ceremony has been programmed into staff work plans. The Ceremony also includes a Citizenship Ceremony.
7. FINANCIAL Any expenses relating to the Australia Day Ceremony can be met from the allocated budget for the Ceremony.

11. COMMUNITY AND STAKEHOLDER ENGAGEMENT The call for nominations to the Australia Day Awards was promoted through many communications channels, including social media, Council’s website, digital signage, the Gully Grapevine and roadside signage.
All nominees and nominators have been invited to the awards ceremony.
12. PROMOTION AND COMMUNICATIONS OF COUNCIL DECISION AND OPERATIONAL IMPACTS The operational impacts of Council’s decision are minimal. The award winner(s) will be announced and added to the honour boards after the Australia Day Ceremony.
